REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910–1918.

I, SIR WILLIAM HILL IRVINE, Deputy of the Governor-General in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910–1918, to come into operation on and from the dates specified therein.

AMENDMENT OF NAVAL FINANCIAL REGULATIONS (STATUTORY RULES 1912, No. 18, AS AMENDED TO PRESENT DATE).

1. The provisions of Statutory Rules 1920, No. 58, notified in the Commonwealth Gazette, No. 35, of 15th April, 1920, shall, in so far as they relate to the allowance payable to Shorthand Writer under regulation 43 (V.) sub-regulation (5) of the Naval Financial Regulations, take effect as from 1st July, 1918, and not otherwise.

2. Regulation 35a is amended, as from 1st October, 1919, by inserting after the second paragraph thereof the following paragraph:—

“In cases where supply of Mess Traps is approved to official residences, a charge at the rate of 8 per centum per annum on the value of such Mess Traps shall be made.”

3. The heading “Fidelity Guarantees of Officers and Others” is omitted, and regulations 36, 37, 38, 39, 40 and 41 are repealed as from 14th April, 1920.

4. Regulation 42 (I.) is amended as from the 1st February, 1919, by adding at the end thereof the following sub-regulation:—

Officers of the Royal Navy.

“(12). Officers of the Royal Navy serving in the Permanent Sea-going Forces may be paid the rates of active pay and allowances prescribed for their relative ranks in the Royal Navy. Deferred Pay shall not be credited in such cases, but the following R.A.N. allowances shall be payable in lieu of the corresponding Royal Navy allowances at the rates and under the conditions prescribed in these Regulations:—

(i) Uniform (Upkeep) Allowance.

(ii) Rations or Allowance in lieu.

(iii) Married and Dependant Allowances.

(iv) Lodging Allowance.

(v) Travelling Allowance.”

5. Regulation 42 (I.) is repealed, as from 1st July, 1919, and the following regulation is inserted in its stead:—

“42 (I.). (1) The daily rates of active pay set forth in this regulation, the allowances set forth in regulations 43 (I.) to 43 (V.), and rates of deferred pay as set forth in regulation 44 shall apply, where not otherwise stated, as from 1st July, 1919, to Officers serving in the Permanent Naval Forces (Sea-going) of the ranks or relative ranks specified, as defined in the King’s Regulations and Admiralty Instructions.”

(2) The following shall be the daily rates of Active Pay for Commissioned Officers:—

An allowance for Engineer duties is included in the scale of pay for officers of the Engineering Branch up to Commander’s rank inclusive. The above rates for the Engineering Branch shall be paid continuously while an officer is employed on Engineering duties. A Lieutenant (E) or Lieut.-Commander (E) who reverts to Deck duties shall, whilst employed on such duties, receive pay on the scale of the Executive Branch.

Chaplains have no relative rank. For the purposes of Lodging and Travelling Allowances, Chaplains shall receive the Lieutenant rate, Chaplains of eight years’ seniority the Lieutenant-Commander rate, and Chaplains of sixteen years’ seniority the Commander rate of such allowances.

The Mechanical Branch (column “A”) shall include the ranks of Warrant Engineer, Commissioned Engineer, Engineer-Lieutenant, and Engineer-Lieutenant-Commander, Warrant Mechanician, Commissioned Mechanician, Warrant Shipwright, Commissioned Shipwright, and Shipwright Lieutenant, Warrant Electrician, Commissioned Electrician, Warrant Ordnance Officer, Commissioned Ordnance Officer, and officers promoted to the ranks of Lieutenant and Lieutenant-Commander in their respective branches from the foregoing ranks.

The Non-Mechanical Branch (column “B”) shall include the ranks of Gunner, Commissioned Gunner, Gunner (T), Boatswain, Commissioned Boatswain, Signal Boatswain, Chief Signal Boatswain, Warrant Telegraphist, Commissioned Telegraphist, Warrant Wardmaster, Commissioned Wardmaster, Warrant Master-at-Arms, Commissioned Master-at-Arms, Warrant Writer, Commissioned Writer, Warrant Victualling Officer, Commissioned Victualling Officer, Warrant Instructor in Cookery, Commissioned Instructor in Cookery, Head Schoolmaster and Chief Schoolmaster (old system), and Officers promoted to the ranks of Lieutenant and Lieutenant-Commander in their respective branches from the foregoing ranks.

