REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1952.*

I, THE ADMINISTRATOR of the Government of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1952.

Amendments of Naval Financial Regulations.

Parts.

1. Regulation 3 of the Naval Financial Regulations is amended by omitting the words and figures—

"Part XVa.—Papua and New Guinea Division.

(Regulation 262a)."

and inserting in their stead the words and figures—

"Part XVa.—Papua and New Guinea Division.

(Regulations 262a-262j).".

Interpretatio

2. Regulation 4 of the Naval Financial Regulations is amended—

(a) by inserting in sub-regulation, (1.), after the definition of "intended", the following definition:—

" 'intermediate term duty' means, in relation to a member serving in an oversea country, a period of duty in that country the duration of which is intended to be more than six months and less than twelve months;";

(b)by omitting from sub-regulation (1.) the definition of "long leave" and inserting in its stead the following definitions:—

" 'long leave' means a period of leave of seventy-two consecutive hours or more;

" 'long term duty' means, in relation to a member serving in an oversea country, a period of duty in that country the duration of which is intended to be twelve months or more;";

(c) by inserting in sub-regulation (1.), after the definition of "rating", the following definition:—

" 'recognized secondary school' includes a higher elementary school and a technical school at which education beyond the accepted primary school standard is undertaken;"; and

(d)by omitting from sub-regulation (1.) the definition of "short leave" and inserting in its stead the following definition:—

" 'short leave' means a period of leave of less than seventy-two consecutive hours;".

Officers' General List— Active Pay.

3. Regulation 9 of the Naval Financial Regulations is amended by omitting from sub-regulation (4.) the words "Midshipman under the Observer Training Scheme "and inserting in their stead the words" Midshipman (S.L.) under the Aircrew Training Scheme ".

Entertainment of visitors.

4. Regulation 22 of the Naval Financial Regulations is amended by omitting sub-regulation (1.) and inserting in its stead the following sub-regulations:—

"(1.) Where persons visit a ship or establishment on the Australia Naval Station in an official capacity and are the guests of a wardroom mess at a meal or meals, or for refreshments, that mess shall, subject to this regulation, be reimbursed an amount in respect of those meals or refreshments at the following rates:—

(a) rate for a meal—Four shillings and sixpence per person;

(b)rate for beverages—Two shillings and sixpence per person;

(c) rate for morning tea—One shilling and sixpence per person, and

(d) rate for afternoon tea—Two shillings and sixpence per person.

"(1a.) Where beverages are provided immediately before or with a meal, reimbursement shall be made in respect of both the meal and beverages at the rates prescribed by paragraphs (a) and (b)of the last preceding sub-regulation.

"(1b.) Where beverages and morning tea or beverages and afternoon tea are provided the mess shall be reimbursed at the rate of Two shillings and sixpence per person.".

Other Cadet Midshipmen.

5. Regulation 29 of the Naval Financial Regulations is amended—

(a)by omitting from sub-regulation (4.) the words "One shilling and sixpence" and inserting in their stead the words "Three shillings";

(b)by omitting from sub-regulation (6.) the words "not exceeding One pound per week";

(c) by omitting sub-regulation (7.) and inserting in its stead the following sub-regulation:—

"(7.) The balance standing to the credit of a Cadet Midshipman in his pay account, after any deductions there from pursuant to sub-regulations (4.) and (5.) of this regulation have been made and after allowing for any sums drawn under

sub-regulation (6.) of this regulation, shall be paid into a Savings Bank account in his name at the end of each College term or, in the event of his service being terminated during the course of a college term, upon that termination of service."; and

(d)by omitting sub-regulation (9.) and inserting in its stead the following sub-regulation:—

"(9.) If the service of a Cadet Midshipman is terminated, the accumulated credit referred to in sub-regulation (4.) of this regulation shall be paid to him.".

Marriage allowance.

6. Regulation 80 of the Naval Financial Regulations is amended—

(a)by omitting from sub-regulation (1.) the words "Seven shillings and ninepence" and inserting in their stead the words "Eight shillings";

(b)by omitting from sub-regulation (3.) the words "Eleven shillings and sevenpence" (wherever occurring), and inserting in their stead the words "Thirteen shillings and sixpence"; and

(c) by omitting from sub-regulation (5.) the words "Eleven shillings and sevenpence" (wherever occurring), and inserting in their stead the words "Thirteen shillings and sixpence".

Qualifying allotment for payment of full rate of marriage allowance.

