REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1918.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act1910-1918, to come into operation forthwith.

NAVAL COLLEGE REGULATIONS.

Part I.—Preliminary.

Citation.

1. These Regulations may be cited as the Naval College Regulations.

Repeal.

2. The Regulations for the Royal Australian Naval College (Statutory Rules 1916, No. 61, as amended to present date) are hereby repealed, save as to any right, privilege, obligation, or liability accrued or incurred thereunder.

Parts.

3. These Regulations are divided into Parts as follows:—

Part I.—Preliminary.

Part II.—Conditions of Entry and Service.

Part III.—Command, Staff, &c.

Part IV.—Leave of Absence.

Part V.—Cadet Midshipmen.

Part VI.—Canteen.

Part VII.—General.

Definitions.

4. In these Regulations, unless the contrary intention appears—

“Captain” means the officer appointed by the Naval Board to command the Naval College;

“Commanding Officer” means the officer in actual command of the College at the moment.

“Cadet Midshipman” is a designation of rank equivalent to that of “Naval Cadet” in the Royal Navy, and means a youth entered at the Naval College for training as a Naval officer.

“Accountant Officer” means the officer in charge, under the Commanding Officer, of duties concerned with cash, victualling and clothing.

Objects of College.

5. The Royal Australian Naval College is established under the authority of the Naval Defence Act1910-1918, for the training of Naval officers.

Part II. Conditions of Entry and Service.

Qualifications for Candidates.

Personal requirements.

6. (1)A candidate for entry to the Naval College must be the son of natural-born or naturalized British subjects, and be substantially of European descent, the burden of proof in a doubtful case resting upon the parents or guardians of the candidate.

Form of application.

(2) Every candidate shall furnish an application for entry on the prescribed form, and shall attach to his application—

(a) A certified extract from the register of his birth, or if this is not obtainable, a certificate of his baptism or other documentary evidence, accompanied by statutory declaration made by his parents or guardians before a justice of the peace, stating the exact date of birth;

(b) A certificate of good moral character, signed by the clergyman of the place of worship he usually attends, orby a prominent citizen who is personally acquainted with the candidate;

(c) A certificate of conduct and ability signed by the head of the school at which he has been educated during the two preceding years at least, and if he should have attended more than one school during that period, a certificate must be obtained from each school.

Age of entry.

7. A candidate for entry to the Naval College must attain the age of thirteen (13) years during the calendar year in which the entrance examination is held.

Assurances required of parents.

8. Parents or guardians, who must be domiciled in Australia or be native-born Australians temporarily residing elsewhere, must declare in writing their intention that the candidate, should he be successful in entering as Cadet Midshipman, will adopt the Navy as his profession in life, and candidates shall be accepted only upon this condition.

Educational Examination.

Date of educational examination.

9. The qualifying Educational Examination for entrance to the College shall be held annually, generally in September, on a date which shall be notified to candidates by the Secretary of the Navy Office.

10. A candidate who, for any reason, is unable to sit for the qualifying Educational Examination shall be considered to have forfeited his candidature.

Interviewing Committee.

11. Every candidate who passes the qualifying Educational Examination shall be required to present himself before a Committee, the constitution of which is detailed in regulation 14, where he shall be separately interviewed with the object of ascertaining his suitability or otherwise for the Naval Service. A candidate who is prevented by illness from appearing before the Interviewing Committee shall be dealt with according to the individual merits of his case.

Medical Examination.

Physical requirements.

12. (1)Every candidate must be in good health, free from any physical defect of body, impediment of speech, defect of hearing, and also from predisposition of constitutional or hereditary disease or weakness of any kind, possess full normal vision as determined by the prescribed tests, and be in all respects well developed and active in proportion to his age.

(2) A candidate who possesses a slight remediable defect must have such defect remedied before he attends before the Naval Medical Officers at the time of interview, when no allowance will be made for any prospective remedial operation and the existence of any such defect shall be a reason for the final rejection of the candidate.

(3) The decision of the Naval Medical Officers examining at the interview is final, and shall be accepted without question.

Dental treatment.

13. A successful candidate should undergo dental treatment of unsound or defective teeth before joining the College. In the event of a Cadet Midshipman requiring dental treatment during the first six months at the College, the cost of such treatment shall be borne by the parents or guardians.

Interviewing Committee.

Personnel.

14. The Interviewing Committee is composed of the following, subject to alteration if desirable, by the Naval Board:—

the Captain of the Naval College;

a Captain or Commander;

an Officer of the Professorial Staff;

and two Naval Medical Officers,

and will sit at properly advertised dates at such capital cities of the Commonwealth as the Naval Board may decide upon.

Candidates attending for interview in other States.

15. A candidate from a State which is not included in the itinerary of the Interviewing Committee, or from the Northern Territory or Papua, may be required to undergo a provisional interview in the capital city of such State or Territory, before a Provisional Committee which shall be appointed by the Naval Board. A candidate who succeeds in passing the Provisional Committee, or in the absence of a provisional interview, who is successful at the qualifying educational examination in such State or Territory, shall be required to present himself before the Interviewing Committee at a place appointed.

Travelling expenses.