Definition of Service.

(5) Service for the purpose of increments of pay shall be defined for all Officers as actual service in rank, specified on Active List of Royal Navy or Royal Australian Navy.

Increments.

(6) All increments of pay shall be subject to such conditions as may be prescribed by the Naval Board. “Provisional” time shall count for increments of pay, but “Acting” time shall not so count. Temporary Acting Warrant Officers may be allowed the same increments of full pay as authorized for confirmed Warrant Officers, R.A.N., of similar rank.

Retention of old Rates of Pay.

(7) Any Officer, whose Pay and Allowances in the nature of Pay under Regulations in force immediately prior to the rates of Pay and Allowances set out in these Regulations coming into force were greater than those set out in these Regulations, may continue to receive such higher Pay and Allowances during the period of his existing appointment, or until such time as the new rates, either on account of increment or promotion, exceed the old rates.

Excess Numbers.

(8) Officers in excess of the authorized number of any rank may be carried on the strength, provided there are vacancies in the higher rank, and that the total establishment is not exceeded.

Not applicable to Consolidated Pay.

(9) This regulation does not at present authorize the transfer to sea-going rates of pay of any Officer now in receipt of a consolidated rate of pay.

Reserve Officers.

(10) Officers of the Naval Reserves (Sea-going) appointed to H.M.A. Ships shall receive the same rates of Pay and Allowances as Officers of the same rank in the Permanent Naval Forces (Sea-going), deferred pay being paid with active pay. Progressive pay for Reserve Officers shall accrue according to seniority in rank.

Citizen Naval Forces and R.A.N.B. Staff Officers.

(11) Officers of the Citizen Naval Forces appointed to H.M.A. Ships shall receive the “on promotion” rates of Pay and Allowances of officers of the same rank in the Permanent Naval Forces (Sea-going), deferred pay being paid with active pay. Officers of the Royal Australian Naval Brigade Staff in receipt of consolidated rates of pay appointed to H.M.A. Ships may receive Sea-going rates of pay and allowances if approved, in special circumstances, by the Naval Board, deferred pay being paid with active pay.

Officers of the Royal Navy.

(12). Officers of the Royal Navy serving in the Permanent Sea-going Forces may be paid the rates of active pay and allowances prescribed for their relative ranks in the Royal, Navy. Deferred Pay shall not be credited in such cases, but the following R.A.N. allowances shall be payable in lieu of the corresponding Royal Navy allowances at the rates and under the conditions prescribed in these Regulations:—

(i) Uniform (Upkeep) Allowance.

(ii) Rations or Allowance in lieu.

(iii) Married and Dependant Allowances.

(iv) Lodging Allowance.

(v) Travelling Allowance.”

5a. Regulation 42 (I.) is amended as from 1st July, 1920, by omitting sub-regulation (9) and inserting in its stead the following sub-regulation:—

Sea-going Officers in Shore Appointments.

“(9) Officers on the Sea-going List (except members of the Naval Board), who, though serving in shore appointments, are eligible and liable to be appointed to sea, shall receive the Sea-going rates of pay and allowances of their respective ranks.”

6. Regulation 42 (II.) is amended, as from 1st April, 1919, by omitting sub-regulation (1) and inserting in its stead the following sub-regulation:—

“(1) the following daily rates of Active Pay, the Allowances specified in regulations 43 (I.) to 43 (V.), and the rates of Deferred Pay specified in regulation 44, shall apply as from 1st April, 1919, to all Chief Petty Officers, Petty Officers, Men, and Boys (of the rating specified) serving in the Permanent Naval Forces (Sea-going) at 7th October, 1919, (Relative rating shall be determined by the King’s Regulations and Admiralty Instructions):—

7. Regulation 43 (I.) is amended as follows:—

(1) Sub-regulation (2) is amended, as from 1st July, 1920, by omitting the following:—

“All Officers..................................................... 1s. per diem

Uniform Allowance to Midshipmen shall not commence until the day following the date of leaving Royal Australian Naval College.”