7. Regulation 84 of the Naval Financial Regulations is amended—

(a) by omitting from paragraph (a)of sub-regulation (1.) the words "Nineteen shillings and fourpence" and inserting in their stead the words "One pound one shilling and sixpence"; and

(b)by omitting from paragraph (b)of sub-regulation (1.) the words

"One pound three shillings and fourpence" and inserting in their stead the words "One pound eight shillings and sixpence".

Repeal of regulations 85 and 86.

8. Regulations 85 and 86 of the Naval Financial Regulations are repealed.

Separation allowance.

9. Regulation 89 of the Naval Financial Regulations is amended by omitting from sub-regulation (1.) the words "Four shillings" and inserting in their stead the words "Seven shillings".

Provision allowance.

10. Regulation 90 of the Naval Financial Regulations is amended by omitting from sub-regulation (1.) the words "Four shillings" and inserting in their stead the words "Seven shillings".

11. After regulation 90 of the Naval Financial Regulations the following regulation is inserted:—

Payment of allowances to members checked sick or granted sick leave.

"90a. Notwithstanding anything contained in this Division, where, in accordance with regulation 245 of these Regulations—

(a) a member is placed on a reduced rate of active pay; or

(b)active pay is not payable to a member,

in respect of a period during which he is checked sick or granted sick leave, marriage allowance and separation allowance, provision allowance or living out allowance shall be payable to the member at such rates and subject to such conditions as the Naval Board approves.".

Living out allowance— unmarried members.

12. Regulation 92 of the Naval Financial Regulations is amended by omitting from sub-regulation (1.) the words "Nine shillings and threepence" and inserting in their stead the words "Nine shillings and sixpence".

13. After regulation 92 of the Naval Financial Regulations the following regulation is inserted:—

Supplementary living out allowance.

"92a.—(1.) A member who is eligible for payment of living out allowance under the last preceding regulation may be paid an allowance, called supplementary living out allowance, where he is appointed or drafted to a new place of duty and, after arrival at that place, satisfies the Naval Board that he—

(a)is unable to obtain board and lodging at a reasonable rate; and

(b)is trying to obtain cheaper board and lodging.

"(2.) Supplementary living allowance is payable at such rates and subject to such conditions as the Naval Board determines.".

Retention of lodgings allowance.

14. Regulation 94 of the Naval Financial Regulations is amended by omitting sub-regulations (2.), (3.) and (4.) and inserting in their stead the following sub-regulations:—

"(2.) Where a member is in receipt of living out allowance under regulation 92 of these Regulations and is admitted to a hospital, he shall, if required to pay for retention of lodgings for the period in hospital, be paid retention of lodgings allowance in respect of that period or thirty consecutive days, whichever is the less.

"(3.) Where a member in receipt of a living out away from home allowance under the last preceding regulation—

(a) is admitted to a hospital; or

(b)proceeds on temporary duty and either lives in or out at his temporary station; or

(c) proceeds on leave of absence for a period exceeding seven days,

he shall, if required to pay for retention of lodgings during that absence, be paid retention of lodgings allowance in respect of that absence or thirty consecutive days, whichever is the less.

"(4.) The allowance payable under this regulation shall be—

(a) in the case of a member, who is not a married member— at a rate of Nine shillings and sixpence per day or an amount equal to the actual cost incurred in the retention of lodgings, whichever is the less; or

(b)in the case of a married member—

(i) at a rate not exceeding two-thirds of the rate of living out away from home allowance which was payable to him under the last preceding regulation immediately prior to his absence; or

(ii) the actual cost incurred in the retention of his lodgings,

whichever is the less.".

General provisions relating to eligibility for certain allowances.

15. Regulation 95 of the Naval Financial Regulations is amended by omitting sub-regulation (5.).

16. Regulation 96 of the Naval Financial Regulations is repealed and the following regulation inserted in its stead:—

Oversea living out allowance.

"96.—(1.) In this regulation—

'furnished hiring' means furnished accommodation which is provided through the Royal Navy for a married member serving in the United Kingdom and which is located outside the limit of the naval establishment at which he is serving;

'official married quarter' means accommodation which is provided for a married member serving in the United Kingdom and which is located within the limits of the naval establishment at which he is serving.

"(2.) Subject to the succeeding provisions of this regulation, an allowance, called 'oversea living out allowance', is payable to a member appointed or drafted for intermediate term duty or long term duty in the United Kingdom, in respect of the period for which he lives out in that country.

