REGULATIONS UNDER THE DEFENCE ACT 1903-1941 AND THE NAVAL DEFENCE ACT 1910-1934.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act 1903-1941 and the Naval Defence Act 1910-1934.

Amendments of the Naval Financial Regulations. 

Active Pay.

1. Regulations 15, 16, 17, 18, 19, 20 and 21 of the Naval Financial Regulations are amended by omitting each of the amounts of active pay specified therein and respectively inserting in their stead amounts ascertained by adding one shilling and six pence to each of the amounts so omitted.

Schoolmaster Branch.

2. Regulation 22 of the Naval Financial Regulations is amended—

(a) by omitting each of the amounts of active pay specified therein and respectively inserting in their stead amounts ascertained by adding one shilling and six pence to each of the amounts so omitted; and

(b) by omitting from sub-regulation (2.) the words and figures “of 18s. per day” and inserting in their stead the words “prescribed for a Schoolmaster, on completion by him of nine years’ service from date of entry,”.

Adjustment of rates of pay of officers.

3.—(1.) If, in respect of the period from and including the thirty-first day of October, 1941, to the sixth day of August, 1942, an officer was paid at a rate less than that prescribed in respect of his rank by regulation 15, 16, 17, 18, 19, 20, 21 or 22 of the Naval Financial Regulations, as amended by regulation 1 or 2 of these Regulations, as the case may be, he shall be paid, in respect of that period, additional active pay at the rate of one shilling per day.

(2.) If, in respect of the period from and including the seventh day of August, 1942, to the date on which these Regulations come into operation, an officer was paid at a rate less than that prescribed in respect of his rank by regulation 15, 16, 17, 18, 19, 20, 21 or 22 of the Naval Financial Regulations, as amended by regulation 1 or 2 of these Regulations, as the case may be, he shall be paid, in respect of that period, additional active pay at the rate of one shilling and six pence per day.

Active Pay.

4. Regulation 23a of the Naval Financial Regulations is amended—

(a) by omitting each of the amounts of active pay specified therein, except those prescribed in respect of members of the Wireless Mechanic Branch, and respectively inserting in their stead amounts ascertained by adding one shilling and six pence to each of the amounts so omitted;

(b) by inserting, after the words and figures relating to Signal Branch, the following words and figures:—

(c) by omitting each of the amounts of active pay specified therein in respect of members of the Wireless Mechanic Branch, and respectively inserting in their stead amounts ascertained by adding six pence to each of the amounts so omitted; and

(d) by omitting from the particulars relating to Sick Berth Attendant the words “service as such” (wherever occurring) and inserting in their stead the words “man’s time in Sick Berth Branch”.

Adjustment of rates of pay of men other than members of the Wireless Mechanic Branch.

5.—(1.) If, in respect of the period from and including the thirty-first day of October, 1941, to the sixth day of August, 1942, a man was paid at a rate less than that prescribed in respect of his rating by regulation 23a of the Naval Financial Regulations, as amended by paragraph (a) of regulation 4 of these Regulations, he shall be paid, in respect of that period, additional active pay at the rate of one shilling per day.

 

(2.) If, in respect of the period from and including the seventh day of August, 1942, to the date on which these Regulations come into operation, a man was paid at a rate less than that prescribed in respect of his rating by regulation 23a of the Naval Financial Regulations, as amended by paragraph (a) of regulation 4 of these Regulations, he shall be paid, in respect of that period, additional active pay at the rate of one shilling and six pence per day.

Pay of members of the Convoy Signal Branch.

6.—(1.) If, in respect of the period from and including the tenth day of March, 1942, to the sixth day of August, 1942, a man was a member of the Convoy Signal Branch, he shall be paid, in respect of that period, at the rate prescribed by regulation 23a of the Naval Financial Regulations, as amended by paragraph (b) of regulation 4 of these Regulations, in relation to his rating less six pence per day.

(2.) If, in respect of the period from and including the seventh day of August, 1942, to the date on which these Regulations come into operation, a man was a member of the Convoy Signal Branch, he shall be paid, in respect of that period, at the rate prescribed by regulation 23a of the Naval Financial Regulations, as amended by paragraph (b) of regulation 4 of these Regulations, in relation to his rating.

Adjustment of rates of pay of members of the Wireless Mechanic Branch.

7. If, in respect of the period from and including the seventh day of August, 1942, to the date on which these Regulations come into operation, any member of the Wireless Mechanic Branch was paid at a rate less than that prescribed in respect of his rating by regulation 23a of the Naval Financial Regulations, as amended by paragraph (c) of regulation 4 of these Regulations, he shall be paid in respect of that period, additional active pay at the rate of six pence per day.

Auxiliary services— Rates of active pay.

