REGULATIONS UNDER THE NAVAL DEFENCE ACT.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1918, to come into operation forthwith, unless otherwise specified herein.

Amendment of Naval Financial Regulations.

(Statutory Rules 1920, No. 248, as amended to present date.)

1. Wherever appearing throughout these Regulations the words “Commissioned Warrant Officer,” “Chief Sick Berth Steward,” “Sick Berth Steward,” “2nd Sick Berth Steward,” “Chief Ship’s Cook,” and “Ship’s Cook” are omitted as from 1st September, 1921, and the following words are, respectively, inserted in their stead:—“Commissioned Officer from Warrant Rank,” “Sick Berth Chief Petty Officer,” “Sick Berth Petty Officer,” “Leading Sick Berth Attendant,” “Chief Petty Officer Cook,” and “Petty Officer Cook.”

2. Regulation 21 is repealed as from 1st July, 1921, and the following regulation is inserted in its stead:—

“21. (1) When the transfer of a member of the Auxiliary Services, not borne on Ship’s Books for pay purposes, is effected, a statement in duplicate in the proper form shall be completed, signed by the Certifying Officer, and transmitted to the District, Ship, or Establishment to which the member is transferred.

(2) One copy of this statement duly certified and signed shall—

(a) be attached, at the District or in the Ship to which transferred, to the voucher on which first payment is made; or

(b) accompany the ship’s ledger into office, as the case may be.

(3) When the transfer of a member of the Auxiliary Services who is borne for pay purposes on the books of one of H.M.A. Ships or establishments is effected, Form A.S. 45 shall be completed and forwarded in accordance with the Naval Account Regulations.

(4) Payment on account of pay shall, in the case of transfers from one District to another, be made up to the last fortnightly pay period, and not necessarily to the date of transfer. When the transfer is made to the books of one of H.M.A. Ships or Training Establishments, the member’s pay account shall be adjusted to the actual date of transfer.

(5) The account for rail, steamer, or other fares for the member transferred shall be rendered to and approved for payment at the office, ship, or establishment from which the warrant for such services was issued; but the member’s claim for travelling allowance and reimbursement of expenses incurred consequent upon transfer will be dealt with by the office, ship, or establishment to which such member is transferred.

(6) Officers and men lent to the Auxiliary Services from the Permanent Naval Forces (Sea-going), who are in receipt of sea-going rates of pay, shall not, in any circumstances, be eligible for transfer, removal, or travelling expenses other than as prescribed for the Permanent Naval Forces (Sea-going) in these Regulations.”

3. Regulation 33 is amended as follows:—

(1) By omitting from sub-regulation (2), as from 1st July, 1921, the scale of pay for Medical Branch, and inserting in its stead, the following scale:—

(3) By omitting from sub-regulation (4) as from 1st May, 1921, the rate “9s. 6d.” for Schoolmaster Candidate and inserting in its stead the rate “10s. 6d.”

 

(4) By omitting sub-regulation (5) as from 1st July, 1921, and inserting in its stead the following sub-regulation:—

“(5) Service in rank on the Active List, for the purpose of increments in pay, shall include all time actually served on full pay in that rank by an Officer on the Active List of the Royal Navy, Royal Australian Navy or Navy of any other of His Majesty’s Dominions.”

(5) By adding, at the end thereof, as from 1st July, 1921, the following heading and sub-regulations:—

“Officers on the Retired and Emergency Lists called up or voluntarily re-employed.

(14) An Officer on the Retired or Emergency List called up for duty in time of war or national emergency shall receive pay and allowances at the rates prescribed for an Officer of corresponding rank in the Permanent Naval Forces (Sea-going), Deferred Pay being paid with Active Pay, provided that—

(a) an Officer who has been promoted after being placed on the Emergency List shall receive the full pay and allowances prescribed for the higher rank; and

(b) unemployed time on the Retired or Emergency List shall not count towards increments in full pay governed by seniority.

(15) An Officer on the Emergency List voluntarily re-employed in time of peace in the Permanent Naval Forces (Sea-going) shall receive pay and allowances at the rates prescribed for an Officer of corresponding rank in the Sea-going Forces, provided that—

(a) unemployed time on the Emergency List shall not count towards increments in pay; and

(b) deferred pay shall not be payable.”

4. Regulation 34 is amended as from 1st July, 1920, as follows:—

(1) By adding the words “Dental Mechanics” immediately after the word “Coopers” in the sub-heading “Plumbers, Painters, Joiners, Coopers,” in sub-regulation (1).