(2) Byinserting after sub-regulation (5) as from 1st January, 1920, the following sub-regulation:—

“(5a) Ratings who have been discharged ‘time expired’ and re-engage, after an interval, for a further period of service in the Royal Australian Navy shall be entitled to be issued with a free kit.

Should a rating not have disposed of his kit prior to his re-engagement, he may, if he so elects, be paid the usual daily allowance as from the date of his re-entry in lieu of being supplied with the free kit as prescribed.”

(3) Sub-regulation (7) is amended, as from 1st July, 1920, by omitting the following:—

“Uniform Allowance at the above daily rates will be credited in cash from date of entry.”

(4) Sub-regulation (7a) is omitted as from 1st April, 1920.

(5) Sub-regulation (11) is amended as from 1st December, 1919,

(i) By omitting from the fifth paragraph thereof the following:—

“for any period exceeding six months, and are not provided with accommodation, shall be paid Lodging Allowance at the following rates:—”

and inserting in its stead the following:—

“and are not provided with accommodation, shall be paid Lodging Allowance at the following rates provided that, where the period of service ashore does not exceed one month, Officers shall be paid the difference between the daily and annual rates of Lodging Allowance prescribed in this sub-regulation:—”

(ii) By omitting, as from 1st July, 1919, the sixth paragraph commencing “Such allowance shall  ” and inserting in its stead the following new paragraphs:—

“The annual rate of Lodging Allowance shall not cease when an Officer proceeds on recreation leave.

In calculating Lodging Allowance at the annual rate, the amount payable shall be ascertained, by multiplying the annual rate by the number of days in the period of calculation and dividing the result by 365.”

(6) Sub-regulation (12) is amended—

Warrant Officers over six years’ seniority shall receive the allowance prescribed for Warrant Officers under six years’ seniority up to a maximum of 3s. per diem.

Commissioned Warrant Officers, in receipt of “on promotion” rates of pay, shall receive 2s. per diem Married Allowance. Commissioned Warrant Officers in receipt of rates of pay prescribed for Commissioned Warrant Officers “after three years’ seniority,” and “after six years’ seniority,” shall receive 1s. per diem Married Allowance.

Commissioned Warrant Officers in receipt of pay as “Commissioned Warrant Officer after nine years’ seniority,” shall not be entitled to Married Allowance.

(iii) byomitting from sub-paragraph (h) of the second paragraph, as from 1st April, 1919, the words “for the period of the war”.

(iv) by omitting sub-paragraph (i), as from 1st April, 1919.

(v) by re-numbering present sub-paragraph (k) as sub-paragraph (i).

(vi) by adding at the end thereof, as from 1st April, 1919, the following sub-paragraphs:—

“(k)for the purposes of mulcts, Married Allowance shall not be included in calculating the daily rate of pay, such allowance being regarded for this purpose similarly to Lodging and Ration Allowances. Married Allowance shall not, however, be payable when a rating is in cells, civil prison or undergoing detention.

(l)The payment of Married Allowance shall be entirely subject to the pleasure of the Naval Board, who may withhold the whole or any part of this allowance as may be considered desirable.”

(7) Sub-regulation (14) is omitted as from 1st April, 1919.

(8) Sub-regulation (13) is re-numbered (14) as from 1st April, 1919.

(9) By inserting after sub-regulation (12), as from 1st April, 1919, the following sub-regulation:—

Dependant Allowance.

“(13) (1) When Married Allowance is not credited, an allowance at the rate of 2s. per diem may be paid to Officers and men in respect of a dependant residing in Australia requiring support, subject to an allotment of one-half of the pay of an Officer or man plus the amount of the Dependant Allowance.

