1. Regulation 3 of the Naval Financial Regulations is amended by omitting the words and figures—

and inserting in their stead the words and figures—

Interpretation.

2. Regulation 4 of the Naval Financial Regulations is amended—

(a)by inserting in sub-regulation (1.), after the definition of “approving authority”, the following definition:—

“ ‘Australia’ includes the Territories of the Commonwealth;”;

(b)by omitting from the definition of “oversea” in sub-regulation

(1.) the words “the Australia Naval Station” and inserting in their stead the word “Australia”; and

(c)by inserting in sub-regulation (1.), after the definition of “supply officer”, the following definition:—

‘the Act’ means the Naval Defence Act 1910-1964;”.

Application of Regulations.

3. Regulation 5 of the Naval Financial Regulations is amended by adding at the end thereof the following sub-regulation:—

“(4.) Except as provided by Part XVI. of these Regulations, the provisions of Parts II. to XV. (inclusive) of these Regulations do not apply to or in relation to a member of the Naval Emergency Reserve Forces or the Citizen Naval Forces.”.

Entertainment of visitors.

4. Regulation 22 of the Naval Financial Regulations is amended—

(a)by omitting from sub-regulation (1.) the words “on the Australia Naval Station” and inserting in their stead the words “in Australia”; and

(b) Made under the Naval Defence Act 1910–1964 on 27 May, 1965; notified in the Commonwealth Gazette on 3 June. 1965.

(b)by omitting from sub-regulation (2.) the words “the Australia Naval Station” and inserting in their stead the word “Australia”.

Officer appointed, &c., outside Australia.

5. Regulation 173 of the Naval Financial Regulations is amended by omitting the words “the Australia Naval Station” and inserting in their stead the word “Australia”.

Reimbursement of cost of insurance.

6. Regulation 194 of the Naval Financial Regulations is amended by omitting from paragraph (a)of sub-regulation (2.) the words “on the Australia Naval Station” and inserting in their stead the words “in Australia”.

7. Part XVI. of the Naval Financial Regulations is repealed and the following Parts are inserted in its stead:—

“Part XVI.—Naval Emergency Reserve Forces and Citizen Naval Forces.

Division 1.-—Preliminary.

Definitions.

“263. In this Part, unless the contrary intention appears—

‘man’ means a male person enlisted in the Naval Emergency Reserve Forces or in the Citizen Naval Forces and holding the rating of Chief Petty Officer or a lower rating;

‘member’ means an officer or a man;

‘officer’ means a commissioned officer or a subordinate officer of the Naval Forces appointed or transferred to the Naval Emergency Reserve Forces or the Citizen Naval Forces, but does not include a Chief Petty Officer or a Petty Officer;

‘training year’ means—

(a)in relation to a member of the Citizen Naval Forces, other than a member of the Royal Australian Fleet Reserve—a period of twelve consecutive months commencing on a first day of July; and

(b)in relation to a member of the Naval Emergency Reserve Forces or a member of the Royal Australian Fleet Reserve—a period of twelve consecutive months commencing on the date of the member’s transfer or appointment to, or enlistment in, those Forces or that Reserve, or on an anniversary of that date, as the case requires.

Division 2.Continuous Full Time Naval Service.

Active pay—general provisions.

“264.—(1.) This regulation applies to and in relation to continuous full time naval service of a member—

(a)if rendered under sub-section (3.) or (7.) of section 32 of the Act or under section 50b of the Defence Act 1903-1964— whether or not rendered in a vacancy in the establishment of the Permanent Naval Forces; and

(b)in any other case—if rendered in a vacancy in the establishment of the Permanent Naval Forces.

“(2.) The rate of active pay of a member in respect of service to which this regulation applies is the rate of active pay specified, in relation to a member of the Permanent Naval Forces having the like rank and pay seniority or rating and pay seniority, as the case requires, as the member has, in the Third, Fifth, Sixth, Seventh, Eighth or Tenth Schedule to these Regulations (whichever is appropriate).

“(3.) The length of service of a member in a rank or rating, for the purposes of active pay, shall be calculated in the manner determined by the Naval Board, and may include a period of service in the like rank or rating, as the case may be, in a force other than the Naval Emergency Reserve Forces or the Citizen Naval Forces.

