REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1952.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1952.

Amendments of the Naval Financial Regulations. 

Commencement.

1.—(1.) Subject to the next succeeding sub-regulation, these Regulations shall be deemed to have come into operation on the first day of January, 1957.

(2.) Regulations 12 and 21 of these Regulations shall come into operation on the day on which these Regulations are notified in the Gazette.

Interpretation.

2. Regulations 4 of the Naval Financial Regulations is amended—

(a)by omitting from sub-regulation (1.) the definition of “executive officer”;

(b)by omitting from that sub-regulation the definition of “officer” and inserting in its stead the following definition:—

“‘officer’ includes an officer of the Special Duties List and a subordinate officer;”; and

(c) by omitting from the definition of “supply officer” in that sub-regulation the word “Branch” and inserting in its stead the word “specialization”.

Officers’ General List, &c., active pay.

3. Regulation 9 of the Naval Financial Regulations is amended by omitting sub-regulations (1.) and (2.) and inserting in their stead the following sub-regulations:—

“(1.) The daily rates of active pay payable to—

(a)officers of the General and Supplementary Lists;

(b)officers of the Instructor and Naval Ordnance Design and Inspection Branches; and

 (c) officers of the Medical and Dental Branches, other than Surgeon Lieutenants and Surgeon Lieutenants (D),

are the rates specified respectively, in relation to the rank that the officer holds and his pay seniority, in the Third Schedule to these Regulations.

“(2.) Where an officer of the Special Duties List is promoted to the rank of Lieutenant on the General List, and the daily rate of active pay payable under regulation 14 of these Regulations to an officer of the Special Duties List of the same rank and pay seniority as the promoted officer held on the day immediately before his promotion is higher than the daily rate of active pay that would, but for this sub-regulation, be payable to him under the last preceding sub-regulation, he shall be paid at the higher rate and, while so paid, he is not eligible for active pay under the last preceding sub-regulation.

“(2a.) Where before the first day of January, 1957, an officer of the Branch List was promoted to the rank of Lieutenant on the General List, and the daily rate of active pay payable under regulation 14 of these Regulations to an officer of the Special Duties List of equivalent rank and the same pay seniority as the promoted officer held on the day immediately before his promotion is higher than the daily rate of active pay that would, but for this sub-regulation, be payable to him under sub-regulation (1.) of this regulation, he shall be paid at the higher rate and, while so paid, he is not eligible for active pay under sub-regulation (1.) of this regulation.”.

Officers of the Special Duties List and officers of Naval Dockyard Police—Active pay.

4. Regulation 14 of the Naval Financial Regulations is amended by omitting the words “Branch officers” and inserting in their stead the words “officers of the Special Duties List”.

Rates of command money.

5. Regulation 18 of the Naval Financial Regulations is amended—

(a) by inserting in the table, after the word “Commander” (first occurring), the words “or Commander (S.D.) or equivalent rank”;

(b) by omitting from the table the words “or Lieutenant” and inserting in their stead the words “,Lieutenant-Commander (S.D.) or equivalent rank or Lieutenant”; and

(c) by omitting from the table the words “Sub-Lieutenant, Senior Commissioned Officer and Commissioned Officer” and inserting in their stead the words “Lieutenant (S.D.) or equivalent rank, Sub-Lieutenant or Sub-Lieutenant (S.D.) or equivalent rank”.

Command money— officers who are eligible for.

6. Regulation 19 of the Naval Financial Regulations is amended by omitting from sub-regulation (1.) the words “of the Executive Branch” and inserting in their stead the words “entitled to exercise sea command”.

Entertaining allowance.

7.Regulation 21 of the Naval Financial Regulations is amended by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation:—

“(1.) Subject to the succeeding provisions of this regulation, an allowance, called ‘entertaining allowance’, is payable to an officer who holds an appointment specified in the following table at the rate specified in that

table in relation to that appointment and his rank or rank and pay seniority:—

Flying pay.

8. Regulation 24 of the Naval Financial Regulations is amended by omitting the words “of the Executive Branch”.

Submarine pay—officers.

9. Regulation 27 of the Naval Financial Regulations is amended by omitting from sub-regulation (1.) the words “or a lower rank, including the rank of Senior Commissioned Officer or Commissioned Officer on the Branch List” and inserting in their stead the words “,Lieutenant-Commander (S.D.) or an equivalent or lower rank”.

Cook (Senior) allowance.