"(3.) Subject to the succeeding provisions of this regulation, a member on intermediate term duty in the United Kingdom shall be paid oversea living out allowance at the rate per day specified, according to his rank or rating, his pay seniority, his marital status and his living conditions in the following table:—

"(4.) Where a member on intermediate term duty in the United Kingdom occupies a furnished hiring or an official married quarter he shall be paid oversea living out allowance at such rate and subject to such conditions as the Naval Board approves.

"(5.) Subject to the succeeding provisions of this regulation, where a member is on long term duty in the United Kingdom and arrived in that country prior to the fourth day of June, 1959, he shall be paid oversea living out allowance at the rate per day specified, according to his rank or rating, his pay seniority, his marital status and his living conditions, in whichever of the following tables is applicable:—

"(6.) Subject to the succeeding provisions of this regulation, where a member is on long term duty in the United Kingdom and arrived in that country on or after the fourth day of June, 1959, he shall be paid oversea living out allowance at the rate per day specified, according to his rank or rating, his pay seniority, his marital status and his living conditions, in whichever of the following tables is applicable:—

"(7.) Where a member to whom sub-regulation (5.) or (6.) of this regulation applies is occupying an official married quarter or a furnished hiring and is provided with domestic assistance by or at the expense of the Department, the rate of oversea living out allowance payable to him shall be reduced by Two shillings and ninepence per day.

"(8.) Where a married member on long term duty in the United Kingdom lives out and his family does not reside in that country, he shall be paid an allowance at such rate and subject to such conditions as the Naval Board approves.

"(9.) Where a member on long term duty in the United Kingdom lives out and does not occupy a house, a flat, a furnished hiring or an official married quarter, he shall be paid an allowance at such rate and subject to 6uch conditions as the Naval Board approves.

" (10.) Where a member referred to in the preceding provisions of this regulation—

(a) is temporarily absent from the place to which he is appointed or drafted; or

(b)is temporarily living in in an Australian ship or in one of Her Majesty's ships or naval establishments,

he may be paid oversea living out allowance at such rate, not exceeding the appropriate rate specified in sub-regulations (3.), (5.) or (6.) of this regulation, for such period and subject to such conditions as the Naval Board approves.

"(11.) Where a member who is appointed or drafted for intermediate term duty or long term duty in the United Kingdom is granted long leave, oversea living out allowance is payable at such rate and subject to such conditions as the Naval Board approves.

" (12.) Oversea living out allowance is not payable—

(a)to a member engaged, re-engaged or re-entered in the United Kingdom, in respect of any period following engagement, re-engagement or re-entry, during which—

(i) he remains on the staff of the Royal Australian Naval Liaison Officer, London;

(ii) he is awaiting passage to Australia; or

(iii) he is undergoing a course of training before embarkation for Australia;

(b)to a member attending the Joint Services Staff College, Latimer, except in respect of any period during which he is granted long leave; or

(c) to a married member on intermediate term duty in respect of any period during which he is paid settling in allowance under regulation 103 of these Regulations.".

17. Regulation 97 of the Naval Financial Regulations is repealed and the following regulation is inserted in its stead:—

Oversea living in allowance.

"97.—(1.) Subject to the succeeding provisions of this regulation, an allowance, called 'oversea living in allowance ', is payable to a member who

is on intermediate or long term duty in the United Kingdom and who lives in in one of Her Majesty's ships or naval establishments in that country, in respect of the period for which he so lives in.

" (2.) A member on intermediate term duty in the United Kingdom shall be paid oversea living in allowance at the rate per day specified, according to his rank or rating, pay seniority and marital status, in the following table:—

"(5.) Where a married member on long term duty in the United Kingdom lives in and his family does not reside in that country, he shall be paid an allowance at such rate and subject to such conditions as the Naval Board approves.

"(6.) Where a member appointed or drafted for long term duty in the United Kingdom lives in one of Her Majesty's ships or naval establishments in the United Kingdom and passages to that country for his family have been granted under these Regulations, or where he has married after his embarkation in Australia for the United Kingdom, the rate of oversea living in allowance payable to him under this regulation, in respect of the period during which his family resides in the United Kingdom while he is so living in, is the same as the rate of oversea living out allowance that would be payable to him under sub-regulation (5.), (6.) or (7.) of the last preceding regulation if he were living out in the United Kingdom,

"(7.) Where a member referred to in sub-regulations (3.), (4.), (5.) or (6.) of the last preceding regulation is temporarily living in in one of Her Majesty's ships or naval establishments, he may be paid oversea living in allowance at such rate, not exceeding the appropriate rate specified in sub-regulations (2.), (3.) or (4.) of this regulation, for such period and subject to such conditions as the Naval Board determines, and this allowance may be in addition to any oversea living out allowance paid to him under sub-regulation (10.) of the last preceding regulation.

