REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1918.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the NavalDefence Act 1910-1918, to come into operation forthwith, unless otherwise specified herein.

Amendment of Naval Financial Regulations.

(Statutory Rules 1924, No. 34.)

(Seventh Amendment.)

1. Regulation 49 is amended as from 27th January, 1925, by omitting sub-regulation (33)—Pilot and Observer Specialist Allowance—and substituting a fresh sub-regulation (33) as under:—

2. Regulation 52 is amended by inserting after the word “Destroyers” in the sixth line of sub-regulation (61) the words “and Sloops”.

3. Regulation. 55, sub-regulation (3), is amended as follows as from 5th December, 1924:—

1. by adding at the end of clause (a) of sub-paragraph (i) the words:—

“provided further that an officer transferred to the Auxiliary Services shall not be paid deferred pay until final discharge from the Auxiliary Services”.

2. by omitting clause (c) of sub-paragraph (ii).

3. by adding at the end of sub-paragraph (ii) the words:—

“provided that a rating transferred to the Auxiliary Services shall not be paid deferred pay until final discharge from the Auxiliary Services.”

4. Regulation 69 is amended as follows, to take effect from 1st July, 1924:—

1. Sub-regulation (1) is omitted and the following sub-regulation is inserted in its stead:—

(1) Except in the case of a member whose position and pay are specially provided in the Appropriation Act, the following consolidated rates of Active pay shall apply to—

(i) Officers on the Auxiliary List of the Permanent Naval Forces, and to

(ii) All other persons engaged for permanent duty in the Auxiliary Services.

Pay shall be inclusive of maintenance of uniform and of all allowances except where otherwise prescribed in these Regulations.

2. Sub-regulation (4) is amended by omitting all the words after “grade” in the third line, and inserting in their stead the following:—

“Advancement to Grade I. shall be subject to Naval Board approval and the existence of a vacancy on the Establishment in that grade.”

5. Regulation 70 is repealed as from 1st July, 1924, and the following regulation is inserted in its stead:—

70. Child Endowment.—(1) In addition to the rates of salary there shall be payable to members of the Auxiliary Services allowances at the following rates:—

(a) To each member who is married or a widower, and who is the father or step-father of dependent children under the age of fourteen years, and who is in receipt of salary at a rate less than £500 per annum—the sum of £13 per annum in respect of each such child so dependent. A similar allowance may, on the approval of the Naval Board, be granted to any member in respect of orphan or adopted children under the age of fourteen years who are dependent upon and maintained by that member.

Provided that the total sum per annum paid to any member under this paragraph shall not exceed the amount by which the salary per annum of the member falls short of £500.

(b) To each member of and below the rank of Warrant Officer, except members of the Naval Dockyard Police, the sum of 3s. 6d. per week in respect of each child, step-child, or dependent child between the ages of fourteen and sixteen years, each additional adult dependant, and each dependent brother or sister under the age of sixteen years. This allowance shall be payable only until 31st December, 1924.

(2) Payment shall be subject to the following conditions:—

(a) The total salary inclusive of the allowance shall not exceed £500 per annum. Where the annual salary, plus the allowance would exceed £500 per annum, the allowance is to be reduced as that the total will not exceed £500 per annum.

(b) For each child (including step-children) provided that the child is not contributing to its own support and is wholly and solely dependent upon the member.

(c) For each dependent child under fourteen years of age, provided that the Deed of Adoption or other satisfactory evidence of adoption is produced when required by superior authority, and that the child is not contributing to its own support and is wholly and solely dependent upon the member. In such cases, the member must not have received or be in receipt of any payment in respect of such adoption.

(d) For additional adult dependants, provided they are wholly and solely dependent on the member and are not in receipt of any income whatsoever, including War, Old-age, or Invalid Pension.

6. Clause (b) of sub-regulation (1) and clause (d), sub-regulation (2), of regulation 70 are repealed as from 1st January, 1925.

