REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1918.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1918, to come into operation on and from the dates specified herein.

Amendments of Naval Financial Regulations.

(Statutory Rules 1920, No. 248, as amended to present date.)

1. Regulation 33 is amended as from 1st May, 1921, by inserting immediately after the second scale of pay in sub-regulation (3), the following paragraph :—

“A Warrant Officer whose total emoluments as a rating, on the date immediately preceding his promotion to Warrant Rank, exceeded the amount to which he would be entitled as a Warrant Officer, may on the approval of the Naval Board, be paid a special rate of pay. Such a case shall be dealt with in accordance with the conditions governing similar cases in the Royal Navy.”

2. Regulation 34 is amended, as from 1st January, 1922; as follows:—

(1) by omitting from sub-regulation (1) the scale of pay for Regulating Branch, and inserting in its stead the following scale:—

(2) by omitting from scale of pay for Stoker Branch in sub-regulation (1), the rates “9s. 4d.”, “9s. 8d.” and “10s. 0d,” for Stoker Petty Officer and inserting in their stead the following rates respectively:— “9s. 6d.”,. “9s. 10d.” and “ 10s. 2d.”

 

3. Regulation 35 is amended as from 1st April, 1921, as follows:—

(1) by omitting sub-regulation (1) and inserting in its stead the following sub-regulation :—

“(1) Kit Upkeep Allowance.—Kit Upkeep Allowance shall be granted to ratings as follows:—

Class I.—Free kit on entry, and allowance of 1s. 4d. per diem commencing from date of entry.

Class II.—Free kit on entry, and allowance of 1s. per diem commencing from date of entry.

Class III.—Free kit on entry, and allowance of 1s. 3d. per diem commencing from date of entry.

Kit Upkeep Allowance shall be credited on the ship’s ledger in cash, and included in the fortnightly payments. Kit Upkeep Allowance shall continue to be credited during periods of detention. In all other, cases where deferred pay is not credited, vide sub-regulation (6) of regulation 40, Kit Upkeep Allowance shall also be stopped for the same period. Kit Upkeep Allowance is, as from 1st December, 1921, subject to reduction when ratings are in receipt of reduced pay in accordance with regulation 96.”

(2) by omitting sub-regulation (6) and inserting in its stead the following sub-regulation :—

“(6) Outfit Gratuities on change of Class of Uniform.—The following Outfit Gratuities shall be paid, in addition to the Kit Upkeep Allowance, to all ratings who are obliged to change their uniform from Class II, to Class I; or Class III., and from Class III, to Class II.—

(a) To Petty Officers dressed as seamen on promotion to Chief Petty Officer £23

(b) To Petty Officers, with 4 years’ service as such, required to change from Class II. to Class III. uniform.......................................................................... £22

(c) To other men and boys on transfer to ratings for which a change of uniform to Class III. is required............................................................................ £21

When a man or boy is transferred owing to unsuitability for the rating held to another rating involving change in class of uniform, he shall be paid an Outfit Gratuity as prescribed in sub-paragraphs (c) or (d) above, but the articles in the compulsory kit of his former rating no longer required in the rating to which he is transferred shall be sold. The proceeds of such sale shall be brought to account in the Monthly Cash Account as a credit to ‘Navy Revenue.’ No Outfit Gratuity shall be paid when the transfer in rating is attributable to misconduct.

In addition, to the gratuity payable under the sub-paragraph (a) above, a further gratuity of £10 towards the cost of frock coat and sword shall be paid to Master-at-Arms on promotion.”

 

4. Regulation 37 is amended, as from 1st April, 1922, by omitting paragraphs (d), (e), and (f) of sub-regulation (8) and inserting, in their stead the following paragraphs:—

5. After regulation 37, as from 1st April, 1921, the following heading and regulation are inserted:—

“Pay for Performing Higher Duties—Officers.