" (8.) Where a member referred to in sub-regulation (1.) of this regulation is eligible for travelling allowance under these Regulations, oversea living in allowance is payable to him for such period and at such rate as the Naval Board determines.

" (9.) Oversea living in allowance is not payable—

(a) to a member entered in the United Kingdom in respect of a period following entry for which—

(i) he is on the staff of the Royal Australian Naval Liaison Officer, London;

(ii) he is awaiting passage to Australia; or

(iii) he is undergoing a course of training before embarkation for Australia; or

(b)in respect of a period for which a member is granted long leave.

"(10.) Where a member lives in in one of Her Majesty's ships or in a naval establishment in the United Kingdom during a course of training and a charge against the Department is made by the Admiralty in respect of the course, so much (if any) of the amount of the charge as represents his messing charge shall be deducted from the amount of the allowance otherwise payable to the member under this regulation.

"(11.) Where a member referred to in sub-regulation (1.) of this regulation is in hospital, oversea living in allowance is payable to him at such rate as the Naval Board determines.".

18. After regulation 97 of the Naval Financial Regulations the following regulation is inserted:—

Outlay allowance.

"97a.—(1.) Subject to the succeeding provisions of this regulation and to such conditions as the Naval Board determines, an allowance, called 'outlay allowance', is payable to a member appointed or drafted to the United Kingdom on long term duty, on arrival at his place of duty in the United Kingdom.

"(2.) The amount of the outlay allowance payable under the last preceding sub-regulation is the amount specified, according to the intended period of the member's appointment or draft to the United Kingdom, his marital status and living conditions, in the following table:—

Child allowance.

19. Regulation 98 of the Naval Financial Regulations is amended by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation:—

"(1.) Where a married member who has been appointed or drafted for long term duty in the United Kingdom is in receipt of either oversea living out allowance or oversea living in allowance under this Division, he shall be paid in respect of the period for which the oversea living out allowance or oversea living in allowance is payable to him, an allowance, called 'child allowance', at the rate of Four shillings and elevenpence for each child who is maintained by him in the United Kingdom during that period.".

Continuation of oversea living allowances after return of certain members to Australia.

20. Regulation 99 of the Naval Financial Regulations is amended—

(a)by omitting from paragraph (d)of sub-regulation (1.) the words and figures "sub-regulation (3.) of regulation 97" and inserting in their stead the words and figures "sub-regulation (6.) of regulation 97";

(b)by omitting from sub-regulation (2.) the words and figures "sub-regulation (3.)", "sub-regulation (3.,)" and "sub-regulation (2.)" and inserting in their stead the words and figures "sub-regulation (6.)", "sub-regulation (6.)" and "sub-regulation (3.) or (4.)", respectively; and

(c) by adding after sub-regulation (4.) the following sub-regulations:—

"(5.) A member shall not be entitled to continuation of an allowance under this regulation unless he allots to the person to whom his qualifying allotment is paid, in addition to the minimum rate of qualifying allotment applicable to him, an amount not less than the amount of the allowance payable to him under this regulation.

"(6.) Where in the opinion of the Royal Australian Naval Liaison Officer, London, the period in respect of which the allowance will under this regulation remain payable, is expected to be less than twenty-eight days, he may waive the obligation to make an additional allotment under the last preceding sub-regulation.".

Additional United Kingdom allowance.

21. Regulation 100 of the Naval Financial Regulations is amended by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation:—

"(1.) Subject to the succeeding provisions of this regulation, where a married member—

(a)on intermediate term duty in the United Kingdom; or

(b)on long term duty in the United Kingdom, who has not been granted a passage for his family to that country under these Regulations, or who has not been reimbursed for such a passage,

lives in, an allowance, called 'additional United Kingdom allowance', is payable in respect of the period of the member's service in that country at the rate of Six shillings and threepence per day.".

22. After regulation 100 of the Naval Financial Regulations the following regulation is inserted:—

United Kingdom exchange allowance.

"100a.—(1.) Subject to the succeeding provisions of this regulation, an allowance, called 'United Kingdom exchange allowance', is payable to a member at the rate per day specified according to his rank or rating and his pay seniority in the following table:—

"(2.) Where in the opinion of the Naval Board circumstances exist which justify the payment of a rate of allowance higher than that applicable to the member under the last preceding sub-regulation, the Naval Board may approve of payment at that higher rate.

