REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1965.*
I, THE
GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the
advice of the Federal Executive Council, hereby make the following
Regulations under the Naval Defence Act 1910-1965.

Amendments of the Naval Establishments
Regulations
1. Regulation 43 of the Naval
Establishments Regulations is repealed and the following regulation inserted in
its stead:—
Rates of pay and increments.
" 43.—(1.) The
rate of annual salary or the scale of rates of annual salary payable to a
person who occupies a position the designation of which is specified in the
second column of Part I. or Part II. of the Third Schedule to these Regulations
is, subject to this regulation, the rate of annual salary or the scale of rates
of annual salary specified in the third column of that Part opposite to the
designation of the position occupied by the person.
" (2.) A person
occupying the position of—
(a) Foreman (Storehouse and Laboratory), Grade A;
(b) Foreman (Storehouse and Laboratory), Grade B;
(c) Foreman (Storehouse and Laboratory), Grade C;
(d) Storehouseman;

may, if he is employed in a
magazine or explosives store, be paid at the rate of Thirty pounds per annum in
addition to the rate payable to him under sub-regulation (1.) or sub-regulation
(14.) of this regulation.
" (3.) The rate of annual salary or each of the
rates in a scale of rates of annual salary applicable to a position specified
in Part I. of the Third Schedule to these Regulations stall, in relation to a
female officer occupying that position, be deemed to be One hundred and
fifty-four pounds less than the rate applicable in relation to a male person
occupying that position.
" (4.) Where a scale of rates of salary
prescribed under this regulation is applicable in relation to a person
occupying a position the designation of which is specified in the second column
of Part I. or Part II. of the Third Schedule to these Regulations, the person
may, subject to this regulation, be paid increments of salary in accordance
with that scale.
" (5.) Subject to this regulation, a person is
not entitled to receive an increment of salary until he has received salary
without the increment for not less than twelve months.
" (6.) The date from which a person is entitled to receive an increment
of salary is not affected by—
(a)
variations of a rate of salary made in
pursuance of regulation 44 of these Regulations; or
(b)an
alteration of the rate in the scale of rates applicable to a position occupied
by the person, being an alteration in relation to which the Naval Board
determines the last preceding sub-regulation does not apply.
" (7.) A person who has been absent on leave of
absence without pay for a period that forms or is to be deemed to be included
as, part of his service for all purposes or for the purpose of the granting of
increments shall, for the purposes of this regulation, be deemed to have
received his salary during that period and also to have received any increments
of salary that would have been paid to him during that period under the
preceding provisions of this regulation if he had been receiving salary.
" (8.) If, having regard to the conduct,
diligence, efficiency or attendance for duty of a person during the period
after which he is entitled to receive an increment of salary, the Secretary is
of opinion that the person should not immediately receive that increment, the
Secretary may, by order in writing, direct that the increment shall not be paid
until the expiration of such period as he thinks fit, and, in that case,
payment of the increment shall be deferred until the expiration of that period.
" (9.) A person in relation to whom the Secretary
has made an order under the last preceding sub-regulation may appeal to the
Minister and the Minister shall, after inquiry, determine the appeal.
" (10.) An
appeal under the last preceding sub-regulation shall be lodged with the
Secretary, who shall forward it to the Minister.
" (11.) Where a person who is transferred or
promoted to a position specified in the Third Schedule to these Regulations is
already in receipt of pay at a rate higher than the minimum rate prescribed in
that Schedule in relation to that position, his transfer or promotion shall be
effected, unless the Naval Board otherwise determines, without reduction of
pay.
" (12.) The scale of rates of annual salary payable to a person
occupying the position of—
(a) Pharmacist, Grade 2;
(b) Pharmacist, Grade 1;
(c) Physiotherapist, Grade 2;
(d) Physiotherapist, Grade 1;
(e) Social Worker, Grade 3;
(f) Social Worker, Grade 2; or
(g) Social Worker, Grade 1,
in a State or Territory of the Commonwealth is the
scale of rates of annual salary payable to an officer, within the meaning of
the Public Service Act 1922-1964, performing like duty in that State or
Territory.
" (13.) The
provisions of sub-regulations (3.), (4.), (5.), (6.), (7.), (8.), (9.), (10.)
and (11.) of this regulation apply to and in relation to a person
occupying a position referred to in the last preceding sub-regulation as if—
(a) the designation of that position were
specified in the Third Schedule to these Regulations; and
(b) the
scale of rates of annual salary applicable under the last preceding
sub-regulation were specified in the third column in that Schedule opposite to
that designation.
" (14.) Where a
person occupies a position the designation of which is specified in the first
column of the table in the Fourth Schedule to these
Regulations is of an age specified in the second column of that table opposite
to that designation, the person is entitled to be paid salary at the annual
rate of salary specified opposite to that age, if the person is a male, in the
third column of that table or, if the person is a female, in the fourth column
of that table.
" (15.) A reference in this regulation to a
person is a reference to an officer, temporary officer or employee, as the case requires.".

2. The Naval Establishments Regulations are
amended by adding at the end thereof the following Schedules:—