(2) Dependant Allowance shall not be credited without the approval of the Naval Board and shall generally be limited to cases of mothers being widows, or of the father being permanently incapacitated, by age or infirmity, from earning wages exceeding £2 per week. Such allowance shall not be payable where there are unmarried sons not serving in the Naval or Military Forces or daughters in receipt of wages exceeding £2 per week or where the allottee possesses income of like amount. An allowance at the minimum rate may also be approved by the Naval Board in any other special case where Married Allowance is not already paid and dependance upon the member of the Permanent Naval Forces (Sea-going) is clearly established, subject to residence in Australia and to the above limitation as to private income. A war pension shall not count as income for the purpose of the foregoing, and Dependant Allowance shall be payable to a widow or other female relative provided she does not possess other income exceeding £2 per week.

(3) Payment of Dependant Allowance shall be entirely subject to the pleasure of the Naval Board who may withhold the whole or any part of the allowance as may be considered desirable.

(4) This allowance shall not be included in the daily rate of pay for the purposes of mulcts, such allowance being regarded for

that purpose similarly to Lodging, Ration and Married Allowances. Payment of Dependant Allowance shall not, however, be made when a rating is in cells, civil prison or undergoing detention.

(5) During periods of detention or imprisonment not exceeding 90 days, the allotment shall be continued at a rate not less than the rate of Dependant Allowance. As allotment will be continued in such circumstances at the rate of at least £3 per month, when the ordinary allotment is stopped on discharge of a man to civil prison or detention quarters, a charge shall be made against his pay in respect of an allotment at the reduced rate. Form A.S. 63 declaring an allotment at the reduced rate shall be forwarded into office in every case.

(6) The debt accumulated by such allotment may be recovered by easy instalments from the pay of the rating. In the event of discharge, the debt incurred shall be communicated to the Director of Navy Accounts for recovery from deferred pay.”

(10) Sub-regulation (13) is amended, as from 1st January, 1920, by omitting paragraph (1) and inserting in its stead the following paragraph:—

“(1) When Married Allowance is not drawn, Dependant Allowance at the rate of 2s. per diem may be paid to—

(a) Warrant Officers, irrespective of the rate of pay received.

(b)Commissioned Warrant Officers in receipt of on promotion rates of pay,

and

(c) Ratings

in respect of a dependant residing in Australia requiring support, subject to an allotment of one-half of the pay of the Officer or man plus the amount of Dependant Allowance credited.

Commissioned Warrant Officers in receipt of pay as ‘Commissioned Warrant Officer after three years’ seniority,’ or ‘Commissioned Warrant Officer after six years’ seniority,’ may be paid Dependant Allowance under similar conditions, at the rate of 1s. per diem only. Commissioned Warrant Officers in receipt of pay as ‘Commissioned Warrant Officer after nine years’ seniority,’ shall not be entitled to this allowance.”

12. Regulation 43 (IV.) is amended as from 1st December, 1919, by omitting sub-regulations (46) and (49).

13. Regulation 43 (V.) is amended as follows:—

(1) Sub-regulation (8a) is omitted as from 1st January, 1918.

(2) By adding, as from ,1st April, 1919, the following sub-regulation:—

Interpreter.

“(12) Ratings acting as Interpreter, whilst actually performing the duties, shall receive an allowance of 1s. per hour, with a maximum payment of 5s. for any one day.”

14. Regulation 44 (I.) is amended as from 1st December, 1919, as follows:—

(1) Sub-regulation (1) is amended by adding at the end thereof the following words:—

“; provided that deferred pay shall not be credited to any Officer of the Royal Navy serving in the Permanent Naval Forces (Sea-going).”

16. Regulation 45 is amended, as from 1st April, 1919, as follows:—

(1) Sub-regulation (1) is amended by adding at the end thereof the following paragraph:—

“The established forms shall be rendered completed in detail for each day’s transactions. The money columns in Daily General Mess Statement, Daily Abstract of Issues and Provision Account shall invariably be completed.’’

