2.—(1.) Where a position specified in the table in sub-regulation (1.) of regulation 43 of the Naval Establishments Regulations as amended by these Regulations is occupied by an officer or employee performing professional duties of an engineering nature and having qualifications—
(
a ) which will admit the officer or employee to graduate member-ship of the Institution of Engineers (Australia); or
(
b ) which in the opinion of the Naval Board are appropriate to discharge efficiently the duties of the position,
the Naval Board may, by instrument in writing, alter the designation of the position to the designation of “Engineer, Class 1”, “Engineer, Class 2”, “Engineer, Class 3”, “Engineer, Class 4” or “Engineer, Class 5”.
(2.) The limits of rates of annual salary of a position re-designated under the last preceding sub-regulation shall be the limits specified in relation to the designation to which the position is altered in the table in sub-regulation (1.) of regulation 43 of the Naval Establishments Regulations as amended by these Regulations.
(3.) An officer or employee who has performed, for the whole or a part of the prescribed period, the duties of a position the limits of rates of annual salary of which have been raised by reason of the preceding provisions of this regulation shall be paid an allowance of such amount as will have the effect of raising his total remuneration in respect of the whole or part, as the case may be, of that period to the remuneration that he would have received if he had been, during that period or during that part of that period, occupying a position having the same limits of rates of annual salary as the limits of rates of annual salary to which the position the duties of which he performed during that period or part of that period have been raised.
(4.) In the last preceding sub-regulation, “the prescribed period” means the period commencing on the twenty-ninth day of June, 1961, and ending on the day immediately before the day upon which the position is re-designated.
3.—(1.) In this regulation, “junior position” means a position in relation to which rates of annual salary according to age are specified opposite to the designation of the position in the table in sub-regulation (1.) of regulation 43 of the Naval Establishments Regulations as in force immediately before the commencement of these Regulations.
(2.) Where the rates of annual salary specified in the Naval Establishments Regulations in relation to a junior position were, immediately before the commencement of these Regulations, lower than the rates specified in relation to the corresponding position in the table in sub-regulation (1.) of regulation 43 of the Naval Establishments Regulations as amended by these Regulations, an officer or employee who has, during the whole or part of the period commencing on the fifth day of October, 1961, and ending on the day immediately before the day of commencement of these Regulations, performed the duties of that junior position shall be paid an allowance of such amount as will have the effect of raising his total remuneration in respect of the whole or part, as the case may be, of that period to the remuneration that he would have received if the amendments made by these Regulations had come into operation on the fifth day of October, 1961.
