REGULATIONS UNDER THE DEFENCE ACT 1903-1941 AND THE NAVAL DEFENCE ACT 1910-1934.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act 1903-1941 and the Naval Defence Act 1910-1934.

Amendments of the Naval Financial Regulations. 

Schoolmaster Branch.

1. Regulation 22 of the Naval Financial Regulations is amended by omitting from sub-regulation (1.) the figures “0 14 0” (second occurring) and inserting in their stead the figures “0 14 6”.

Allowances to officers.

2.—(1.) Regulation 45 of the Naval Financial Regulations is amended—

(a) by inserting after sub-regulation (13.) the following sub-regulations:—

“(13a.) Navigating Allowance—to be paid in time of war only, to (H) officers of the rank of Lieutenant or Lieutenant-Commander, when actually appointed to seagoing ships for navigating duties in lieu of (N) Specialists—

(i) if with less than one year’s service on (N) duties..................

(ii) on completion of one year’s service on (N) duties and on recommendation of Commanding Officer—

if with less than five years’ seniority as Lieutenant.......

“(13b.) Navigating Allowance—to be paid in time of war only, to (H) officers of the rank of Lieutenant or Lieutenant-Commander, on completion of three years’ service at sea on hydrographic duties (or combined hydrographic and navigating duties), and when actually appointed to sea-going ships for navigating duties in lieu of (N) Specialists qualified for 1st Class Ships—

(i) if with less than one year’s service on (N) duties................

(ii) if with one year’s service on (N) duties, and on recommendation of Commanding Officer...................

“(13c.) Navigating Allowance under sub-regulation (13a.) or (13b.) of this regulation shall not be payable concurrently with Surveying Pay.”; and

(b) by omitting sub-regulation (16.) and inserting in its stead the following sub-regulation:—

“(16.) Allowance to Non-Specialist—when specifically appointed in lieu of a Specialist in Gunnery, Torpedo, Signals, Wireless Telegraphy, Staff (Operations or Intelligence), Navigating (except as provided in sub-regulations (13a.) and (13b.) of this regulation), or Anti-Submarine duties in a ship in which an appropriate Specialist officer is allowed, but not borne.......................... 1 0”.

(2.) Any (H) officer of the rank of Lieutenant or Lieutenant-Commander who, during the period from and including the ninth day of June, 1941, to the date of commencement of this regulation, has performed the duties specified in sub-regulation (13a.) or (13b.) of regulation 45 of the Naval Financial Regulations, as amended by this regulation, subject to the conditions therein specified, shall be paid in respect of those duties at the appropriate rate prescribed in sub-regulation (13a.) or (13b.), as the case may be, of that regulation as so amended.

Auxiliary-Services—Rates of Active Pay.

3. Regulation 64 of the Naval Financial Regulations is amended by inserting in the table in sub-regulation (1.), after the words and figures—

Furlough.

4. Regulation 139 of the Naval Financial Regulations is amended:—

(a) by inserting in sub-regulation (5.) after the word “absence,” the words “or where the Naval Board, after consideration of all the circumstances, directs that the death of a member so eligible be presumed,”; and

(b) by adding at the end of sub-regulation (5.) the words “or, in any case where the Naval Board has directed that the death of a member be presumed, at a date determined by the Naval Board”.

 

5. Regulation 140 of the Naval Financial Regulations is amended by omitting sub-regulation (5.) and inserting in its stead the following sub-regulation:—

Scale of extended leave when not eligible for furlough.

“(5.) Where, before a person has completed twenty years’ service, and either before or after he has attained the prescribed age for retirement—

(a) the person dies; or

(b) the Naval Board, after consideration of all the circumstances, directs that the death of the person be presumed,

the Naval Board may authorize payment to the dependants of the person of a sum equivalent to the pay for the period of leave which the person would have received had he, under sub-regulation (1.) of this regulation, been eligible for, and been granted leave of absence at the date of his death, or, in any case where the Naval Board has directed that the death of the person be presumed, at a date determined by the Naval Board.”.

6.— (1.) After regulation 148a of the Naval Financial Regulations the following regulation is inserted:—

Paravanes—Awards for the salvage or recovery of, &

“148b.—(1.) The Naval Board may authorize payment of an award in accordance with the following table for the salvage or recovery of a paravane or for the first report which leads to the recovery of a paravane:—

Provided that a member of the Defence Forces shall not be eligible for any award payable under this regulation.

“(2.) For the purposes of this regulation ‘a local authority’ means a local authority as defined in regulation 148a of these Regulations.”.

(2.) If during the period from and including the sixth day of March, 1941, to the date of commencement of this regulation, any person has salved or recovered and delivered a paravane to a local authority or made a report to a local authority which led to the recovery of a paravane, the Naval Board may authorize payment to that person of an award of such amount as is specified as appropriate in the Naval Financial Regulations as amended by this regulation.

7. Regulation 154 of the Naval Financial Regulations is amended by inserting, after sub-regulation (3.), the following sub-regulation:—

Officer-in-Charge, Naval Store Depot, Darling Island.

“(3a.) The Officer-in-Charge, Naval Store Depot, Darling Island, New South Wales, is authorized—

(a) To approve of contract demands on the Contract Board or the District Contract Board or requisitions for the local purchase of—

(i) Naval Stores which are authorized for local purchase and which are required to replenish authorized stock which will not be exceeded on receipt of stores purchased;

 

(ii) Naval Stores which are required for repair and refit of H.M.A. Ships approved by the Naval Board; and

(iii) Naval Stores for supply to H.M.A. Ships or Shore Establishments in accordance with a demand specially approved by superior authority.

(b)To approve of requisitions for minor items of Naval Stores not ordinarily kept in stock, not exceeding Five pounds in value in each case, required for specific Yard Services; and

(c) To approve of requisition for all services in connexion with Naval Stores not exceeding Twenty pounds for any particular service in respect of any one shipment.”.