10. Regulation 40 of the Naval Financial Regulations is amended by omitting from sub-regulation (1.) the words “Senior Commissioned Cookery Officer or a Commissioned Cookery Officer” and inserting in their stead the words “Supply Lieutenant (CK) or a Supply Sub-Lieutenant (CK)”.

Senior Engineer’s allowance.

11. Regulation 46 of the Naval Financial Regulations is amended by omitting from sub-regulation (1.) the words “Commander (E) without alternative” and inserting in their stead the words “a Commander of the Engineering specialization or an Engineer Commander, but not for an alternative lower rank”.

Good Conduct Badge Pay.

12. Regulation 48 of the Naval Financial Regulations is amended—

(a)by omitting from sub-regulation (1.) the words “An allowance” and inserting in their stead the words “Subject to sub-regulation (3.) of this regulation, an allowance”; and

(b)by adding at the end thereof the following sub-regulation:—

“(3.) Where a man has been awarded a Good Conduct Badge for which he has not qualified, the holding of that Badge shall be disregarded for the purpose of payment of Good Conduct Badge Pay.”.

Captain’s Writer allowance.

13. Regulation 59 of the Naval Financial Regulations is amended by omitting from sub-regulation (1.) the words “a Supply Officer” and inserting in their stead the words “an officer of the Supply and Secretariat specialization”.

Gunnery Office Writer allowance.

14. Regulation 63 of the Naval Financial Regulations is amended by omitting the word “Officer’s” (wherever occurring) and inserting in its stead the word “Office”.

Captain’s Secretary allowance.

15. Regulation 67 of the Naval Financial Regulations is amended by omitting from sub-regulation (1.) the words “a Supply Officer” (wherever occurring) and inserting in their stead the words “an officer of the Supply and Secretariat specialization”.

In charge of accounts allowance.

16. Regulation 68 of the Naval Financial Regulations is amended by omitting from sub-regulation (1.) the words “a Supply Officer” and inserting in their stead the words “an officer of the Supply and Secretariat specialization”.

Living out away from home allowance—married members.

17. Regulation 93 of the Naval Financial Regulations is amended by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation:—

“(1.) Subject to the succeeding provisions of this regulation and to regulation 95 of these Regulations, a married member who is living out and is not living at his home may, for such period and subject to such conditions as the Naval Board determines, be paid an allowance, called ‘living out away from home allowance’, at the rate per day specified in relation to his rank or rating, his pay seniority and the circumstances of his case, in the following table:—

Oversea living out allowance.

18. Regulation 96 of the Naval Financial Regulations is amended by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation:—

“(1.) Subject to the succeeding provisions of this regulation, an allowance, called ‘oversea living out allowance’, is payable to a member appointed or drafted for duty in the United Kingdom in respect of a period for which he lives out in the United Kingdom while so appointed

or drafted at the rate per day specified, according to his rank or rating, his pay seniority and his marital and living conditions, in the following table:—

20. Regulation 110 of the Naval Financial Regulations is amended by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation:—

21. Regulation 157 of the Naval Financial Regulations is amended by inserting, after the words “or Commander”, the words “other than an officer of the Special Duties List”.

Outfit allowance— officer.

22. Regulation 171 of the Naval Financial Regulations is amended by omitting from sub-regulation (2.) the words “Branch List” and inserting in their stead the words “Special Duties List”.

 

Travel by sea.

23. Regulation 190 of the Naval Financial Regulations is amended—

(a)by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation:—

“(1.) Subject to the next succeeding sub-regulation, when an officer travels on duty by sea to or from a place oversea, he shall be allowed the class and grade of accommodation specified, in relation to his rank or rank and pay seniority, in the following table:—

24. Regulation 201 of the Naval Financial Regulations is amended by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation:—

Service of former Branch List officers.

25. After regulation 267 of the Naval Financial Regulations the following regulation is inserted:—

“267a. In determining the pay seniority or seniority of officers of the Special Duties List for the purposes of these Regulations—

(a)service as a Commissioned Officer shall be deemed to be service as a Sub-Lieutenant (S.D.) or in an equivalent rank;

(b)service as a Senior Commissioned Officer shall be deemed to be service as a Lieutenant (S.D.) or in an equivalent rank; and

(c) service as a Lieutenant on the Branch List, other than service in an acting rank, shall be deemed to be service as a Lieutenant-Commander (S.D.) or in an equivalent rank.”.

Fourth Schedule.

26. The Fourth Schedule to the Naval Financial Regulations is repealed and the following Schedule inserted in its stead:—
