1953. No. 95

REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1952.*

WHEREAS, by sub-section (4.) of section forty-one of the Naval Defence Act 1910-1952, it is provided that the fixing of rates of salary for persons employed in a civil capacity in pursuance of that section, other than rates fixed by an industrial award, order, determination or agreement, shall be subject to the approval of the Public Service Board:

And whereas the rates of salary specified in the following Regulations have been approved by the Public Service Board:

Now therefore, I, the Governor-General in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1952.

1. Regulation 43 of the Naval Establishments Regulations is amended—

(a) by omitting from the table in sub-regulation (1.) the words and figures

2. Regulation 44 of the Naval Establishments Regulations is repealed and the following regulation inserted in its stead :—

Variations of salary according to variations in the cost of living.

“ 44.—(1.) The rate of salary payable to an officer or employee included in a class of officers or employees specified in the first column of the table in this sub-regulation shall be increased, by reason of variations in the cost of living, by the amount per annum specified in the second column of that table opposite to the description of that class.

“ (2.) Notwithstanding anything contained in the last preceding sub-regulation, if an officer or employee, who has not attained the age of twenty-one years occupies a position in respect of which a rate of salary payable to an officer or employee according to ago is not prescribed, the rate of salary payable to that officer or employee shall be increased as if he had attained that age.”.