(2) By inserting after sub-regulation (9) the following sub-regulation:—

“(9a) Where Government contracts of any kind exist, purchase of articles under contract must be made from such contractors. Should exceptional reasons justify any departure from this rule, a detailed statement shall accompany the purchase voucher showing the reasons and approval of the Commanding Officer. When no contracts are in force, the Accountant Officer shall obtain three quotations where possible on the special Tender Form established for the purpose. In placing orders for supplies, the lowest tender should be accepted unless for special reasons approved by the Commanding Officer.”

(3) Sub-regulation (12) is amended by adding at the end thereof the following paragraphs:—

“Any extra issues necessary, other than for the ordinary meals and on the hands turning out in the morning, shall not be charged against the messing allowance but shall be included in the Provision Account and credit taken for same at the end of each quarter or period of account.

In Home ports where repayment messes draw provisions for individuals to take ashore to their homes, this concession shall apply generally to married ratings only and, then, only

in so far as the same is permissible by the Customs or other Government Regulations, no departure from which shall be permitted under any circumstances. Other ratings may, for special reasons approved by the Executive Officer in each case, be granted the same privilege and their names added to a Permission List which shall be kept in all ships. No provisions drawn in this manner shall be landed unless accompanied by the established pass for this purpose, and no rating shall be allowed to take up, for any one month, provisions in excess of his Ration Allowance.

All seamen’s mess utensils shall be mustered at least every three months to insure that breakages are replaced and, more particularly, to insure that an adequate supply is maintained in all messes to meet requirements, as suitable and adequate mess traps are essential to a reasonable standard of comfort. Excess breakages, due to stress of weather or circumstances other than neglect, may, at the Captain’s discretion, be replaced free of charge to the messes, but recovery shall be made in all cases of neglect. The Accountant Officer shall bring under notice of the Commanding Officer any action desirable for the comfort of the lower deck in connexion with victualling arrangements.”

17. Regulation 46 is amended, as from 1st April, 1919, by adding at the end thereof the following sub-regulations:—

“(5)Pay whilst on Leave.—When proceeding on leave for seven days or longer, Officers and men of the Permanent Naval Forces (Sea-going) may be advanced pay and leave allowance due up to the date of expiration of such leave.

When proceeding on leave for over 48 hours but under seven days, pay may be advanced to Officers and men when a pay day will occur prior to the expiration of the leave only.

(6) Gratuitous Issues.—When gratuitous issues of clothing or uniform are made to members of the Permanent Naval Forces (Sea-going) to replace articles of clothing or uniform lost, the total value of such issues shall be shown in the Ship’s Ledger in the column “ Value of Free Issues of Clothing” and the reason and authority for such issues inserted. Gratuitous issues of clothing granted as compensation for loss shall be shown separately in ratings’ accounts and separate totals shown in the ledger and summary.”

18. Regulation 47 (I.) is amended, as from 1st October, 1918, byomitting from sub-regulation (1) the words “Chief Naval Instructor “, “Senior Naval Instructor”, and “Naval Instructor”, and inserting in their stead, respectively, the words “Instructor Commander”, “Instructor Lieutenant-Commander “, and “Instructor Lieutenant”.

19. Regulation 47 (II.) is amended, as from 1st April, 1919, by omitting the second paragraph of sub-regulation (7).

20. Regulation 48 is amended, as from 1st April, 1919, as follows:—

(1) By omitting sub-regulations (1) and (2) and inserting in their stead the following sub-regulations:—

“(1) Allotments.—Allotments of active pay may be made by Officers and men of the Permanent Naval Forces (Sea-going) to any

person above the age of 18 years, at any rate from 10s. per month upwards within the amount of pay and allowances earned, clothing allowance being excluded.

(2) Bi-monthly payments on account of pay shall be made on the basis of 15 days’ pay (14 in February) and allowances exclusive of Deferred Pay, less half the allotment in force and any odd pence, settlement being effected at the end of each quarter.

