STATUTORY RULES

1966 No. 135

REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1965.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1965.

Amendments of the Naval Establishments Regulations 

Rates of pay and increments.

1. Regulation 43 of the Naval Establishments Regulations is amended by omitting sub-regulation (6.) and inserting in its stead the following sub-regulation:—

" (6.) The date from which a person is entitled to receive an increment of salary is not affected—

(a)by a variation of the rate of his salary effected by regulation 44 of these Regulations; or

(b)by an alteration of the rate or the scale of rates applicable to a position occupied by the person, being an alteration in relation to which the Naval Board determines that the last preceding sub-regulation shall not apply.".

Variation of salaries.

2. After regulation 43a of the Naval Establishments Regulations the following regulation is inserted:—

" 44.—(1.) The rate of annual salary otherwise payable to an officer or employee included in a class of officers or employees specified in the first column of the table in this sub-regulation shall, subject to this regulation, be increased by the amount per annum specified in the second column of that table opposite to the description of that class of officer or employee.

" (2.) The salary payable to an officer or employee who has not attained the age of twenty-one years shall be increased as if that officer or employee had attained that age if the officer or employee occupies a position in respect of which rates of salary payable to an officer or employee under the age of twenty-one years occupying such a position are not prescribed.

" (3.) In the last two preceding sub-regulations, a reference to an officer shall be read as including a reference to a temporary officer.".

Third Schedule.

3.—(1). The Third Schedule to the Naval Establishments Regulations is amended—

(a)by omitting items 19 and 20 and inserting in their stead the following items:—

(2.) The scale of rates of annual salary specified in relation to a position in item 19 or item 20 of the Third Schedule to the Naval Establishments Regulations, as amended by these Regulations, applies to and in relation to service in that position on and after the twenty-sixth day of May, 1966.

(3.) A person who occupied a position specified in item 19 or item 20 in the Third Schedule to the Naval Establishments Regulations during the period from and including the eighth day of July, 1965, to and including the twenty-fifth day of May, 1966, or a part of that period, is, by virtue of this sub-regulation, entitled to be paid additional salary in respect of that period or that part of that period of an amount equal to the amount by which the salary paid or payable to him by virtue of regulation 43 of the Naval Establishments Regulations in respect of that period or that part of that period is less than the salary that would have been payable to him if he had been entitled to be paid salary in accordance with the following scale of rates of annual salary, but otherwise in accordance with the Naval Establishments Regulations:—

$3,384-$3,508-$3,632-$3,756.

 

4. Regulations 43 and 44 of the Naval Establishments Regulations as amended by regulations 1 and 2 of these Regulations apply to salary payable to an officer or employee in respect of the twenty-first day of July, 1966, and any subsequent day.