(2) By omitting from sub-regulation (1) the scale of pay for “Butchers” and inserting in its stead the following scale:—

5. Regulation 35 is amended as follows:—

(1) By inserting immediately after the word “men” in the first line of sub-regulation (4) the words “entered prior to 1st July, 1921.”

 

(2) By inserting after sub-regulation (4), as from 1st July, 1921, the following sub-regulation:—

“(4a). In the case of new entrants who join on and after 1st July, 1921, discharged within two years of entry at own request, a charge shall, if deferred pay is granted, be made against deferred pay of £1 10s. per month in the case of Ratings Classes I. and III., and of £1 5s. per month in the case of Ratings Class II., for each full month of the unexpired portion of two years. A similar charge shall be made in all cases of discharge within two years where deferred pay is not forfeited, except that in the case of men invalided no charge is to be made. In the case of ratings discharged within two years of entry, other than by invaliding, being in debt or having insufficient credit of deferred pay to cover the charge referred to in the foregoing, the kit, or portion thereof, shall be recovered and sold, except such as is necessary to meet immediate requirements. Any balance received for sale of kit shall be paid to the rating.

In the event of the amount of deferred pay and the sum realized from the sale of kit being insufficient to meet the charge to be recovered in accordance with the foregoing, no deduction shall be made from active pay on that account.”

(3) By inserting after sub-regulation (7) as from 1st July, 1921, the following sub-regulations:—

“(7a). Equipment Allowance to Officers on the Emergency List.—An officer on the Emergency List voluntarily re-employed in the Permanent Naval Forces (Sea-going) will be granted an Equipment Allowance at a rate prescribed in the subjoined scale, provided that no such officer shall receive any such allowance if less than three years shall have elapsed between the date of his resignation from the Active List and the date of his re-employment, and that an officer may be paid equipment allowance only once in any period of five years:—

(7b) Outfit Gratuity to Officers on the Emergency List.—When called up for service in time of war or national emergency, an officer on the Emergency List shall receive the Outfit Gratuity of £30 under the conditions prescribed in this regulation for officers appointed for temporary service in the Permanent Naval Forces (Sea-going).”

(4) By omitting from sub-regulation (12), as from 1st June, 1921, the second paragraph “Payment of Lodging Allowance at the annual rate shall not cease when an officer proceeds on recreation leave,” and inserting in its stead the following clause:—

“Payment of Lodging Allowance at the annual rate shall continue to be paid when an officer proceeds on recreation leave, or on sick leave, provided the officer is not accommodated in hospital.

 

Payment of Lodging allowance at the annual rate shall also continue to be paid—

(a) for the first seven days whilst an officer is accommodated in hospital; and

(b) for the first seven days only when temporarily absent from head-quarters and travelling allowance is drawn under the conditions prescribed in sub-regulation (8) of regulation 74.

Provided, always, that the lodgings are retained and paid for during the period.”

(5) By inserting after paragraph (iv) of sub-regulation (13), as from 1st July, 1921, the following paragraph:—

“(iva) When a member of the Auxiliary Services is serving or undergoing training for a limited period in one of H.M.A. Ships and is in receipt of sea-going rates of pay and allowances, the declaration of an allotment shall be at the discretion of the Commanding Officer. Should an allotment not be declared, such member shall make a Statutory Declaration before the Commanding Officer—

(a) that the member is maintaining his wife and children, specifying name and date of birth of each child; and

(b) that such children are not contributing towards their own support.”

(6) By adding at the end of paragraph (ix) of sub-regulation (13), as from 1st February, 1920, the following clause:—

“If the children are in the care of more than one guardian, a separate allotment in favour of each guardian shall be made, and the total amount of such allotments shall equal or exceed one quarter of active pay (excluding allowances) plus the full amount of Married Allowance.”

(7) By adding at the end of paragraph (i) of sub-regulation (14), as from 1st July, 1921, the following sub-paragraph:—

“When a member of the Auxiliary Services is serving or undergoing training for a limited period in one of H.M.A. Ships and is in receipt of sea-going rates of pay and allowances, the declaration of an allotment shall be at the discretion of the Commanding Officer.”

(8) By renumbering sub-regulation (16) as (17), as from 15th June, 1921.

(9) By inserting after sub-regulation (15), as from 15th June, 1921, the following sub-regulation:—

“(16) Table Money.—(i) The Officer appointed to command H.M.A. Fleet shall be entitled to Table Allowance at such rate as may be approved by the Minister, on the recommendation of the Naval Board, not exceeding £6 15s. per diem.

(ii) Payment of Table Allowance to this Officer shall be subject to the conditions, where such can be applied, of the King’s Regulations and Admiralty Instructions for payment of such allowance in the Royal Navy.”