"(3.) United Kingdom exchange allowance is payable to a member engaged, re-engaged or re-entered in the United Kingdom, who serves in the United Kingdom and is not entitled to an allowance under regulations 96, 97, 112 or 209 of these Regulations.

"(4.) Where a married member in receipt of United Kingdom exchange allowance proceeds to Australia and his family remains in the United Kingdom after his embarkation for Australia, that allowance remains payable, subject to the next succeeding sub-regulation, until the day prior to the date of embarkation of his family for Australia.

"(5.) Payment of an allowance under the last preceding sub-regulation shall not be made—

(a)where the member's family does not intend to proceed to Australia;

(b) after eighteen months after the date of the member's departure from the United Kingdom, unless the Naval Board otherwise approves; or

(c) if the member does not allot to the person to whom his qualifying allotment is paid, in addition to the minimum rate of qualifying allotment an amount not less than the amount of allowance payable to him under this regulation.

" (6.) Where, in the opinion of the Royal Australian Naval Liaison Officer, London, the period in respect of which the allowance will remain payable under sub-regulation (4.) of this regulation is expected to be less than twenty-eight days, he may waive the obligation to make an additional allotment under paragraph (c) of the last preceding sub-regulation.

"(7.) In this regulation, 'family', in relation to a member, means his wife or children in respect of whom marriage allowance is payable under these Regulations.".

Dates of payment of oversea allowances.

23. Regulation 101 of the Naval Financial Regulations is amended by omitting the word and figures "regulation 99" and inserting in their stead the words and figures "regulations 99 and 100a."

24. After regulation 101 of the Naval Financial Regulations the following regulation is inserted:—

Payment of oversea living out allowance and child allowance when on long leave.

"101a. Where a member on long term duty in the United Kingdom is granted long leave immediately prior to his return to Australia and he takes that leave—

(a)in the United Kingdom; or

(b)in another country en route to Australia,

he may be paid oversea living out allowance and child allowance for such periods of that leave at such rates and subject to such conditions as the Naval Board approves.".

Allowances payable to other members serving oversea.

25. Regulation 105 of the Naval Financial Regulations is omitted and the following regulation is inserted in its stead:—

"105.—(1.) Where a member is appointed or drafted for duty oversea otherwise than in one of Her Majesty's ships or in a naval establishment

in the United Kingdom, he may be paid an oversea living allowance and such other allowances as the Naval Board determines, at such rates and subject to such conditions as the Naval Board determines.

"(2.) Where a member referred to in the last preceding sub-regulation is granted long leave immediately prior to his return to Australia and he takes that leave—

(a)in the oversea country to which he was appointed or drafted for duty; or

(b) in another country en route to Australia,

he may be paid oversea living allowance and such other allowances for such periods of that leave at such rates and subject to such conditions as the Naval Board approves.".

26. After regulation 105 of the Naval Financial Regulations the following regulation is inserted:—

Allowance to widow of member who dies while serving oversea.

"105a.— Where a member dies while serving oversea and passages were provided for his family under these Regulations to his place of duty oversea, his widow may be paid such allowances for such period and subject to such conditions as the Naval Board determines.".

District allowance.

27. Regulation 107 of the Naval Financial Regulations is amended by inserting after sub-regulation (9.) the following sub-regulation:—

"(9a.) Where a member serves under an appointment or draft in an isolated district and, immediately upon the conclusion of such service—

(a)proceeds on recreation leave or sick leave; or

(b) is admitted to hospital,

district allowance continues to be payable, provided that the period in respect of which payment is made under this sub-regulation shall not exceed a period equal to the period of recreation leave due to the member at the time of his ceasing duty in that isolated district.".

28. After regulation 109 of the Naval Financial Regulations the following regulation is inserted:—

Antarctic allowance.

"110.—(1.) Subject to the succeeding provisions of this regulation, where a member is appointed or drafted for duty with the Antarctic Division of the Department of External Affairs and proceeds on an Antarctic expedition with that Division, an allowance, called 'Antarctic allowance', is payable at the following rates:—

Married member.

"(2.) The allowances payable under the last preceding sub-regulation shall commence on the date of departure of the member from the last Australian port of call and shall cease on the date of arrival of the member at the first Australian port of call on return to Australia.

" (3.) Where a member is eligible for the payment of Antarctic allowance under the provisions of paragraph (b)of sub-regulation (1.) of this regulation and travels in a ship which is not a ship of the Royal Australian Navy, the rate of allowance payable to him whilst that ship is south of latitude forty-five degrees South, shall be Eight shillings and ninepence per day.