Deduction shall be made from bi-monthly payments on account of clothing issued and other charges. Accountant Officers shall be held responsible that payments are not made which would bring any person into debt to the Grown.

(2) Sub-regulations (4) and (5) are omitted.

21. The heading “Allotments of Pay” immediately after regulation 48, Part IV. of the Regulations, is omitted, as from 1st January, 1918.

22. Regulation 49 is repealed as from 1st January, 1918.

23. After Regulation 48 the following Regulation is inserted as from 1st May, 1920:—

“49. Recruits.—Capitation and Medical Fees and Travelling Expenses.

(1) Capitation Fees.—At places where there is no District or Sub-District Naval Office, the local Military Warrant or Non-Commissioned Officers of the Instructional Staff who act as Recruiting Officers for the Navy Department may be granted a capitation allowance of £1 for each recruit finally entered for service in the Permanent Naval Forces (Seagoing).

(2) Medical fees.—A fixed fee of 10s. 6d. per capita shall be paid to Military Area Medical Officers for the examination of Naval Recruits at places where there is no Naval Medical Officer available.”

24. Regulation 49a is amended, as from 1st April, 1919, by omitting the words “ by the Accountant Officer “ in the last paragraph thereof.

25. Regulation 49b is amended, as from 1st. April, 1919, by omitting subparagraphs (c) and (d), and inserting in their stead the following sub-paragraphs:—

“(c) After three months from date of first entry—

Boys under eighteen years of age, £40.

Men—

Up to four years’ service since date of engagement, £48.

Over four years’ and up to six years’ service since date of engagement, £36.

Over six years’ service since date of engagement, £24.

Time served as boy shall not be allowed to count as “ service.”

(a)After re-engagement, £20 and refund of any re-engagement gratuity paid.”

26. Regulation 49c is repealed, as from 1st April, 1919, and the following regulation numbered 50 is inserted in its stead:—

“50. Ratings, except boys, discharged by purchase from the Royal Australian Navy and subsequently allowed to re-engage in the Service within a period of two years from date of their discharge, may, on the

 

approval of the Naval Board, be refunded one-half of the amount paid for discharge in each case or the full amount paid when deferred pay has been forfeited, provided an engagement to serve for five years is executed on re-entry of the rating concerned.”

27. Regulation 50 (I.) is re-numbered 50a and amended, as from 1st July, 1919, as follows:—

(2) Sub-regulation (6) is amended by omitting from the last line the figures “ £192 ” and inserting in their stead the figures “ £204 ”.

(3) Sub-regulation (8) is amended by adding at the end thereof the following paragraph:—

“Persons appointed to the Royal Australian Naval Brigade Staff from the Permanent Naval Forces (Sea-going) and permitted to carry forward recreation leave not taken prior to date of transfer may, on the approval of the Naval Board, be granted such leave subsequently but at R.A.N.B. Staff rates of pay only.”

28. Regulation 50 (e) is repealed as from 1st January, 1919.

29. Regulations 51 (I.) and 51 (II.) are re-numbered 51 and 51a, respectively, as from 1st January, 1920.

30. After regulation 69 the following regulation is inserted as from 1st January, 1919:—

“69a. Minor Injuries.—(1) The Naval Board may authorize payment of a gratuity, not exceeding a maximum of £8 in each case, to Chief Petty Officers, Petty Officers and men invalided or discharged who, at date of discharge are suffering from any disabilities resulting from minor injuries sustained on duty for which a Hurt Certificate Form A.M. 183 has been granted in accordance with the King’s Regulations and Admiralty Instructions. Such gratuity shall be payable at the expiration of the rating’s engagement only and may be in addition to any compensation awarded under the provisions of regulation 68 in respect of any other disability.

(2) The following conditions shall apply generally to payment of the gratuity:—

(i) The injury must be one for which a hurt certificate has been granted, but possession of a hurt certificate shall not entitle any rating to the gratuity where no disability exists.

(ii) The amount of gratuity shall be assessed by a Board of Survey consisting of, at least, two Medical Officers, due regard being given to the rating’s future occupation.