Allowances— general.

“265. Where an officer or man is rendering continuous full time naval service to which the last preceding regulation applies—

(a)in the case of an officer—the allowances (other than Chaplain’s equipment allowance) provided for in Parts II. and IV. of these Regulations for an officer of the Permanent Naval Forces having the like rank as the officer has are payable, in the like circumstances and subject to the like conditions, to the officer in respect of that service; and

(b) in the case ofa man—the allowances provided for in Part III. and IV. of these Regulations for a man of the Permanent Naval Forces having the like rating as the man has are payable, in the like circumstances and subject to the like conditions, to the man in respect of that service.

General conditions of service.

“266. The provisions of Parts V., VI. (other than regulations 134, 136, 146, 146a, 149 and 150), VIII., X. (other than regulations 212, 213, 214, 215 and 223), XI, XII. and XIII., and of regulations 88a, 175, 176, 177, 181 and 182 of these Regulations, apply to and in relation to the service of a member to which regulation 264 of these Regulations applies as if that service were service in the Permanent Naval Forces of a member of the Permanent Naval Forces having the like rank or rating as the member has.

Active pay— general provisions.

“267.—(1.) This regulation applies to and in relation to continuous full time naval service of a member that—

(a)is not rendered under sub-section (3.) or (7.) of section 32 of the Act or under section 50b of the Defence Act 1903-1964; and

(b)is not rendered in a vacancy in the establishment of the Permanent Naval Forces.

“(2.) The rate of active pay of a member in respect of service to which this regulation applies is the rate of active pay specified in the Seventeenth Schedule to these Regulations in relation to the rank held by the member or the rating held by the member and the branch in which he is included, as the case requires.

Allowances— general.

“268. Where a member is rendering continuous full time naval service to which the last preceding regulation applies, the allowances (other than the allowances specified in Part I. of the Eighteenth Schedule to these

Regulations) provided for in Parts II., III. and IV. of these Regulations for a member of the Permanent Naval Forces having the like rank or rating as the member has are payable, in the like circumstances and subject to the like conditions, to the member in respect of that service.

General conditions of service.

“269. The provisions of Parts V., VI. (other than regulations 134, 136, 146, 146a, 149 and 150), VIII., X. (other than regulations 212, 213, 214, 215 and 222 to 226 (inclusive) and Divisions 5 and 6), XI., and XII., and of regulations 88a, 175, 176, 177, 181 and 182 of these Regulations, apply to and in relation to the service of a member to which regulation 267 of these Regulations applies as if that service were service in the Permanent Naval Forces of a member of the Permanent Naval Forces having the like rank or rating as the member has.

Commencement and cessation of pay and allowances.

“270.—(1.) Subject to the next succeeding sub-regulation, the credit to a member of pay and allowances under these Regulations in respect of continous full time naval service—

(a)commences on the day upon which he commences to render that service; and

(b)ceases at the end of the day upon which he is released from that service.

“(2.) In such circumstances as the Naval Board determines, a member may be credited with pay and allowances in respect of a period approved by the Naval Board, being a period spent by him—

(a)in travelling to the place at which he is directed to report for the purpose of rendering continuous full time naval service; or

(b)in travelling to his place of residence upon being released from that service.

Division 3.—Naval Service other than Continuous Full Time Naval Service.

Interpretation.

“271. In this Division, references to naval service shall be read as references to naval service other than continuous full time naval service.

Active pay— officers.

“272.—(1.) The rate of active pay of an officer in respect of naval service is the rate specified in Table 1 in the Seventeenth Schedule to these Regulations in relation to the rank that the officer holds.

“(2.) The rate of active pay of a chaplain of the Citizen Naval Forces in respect of naval service is the rate specified in Table 2 in the Seventeenth Schedule to these Regulations.

Active pay— men.

“273. The rate of active pay of a man in respect of naval service is the rate specified in Table 3 in the Seventeenth Schedule to these Regulations in relation to the rating that the man holds and the branch in which the man is included.

Allowances.