7. After Regulation 78, the following regulation is inserted as from 5th December, 1924:—

78a. (1) Except where otherwise provided in this Regulation, deferred pay shall be allowed to accumulate to the credit of and shall be paid to a member of the Auxiliary Services at the rates and under the conditions prescribed in Regulations 55 and 56 for a member of the Permanent Naval Forces (Sea-going) of similar rank or rating.

(2) The amount of deferred pay which may be paid to an officer of the Auxiliary Services who is transferred thereto from the Permanent Naval Forces (Sea-going) shall not exceed the amount which would have accumulated to his credit had he remained in the Sea-going Force and attained in such Force a rank equivalent to the rank held by him in the Auxiliary Services.

(3) Deferred pay shall not be paid upon completion of engagement or re-engagement, but shall accumulate until final discharge from the Auxiliary Services.

8. The following is inserted, as from 31st December, 1920, as Regulation 78b:—

78b. (1) Except where otherwise provided in this regulation, there shall be payable to each member of the Auxiliary Services on discharge on account of having attained the prescribed age for retirement or on account of invalidity or on retrenchment, a retiring allowance of a sum equivalent to one year’s pay (including Deferred Pay at the rates prescribed for a member of the Permanent Naval Forces (Sea-going) of similar rank or rating, provided that no member who retired prior to 5th December, 1924, shall be eligible for any payment under this regulation unless he had completed ten years’ continuous service in the Permanent Naval Forces immediately prior to retirement.

(2) For the purposes of this regulation, the compulsory termination of the services of a member for the reason that his service or position is not necessary, or for the reason that the work for which he was appointed or engaged is finished, or for the reason that the quantity of work has diminished and has rendered necessary a reduction in numbers borne, shall be deemed “retrenchment” if the member has been in the service of the Commonwealth for not less than ten years continuously immediately prior to termination of his service.

(3) Where a member, retired prior to 5th December, 1924, who would have been eligible for the retiring allowance prescribed in sub-regulation (1), is deceased, and in the event of the death whilst serving of a member on or subsequently to 5th December, 1924, the allowance shall be payable to the widow and/or dependent children.

(4) The amount payable under this regulation shall be reduced by the amount of any Deferred Pay accumulated to the credit of the member and by any amount of Deferred pay paid in respect of previous service in the Permanent Naval Forces (Sea-going or Auxiliary Services), and also by the amount of any payment made to a member or his dependants as an Act of Grace.

(5) An Officer or a rating in receipt of Royal Navy Retired Pay or Long Service Pension appointed to or engaging in the Auxiliary Service shall not receive the retiring allowance unless he has completed five years’ service in the Permanent Naval Forces (Sea-going or Auxiliary Services) subsequent to completion of time for R.N. pension.

(6) A member who retired under the Defence Retirement Act 1922 shall not be eligible to receive any payment under this regulation.

9. Regulation 82 is amended by adding at the end of sub-regulation (2) the following:—

“In lieu of Fresh Meat and Fresh or Dried

Vegetables (excluding Potatoes)..................... ...Meat and Vegetable Ration, 8 ozs.”

10. Regulation 92 is amended by omitting sub-regulation (2), and inserting in its stead the following sub-regulation:—

(2) Except as provided in regulations 104 and 105, and subject to such other conditions as any be determined by the Naval Board, a member of the Auxiliary Services employed in camps of training or on other duty which necessitates his absence over night from usual place of residence, shall be entitled to rations in kind or allowance in lieu in accordance with the rate and scale approved for a member of the Permanent Naval Forces (Sea-going).

11. Regulation 93 is amended, as from 1st July, 1924, by omitting sub-regulation (6).

12. Regulation 97 is amended as follows:—

1. by omitting sub-regulations (1) and (2), and inserting in their stead the following sub-regulation:—

(1) The following shall be the rates of travelling allowances which may be drawn by members of the Permanent Naval Forces (Sea-going) when travelling on duty and in receipt of Sea-going rates of pay:—

2. By adding at the end of sub-regulation (3) the words “and the maximum period fourteen days except in such special cases as may be approved by the Naval Board.”