6. Regulation 36 is amended as follows:—

(1) By omitting sub-regulation (5) as from 1st February, 1921.

(2) By inserting immediately after the word “Torpedo,” in sub-regulation (6), as from 1st February, 1921, the word “Navigating.”

 

(3) By-omitting from sub-regulation (27a), as from 1st June, 1921, the second paragraph thereof commencing “Command Money to be paid.”

(4) By inserting after sub-regulation (27a), as from 1st June, 1921, the following sub-regulations:—

“(27b) Command Money, wherever provided for in this regulation, shall be paid under the conditions set forth in Article 1402 of the King’s Regulations and Admiralty Instructions.

(27c) Entertainment Allowance, wherever provided for in this regulation, shall be payable as from the date of actually assuming command, and shall cease to be credited as from the date of giving up command.”

(5) By omitting sub-regulation (33) as from 1st July, 1921.

(6) By inserting after sub-regulation (34), as from 1st April, 1921, the following sub-regulation:—

“(34a). Machinery Allowance is payable to Engineer officers only when in charge of propelling machinery in ships in commission. Machinery Allowance according to rank may, however, subject to Naval Board approval, be paid to Engineer Officers attached to a sea-going base for service with sea-going destroyers additional to the Engineer Officer in charge of the machinery of the ship.”

(7) By inserting after sub-regulation (36), as from 1st January, 1921, the following sub-regulation:—

“(36a) For victualling duties at Flinders Naval Depot, when in charge of Victualling, Clothing, and the School of Cookery—

10. Regulation 43 is amended, as from 1st March, 1921, by inserting immediately after the word “quarter” in the second line of sub-regulation (7) the words “and on supercession or paying off”

 

11. Regulation 45 is repealed, and the heading thereof is omitted, as from 1st July, 1921.

12. Regulation 46 is repealed and the heading thereof is omitted, as from 1st July, 1921, and the following heading and regulation are inserted in their stead:—

“Previous ServicePetty Officers and Men.

“46. All previous service in the Royal Navy or Royal Marines, or in the Navy of any other of His Majesty’s dominions, of Petty Officers and men serving in the Permanent Naval Forces (Sea-going), shall be allowed to count as if served in the Royal Australian Navy towards ‘service’ for seniority, rates of pay and allowances, and award of good conduct badges, provided that the provisions of sub-regulation (53) of regulation 38 shall also apply in the case of good conduct badges.”

13. Regulation 53 is amended as from 1st July, 1920, by omitting from the sixth and seventh lines the words “any expenses incidental to arrest,” and inserting in their stead the words “cost of his own passage to his ship or depôt.”

14. Regulations 57, 58, and 59; 59b, 60, 61, and 62; and 64 and 65 are repealed as from 1st July, 1921.

15. Regulations 59a, 63a, and 63 are renumbered 64, 65, and 65a respectively, as from 1st July, 1921.

16. After regulation 56 the following regulations are inserted, as from 1st July, 1921

“57. Officers on Sea-going List.—Officers on the Sea-going List of the Permanent Naval Forces lent to the Auxiliary Services shall receive the rates of pay and allowances prescribed for their corresponding ranks in the Permanent Naval Forces (Sea-going).

“58. Officers on the Auxiliary List.—Officers on the Auxiliary List of the Permanent Naval Forces shall receive the consolidated rates of pay and allowances prescribed in regulations 62, 64, 65b, and 65c.

“59. Sea-going Rates of Pay—When Payable.—(1) Officers and men of the Auxiliary Services detailed for service or undergoing training in one of H.M.A. Ships or R.A.N. Training Schools, shall, subject to the approval of the Naval Board, receive the rates of pay and allowances prescribed for their corresponding ranks and ratings in the Permanent Naval Forces (Sea-going), deferred pay being paid with active pay. In such cases members of the Auxiliary Services shall be temporarily transferred to the books of the ship or establishment concerned for purposes of pay and allowances.

(2) Service on consolidated rates of pay shall not count towards the service required to qualify for increments in Sea-going rates of pay.

“60. Men of the Auxiliary Services.—Ratings and employees engaged under conditions prescribed in the Naval Forces Regulations for five years’ service in the Auxiliary Services shall, subject to the provisions of regulation 59, receive the consolidated rates of pay and allowances prescribed in regulations 62, 63, 64, 65, 65b, and 65c, as from the date of their entry in the Auxiliary Services.