“274. Except as expressly provided by this Part, where a member is rendering naval service, the allowances (other than the allowances specified in the Eighteenth Schedule to these Regulations) provided for in Parts II., III. and IV. of these Regulations for a member of the Permanent

Naval Forces having the like rank or rating, as the case may be, as the member has are payable, in the like circumstances and subject to the like conditions, to the member in respect of that service.

Variation of conditions, &c., subject to which certain allowances payable.

“275. The circumstances in which and conditions subject to which—

(a) marriage allowance;

(b) separation allowance;

(c) provision allowance;

(d) living out allowance;

(e)living out away from home allowance; or

(f) retention of lodgings allowance,

 is payable to a member of the Permanent Naval Forces do not apply to or in relation to the payment of that allowance to a member in respect of naval service but each of those allowances is payable to a member in respect of that service in such circumstances and subject to such conditions as the Naval Board determines.

Credit of pay and allowances.

“276.—(1.) Subject to the succeeding provisions of this regulation and to the next three succeeding regulations, a member shall be credited with active pay and allowances under this Division in respect of a period of naval service rendered by him.

“(2.) A member who sustains injury or contracts disease while rendering naval service may, subject to the approval of the Naval Board, continue to be credited with active pay and allowances under this Division until the termination of the period of naval service for which he was appointed or drafted.

“(3.) For the purpose of this regulation, naval service includes the time spent by a member in travelling from his normal place of duty to a ship, naval establishment or camp for the purpose of rendering naval service and the time spent by that member in travelling from that ship, naval establishment or camp to his normal place of duty on completion of that service.

“(4.) In the last preceding sub-regulation, ‘normal place of duty’, in relation to a member, means the Naval Reserve Training Establishment to which the member is attached, or, in the case of an unattached member, a place determined by the Naval Board.

“(5.) A member is not entitled to be credited with—

(a)pay or allowances in respect of a period of naval service that he has volunteered to render without pay; or

(b) allowances in respect of naval service for a period of less than one day.

Pay for period of less than one day.

“277.—(1.) Where an officer or man renders naval service for a period of less than one day but not less than two hours, he shall be credited—

(a)if the period is not less than six hours—with one day’s active pay;

(b) if the period is less than six hours but not less than three hours —with one-half of one day’s active pay; or

 (c) if the period is less than three hours—with one-third of one day’s active pay.

“(2.) A member is not entitled to be credited with pay in respect of naval service rendered by him in a training year in excess of a period of naval service determined by the Naval Board for the purposes of this regulation.

Pay for attendances at guards of honour, &c.

“278.—(1.) Subject to the next succeeding sub-regulation, a member: who, with the approval of the Naval Board, performs duties—

(a)as a member of a guard of honour;

(b) as a member of a naval band at a public performance by the band; or

(c)at a ceremonial parade or naval funeral,

 shall be credited with—

(d)if the duties are performed for a period of not less than three hours—one day’s active pay; or

(c)if the duties are performed for a period of less than three hours — one-half of one day’s active pay.

“(2.) A member is not entitled to be credited with active pay under the last preceding sub-regulation in respect of duties performed during a period of continuous full time naval service or naval service rendered by him.

Pay for religious ministrations by Chaplains.

“279.—(1.) Subject to the succeeding provisions of this regulation, a Chaplain of the Citizen Naval Forces may, subject to the approval of the Naval Board, be credited with active pay under this Division in respect of religious ministrations to members of the Naval Forces.

“(2.) Active pay in respect of religious ministrations shall be credited at the rate specified, in relation to the period of duty necessary for the religious ministrations, in the following table:—

“(3.) A Chaplain of the Citizen Naval Forces is not entitled to be credited with active pay under this regulation in respect of religious ministrations performed during a period of continuous full time naval service or naval service rendered by the Chaplain or during a period in respect of which the Chaplain is entitled to the credit of active pay under the last preceding regulation.

Locum tenens allowance.

“280. Where an officer of the Medical Branch or the Dental Branch, of the Naval Emergency Reserve Forces or the Citizen Naval Forces employs a locum tenens while rendering naval service for a period of not less than three days, an allowance called ‘locum tenens allowance’, is payable to that officer at the rate of Seven pounds seven shillings per day.

