REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1971.*

I, THE GOVERNOR-GENERAL of Australia, acting with the advice of the Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1971.

Amendments of the Naval Financial Regulations 

1. Regulations 272 and 273 of the Naval Financial Regulations are repealed and the following regulation substituted:—

Active pay of members.

“ 272. (1) Members of the Citizen Naval Forces and the Naval Emergency Reserve Forces rendering naval service shall be paid active pay at the daily rate fixed in accordance with this regulation.

“ (2) Subject to sub-regulations (3), (4) and (5), where an officer renders naval service, the daily rate of active pay applicable to the officer in respect of that service is the rate specified in column 2 of the following table opposite to the description of the rank held by the officer in column 1 of that table:—

“ (3) Where an officer of the Chaplain’s Branch of the Citizen Naval Forces renders naval service, the daily rate of active pay applicable to the officer in respect of that service is Seventeen dollars sixty-five cents.

“ (4) Where an officer of the Special Duties List who holds the rank of Sub-Lieutenant or Lieutenant and, immediately before he was appointed an officer, held the rating of Petty Officer or a higher rating, renders naval service, the daily rate of active pay applicable to the officer in respect of that service is—

(a) in the case of an officer who holds the rank of Sub-Lieutenant—Nineteen dollars twelve cents; or

(b) in the case of an officer who holds the rank of Lieutenant—Twenty dollars ten cents.

“ (5) Where an officer of the Medical Branch or the Dental Branch renders naval service, the daily rate of active pay applicable to the officer is the rate specified in column 2 of the following table opposite to the description of the rank held by the officer in column 1 of that table:—

“ (6) Subject to sub-regulation (7), the daily rate of active pay payable to a man in respect of naval service referred to in sub-regulation (1) is—

(a) in the case of a man who holds a rating specified in Part I of the Nineteenth Schedule—the rate specified in relation to the rating held by the man and the pay level appropriate, under regulation 31 in its application to a man rendering naval service referred to in sub-regulation (1), to the man;

(b) in the case of a man who holds a rating specified in Part II of the Nineteenth Schedule—the rate specified in column 2 of that Part opposite to the description of the rating held by the man in column 1 of that Part; and

(c) in the case of a man who holds the rating of Petty Officer—the appropriate rate.

“ (7) The daily rate of active pay payable to a man who holds the rank of Recruit in respect of naval service referred to in sub-regulation (1) is Seven dollars twenty-five cents.

“ (8) The ‘ appropriate rate ’ for the purposes of paragraph (c) of sub-regulation (6) is—

(a) in the case of a man who, immediately before the commencement of this regulation held the rating of Petty Officer and was paid at a rate specified in a paragraph in the second column of the table in sub-regulation (2) of regulation 31a—the rate specified in the paragraph in Part III of the Nineteenth Schedule designated by the same letter as that first-mentioned paragraph; or

(b) in the case of a man who, after the commencement of this regulation, is promoted to, or enlists with, the rating of Petty Officer—the rate that would be applicable to the man if—

(i) regulation 31a (in so far as that regulation is expressed to apply to a man promoted to, or enlisting with, the rating of Petty Officer) applied to the man;

(ii) a reference to the prescribed table in that regulation were read as reference to Part III of the Nineteenth Schedule;

(iii) a reference to a rate specified in a paragraph in the second column of item 4 of that table (however expressed) were read as a reference to the rate specified in a paragraph in column 2 of that Part;

(iv) sub-regulations (1), (2) and (2a) and sub-regulations (6) to (14) (inclusive) of that regulation were omitted; and

(v) the reference in that regulation to regulation 32 were omitted.

“ (9) The provisions of regulation 31 apply to and in relation to men of the Citizen Naval Forces or of the Naval Emergency Reserve Forces rendering naval service as if—

(a) sub-regulations (1), (1a), (2B), (2a) and (3) were omitted; and

(b) the words ‘ the Fifth Schedule to these Regulations to which the pay levels referred to in that Schedule ’ in sub-regulation (5) were omitted and the words ‘ Part I of the Nineteenth Schedule to which the pay levels referred to in that Part ’ were substituted.”.

Sixteenth Schedule.

2. The Sixteenth Schedule to the Naval Financial Regulations is repealed and the following Schedule substituted:—