37a. When the Accountant Officer (the rank allowed by complement being not below Paymaster Lieutenant-Commander) is absent from the ship continuously for upwards of three months otherwise than on leave, the Paymaster Lieutenant, Paymaster Sub-Lieutenant, or Paymaster Midshipman, performing his duty, although not holding an acting order as Paymaster Lieutenant-Commander, may, on the approval of the Naval Board, be granted additional pay ; but the special remuneration thus granted shall not exceed the difference between the officer’s own rate of pay and the lowest rate of pay for a Paymaster Lieutenant-Commander. A full report of the circumstances shall be made to the Naval Board in order that the rate payable may be decided.”

6. Regulation 38 is amended as follows :—

(1) by inserting after sub-regulation (17) as from 1st December, 1921, the following sub-regulation :—

(2) by omitting sub-regulation (25), as from 1st July, 1921, and inserting in its stead the following sub-regulation:.—

(a) To all Engine-room, Officers’ Cook, and Ship’s Cook ratings and Seamen under training in the stokehold when actually employed and doing duty in engine-rooms, stokeholds, boiler rooms, and auxiliary machinery compartments in connexion with the Engine-room Department or in the galleys of surface craft, including steam-boats but excluding open motor boats, or in the interiors of submarines, subject to the conditions herein laid down, both when at sea and in harbour, in the following circumstances :—

(i) Within the Tropics, at any time.

(ii) Within the Red Sea or Persian Gulf, between the 1st April and 30th November inclusive.

(iii) In surveying ships only, when employed in surveying, but not on ordinary passages, when between the Northern Tropic and latitude 30 deg. north, between the 15th June and 15th October inclusive, or between the Southern Tropic and latitude 30 deg. south, between 15th December and 15th April inclusive, but payment shall not be made in addition to payment under (ii) above

(b) To ratings of all other branches when continuously employed other than as Stokers, under the conditions herein laid down. Payment to such ratings shall be confined to those employed whilst at day work for a full day, or keeping regular watches during the 24 hours.........

Payment shall not be made in respect of employment elsewhere in the ship without prior Naval Board sanction, and shall be confined to periods during which steam is raised or internal combustion engines are in use, or when galley fires are burning.”

(3) by omitting from sub-regulation (30), as from 1st January, 1922, the words—

(4) by omitting sub-regulation (53), as from 1st June, 1921, and inserting in its stead the following sub-regulation :—

Men who have served in any Permanent Military Force of the British Empire, or in any temporary British or Dominion Military Force raised during the War 1914-1919 may, with the approval of the Naval Board; be allowed to count towards the award of Good Conduct Badges any ‘V.G.’ time not exceeding four years which may have been served in those Forces, provided that the conditions prescribed in Article 748 of the King’s Regulations and Admiralty Instructions are fulfilled, and that their enlistment was for Service Overseas, and not for Home Service only. Men invalided from any of the above Forces may, with approval of the Naval Board, be allowed to recken their service without limitation as to its length. Men who have served at sea in the British or Colonial Merchant Servies may, with the approval of the Naval Board, be allowed to count only ‘V.G.’ time not exceeding two years, towards the award of Good Conduct Badges, provided the conditions prescribed in Article 749, King’s Regulations and Admiralty Instructions, are fulfilled. Time served under the age of eighteen years in any of the above services or time served on Shore in the Citizen Military Forces shall not be allowed to count towards Badge time.”

(5) by adding at the end thereof, as from 1st January, 1922, the following sub-regulation :—

To rating doing duty in each Ship or Establishment, including Torpedo Boat Destroyers and Sloops, but not including Submarines. Payable to one rating only in each Ship or Establishment

7. After regulation 38, as from 1st April, 1921, the following heading and regulation are inserted:—

“Pay for Performing Higher Duties—Petty Officers and Other Ratings.

38a. Where a Senior Rating is absent for a period of fourteen or more consecutive days through sickness or on duty, and the consequent vacancy cannot be filled by drafting, the rating required to perform the higher duties of the Senior Rating may be paid the difference between his rate of Active and Deferred Pay received in the lower rating and the corresponding minimum rates prescribed for the higher rating.”