General conditions of service.

“281.—(1.) Except as expressly provided by this Part, the provisions of Parts V., VI. (other than regulations 134, 135, 136, 146, 146a, 149 and 150), VIII., X. (other than regulations 212, 213, 214, 215 and 222 to 226 (inclusive) and Divisions 5 and 6), XI. and XII., and of regulations 175, 176, 181 and 182 of these Regulations, apply to and in relation to naval service for a period of more than one day rendered by an officer or man.

“(2.) Except as expressly provided by this Part, the provisions of regulations 132a, 137, 138, 139, 140, 142, 181, 182, 185, 186, 196, 197 and 211 of these Regulations apply to and in relation to naval service for a period of one day or less rendered by an officer or man.

Cadets.

“282.—(1.) The provisions of Divisions 1 and 2 of Part X. of these Regulations apply to and in relation to naval service rendered by a member of the Naval Reserve Cadets as if he were rendering that service as a member of the Permanent Naval Forces.

“(2.) Except as provided by the last preceding sub-regulation, the provisions of Parts I. to XV. (inclusive) of these Regulations do not apply to or in relation to naval service rendered by a member of the Naval Reserve Cadets.

“Division 4.—Annual Allowances, Grants, Retainers, Training Fees,

Gratuities and Bounty.

Band allowance.

“283.— (1.) An allowance, called ‘band allowance’, is payable to a Bandmaster Lieutenant or Bandmaster Sub-Lieutenant of the Royal Australian Naval Reserve who performs the duties of Music Instructor.

“(2.) The amount of band allowance payable under the last preceding sub-regulation is—

(a)if those duties are performed during the whole of a training year—Fifty pounds:

(b) if those duties are performed for a part of a training year— an amount that bears to Fifty pounds the same proportion as that part of a training year bears to one training year.

Efficiency grant.

“284. An efficiency grant is payable at the rate of Ten pounds per annum to an officer or man of the Royal Australian Naval Reserve who has, during a training year—

(a)rendered such naval service as the Naval Board requires for the purposes of this regulation; and

(b) been certified as efficient by his Commanding Officer.

Retainers.

“285. Subject to such conditions as the Naval Board determines, a retainer of Twenty-four pounds per annum is payable to a member of the Royal Australian Fleet Reserve.

Rate of training fees.

“286. Subject to such conditions as the Naval Board determines, a training fee is payable to an officer of the Royal Australian Naval Reserve (Sea-going) at the rate specified in the following table in relation to the rank that he holds:—

Retaining fee.

“287.—(1.) Subject to the succeeding provisions of this regulation, a retaining fee is payable to a medical officer holding an appointment as District Naval Medical Officer or Port Division Medical Officer at the rate specified, in relation to the appointment that he holds, in the following table:—

“(2.) A retaining fee is payable to a medical practitioner holding an appointment as Acting District Naval Medical Officer or Acting Port Division Medical Officer during the absence on leave, being absence for a period exceeding three months, of the District Naval Medical Officer or Port Division Medical Officer, as the case may be.

“(3.) A retaining fee is not payable to a District Naval Medical Officer or Port Division Medical Officer in respect of any period, being a period exceeding three months, during which he is on leave of absence.

Chaplains’ equipment allowance.

“288.—(1.) Where a Chaplain of the Citizen Naval Forces conducts divine service on board a ship or in a naval establishment, he shall, if his Senior Naval Chaplain so recommends, be paid an allowance, called ‘Chaplains’ equipment allowance’, to cover the purchase and maintenance of appropriate ecclesiastical vestments and equipment.

“(2.) The amount of the allowance payable under the last preceding sub-regulation is—

(a)an amount of Ten pounds, payable on appointment, to cover the purchase of the vestments and equipment; and

(b)an amount of Five pounds, payable on completion of each year of service, to cover the maintenance of the vestments and equipment.

Allowances, &c., not payable in respect of continuous full time naval service.

“289. Any period during which a member is rendering continuous full time naval service under the Act or under section 50b of the Defence Act 1903-1964 does not count for the purposes of payment of an allowance, efficiency grant, retainer, training fee or retaining fee under a preceding regulation of this Division.