8.—(1.) Regulation 64 of the Naval Financial Regulations is amended—

(a) by omitting the table in sub-regulation (1.) thereof, and inserting in its stead the following table:—

(b) by omitting from sub-regulation (8.) the figures “241, 215, and 209” and inserting in their stead the figures “253, 231, and 227” respectively; and

(c) by omitting sub-regulation (12.) and inserting in its stead the following sub-regulation:—

“(12.) Time served in an acting capacity shall not count for the purpose of increments of pay, except in the case of a member who is appointed to be Acting Sub-Inspector, Acting Sergeant 1st Class or Acting Sergeant 2nd Class of the Naval Dockyard Police, who shall be eligible for incremental advancement, as if he had been permanently advanced to that rank or rating, as the case may be”.

(2.) If, in respect of the period from and including the thirtieth day of October, 1941, to the date on which these Regulations come into operation, any member of the Permanent Naval Forces (Auxiliary Services) other than a member of the Naval Dockyard Police was paid at a rate less than the rate of active pay prescribed in respect of his rank, rating, appointment or position by regulation 64 of the Naval Financial Regulations, as amended by sub-regulation (1.) of this regulation, any payment so made shall, subject to regulation 12 of these Regulations, be adjusted by payment to the member concerned of the difference between the rate paid and the rate prescribed by that regulation as so amended.

(3.) If, in respect of the period from and including the first day of October, 1941, to the twenty-ninth day of October, 1941, any member of the Naval Dockyard Police (Guard Section) who had served for a period of not less than twelve months in the Naval Dockyard Police (Guard Section) was paid at a rate less than the rate of active pay prescribed in respect of his rating by regulation 64 of the Naval Financial Regulations, as amended by sub-regulation (1.) of this regulation, additional active pay at the rate of ten pounds per annum shall be paid to that member in respect of any portion of that period subsequent to his completion of twelve months’ service.

(4.) If, in respect of the period from and including the thirtieth day of October, 1941, to the eighteenth day of March, 1942, any member of the Naval Dockyard Police (Guard Section) was paid at a rate less than the rate of active pay prescribed in respect of his rating by regulation 64 of the Naval Financial Regulations, as

 

amended by sub-regulation (1.) of this regulation, he shall be paid additional active pay at the rate of twelve pounds per annum, and if he had completed twelve months’ service in the Naval Dockyard Police (Guard Section) during that period, he shall be paid further active pay at the rate of ten pounds per annum for any portion of that period subsequent to his completion of twelve months’ service.

(5.) If in respect of the period from and including the thirtieth day of October, 1941, to the eighteenth day of March, 1942, any member of the Naval Dockyard Police other than a member of the Naval Dockyard Police (Guard Section) was paid at a rate less than the rate of active pay prescribed in respect of his rank, rating, appointment or position by regulation 64 of the Naval Financial Regulations, as amended by sub-regulation (1.) of this regulation, additional active pay at the rate of twelve pounds per annum shall be paid to that member in respect of that period.

(6.) If in respect of the period from and including the nineteenth day of March, 1942, to the date on which these Regulations come into operation, any member of the Naval Dockyard Police or the Naval Dockyard Police (Guard Section) was paid at a rate less than the rate of active pay prescribed by regulation 64 of the Naval Financial Regulations, as amended by sub-regulation (1.) of this regulation, any payment so made shall be adjusted by payment to the member concerned of the difference between the rate paid and the rate prescribed by that regulation, as so amended.

(7.) If, in respect of the period from and including the thirtieth day of March, 1942, to the date on which these Regulations come into operation, any member of the Naval Dockyard Police (Guard Section) was performing the duties of a Sergeant 1st Class, Sergeant 2nd Class, or Constable 1st Class, the Naval Board may approve of payment to that member of active pay at the rate prescribed for Sergeant 1st Class, Sergeant 2nd Class, or Constable 1st Class by regulation 64 of the Naval Financial Regulations, as amended by sub-regulation (1.) of this regulation, in respect of the period during which such duties were performed.

(8.) The total amount payable under regulation 65 of the Naval Financial Regulations in respect of the period from and including the thirtieth day of October, 1941, to the date on which these Regulations come into operation shall be deducted from any sum payable to a member of the Permanent Naval Forces (Auxiliary Services) in pursuance of sub-regulations (2.), (4.), (5.) and (6.) of this regulation.

Variations of pay on account of variations in cost of living.

9.—(1.) Regulation 64a of the Naval Financial Regulations is amended by omitting from sub-regulations (2.) and (4.) the words “July” and “January” and inserting in their stead the words “May” and “November”, respectively.

(2.) If in respect of the period from and including the fourteenth day of May, 1942, to the date on which these Regulations come into operation, any member of the Auxiliary Services, other than a member paid Sea-going rates in accordance with regulation 12 of these Regulations, was paid at a rate less than the rate of active pay prescribed for his rank, rating, appointment or position by regulation 64 of the Naval Financial Regulations as varied by regulation 64a of the Naval

 

Financial Regulations (as amended by sub-regulation (1.) of this regulation), any payment so made shall be adjusted by payment to the member concerned of the difference between the rate paid and rate as so varied.

Child endowment.

10. Regulation 65 of the Naval Financial Regulations is repealed.

11. After regulation 70 of the Naval Financial Regulations the following regulations are inserted:—

Auxiliary Services— Uniform rates of pay with Sea-going Forces.

