REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1975.*

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1975.

Amendments of the Naval Financial Regulations 

Commencement.

1. These Regulations shall come into operation on 9 February 1976.

Furlough.

2.Regulation 247 of the Naval Financial Regulations is amended by omitting from sub-regulation (5) the words “ Upon the death of a member who, at the date of his death,”, and substituting the following words:—

“ Where—

(a) a member dies; or

(b) the Minister, after consideration of all the circumstances, directs that a member be presumed to have died on a particular date,

and at the date of his death or on which he is presumed to have died he ”.

Pay in lieu of leave.

3. Regulation 250a of the Naval Financial Regulations is amended by omitting sub-regulation (3) and substituting the following sub-regulation:—

“ (3) For the purposes of sub-regulation (2), the period of leave that could have been granted to the member shall, except in the case of a member whose services were terminated by reason of his having been dismissed, be deemed to include the leave credit that would have accrued to him on the First day of July immediately following the termination of his services if he had continued to serve in the Navy and had been on leave without pay from and including the day immediately following the termination of his service ”.