Bounty.

“290.—(1.) Subject to such conditions as the Naval Board determines, a bounty is payable to a member of the Naval Emergency Reserve Forces, in accordance with the following scale, in respect of his service in those Forces:—

On completion of one year’s service—One hundred pounds;

On completion of two years’ service—One hundred and twenty-five pounds;

On completion of three years’ service—One hundred and fifty pounds;

On completion of four years’ service—One hundred and seventy-five pounds;

On completion of each year’s service subsequent to four years’ service—One hundred and seventy-five pounds.

(2.) Where a member of the Naval Emergency Reserve Forces ceases to be such a member upon the completion of—

(a)a period of service that is less than one year;

(b)one year’s service and a further period of service that is less than one year; or

(c) two or more years’ service and a further period of service that is less than one year,

the member may be paid a bounty, in respect of the period or further period of that service that is less than one year, in such circumstances, subject to such conditions and of such amount as the Naval Board determines.

“(3.) For the purpose of calculating the bounty payable to a member of the Naval Emergency Reserve Forces under this regulation, the service of a member of those Forces commences on the day on which he becomes a member of those Forces, or, if he becomes a member of those Forces on more than one occasion, onthe day on which he last becomes such a member.

“(4.) Where a person who has previously been a member of the Naval Emergency Reserve Forces again becomes such a member onthe day immediately following the day on which he ceased to be such a member, the person is not, by reason only of those facts, a person who becomes a member of those Forces on two occasions.

Gratuity.

“291. Where a member of the Naval Emergency Reserve Forces commences to render continuous full time naval service by reason of those Forces or a part of those Forces having been called out for continuous full time naval service under section 32 of the Act, a gratuity of Fifty-five pounds is payable to the member.

“Division 5.Allowances to Establishments.

Competition allowance— Naval Reserve.

“292.—(1.) A Naval Reserve Training Establishment shall be credited annually with an allowance called ‘competition allowance’, calculated at the rate of Three shillings for each man of the Royal Australian Naval Reserve and each member of the Naval Reserve Cadets who is attached to the Establishment on the first day of July in the year.

“(2.) Subject to such conditions as the Naval Board determines, competition allowance shall be expended on inter-service and divisional competitions in which members of the Royal Australian Naval Reserve or the Naval Reserve Cadets take part.

Welfare and betterment allowance— Naval Reserve.

“293.—(1.) A Naval Reserve Training Establishment shall be credited annually with an allowance, called ‘welfare and betterment allowance’, calculated at the rate of Three shillings for each officer and man of the Royal Australian Naval Reserve and for each member of the Naval Reserve Cadets who is attached to the Establishment on the first day of July in the year and has rendered, during the training year ended on the last preceding thirtieth day of June, such naval service or, in the case of a member of the Naval Reserve Cadets, such training, as the Naval Board requires for the purposes of this regulation.

“(2.) Subject to such conditions as the Naval Board determines, welfare and betterment allowance shall be expended upon social, athletic and sporting activities or other approved objects for promoting the welfare and betterment of the members of the Royal Australian Naval Reserve or Naval Reserve Quiets.

Allowances limited to approved establishment.

“294. An amount shall not be credited to a Naval Reserve Training Establishment under either of the last two preceding regulations for a number of members of the Royal Australian Naval Reserve or Naval Reserve Cadets exceeding the approved establishment of the Naval Reserve Training Establishment

Division 6.—Miscellaneous.

Uniform.

“295.—(1.) A member shall be issued with the items of uniform kit appropriate to his rank or rating at departmental expense.

“(2.) A member, other than a member in receipt of uniform allowance under the next succeeding sub-regulation, shall be issued at departmental expense with such items of his uniform kit as are rendered unserviceable by fair wear and tear.

“(3.) An allowance, called ‘uniform allowance’, is payable at the rate specified in regulation 178 of these Regulations to a member who is rendering continuous full time naval service—

(a) if rendered under sub-section (3.) or (7.) of section 32 of the Act or under section 50b of the Defence Act 1903-1964-whatever the period for which he is bound to serve; or

(b) in any other case—if he is bound to serve for a period of not less than three months,

in such circumstances as the Naval Board determines.