 

“61. Men Lent from the Sea-going Forces.—Chief Petty Officers and Petty Officers of the Permanent Naval Forces (Sea-going) lent for service on the Royal Australian Naval Reserve Staff of the Auxiliary Services shall continue to receive the rates of pay and allowances prescribed for their corresponding ratings in the Permanent Naval Forces (Sea-going).

“62. Rates of Pay.—(1) The following consolidated rates of pay, inclusive of maintenance of uniform and of all allowances except travelling and other allowances specially provided, shall, except as prescribed in regulation 59, apply to—

(a) Officers on the Auxiliary List of the Permanent Naval Forces, and to

(b) All other persons engaged for permanent duty in the Auxiliary Services:—

Rates according to age in accordance with Commonwealth Public Service Scale

(2) The commencing rate of pay on appointment to the Auxiliary Services shall be determined according to the rank or rating and the seniority last held in the Permanent Naval Forces (Sea-going).

(3) General Workmen and Workmen, on appointment to the Auxiliary Services, shall be graded in accordance with the scale set forth below, and salary within a grade shall be determined by the seniority in rating last

 

held in the Permanent Naval Forces (Sea-going), provided that former Chief Petty Officers shall be appointed at the maximum salary of Grade II.:—

(4) General Workmen and Workmen shall be advanced to the next higher grade, up to and including Grade II., on completion of one year’s service on the maximum salary of a grade; provided that persons already classified in Grade V. shall be compulsorily discharged on attaining the age of twenty-one (21) years.

“63. Navy Office Sentries.—Persons appointed for duty as Sentries at the Navy Office shall receive, in addition to the salary of their respective grades, an annual allowance in the nature of pay to bring their total annual salary to the minimum rate of Grade II General Workmen. The amount of such allowance shall be reduced by the amount of any increment granted from time to time.”

17. After regulation 65a the following regulations are inserted, as from 1st July, 1921:—

“65b. Uniform Gratuities on First Appointment.—(1) On first appointment to the Auxiliary Services, direct from the shore, and after the expiration of six calendar months from discharge or resignation from the Permanent Naval Forces (Sea-going) or other Naval Forces, the following uniform gratuities will be payable:—

(2) Persons appointed to the Auxiliary Services within six months of their resignation or discharge from the Permanent Naval Forces (Sea-going) or other Naval Forces will be granted uniform gratuities in accordance with the scale set forth in sub-regulation (1) above, subject to deduction therefrom of the value of the necessary articles of uniform in their possession at the date of first appointment to the Auxiliary Services.

(3) Persons permanently transferred to the Auxiliary Services direct from the Permanent Naval Forces (Sea-going) will not normally be eligible for uniform gratuities set forth herein, but, when such transfer involves a change in class of uniform, the District Naval Officer or

 

Commanding Officer may approve of the payment of uniform gratuities not exceeding the maximum rates prescribed in sub-regulation (1) of regulation 65c.

(4) Uniform gratuities prescribed in sub-regulation (1) of this regulation shall not be payable again on re-engagement in the Auxiliary Services.

“65c. Uniform Gratuities on Promotion Subsequent to Entry.—(1) The following gratuities shall be payable to members of the Auxiliary Services who are promoted subsequent to entry:—

(2) Persons lent to the Auxiliary Services from the Permanent Naval Forces (Sea-going) who are in receipt of sea-going rates of pay shall be entitled to Uniform Gratuities and Kit Up-keep Allowance as prescribed for their relative ranks or ratings in these Regulations.”

18. Regulation 74 is amended as follows:—

(1) By omitting from sub-regulation (8) as from 1st June, 1921, all the words appearing after the word “may” in the fourth line thereof, and inserting in their stead the words “when absent from head-quarters on duty, draw such allowance concurrently with Travelling Allowance for a period not exceeding seven days provided lodgings are retained and paid for during the period.”

(2) By omitting from sub-regulation (22a) as from 1st May, 1921, the words “6½d. per mile” and inserting in their stead the words “8d. per mile.”

(3) By inserting immediately after the word “Australia” in the third line of sub-regulation (23) as from 1st March 1921, the words “Except as provided in sub-regulations (24), (24a), (25) and (26) hereunder.”

(4) By omitting sub-regulation (24) as from 1st March, 1921, and inserting in its stead the following sub-regulations:—

“(24) When travelling by rail, from Port Augusta to Perth, or vice versâ, Chief Petty Officers may be granted first-class accommodation and sleeping berths on both the Transcontinental and State Railways, and first-class meal tickets on the Transcontinental Railway.”

“(24a) Chief Petty Officers travelling by rail on inter-State journeys may be granted first-class accommodation between capital cities only. This concession shall not include sleeping-berth accommodation for such journeys, and shall not apply to any subsidiary intra-State travelling involved.”