“70a.—(1.) Notwithstanding the provisions of regulations 64 and 74 of these Regulations, a member of the Permanent Naval Forces (Auxiliary Services) may, upon the recommendation of the Naval Board, approved by the Treasurer, or an officer authorized by him, be paid active pay, allowances in the nature of pay (including marriage allowance), and be credited with and paid deferred pay, at the rates and in accordance with the conditions prescribed for a member of relative rank or rating in the Permanent Naval Forces (Sea-going):

Provided that—

(a) any such member, other than a member of the Shore Wireless Service, shall not be eligible to receive kit upkeep, lodging, provision or leave allowance as prescribed by these Regulations for members of the Permanent Naval Forces (Sea-going), but shall continue to be eligible to receive kit upkeep allowance in accordance with regulation 72a of these Regulations; and

(b) any such rating (other than a Boatman) may be credited with pay for such non-substantive rating as the Naval Board determines to be appropriate to his Auxiliary Service rating.

Special allowance.

70b.—(1.) Subject to the provisions of the next succeeding sub-regulation, where the total of the rate of active pay and allowances paid, and the rate of deferred pay credited, to a member of the Auxiliary Services under the provisions of regulation 70a of these Regulations, plus the value of victuals and accommodation supplied to him, is less than the consolidated rate of active pay and allowances (including district allowance) paid, and deferred pay credited, to him in respect of the day immediately prior to his transfer to the rates payable under that regulation, he shall be paid a special allowance at a rate equal to the difference.

(2.) A member, having ceased to be eligible for payment of a special allowance under sub-regulation (1.) of this regulation, shall thereafter again become eligible for payment of such an allowance only if the total specified in that sub-regulation falls in his case, as the result of—

(a) a reduction in the amount of the marriage or the dependant allowance payable to him under these Regulations; or

(b) his reversion to a lower rank or rating for other than disciplinary reasons,

below the consolidated rate which, but for the fixing of his emoluments under regulation 70a of these Regulations, would have been payable to him under these Regulations.

Subsistence allowance— Neither victualled nor accommodated.

70c.—(1.) Except as provided by sub-regulation (2.) of this regulation, a member of the Auxiliary Services who is supplied neither with rations nor with Service accommodation shall be paid a subsistence

 

allowance at the rate of 3s. per diem, but if he is required, for Service reasons, to reside away from his home, the rate of allowance payable to him shall be 4s. 6d. per diem.

(2.) Where a member of the Auxiliary Services to whom marriage allowance or dependant allowance has been approved is required, for Service reasons, to reside away from his home and is provided neither with rations nor with Service accommodation, he shall be paid subsistence allowance in accordance with the following scale:—

(3.) For the purposes of this regulation, ‘a member of the Auxiliary Services’ shall mean a member of the Auxiliary Services, other than the Shore Wireless Service, paid in accordance with the provisions of regulation 70a of these Regulations.

Subsistence allowance— Either not victualled or not accommodated.

70d.—(1.) Except as provided by sub-regulation (3.) of this regulation, a member of the Auxiliary Services who is supplied with rations, but is not provided with Service accommodation, shall be paid subsistence allowance as follows:—

(2.) Except as provided by sub-regulation (3.) of this regulation, a member of the Auxiliary Services who is provided with Service accommodation, but is not supplied with rations, shall be paid subsistence allowance as follows:—

(3.) (4.) For the purposes of this regulation ‘a member of the Auxiliary Services’ shall mean a member of the Auxiliary Services, other than the Shore Wireless Service, paid in accordance with the provisions of regulation 70a of these Regulations”.

Adjustment of rates of pay, &c., of certain members of the Auxiliary Services.

12. If, during the period from and including the second day of April, 1942, to the date on which these Regulations come into operation, an approval, upon the recommendation of the Naval Board, such as is specified in regulation 70a of the Naval Financial Regulations, is given, the rates of emolument paid to any member of the Auxiliary Services, the subject of such approval, shall, in respect of his service thereafter, be adjusted to accord with the rates payable under the Naval Financial Regulations, as amended by regulation 11 of these Regulations:

Provided that—

(a) the rate of subsistence allowance prescribed by sub-regulation (1.) of regulation 70c of the Naval Financial Regulations shall be deemed to be 2s. 5d. per diem in respect of service prior to the twenty-sixth day of June, 1942;

(b) a subsistence allowance at the rate prescribed by sub-regulation (2.) of that regulation shall not be payable in respect of any service prior to the seventh day of December, 1942;

(c) a subsistence allowance at the rate prescribed by sub-regulation (1.) or sub-regulation (3.) of regulation 70d of the Naval Financial Regulations shall not be payable in respect of service prior to the fifth day of February, 1943; and

(d) the rate of subsistence allowances prescribed by sub-regulation (2.) of that regulation shall be deemed to be 1s. 9d. per diem in respect of service prior to the fifth day of February, 1943.

Deferred pay.

13. Regulation 74 of the Naval Financial Regulations is amended by omitting from paragraph (a) of sub-regulation (8.) the words and figures—
