REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1934.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations, under the Naval Defence Act 1910-1934.

Amendment of Naval Financial Regulations. 

Application of Financial Emergency Act.

1. The rates of pay, fees or allowances prescribed by the Naval Financial Regulations as amended by these Regulations shall be subject to adjustment by or under the Financial Emergency Act 1931-1935 in the same manner as they would have been so subject had those Regulations as so amended been in force on the twenty-seventh day of October, 1933.

2. Regulation 22 of the Naval Financial Regulations is repealed and the following regulation inserted in its stead:—

Increments.

3. Regulation 25 of the Naval Financial Regulations is amended by adding the following sub-regulation:—

“(4) In the case of a Surgeon Lieutenant the time served prior to entry in an approved civil hospital which has been allowed to count towards seniority shall be allowed as time served towards the period of three years necessary to qualify for increment of pay as Surgeon Lieutenant.”

4. Regulation 41 of the Naval Financial Regulations is repealed and the following regulation inserted in its stead:—

Marriage Allowance—Rates of.

“41. (1) Subject to such conditions as may be determined from time to time by the Naval Board, a member may be credited with Marriage Allowance in accordance with the appropriate scale hereunder; provided that the Naval Board may, at their discretion, reduce the amount of the allowance to which a member may otherwise be entitled under the appropriate scale, or may disallow the whole of such allowance in any case.

(2) For the purpose of this regulation the term children shall mean children of the member (including step-children and children legally adopted by him) who are under the age of sixteen years and are fully maintained by him.”

Allowance of officers.

5. Regulation 45 of the Naval Financial Regulations is amended by–

(a) omitting sub-regulations (26) and (27);

(b) omitting from sub-regulation (28) the words “excluding Flagships”; and

(c) inserting at the end of sub-regulation (28) the following:—“provided that the rate of Entertaining Allowance payable to a Flag Captain shall be 5s. 0d. per diem”.

Deferred pay.

6.Regulation 51, sub-regulation (9), of the Naval Financial Regulations is amended by omitting the following “paragraph (b)of sub-regulation (1) of regulation 57” and inserting in its stead the following:—“regulation 59”.

7. Regulation 64 of the Naval Financial Regulations is repealed and the following regulation inserted in its stead:—

“64.—(1) The following consolidated rates of Active Pay shall apply to—

(a) Officers of the Auxiliary List of the Permanent Naval Forces, and to—

(b) All other persons appointed to or engaged in the capacity stated for permanent duty in the Auxiliary Services:—

Pay shall be inclusive of all allowances except where otherwise prescribed in these Regulations.

(2) Except as may be provided otherwise in this regulation, the commencing rate of pay on appointment to the Auxiliary Services shall be the minimum rate of the rank, rating class or appointment prescribed in sub-regulation (1) of this regulation.

(3) In the case of an appointment to the Auxiliary Services of an officer or a Chief Petty Officer with previous service in the Permanent Naval Force (Seagoing), each completed year served on full pay on the active list of such force (not including acting time) in the rank or rating to which appointed in the Auxiliary Services may be allowed to count for purposes of determining the commencing rate of pay as if such time had been served in the Auxiliary Services.

(4) In the case of appointment to the Naval Dockyard Police, the commencing rate of pay shall be determined in accordance with the following scale:—

(5) A person engaged as Constable in the Naval Dockyard Police without prior service in the Permanent Naval Force (Sea-going) shall receive on first appointment the minimum rate of pay for Constable prescribed in sub-regulation (1) of this regulation.

(6) Increments of pay prescribed shall be payable only on the approval of the Naval Board and shall be subject to such conditions as the Naval Board may determine.

(7) Time for the purpose of determining increments of pay shall commence to accrue from the date of appointment to the Auxiliary Services.

(8) No increment shall be granted to a member at a shorter interval than prescribed.

(9) ‘Acting’ time served in a rank or rating shall not count for purposes of increments of pay”.

8. Regulation 66 of the Naval Financial Regulations is repealed.

Leave due on transfer.

9. Regulation 69 of the Naval Financial Regulations is repealed.