“(4.) Additional items of uniform kit may be supplied to a member who—

(a)is rendering continuous full time naval service; or

(b)is rendering naval service for a period of not less than three months.

“(5.) Where a member referred to in the last preceding sub-regulation is not issued with additional items of uniform kit, he may be paid an allowance, called ‘outfit allowance’ at such rates as the Naval Board approves, to provide himself with necessary additional items of uniform.

“(6.) Upon termination of his appointment or upon his discharge, or where the items of uniform kit issued to him cease to be appropriate to his rank or rating, a member shall return to a Naval Establishment such items of uniform kit as the Naval Board, by instructions issued from time to time, requires to be so returned.

“(7.) Regulation 172 of these Regulations applies to and in relation to an officer whether or not he is rendering naval service.

Victualling.

“296. The conditions concerning the victualling of members of the Permanent Naval Forces apply to and in relation to the victualling of members of the Naval Emergency Reserve Forces or Citizen Naval Forces who are rendering naval service in one of Her Majesty’s Australian ships or Naval Establishments.

Special allowance for medical officers and dental officers.

“297.—(1.) An officer of the Medical Branch or of the Dental Branch of the Citizen Naval Forces is entitled, in respect of periods of naval service, to a special allowance at the rate specified, in relation to his rank, in the following table:—

“(2.) In the application of the last preceding sub-regulation, an officer shall be credited, in respect of each day on which he renders naval service for a period of less than one day but not less than two hours—

(a)if the period is not less than six hours—with one day’s special allowance under that sub-regulation;

(b) if the period is less than six hours but not less than three hours —with one-half of one day’s special allowance under that sub-regulation; or

(c) in any other case—with one-third of one day’s special allowance under that sub-regulation.

“Part XVII.—Miscellaneous.

Definition.

“208. In this Part, ‘member’ means an officer or man of the Permanent Naval Forces, Naval Emergency Reserve Forces or Citizen Naval Forces.

Payment to dependants.

“299. Where, under these Regulations, a sum is payable to the dependants of a member or a deceased member, that sum shall be paid to, or apportioned among, the dependants as the Naval Board directs, and, where a dependant is under a legal disability, may be paid to such trustee or trustees as the Naval Board appoints upon such trusts as the Naval Board approves.

Incorrect credits and overdrawn pay account.

“300.—(1.) Where any amount is incorrectly paid or credited to a member, that amount shall be deducted from the pay and allowances that are or become payable to the member under these Regulations.

“(2.) Where deductions are made under the last preceding sub-regulation, or the pay account of a member in receipt of active pay is overdrawn, the member shall be permitted to draw from his pay account such amount not being less than One shilling per day as the Naval Board approves until that account is in credit.

Drawing rate in hospital.

“301. A member who is sick in a naval or military hospital, sick bay or sick quarters shall be permitted to draw from his pay account only such amount as the Naval Board determines.

Allowance not payable when active pay is not payable.

“302. Except where otherwise specifically provided by these Regulations, an allowance is not payable to a member in respect of a day for which active pay is not payable to him.

Deductions from pay and allowances.

“303. The pay and allowances of a member of the Naval Forces are payable without any deduction other than a deduction authorized by the Act, by these Regulations or by another Act or regulations made under another Act.

Assignment of pay void.

“304. Any assignment or charge, other than an assignment or charge under these Regulations or the Naval Account Regulations, in respect of the pay or allowances of a member, and every agreement to make such a charge or assignment, is void.

Medical officer granted leave to study.

“305.—(1.) Where leave with pay is granted to a medical officer to undertake a course of study at his own expense and the officer is remunerated for any civil employment associated with the course of study in which he is engaged during the period of that leave, he is liable to pay to the Commonwealth so much of the amount of that remuneration as does not exceed the amount of active pay and allowances payable to him under these Regulations in respect of that period.

“(2.) Without prejudice to the right of the Commonwealth to recover by other means an amount payable under the last preceding sub-regulation, that amount may be deducted from the pay and allowances that are or become payable to the officer under these Regulations.”.

8. The Naval Financial Regulations are amended by adding at the end thereof the following Schedules:—