8. Regulation 39 is amended, as from 1st April, 1921, by omitting sub-regulations (2) and (3) and inserting in their stead the following sub-regulations :—

“(2) Cartridge Cases—Annual Grants for Collecting and Returning— Grants in accordance with the following scale may be paid to H.M.A Ships in full, active or reserve commission, for collecting and returning cartridge cases:—

Payment may be made quarterly, in advance, and will be subject to such other conditions as may be approved by the Naval Board.

(3) Cartridge Cases—Allowance for Collecting and Returning

When the annual grant set forth in sub-regulation (2) of this regulation is not drawn, the Naval Board may approve of payment of allowances for collecting and returning cartridge cases, fired tubes, and metals (from bullets) being made in accordance with the following scale :—

Fractional parts of these quantities shall be paid for in proportion. Payment of these allowances shall be subject to such other conditions as may be approved by the Naval Board.”

 

9. Regulation 40 is amended as follows:—

(1) by omitting sub-regulation (2), as from 30th June, 1920, and inserting in its stead the following sub-regulation :—

“(2) Interest at the rate of 3½ per cent. shall be credited annually on the 30th June in each year on the amount of deferred pay standing at credit of each member on 30th June of the previous year, provided that a full year’s interest shall be allowed only on amounts which have stood to the credit of the member for a full year.”

(2) by adding at the end of sub-regulation (2), as from 1st March, 1922, the following paragraph:—

“In the event of any member or his estate becoming entitled to receive deferred pay on account of discharge, expiration of engagement; resignation, death, or for any other reason, interest on the amount standing at credit on 30th June prior to discharge, resignation, death, expiration of engagement, or other reason, shall be allowed from 1st July to the end of the month in which payment of deferred pay becomes due.”

10. Regulation 41 is amended as follows:—

(1) by inserting immediately after the words “Medical Officers” in the first line of sub-regulation (3), as from 1st January, 1918, the words “and Chaplains.”

(2) by adding at the end thereof, as from 1st January, 1918, the following sub-regulation :—

11. Regulation 44 is amended, as from 1st April, 1921, by omitting sub-regulation (5a).

12. Regulation 74b is repealed, as from 1st January, 1922, and the following regulation is inserted in its stead :—

“74b. Recruits.—Recruits may receive travelling allowance and be provided with accommodation by rail or steamer as per scale prescribed for Seamen and other ratings in sub-regulations (1) and (23) of regulation 74, for the journey from the place where they are recruited to the ship or depot of final entry.

If rejected at the final examination, travelling allowance and accommodation may also be granted for the return journey.”

 

13. Sub-Regulation (6) of regulation 76 is amended, as from 1st January, 1922, by omitting the figures “(15)” and “75” in the ninth line and inserting in their stead the figures “(5)” and “74” respectively.

14. After regulation 78c, as from 1st February, 1922, the following regulation is inserted:—

“78d. In exceptional cases when members of the Auxiliary Services in receipt of Consolidated rates of pay (other than the Duty Chief Petty Officer, or Duty Petty Officer, or the General Workman detailed as Night Watchman) are required to remain on duty after 6.30 p.m., after performing continuous duty during the day, and when such attendance necessitates their obtaining their evening meal away from their usual place of residence, they may be granted the actual amount necessarily expended on such meal, provided that the maximum sum allowable in such instance shall not exceed two shillings.”

15. Regulation 85 is amended, as from 1st December, 1921, as follows:—

(1) by inserting immediately after the words “Garden Island” in the fourth and fifth lines of sub-regulation (3), the words “ and the Venereal Ward at Flinders Naval Depôt.”

(2) by adding at the end of sub-regulation (3) the following, paragraph:—

“All medical cases under ‘bed’ treatment at Flinders Naval Depôt shall be regarded as receiving treatment in a hospital with approved accommodation.”