(iii) The Board of Survey shall assess, separately, the gratuity for any disability arising from any previous minor injury for which a hurt certificate is held in any case where the rating is being invalided in consequence of a hurt or sickness attributable to the Service.

(iv) The Naval Board shall determine the amount of gratuity, if any, payable, each case being dealt with on its merits.”

31. Regulation 77 is amended as follows:—

(1) By inserting after sub-regulation (19), as from 1st April, 1920, the following sub-regulation:—

“(19a) Chief Petty Officers when travelling by rail on duty on Inter-State journeys may be granted first class accommodation.”

(2) By omitting sub-regulation (29), as from 1st January, 1918, and inserting in its stead the following sub-regulation:—

Recruits.—(29) Recruits entered in the Permanent Naval Forces (Sea-going) in one place and proceeding to join a ship or depot in another place may receive travelling allowance and be provided with accommodation byrail or steamer as per scales prescribed in sub-regulations (1) and (19) respectively.”

(3) By inserting after sub-regulation (30), as from 1st April, 1919, the following sub-regulations:—

Government Fares.—(30a) Railway warrants shall be prepared in such form and under such conditions as may be prescribed by the Naval Board.

(30b) Railway warrants are in the nature of cheques drawn on the Department of the Navy and shall be prepared and issued with every regard to the prevention of unauthorized use and to insuring that accounts can be readily checked and passed for payment.

(30c) Officers and men proceeding to complete unexpired leave after recall shall be entitled to railway warrants for both the forward and return journeys, but shall not be entitled to such railway warrants or any expenses unless the unexpired portion of the leave subsequent to recall will admit of at least twenty-four hours being spent at their destinations.

Officers and men, who are aware, before proceeding on leave, that it is probable they will be recalled, shall not, if recalled, be entitled to railway warrants or any repayment in respect of expenses incurred.

(30d) Warrants chargeable to the Department of the Navy may be issued in the following cases:—

(i) Officers and men given Christmas leave at Sydney or Melbourne, in respect to the journey beyond

Adelaide or Brisbane to home, such ranks and ratings themselves meeting the cost of the journey as far as Adelaide or Brisbane.

(ii) Boys on leave from the Training Ship to their homes at Christmas, and on final leave from Training Ship prior to being drafted to sea service, provided that a period of three months has elapsed since return from Christmas leave.

(30e) Ratings discharged—

(i) Time expired.

(ii) For misconduct.

(iii) Invalided.

(iv) Demobilized.

may be granted free railway or steamer warrant to actual place from whence they were originally recruited within the Commonwealth, or to Port Division, as they may elect. Railways are to be used whenever possible.

Ratings discharged at own request whose engagements have not expired must themselves defray the cost of return to actual place whence they were recruited or to their Port Division.”

(4) By omitting sub-regulation (34), as from 1st December, 1919, and inserting in its stead the following sub-regulation:—

“(34) When an Officer or rating is travelling on duty by rail with service baggage in excess of the weight allowed by the Railway Department to be carried free of charge, a railway warrant should be issued to cover such baggage.

Where the weight for which the railway warrant is issued is in excess of weight allowable under the scale prescribed in sub-regulation (31), the Commanding Officer shall see that action is taken to recover the cost of such excess from the officer or rating concerned.”

32. The heading “Allowances to Witnesses at Courts-Martial or Courts of Inquiry” in Part IX. of these Regulations is omitted, as from 1st April, 1919, and the following heading is inserted in its stead:—

“Courts-Martial and Courts of Inquiry.”

33. The heading “Allowances to Officiating Judge Advocates and Provost Marshals at Courts-Martial” in Part IX. of these Regulations is omitted as from 1st April, 1919.

34. Regulation 81a is repealed, as from 1st April, 1919, and the following regulation is inserted in its stead:—

“81a. Courts-Martial and Disciplinary Courts.

