REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1952.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1952.

Amendments of the Naval Financial Regulations. 

Medical and dental officers—special allowance.

1.—(1.) Regulation 11 of the Naval Financial Regulations is amended by omitting the table in sub-regulation (1.) and inserting in its stead the following table:—

(2.) This regulation shall be deemed to have come into operation on the thirtieth day of January, 1958.

Artisan and Mechanic Branches—active pay.

2. Regulation 34 of the Naval Financial Regulations is amended by omitting sub-regulation (2.).

Coxswain allowance.

3. Regulation 41 of the Naval Financial Regulations is amended—

(a) by omitting from sub-regulation (1.) the words “, Submarine Coxswain or Surveying Coxswain”; and

(b)by omitting from sub-regulation (3.) the words “or a Submarine Coxswain”.

Payment in accordance with an allotment after death.

4. Regulation 88 of the Naval Financial Regulations is amended—

(a)by omitting from sub-regulation (1.) the words “war service” and inserting in their stead the words “Malayan service”; and

(b)by omitting sub-regulation (2.) and inserting in its stead the following sub-regulation:—

“(2.) For the purpose of this regulation, ‘Malayan service’ has the same meaning as in the Repatriation (Far East Strategic Reserve) Act 1956.”.

Repeal of regulation 110.

5. Regulation 110 of the Naval Financial Regulations is repealed.

Linguist bounty.

6. Regulation 118 of the Naval Financial Regulations is repealed and the following regulation inserted in its stead:—

“118.—(1.) Subject to such conditions as the Naval Board determines, an allowance, called ‘linguist bounty’, may be paid to a member who has qualified in one or more foreign languages at the Royal Australian Air Force School of Languages.

“(2.) The amount of linguist bounty payable under the last preceding sub-regulation shall be—

(a) in the case of a member who has qualified in one language—Fifty pounds per annum; and

(b)in the case of a member who has qualified in more than one language—One hundred pounds per annum.”.

7.—(1.) Regulation 119 of the Naval Financial Regulations is repealed and the following regulation inserted in its stead:—

Hard-lying money.

“119.—(1.) Subject to the succeeding provisions of this regulation, an allowance, called ‘hard-lying money’, is payable—

(a)to a man who is living on board a ship employed on sea service; and

(b)to an officer who is living on board a ship employed on sea service—

(i) in which the living conditions, in the opinion of the Naval Board, are markedly inferior to those experienced in a destroyer on normal service; or

(ii) in which the accommodation provided for him, in the opinion of the Naval Board, is not superior to that provided for a Petty Officer or a Chief Petty Officer, not being the Master-at-Arms, in that ship.

“(2.) In this regulation, ‘employed on sea service’ includes such time spent in port as the Naval Board determines.

“(3.) The rate at which hard-lying money is payable is Two shillings and sixpence per day, or One shilling and threepence per day, as the Naval Board determines.

“(4.) Hard-lying money is not payable to an officer in respect of any service for which he is paid surveying pay.”.

(2.) This regulation shall be deemed to have come into operation on the fourteenth day of February, 1958.

Outfit allowance—officer.

8. Regulation 171 of the Naval Financial Regulations is amended by adding at the end thereof the following sub-regulation:—

“(5.) Where an officer is appointed as a Service Equerry, he may be paid an allowance, called ‘Equerry’s outfit allowance’, of such amount and subject to such conditions as the Naval Board determines.”.

Travel on termination of service.

9. Regulation 193 of the Naval Financial Regulations is amended—

(a) by omitting from sub-regulation (1.) the words “A member” and inserting in their stead the words “Subject to sub-regulation (3a.) of this regulation, a member”;

(b)by omitting from sub-regulation (2.) the words “A member” and inserting in their stead the words “Subject to sub-regulation (3a.) of this regulation, a member”; and

(c) by inserting after sub-regulation (3.) the following sub-regulation:—

“(3a.) Where the family and the household furniture and effects of a member are, on the termination of his service otherwise than at his own request, removed under regulation 231 of these Regulations to a place other than the place referred to in sub-regulation (1.) or (2.) of this regulation, the member shall be transported at the expense of the Department to that other place.”.

Rate of travelling allowance within Australia.

10.—(1.) Regulation 201 of the Naval Financial Regulations is amended by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation:—

“(1.) Subject to this Division, the rate of travelling allowance within Australia is that specified, according to the rank or rating of the member or his rank and pay seniority and the other circumstances, in the following table:—

(2.) This regulation shall be deemed to have come into operation on the first day of September, 1958.

Second Schedule.

11. The Second Schedule to the Naval Financial Regulations is amended—

(a) by omitting the words—

“Regulation 118.”

and inserting in their stead the words—

“Sub-regulation (1.) of regulation 118.”;

(b) by omitting the words—

“Sub-regulations (1.), (3.) and (4.) of regulation 171.”

and inserting in their stead the words—

“Sub-regulations (1.), (3.), (4.) and (5.) of regulation 171.”; and

(c) by omitting the words—

“Regulation 235.”.