" (4.) Where a ship of the Royal Australian Navy proceeds to the Antarctic whilst accompanying or transporting an Antarctic expedition, a member serving in that ship, not being a member entitled to an allowance under sub-regulation (1.) of this regulation, shall be eligible for the payment of Antarctic allowance at the rate of Six shillings and threepence per day.".

29. Regulation 112 of the Naval Financial Regulations is repealed and the following regulations are inserted in its stead:—

Special allowances.

"112. A member serving oversea in an Australian ship may, if the Naval Board so approves, be paid special allowances at such rates, for such periods and subject to such conditions as the Naval Board determines.".

Payment of fares and travelling expenses of wife of ana, Washington.

"112a. Where an officer is appointed Australian Naval Representative and Naval Attaché, Washington, and Naval Adviser to the Australian High Commissioner, Ottawa, and his wife, at the request of the Australian High Commissioner, Ottawa, accompanies him on official visits to Ottawa—

(a)at the commencement and termination of his appointment; or

(b)with the approval of Her Majesty's Australian Ambassador, Washington, at any other time during the term of his appointment,

the cost of—

(c) her return fares from Washington to Ottawa; and

(d)her hotel costs and travelling expenses for the minimum period during which it is necessary for the officer to remain in Ottawa,

shall be met at departmental expense.".

Hard-lying money.

30. Regulation 119 of the Naval Financial Regulations is amended by inserting after sub-regulation (1.) the following sub-regulation:—

"(1a.) Where an officer, not being an officer entitled to an allowance under sub-regulation (1.) of this regulation, is eligible for payment of Antarctic allowance under the provisions of sub-regulation (4.) of regulation 110 of these Regulations, hard-lying money is payable in respect of any day on which the ship is south of latitude forty-five degrees South.".

31. After regulation 121 of the Naval Financial Regulations, the following regulations are inserted:—

Education allowance.

"122.—(1.) For the purposes of this regulation 'child' in relation to a member, means—

(a)the child (not being an ex-nuptial child) or the step-child of the member; or

(b)the legally adopted child of the member,

who is under the age of eighteen years.

"(2.) Subject to such conditions as the Naval Board determines, an allowance, called 'education allowance', is payable at the rate of Eighty pounds per annum in respect of each child of a member who, as a result

of a removal in respect of which expenses have been met by the Department under regulation 231 of these Regulations, finds it necessary to arrange for that child or those children to continue full-time education at a recognized secondary school at the locality from which that removal was granted.

"(3.) Where a member is eligible for the payment of education allowance in respect of a child under the preceding provisions of this regulation, the Department will, subject to such conditions as the Naval Board determines, bear the cost of—

(a)the return fare of that child for travel once a year; and

(b)the single fare of that child on completion of its education,

between the locality of the place of education and the place to which the member was last removed.

Chaplains' equipment allowance.

"122a.—(1.) An allowance, called 'Chaplains' equipment allowance', is payable to a Chaplain of the Permanent Naval Forces to cover the purchase and maintenance of appropriate ecclesiastical vestments and equipment.

"(2.) The amount of the allowance payable under the last preceding sub-regulation is—

(a)an amount of Fifty pounds, payable on appointment, to cover the purchase of the vestments and equipment; and

(b)an amount of Five pounds, payable on completion of each year of service, to cover the maintenance of the vestments and equipment.

"(3.) For each year or part thereof by which a Chaplain fails to complete four years' service, he shall repay an amount of Ten pounds.".

32. After regulation 146 of the Naval Financial Regulations the following regulation is inserted:—

R.N. foreign languages and Naval History prizes.

"146a.—(1.) An officer who qualifies for a prize at the annual examination in foreign languages or in the annual competition for Naval History conducted by the Royal Navy may be awarded a prize at departmental expense.

"(2.) The value of the prize awarded to the officer under the last preceding sub-regulation shall not exceed the value of the prize which would have been awarded to the officer had he been an officer of the Royal Navy.".

33. Regulations 158 and 159 of the Naval Financial Regulations are repealed and the following regulations are inserted in their stead:—

Gratuities.

"158. Subject to this Division, a gratuity in respect of service in the Permanent Naval Forces is payable to such members, including members of the Women's Service, at such rates and subject to such conditions as the Naval Board determines.

Gratuities not payable in certain cases.

