REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1934.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations, under the Naval Defence Act 1910-1934.

Amendment of Naval Financial Regulations. 

1. Regulation 30 of the Naval Financial Regulations is repealed and the following regulations are inserted in its stead:—

Outfit gratuities to Seagoing Officers.

“30. (1) An outfit gratuity in accordance with the following scale, may be paid to an officer on first joining, on promotion to officer rank, or on confirmation, in rank, as the case may be:—

(2)A Paymaster Cadet may be supplied gratuitously, on entry, with necessary articles of uniform outfit.

(3) An officer transferred from another Branch of the Royal Australian Navy shall receive no outfit gratuity on transfer.

(4) Retention by an officer of an outfit gratuity under the provisions of this regulation shall be subject to his continuing to serve for the appropriate period specified hereunder, subsequent to the date of eligibility for the gratuity:—

An officer to whom an outfit gratuity has been paid, and who fails to serve for the periods prescribed above, shall be required to refund the whole or portion of the gratuity as under:—

Officers included in Group (A)—One-sixth of the gratuity in respect of each period of 6 months (or part of such period) by which their service falls short of 3 years.

Officers included in Group (B)—One-fourth of the gratuity in respect of each period of 6 months (or part of such period) by which their service falls short of 2 years, provided that in the case of Schoolmaster, service for the purpose of this regulation shall count from the date of advancement to Probationary Schoolmaster.

If failure to complete the appropriate period of service prescribed is due to death, invaliding through causes beyond the officer’s own control, or other special circumstances, the refund may be waived in whole or in part, at the discretion of the Naval Board.

(5) The rates of outfit gratuity prescribed in this regulation are payable only under peace conditions and will, in time of war or emergency, be subject to variation at the discretion of the Nayal Board.

Equipment allowance to Midshipman.

30a. A Midshipman specializing in engineering may, on appointment to the Royal Naval Engineering College, Keyham, be granted an equipment allowance of £10 for the purchase of technical books and instruments.”

Emergency List Officers called up—outfit gratuity.

2. Regulation 32 of the Naval Financial Regulations is amended by omitting all the words after the word “receive” and inserting in their stead the words and figures “an outfit gratuity of £30.”.

Special allowances.

3. Regulation 48, sub-regulation (54), of the Naval Financial Regulations is amended by omitting all the words and figures prior to paragraph (b)and inserting in their stead the following:—

Where a complete set of Mess Traps is not maintained the rate of allowance payable will be subject to such reduction as may be determined by the Naval Board.”

4. Regulation 109a of the Naval Financial Regulations is repealed and the following regulation is inserted in its stead:—

Reimbursement of fares—remote localities.

“109a.—(1) In the case of members of the Auxiliary Services stationed in localities classified for the purposes of District Allowances, as prescribed in regulation 71 of these Regulations, partial reimbursement of fares paid by those members for themselves, their wives and families, when travelling on recreation leave or on furlough, may be approved by the Naval Board, subject to the following conditions:—

(a) A married member whose family resides with him at his station may, provided his wife and children (if any), under the age of fourteen years, travel with him on his recreation leave or furlough, be granted:—

(i) in the case of an officer—an amount equal to the excess beyond £15 on first-class return fares between his station and the nearest capital city or other destination of less distance.

(ii) in the case of a rating—an amount equal to the excess beyond £10 on second-class return fares between his station and the nearest capital city or other destination of less distance.

(b)A married member travelling alone or an unmarried member journeying on recreation leave or furlough may be granted—

(i) in the case of an officer—an amount equal to the excess beyond £10 on first-class return fares between his station and the nearest capital city or other destination of less distance.

(ii) in the case of a rating—an amount equal to the excess beyond £6 13s. 4d. on second-class return fares between his station and the nearest capital city or other destination of less distance.

 

(c) A member who elects to travel, while on recreation leave or furlough, a greater distance than is represented by the distance between his station and the nearest capital city, may be granted the amount which would have been allowed him had he elected to travel only to the nearest capital city.

(d)A member appointed or transferred for a definite period of three years or less to a locality classified for the purpose of District Allowance, shall not be granted partial reimbursement of fares under this regulation.

(e) Partial reimbursement of fares in accordance with this regulation shall not be granted to a member more than once in every three years.

(2) Notwithstanding anything contained in this regulation, if a member, whose period of transfer to and service at a locality classified for the purposes of District Allowance is not less than three years, proceeds on recreation leave or furlough, the cost of fares to and from the capital city of the State in which he was stationed prior to such transfer, in excess of the amounts specified in sub-paragraphs (a) or (b)of sub-regulation (1) of this regulation, as the case may be, may be granted to him subject to the approval of the Naval Board provided that the member returns at the expiration of his leave or furlough for a further period of duty at the locality from which his recreation leave or furlough commenced.”
