REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910–1971.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910–1971.

Amendments of the Naval Financial Regulations 

Officers’ General List—active pay.

1. Regulation 9 of the Naval Financial Regulations is amended—

(a) by omitting sub-regulation (1a.) and inserting in its stead the following sub-regulation:—

“(1a.) The daily rate of active pay payable to—

(a) an officer of the Special Duties List who holds the rank of Sub-Lieutenant or Lieutenant and, immediately before he was appointed an officer, held the rating of Petty Officer or a higher rating; or

(b) an officer of the Naval Police who holds the rank of Sub-Inspector or Inspector,

is the rate specified, in relation to his rank and pay seniority, in Division 3 of the Third Schedule to these Regulations.”;

(b) by omitting from sub-regulation (2.) the words “other than an officer on the Special Duties List,”;

(c) by inserting in paragraph (a)of sub-regulation (3.), after the figure “(1.)”, the word and figure “or (1a.)”; and

(d) by omitting sub-regulations (4.) and (5.).

2. Regulation 10 of the Naval Financial Regulations is amended by omitting from sub-regulation (2.) the words “Fifteen dollars eighty-eight cents” and inserting in their stead the words “Sixteen dollars sixty-six cents”.

3. Regulation 12 of the Naval Financial Regulations is amended by omitting the table and inserting in its stead the following table:—

4. Regulation 25 of the Naval Financial Regulations is amended by omitting from sub-regulation (7.) the word and figure “or (5.)”.

5. Regulation 27 of the Naval Financial Regulations is amended by omitting from sub-regulation (9.) the word and figure “or (5.)”.

Difference of mess subscription allowance.

6. Regulation 121 of the Naval Financial Regulations is amended by omitting the word and figure “or (5.)”.

Rules or pay—service women holding the rating Leading Wran or a lower rating.

7. Regulation 253 of the Naval Financial Regulations is amended by omitting from sub-regulation (2.) the words “Five dollars forty-six cents” and inserting in their stead the words “Six dollars forty-six cents”.

Pay of servicewomen holding the rating Petty Officer Wran or a higher rating.

8. Regulation 253a of the Naval Financial Regulations is amended by omitting the table in sub-regulation (2.) and inserting in its stead the following table:—

Transitional.

11.—(1.) Where the sum of the active pay and allowances that would have been payable to an officer of the Naval Forces in respect of his service during the period from and including the seventeenth day of December, 1971, to and including the day immediately before the day on which this regulation comes into operation if—

(a) the amendments of the Naval Financial Regulations effected by regulations 1, 2, 3, 4,5, 6 and 9 of these Regulations had come into operation on that first-mentioned date; and

(b)the rates of active pay provided for in Table 1 in the Fifteenth Schedule to the Naval Financial Regulations as amended by these Regulations had applied to service on and after that first-mentioned date,

exceeds the sum of the active pay and allowances paid or payable to the officer in respect of his service during that period, the officer is entitled to be paid, as additional active pay in respect of his service, an amount equal to the excess.

(2.) The rates of active pay provided for in regulations 253 and 253a of the Naval Financial Regulations as amended by these Regulations and in Table 2 in the Fifteenth Schedule to the Naval Financial Regulations as so amended apply to and in relation to service of a servicewoman in the Naval Forces on and after the first day of January, 1972.

(3.) The rates of active pay provided for in the Sixteenth Schedule to these Regulations apply to and in relation to—

(a) service of an officer in the Citizen Naval Forces on and after the seventeenth day of December, 1971; and

(b)service of a female member of the Citizen Naval Forces, not being an officer, on and after the first day of January, 1972.