"159. A gratuity is not payable under this Division in respect of any period of service—

(a)which is service for pension under the Defence Forces Retirement Benefits Act 1948-1959, or under that Act as amended from time to time, and in respect of which a pension or

benefit (other than a refund of contributions) is payable under that Act or under that Act as amended from time to time;

(b)by an officer who, while serving under a short commission, is appointed to a permanent commission, or who, immediately following service under a short term commission, is appointed to a further short term commission and who elects under the provisions of the Defence Forces Retirement Benefits Act 1948-1959, or of that Act as amended from time to time, not to receive a gratuity under this Division;

(c) where, on completion of that service, a member is appointed to the Public Service of the Commonwealth and who elects under the provisions of the Defence Forces Retirement Benefits Act 1948-1959, or of that Act as amended from time to time, to transfer to the Superannuation Fund established under the Superannuation Act 1922 the contributions made by him to the Defence Forces Retirement Benefits Fund;

(d)by an officer of the Medical Branch during which he is serving under a short term commission and is undertaking a refresher course of training prior to the termination of his appointment;

(e) under a short service commission or an engagement which has been terminated for disciplinary reasons;

(f) which has been terminated on the grounds of incapacity of the member or during which the member has ceased to be a member by reason of death, where the incapacity or death is, in the opinion of the Naval Board, due to causes within the member's own control, or where the incapacity or death resulted from a disability which was present at the commencement of service and was not aggravated by his service;

(g)of more than twenty-one consecutive days for which the member is not credited with active pay; or

(h)of a member, not being a married member, who dies during a period of service.".

34. After regulation 177 of the Naval Financial Regulations the following regulation is inserted:—

Khaki clothing allowance.

"177a.—(1.) Where an officer is appointed for duty in North America, he may be paid an allowance, called 'khaki clothing allowance', to cover the purchase of khaki clothing in accordance with a scale approved by the Naval Board.

"(2.) The allowance payable under the last preceding sub-regulation shall be such amount, based on the prices charged by the Commonwealth Government Clothing Factory for the items listed in the scale of khaki clothing referred to in the last preceding sub-regulation, as the Naval Board determines.".

Travel on termination of service.

35. Regulation 193 of the Naval Financial Regulations is amended—

(a) by omitting from sub-regulation (5.) the words "A member" and inserting in their stead the words "Subject to the next succeeding sub-regulation, a member "; and

(b) by inserting after sub-regulation (5.) the following sub-regulation:—

"(6.) Where an officer of the Fleet Air Arm who holds a Short Service Commission—

(a) is permitted to resign his Commission to take up employment other than with the Australian Military Forces or the Royal Australian Air Force; and

(b)is not transported to his new place of employment at the expense of his new employer,

he may, on the termination of his service, be transported at departmental expense to a place referred to in sub-regulation (1.), (2.), (3.) or (3a.) of this regulation.".

Rate of travelling allowance within Australia.

36. Regulation 201 of the Naval Financial Regulations is amended by omitting sub-regulation (2.) and inserting in its stead the following sub-regulations:—

"(2.) The rate of travelling allowance within Australia payable to the First Naval Member of the Naval Board and to a Vice-Admiral appointed as Chairman, Chiefs of Staff Committee, is Six pounds six shillings per day.

"(2a.) Subject to the last preceding sub-regulation, the rate of travelling allowance within Australia payable to a member of the Naval Board, or an officer of the rank of Rear-Admiral or a higher rank is Five pounds five shillings per day.".

Rate of allowance for journey.

37. Regulation 202 of the Naval Financial Regulations is repealed and the following regulation inserted in its stead:—

"202. When a member is absent from his normal place of duty involving absence overnight and travel is by other than normal means of transport, the rate of travelling allowance payable to the member shall be at such rate and subject to such conditions as the Naval Board determines.".

Repeal of regulation 238.

38. Regulation 258 of the Naval Financial Regulations is repealed.

39. Part XVa. of the Naval Financial Regulations is repealed and the following Part is inserted in its stead:—

"Part XVa.—Papua and New Guinea Division.

Interpretation.

"262a. In this Part, unless the contrary intention appears—

(a) 'member' means a member of the Papua and New Guinea Division of the Royal Australian Navy; and

(b)the terms 'rating', 'supply officer' and 'departmental', in relation to a member, have the same meanings as those terms have, in relation to other members of the Permanent Naval Forces, under regulation 4 of these Regulations.

Rates of pay.

"262b.—(1.) The annual rate of pay payable to a member is the rate specified, in relation to the rating that the member holds and his period of service in that rating, in the Fifteenth Schedule to these Regulations.

"(2.) The qualifications required for inclusion of a member in a group referred to in the Fifteenth Schedule shall be as determined by the Naval Board.

Uniform and equipment.

