STATUTORY RULES.
REGULATIONS UNDER THE DEFENCE ACT 1903-1939 AND THE NAVAL DEFENCE ACT 1910–1934.*

under the

Amendments of the Naval Financial Regulations.
“(1) Subject to the provisions of this regulation and of regulation 25 of these Regulations, the daily rates of Active Pay of officers of, and promoted from, warrant rank, except those referred to in regulation 22 of these Regulations., shall be as specified in the following table:—

“22.—(1) Subject to the provisions of this regulation and of regulation 25 of these Regulations, the daily rates of Active Pay of officers of the Schoolmaster Branch shall be as specified in the following table:—

(2) Advancement of a Schoolmaster under this regulation beyond the rate of 18s. per day shall be subject to such conditions as are determined by the Naval Board.
(3) Notwithstanding anything contained in this regulation, the rate of Active Pay of an officer who was promoted to the rank of Senior Master prior to the twenty-eighth day of May, 1936, shall, on and from the date of commencement of this regulation, be the rate appropriate to his seniority in the rank of Senior Master specified in the following table:—

“23. The daily rates of Active Pay prescribed in regulation 23a, the rates of allowances prescribed in regulations 33 to 50 and the rates of Deferred Pay prescribed in regulation 52 of these Regulations shall, where not otherwise stated, be the rates of Active Pay, Allowances or Deferred Pay of Chief Petty Officers, Petty Officers, Men and Boys, borne for service in the Permanent Naval Forces (Sea-going).

“(3a) Notwithstanding anything contained in sub-regulation (3) of this regulation, a former rating of the Royal Navy or the Royal Australian Navy who, within five years of his discharge therefrom, engages, in time of war, for service in the Permanent Naval Forces (Sea-going) for a period of two years or the duration of the war and six months thereafter (whichever is the longer) may be supplied gratuitously with the kit of the rating in which he is entered in accordance with the scale approved by the Naval Board.”.

(2.) The rate of pay of a member of the Naval Dockyard Police (Guard Section) who was entered and served therein for any period from the twenty-second day of April, 1939, to the date upon which these Regulations came into operation shall, in respect of that period of service, be the rate of pay prescribed in regulation 64 of the Naval Financial Regulations, as amended by sub-regulation (1.) of this regulation.
(3.) If in respect of the period from and including the eleventh day of April, 1940, to the date upon which these Regulations came into operation, any officer was paid at a rate less than the rate of Active Pay prescribed in respect of his rank or appointment by regulation 64 of the Naval Financial Regulations, as amended by sub-regulation (1.) of this regulation, any payment so made shall be adjusted by payment to the officer concerned of the difference between the rate paid and the rate prescribed by that regulation as so amended.
(4.) Where, at the date immediately prior to the date upon which these Regulations came into operation, an officer was, under regulation 64 of the Naval Financial Regulations, paid at a rate of Active Pay higher than the rate payable to him, in respect of the rank or appointment which he holds, under that regulation, as amended by sub-regulation (1.) of this regulation, he shall, so long as he continues to hold that rank or appointment, be paid and be eligible for incremental advancement at the rate prescribed by that regulation or that regulation as so amended, whichever is the higher.

“(1) On discharge on account of having been found medically unfit for further service or on completion of the term of service for which he was engaged or appointed, a member of the Auxiliary Services (other than a member of the Naval Dockyard Police (Guard Section)) may be provided at Commonwealth expense with rail, steamer or coach transport for himself, his wife and children to his home port, or in lieu thereof, to any other place in Australia, if the cost of such transport does not exceed the cost of transport to his home port.”.