 

19. Regulation 74c is amended as from 1st March, 1921, by inserting immediately after the word “warrant” in the sixth line of sub-regulation (5) the words “and, where necessary, warrant for transport of excess luggage within the limits of the scale prescribed in sub-regulation (1) of regulation 74d.”

20. Regulation 75 is amended as follows:—(1) By omitting sub-regulation (6) as from 1st October, 1920, and inserting in its stead the following sub-regulation:-—

“(6) Allowance where Official Quarters or Private Residence are not available.—Where a married member, upon transfer, cannot enter into occupancy of quarters or private residence through unavoidable delay in transmission of his furniture and household effects, or for any other reason approved by the Naval Board, and the member must therefore reside, for the time being, with his family at an hotel or other house of accommodation, the Naval Board may approve of payment to such member of an allowance not exceeding half the cost of board and lodging of himself and family, provided that the amount payable shall not exceed the daily rate of travelling allowance to which the member is entitled under the Regulations, and shall not be paid beyond one month unless in exceptional circumstances approved by the Naval Board.”

(2) By omitting sub-regulation (16), as from 1st July, 1921.

21. Regulation 78 is repealed as from 1st July, 1921, and the following regulations are inserted in its stead:—

“78. Rations.—(1) A member of the Auxiliary Services shall not be eligible for any issue of rations in kind or to payment in lieu thereof except as provided in sub-regulation (2) hereunder and in regulations 78a and 78b.

(2) A member of, or an employee attached to, the Royal Australian Naval Reserve Staff employed in a camp of training or engaged on duty ashore in time of war or emergency on continuous or other duty which necessitates his absence overnight from his usual place of residence shall be entitled to issue of rations in kind in accordance with the scale and at the rate approved for a member of the Permanent Naval Forces (Sea-going).

“78a. Luncheon Allowance when attending Courses.—A member of the Royal Australian Naval Reserve Staff detailed to attend a Military course of training away from his head-quarters in a city or suburban area and required to obtain his midday meal away from his usual place of residence, may be paid a luncheon allowance not exceeding 1s. 6d. per diem for each whole day attendance

78b. Meal Allowance in Time of War or National Emergency.—(1) A member of the Auxiliary Services employed on duty ashore in time of war or national emergency, who is entitled to issue of rations in kind, in accordance with the provisions of regulation 78, may be granted meal allowance in lieu of such issue of rations in kind under the following conditions only:—

(a) That Travelling Allowance is not drawn, or rations in kind are not issued concurrently;

(b) that no arrangements for victualling exist in the locality;

(c) that no arrangements can be made to enable the member to return to his place of residence for meals;

 

(d) that expenditure additional to his ordinary expenditure has been incurred as a direct result of inability to obtain, at his place of residence, the meals usually taken thereat;

(e) that the claim for payment is supported by a certificate signed by the D.N.O. that the conditions governing payment as prescribed in this sub-regulation have been complied with.

(2) The amount payable in respect of meals obtained under the foregoing conditions shall be the actual amount necessarily expended, provided that payment for meals shall not exceed the following amounts:—

(3) Meal allowance shall not be allowable for the first meal partaken away from the usual place of residence of the member after the time of commencement of daily duty, nor for any meal immediately preceding cessation of duty when the member concerned ceases duty at, or before, the following hours:—

22. After regulation 85, the following regulation is inserted as from 1st July, 1920:—

“(85a). Spectacles, orthopædic or other surgical appliances are to be supplied only when recommended by the Board of Medical Survey, and approved by the Naval Board, in those cases where disability is directly attributable to service in the Permanent Naval Forces (Sea-going).”

23. Regulation 89 is amended as from 1st December, 1920, as follows:—

(1) By omitting sub-regulation (1) and inserting in its stead the following sub-regulations:—

“Medical Attendance.—(1). Civilian masters and employees permanently or temporarily employed at the Royal Australian Naval College, their wives and families, also the wives and families of members of the Permanent Naval Forces (Sea-going) detailed for duty at the Royal Australian Naval College, may be granted medical attendance at the College free of charge, by the Surgeon appointed for duty.

(1a). The concession of free medical attendance for all persons referred to in sub-regulation (1) above is conditional upon the work being carried out by the Surgeon appointed for official duty at the College, and subject to no additional expense being incurred by the Department.

(1b). The cost of medical attendance for confinements shall not be allowed.”

(2) By inserting immediately after the word “families” in the second line of sub-regulation (2) the words “and the wives and families of members of the Permanent Naval Forces (Sea-going) detailed for duty at the College.”