"262c.—(1.) A member shall be issued, at departmental expense, with the articles of uniform kit and equipment appropriate to his rating.

"(2.) A member shall be issued, at departmental expense, with replacements of such articles of uniform kit and equipment as are rendered unserviceable by fair wear and tear.

"(3.) Where articles of uniform kit or equipment issued to a member cease to be appropriate to his rating, he shall return them to the supply officer of the naval establishment to which he is attached.

"(4.) Upon discharge, a member shall return to the supply officer of the naval establishment to which he is attached, such articles of uniform kit and equipment as the Naval Board, by instructions issued from time to time, requires to be so returned.

Rations.

"262d. Subject to the succeeding provisions of this Part, a member shall be issued with rations, at departmental expense, in accordance with the scale of rations approved by the Naval Board.

Canteen issues.

"262e. Subject to the succeeding provisions of this Part, a member of the rating of Ordinary Seaman or a lower rating shall be issued with canteen issues, at departmental expense, in accordance with the scale of canteen issues approved by the Naval Board.

Canteen allowance.

"262f. Subject to the succeeding provisions of this Part, an allowance, called 'canteen allowance', is payable to a member of the rating of Able Seaman or a higher rating at such rates, based on the value of canteen issues issued to other ratings under the last preceding regulation, as the Naval Board determines.

Issues to members' families.

"262g. Subject to the succeeding provisions of this Part, a member shall be issued, at departmental expense, with rations, canteen issues and food utensils, for use by his wife and his children aged over one year but under fourteen years.

Leave allowance.

"262h.—(1.) Where a member has been granted leave and, during that leave, he and his family live elswhere than at the naval establishment to which he is attached, an allowance, called 'leave allowance', is payable to him—

(a)in respect of the member—at the rate of Five shillings per day;

(b)in respect of the member's wife—at the rate of Five shillings per day; and

(c) in respect of the member's children—

(i) over the age of ten years, but not over the age of fourteen years—at the rate of Five shillings per day;

(ii) over the age of one year, but not over the age of ten years—at the rate of Two shillings and sixpence per day.

"(2.) A member shall not be eligible to receive the issues and allowance referred to in regulations 262d, 262e, 262f and 262g of these Regulations in respect of any period of leave for which he receives leave allowance under the last preceding sub-regulation.

Married quarters.

"262j. A married member shall be provided, at departmental expense with married quarters within the limits of the naval establishment at which he is serving.".

Second Schedule.

40. The Second Schedule of the Naval Financial Regulations is amended;—

(a) by omitting the words and figures "Sub-regulation (3.) of regulation 85.";

(b)by omitting the words and figures "Sub-regulations (2.) and (5.) of regulation 86.";

(c) by inserting after the words and figures "Sub-regulation (1.) of regulation 88.", the word and figures "Regulation 90a.";

(d)by inserting after the words and figures "Sub-regulation (2.) of regulation 91.", the words and figures "Sub-regulation (2.) of regulation 92a.";

(e) by omitting the words and figures "Sub-regulation (2.) of regulation 96." and inserting in their stead the words and figures "Sub-regulations (4.), (8.), (9.), (10.) and (11.) of regulation 96.";

(f) by omitting the words and figures "Sub-regulations (4.), (5.), (7.), (9.) and (10.) of regulation 97." and inserting in their stead the words and figures "Sub-regulations (5.), (7.), (8.) and (11.) of regulation 97." and the words and figures "Sub-regulation (1.) of regulation 97a.";

(g)by inserting after the words and figures "Sub-regulation (4.) of regulation 99.", the words and figures "Sub-regulations (2.) and (5.) of regulation 100a." and the word and figures "Regulation 101a.";

(h)by inserting after the word and figures "Regulation 105.", the word and figures "Regulation 105a.".

(i) by inserting after the words and figures "Sub-regulation (1.) of regulation 118.", the word and figures "Regulation 122.";

(j) by inserting after the words and figures "Sub-regulation (1.) of regulation 177.", the words and figures "Sub-regulation (1.) of regulation 177a.";

(k)by inserting after the word and figures "Regulation 196.", the word and figures "Regulation 202.".

(l)by omitting the word and figures "Regulation 258."; and

(m) by omitting the words and figures "Sub-regulation (2.) of regulation 262a." and inserting in their stead the words and figures "Sub-regulation (2.) of regulation 262b.".

Fifteenth Schedule.

41. The Fifteenth Schedule to the Naval Financial Regulations is amended by omitting the figures "262a." and inserting in their stead the figures "262b.".
