REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1952.*

THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the
advice of the Federal Executive Council, hereby make the following Regulations
under the

AMENDMENTS OF THE NAVAL FINANCIAL REGULATIONS.
(
a ) by inserting after sub-regulation (1.) the following sub-regulations:—“(1A.) Subject to such conditions as are approved by the Naval Board, an officer holding the confirmed rank of Captain may, in lieu of the rate of active pay to which he is entitled in accordance with the preceding sub-regulation, be paid the rate of active pay prescribed in the Third Schedule to these Regulations, in relation to an officer holding the rank of Commodore 2nd Class.
“(1B.) Where an officer is eligible under the last preceding sub-regulation to be paid the rate of active pay prescribed for an officer holding the rank of Commodore 2nd Class, he shall be eligible to be paid the rate of allowances prescribed for an officer of that rank under these Regulations.”;
(
b )by inserting in sub-regulation (3.), after the word “Regulations” (third occurring), the word “,any supplementary flying pay payable under regulation 119A of these Regulations”; and(
c ) by inserting in sub-regulation (3.), after the words “flying pay” (second occurring), the words “,supplementary flying pay”.

“9A.—(1.) The Naval Board may approve payment of special allowances to ensure that increases in gross emoluments payable from 4th July, 1958, to specified categories of members are not less than such amounts, not exceeding in any case Five shillings and fivepence per day, as may be determined by the Naval Board as minimum increase for the respective categories.
“(2.) A special allowance payable in accordance with the last preceding sub-regulation shall be assessed and be subject to adjustment and cancellation in accordance with rules determined by the Naval Board.
“(3.) For the purposes of this regulation, ‘gross emoluments’ means active pay payable under these Regulations and such allowances payable under these Regulations as the Naval Board determines.”.

“13. In addition to Active Pay in accordance with last preceding regulation, an allowance, called ‘Senior Chaplain’s allowance’, is payable at the rate of Three shillings per day to a Senior Chaplain with less than twenty-four years’ pay seniority.”.
(
a )by omitting from sub-regulation (1.) the words “at such rate as the Minister for Defence determines” and inserting in their stead the words “of Six thousand one hundred and fifty pounds”;(
b )by inserting after sub-regulation (1.) the following sub-regulation:—“(1A.) A Vice-Admiral appointed as Chairman, Chiefs of Staff Committee, shall be paid a consolidated rate of pay of Six thousand four hundred pounds.”;
(
c ) by omitting sub-regulation (2.) and inserting in its stead the following sub-regulation:—“(2.) A Vice-Admiral, not being the First Naval Member of the Naval Board and not being Chairman, Chiefs of Staff Committee, shall be paid a consolidated rate of pay of Five thousand four hundred pounds per annum.” and
(
d )by omitting from sub-regulation (3.) the words “Four thousand one hundred pounds” and inserting in their stead the words “Four thousand seven hundred and seventy-seven pounds”.
“(6.) Where an officer is appointed Assistant Surveyor, Fourth Class, surveying pay is not payable in respect of any day in respect of which hard-lying money is payable.”.
(
a )by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation:—“(1.) Subject to the succeeding provisions of this regulation, an allowance, called ‘submarine pay’, is payable to an officer of the rank of Commander or below (including an
officer of the Special Duties List) at the rate specified in the following table in relation to the rank that he holds where he—
(
a ) is a qualified submarine officer; or(
b )proceeds to sea in a submarine for specific duty or training:—

“76A. An allowance, called ‘Winch Operator’s flying pay’, is payable at such rates and subject to such conditions as are determined by the Naval Board to a man in respect of a period for which he is employed as a Winch Operator in a helicopter.”.
“77.—(1.) Subject to such conditions as the Naval Board determines, an allowance, called ‘submarine pay’, is payable to—
(
a ) a man who is qualified for service in submarines and belongs to the Submarine Branch; and(
b )a man who does not belong to that Branch but is at sea in a submarine for the purpose of performing a specific duty in the submarine,
at the rate specified, in relation to the rating that the man holds, in the following table:—

“(5.) Subject to such conditions as are approved by the Naval Board, where a member appointed or drafted to a ship is entitled to hard-lying money under this regulation, payment of that allowance shall continue in respect of any period during which he is required as a member of a surveying party to camp ashore.”.
“119A. Subject to such conditions as the Naval Board determines, a member employed on flying duties may be paid an allowance called ‘supplementary flying pay’, at the rate of One shilling and sixpence per day.”.
“(1.) Where a member is eligible for leave of absence or pay in lieu of leave of absence under this Part, the period of the leave or pay shall be reduced by any period of leave of absence or pay in lieu of leave of absence of a similar nature previously granted to the member under this Part or under any other law of the Commonwealth (including the repealed Regulations) or of a State or Territory of the Commonwealth in respect of any service that is permitted to count as service under this Part.”.

(2.) In determining rates and amounts of pay and allowances under the last preceding sub-regulation, the Naval Board—
(
a ) may determine different rates and amounts for specified portions of the period specified in that sub-regulation and for members included in a specified class of members; and(
b )shall not determine rates and amounts that would, in respect of a specified portion of that period, result in a member being entitled to an amount of pay and allowances that is less than that prescribed by the Naval Financial Regulations as in force during that period.
