REGULATIONS UNDER THE DEFENCE ACT 1903-1941 AND THE NAVAL DEFENCE ACT 1910-1934.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act 1903-1941 and the Naval Defence Act 1910-1934.

Amendments of the Naval Financial Regulations. 

1. Regulation 15 of the Naval Financial Regulations is repealed and the following regulations are inserted in its stead:—

“15. Except as prescribed by regulation 21 of these Regulations, the following shall be the daily rates of active pay for Executive Officers:—

Provided that an officer who is in possession of such technical Radar qualifications as are determined by the Naval Board and is appointed for Radar duties shall, while holding that appointment, be paid at the same daily rate of active pay as is prescribed by regulation 15a of these Regulations for an officer of the Engineering Branch of corresponding rank and seniority.

Officers of the Engineering Branch.

“15a.—(1.) Subject to the provisions of this regulation and except as prescribed by regulation 21 of these Regulations, the following shall be the daily rates of active pay for officers of the Engineering Branch:—

An allowance for Engineer duties is included in the scale of pay for officers of the Engineering Branch up to Commander’s rank inclusive.

(2.) A Probationary Engineer Sub-Lieutenant shall be entitled to pay and allowances at the rates prescribed as payable to an Engineer Sub-Lieutenant ‘on promotion’.

(3.) The rates prescribed by sub-regulation (1.) of this regulation for officers of the Engineering Branch shall be paid continuously to an officer while he is employed on Engineering duties.

(4.) A Lieutenant (E) or Lieutenant-Commander (E) who reverts to deck duties shall, whilst employed on those duties, be paid at the rate prescribed for an Executive Officer of corresponding rank and seniority.

(5.) The conditions regarding the commencement of (E) pay for Sub-Lieutenants (E) and Lieutenants (E) shall be as approved by the Naval Board.

 

Officers of the Electrical Branch.

“15b. Except as prescribed by regulation 21 of these Regulations, the following shall be the daily rates of active pay for officers of the Electrical Branch:—

Officers of and promoted from Warrant Rank —Pay.

2. Regulation 21 of the Naval Financial Regulations is amended—

(a) by omitting from sub-regulation (5.) the word “The” (first occurring) and inserting in its stead the words “Except as prescribed by sub-regulation (6) of this regulation, the”; and

(b) by adding at the end thereof the following sub-regulation:—

“(6) An officer of the Non-Mechanical Branch who is in possession of such technical Radar qualifications as are determined by the Naval Board and is appointed for Radar duties shall, while holding that appointment, be deemed to be for the purpose of this regulation, an officer of the Mechanical Branch.”.

Adjustment of pay of officers performing Radar duties.

3. An officer who, during the period on and from the ninth day of April, 1942, to the date of commencement of these Regulations, was in possession of such technical Radar qualifications as are determined by the Naval Board and was appointed for Radar duties may, in respect of that appointment, be paid active pay at the daily rate and subject to the conditions prescribed by the Naval Financial Regulations, as amended by these Regulations.

4. Regulation 23a of the Naval Financial Regulations is amended by omitting therefrom the words and figures relating to the daily rates of active pay for the Wireless Mechanic Branch and inserting in their stead the following words and figures:—

5. Regulation 35 of the Naval Financial Regulations is repealed and the following regulation is inserted in its stead:—

Outfit Gratuities on change of class of uniform.

“35. (1) Subject to this regulation, the following Outfit Gratuities shall be paid, in addition to Kit Upkeep Allowance, to all ratings, including those lent from the Royal Navy, who are obliged to change their uniform from Class II. to Class I. or Class III., or from Class III. to Class II.

In addition to the gratuity under paragraph (a) above, a further gratuity of £15 towards the cost of frock-coat and sword shall be paid to Master-at-Arms on promotion.

(2) When a rating is required to change his class of uniform and is paid an outfit gratuity as prescribed in sub-regulation (1) of this regulation, articles of kit of his former rating which are not required as compulsory kit for his present rating shall be returned by the rating. Such of these articles as are in new condition and fit for sale at the fixed issuing price shall be sold accordingly and other articles which are considered suitable for re-sale at two-thirds of the fixed issuing price shall be valued and sold at that rate.

(3) An outfit gratuity shall not be paid when the transfer in rating is attributable to misconduct.

(4) When a man is transferred from any rating to that of Bandsman, he shall receive a gratuitous issue of the approved compulsory kit for a Bandsman, except those articles which are common to the kits of his former rating, and that of Bandsman. Such articles in the compulsory kit of his former rating as are not included in that of Bandsman shall be returned by the rating.

(5) Uniform gratuities shall not be payable to officers and men lent from the Royal Navy, and a free kit shall not be issued in such cases, except as provided in sub-regulation (1) of this regulation.

(6) In addition to the allowances and gratuitous issues specifically prescribed by these Regulations, the Naval Board may authorize the gratuitous issue of articles of clothing to officers and ratings employed on special duties, under conditions embodied in standing orders and instructions of the Naval Board.”.

 

Allowances to officers.

6. (1) Regulation 45 of the Naval Financial Regulations is amended by inserting after sub-regulation (50) the following sub-regulation:—

“(50a) Commissioned Officers from Warrant Rank and Warrant Officers specifically appointed in lieu of Officers who have passed the Advanced Gunnery Course—in a ship where one is allowed, but not borne........................................

(2) A Commissioned Officer from Warrant Rank or a Warrant Officer, who, during the period on and from the first day of July, 1942, to the date of commencement of this regulation, was appointed in lieu of an Officer who has passed the Advanced Gunnery Course—in a ship where one was allowed but not borne, may be paid an allowance in respect of that period at the rate prescribed in regulation 45 of the Naval Financial Regulations, as amended by this regulation.”.

Special allowances.

7. Regulation 48 of the Naval Financial Regulations is amended by inserting, after sub-regulation (8c), the following sub-regulation:—