The allowances prescribed in King’s Regulations and Admiralty Instructions shall be paid to the Officiating Deputy Judge Advocate or Clerk of Court, and to the Provost Marshal at Courts-Martial,”

35. Regulations 83 and 84 are repealed as from 1st August, 1919.

36. Regulation 85 is repealed as from 1st April, 1920.

37. After regulation 82, the following sub-heading and regulation are inserted as from 1st May, 1920:—

Royal Australian Naval College Staff.

“83. Medical Attendance.—(1) Civilian Masters and Employees, permanently or temporarily employed at the Royal Australian Naval College, also their wives and families, may be granted free medical attendance under the conditions prescribed in regulation 82, sub-paragraphs (a), (b), (d), and (e). Such medical attendance shall form part of the duties of the Surgeon appointed for duty at the College.

The cost of medical attendance for confinements shall not be allowed.

Hospital Accommodation.—(2) Civilian Masters and Employees, their wives and families may, subject to the approval of the Commanding Officer, be admitted to the Hospital at the College. No charge for such accommodation shall be made in respect of the Masters and Employees, but a charge at the rate of 30s. per capita per week shall be made in the cases of wives and families. Such payments shall be brought to account as credits to Navy Revenue.

In admitting such cases into hospital, the Commanding Officer shall be responsible that, at all times, a sufficient number of beds is available for Cadet Midshipmen and other members of the Permanent Naval Forces (Sea-going).

Dental Treatment.—(3) Civilian Masters and Employees may, where circumstances permit, receive free dental treatment by the Dental Surgeon so far as is necessary for the relief of pain only, provided no extra expense to the Department is incurred.”

38. Regulations 86, 87 and 89 are re-numbered, as from 1st May, 1920, 84, 85 and 86 respectively.

39. Regulation 91 is re-numbered, as from 1st May, 1920, as sub-regulation (2) of regulation 90.

40. Regulations 90, 92 and 92a are re-numbered, as from 1st May, 1920, 87, 88 and 89 respectively.

41. After regulation 89 the following regulation is inserted, as from 1st May, 1920:—

“90. Sick Leave.—(1) Sick leave shall be granted only to persons requiring convalescence after a severe illness, operation, or illness due to service in the tropics or in an unhealthy climate and, then, only on the recommendation of a Naval Medical Officer.

(2) The period of sick leave allowable shall be limited to 30 days’ provided that, in exceptional circumstances where there is a reasonable probability of the member returning to duty, the Naval Board may grant an extension of sick leave up to but not exceeding 91 days.

(3) In the case of Officers, the prior approval of the Naval Board shall be obtained to any period of sick leave.

(4) Medical Officers shall be responsible that persons proceeding on sick leave clearly understand that the Department will not be responsible for the payment of any expenses incurred for medical and surgical treatment during sick leave, unless in such exceptional circumstances as may be specially approved by the Naval Board.”

42. Regulations 92b to 92g inclusive are re-numbered, as from 1st May, 1920, in corresponding order, 91, 92, 92a, 92b and 92c.

43. After Regulation 98, the following regulation is inserted, as from 1st June, 1920:—

“98a. Triennial period.—(1) Sick leave allowable under regulations 94, 95 and 97 may be granted in one or more periods, but the aggregate amount of leave provided for in the schedules is intended to cover a  period of three years, commencing from the date of first absence on sick leave.

(2) The second or any subsequent triennial period of sick leave shall commence on the date of the first absence on sick leave following the date upon which the previous triennial period expires, and for the three years thus commencing, the full amount of leave provided in the schedules according to length of service may again be allowed.”

44. Regulation 102a (I.) is re-numbered 102 and amended, as from 1st April, 1920, by omitting the word “salary” in the fourth line of the third paragraph and inserting in its stead the word “pay”.

45. Regulation 102a (II.) is re-numbered 102a, and amended as from 1st April, 1920, by omitting the word “salary” in the third and sixth lines of the third paragraph and inserting in its stead the word “pay”.

46. Regulation 102a (III.) is re-numbered 102b, and amended as from 1st April, 1920, by omitting the word “salary” in the first line and inserting in its stead the word “pay”.