16. (1)In those cases only where a candidate is brought from one State to another to suit the convenience of the Interviewing Committee, cost of rail or steamer fares and travelling allowance at the rate of 10s. per day shall be allowed, such allowance to cover all expenses other than rail or steamer fares.

(2) When travelling by steamer or other vessel on which the fare paid includes subsistence, one-quarter of the above rate of travelling allowance shall be paid.

Special Cadetships.

Sons of sailors and soldiers.

17. (1) Two of the annual vacancies for Cadetships at the College shall be reserved for candidates who are the sons of persons who have been on active service, abroad in the Royal Australian Navy or in an Expeditionary Force raised under the provisions of the Defence Act. These special nominations shall be made from candidates in each of the following classes, in the order of priority shown:—

(a) The sons of persons who have lost their lives or become totally incapacitated on active service abroad;

(b)The sons of persons who have been on active service abroad with the Royal Australian Navy;

(c) The sons of persons who have been on active service abroad with an expeditionary force raised under the provisions of the Defence Act.

(2) Candidates eligible under these conditions must qualify at the Educational Examination, and be recommended as suitable by the Interviewing Committee, and, except as provided in sub-regulation (3), shall compete for these special cadetships with candidates in their own particular class only.

(3) Candidates who are unsuccessful in obtaining a special cadetship shall be considered on their merits, with the ordinary candidates, for nomination to an ordinary cadetship.

(4) In the event of a vacancy for a special cadetship not being filled owing to dearth of qualified candidates, it will be allotted to a nominee from among the ordinary candidates.

Boys from Tingira.

18. (1) Boys from H.M.A.S. Tingira shall be allowed to enter the Naval College under the conditions prescribed in the following sub-regulations:—

(2) Candidates for entry shall be not more than sixteen years of age on the first day of January of the year following the date of their selection, and they will be required to pass an examination in the following subjects:—

(a) Seamanship.—Up to standard of 1st and 2nd year Cadet Midshipmen.

(b) Mathematics

(c) Physics Up to the standard of 1st year Cadet Midshipmen.

(d)English

(e) Geography

The papers for this examination shall be set, corrected and marked at the Naval College, the results being communicated to the Commanding Officer, H.M.A.S., Tingira.

(3) This examination may be held at any time during the year, at the discretion of the Commanding Officer, H.M.A.S. Tingira, who will request the Captain to set the papers. The selection of candidates to sit for the examination is the responsibility of the Commanding Officer, H.M.A.S. Tingira.

(4) On receipt of the results of the examination from the Naval College, the successful candidates shall appear before a Selection Committee consisting of the following officers:—

Commanding Officer, H.M.A.S. Tingira;

First Lieutenant or Lieutenant-Commander; and

Chaplain,

who will select the number of entrants required. The boys selected shall be chosen primarily for:—

(a)personality, strength of character;

(b) intellect;

(c) physical fitness, aptitude for games, &c.,

and marks shall be awarded in the following ratios:—

(a)50 per cent.;

(b)40 per cent.;

(c)10 per cent.

(5) The Selection Committee shall refer their recommendations to the Naval Board for decision.

(6) Successful candidates joining the Naval College after the date of commencement of the first College term of the year shall be classed with the “First Year” Cadet Midshipmen. Those candidates who join on or before that date shall be classed with the “Second Year” Cadet Midshipmen.

Entry to the College.

Nominations to be made by Minister.

19. Nominations for entry to the College shall be made by the Minister for the Navy, upon the recommendation of the Naval Board, from such candidates as are considered most suitable by the Interviewing Committee, and who have passed the qualifying examination in the educational subjects.

Names published in Gazette.

20. The names of candidates who are selected for appointment as Cadet Midshipman shall be published in the Commonwealth of Australia Gazette in alphabetical order, and all candidates shall be informed whether they have passed or failed in their examination and whether they have been selected for appointment.

Conditions of Service.

Engagement.

21. On the entry of a Cadet Midshipman to the Naval College, one of his parents or guardians shall be required to execute an engagement that he will serve in the Royal Australian Navy for a term of twelve years from the date of his attaining the age of eighteen years, in addition to whatever period of service shall be necessary until he reaches that age.

Conditions of service identical in all cases.

22. (1)All Cadet Midshipmen shall enter the Naval Service under identical conditions of service, and shall be trained together until passing for the rank of Lieutenant.

(2) Cadet Midshipmen, after passing for the rank of Lieutenant, will be required to serve either as general service officers or to specialize in engineering, gunnery, torpedo or navigation.

(3) Subject to the discretion of the Naval Board, and to the requirements of the service, officers will be allowed to choose the branch in which they desire to specialize.

Period of training is probationary.

23. (1)The period of training at the Naval College and on the Training Cruiser, is probationary, and the parents or guardians of every successful candidate shall be required to sign a declaration on his admission as Cadet Midshipman, to the effect that he shall be immediately withdrawn on the receipt of an official request for his withdrawal.

(2) A Cadet Midshipman who fails to attain a certain standard during any period of his training, or who is considered unsuitable for the Naval Service, may be required to withdraw at any time.

(3) The foregoing sub-regulation shall apply to a Cadet Midshipman who does not show an aptitude for naval life or whose constitution is weak, although no disease may have developed.

(4) When a Cadet Midshipman is found to be making unsatisfactory progress a letter shall be sent warning his parents or guardians, of the possibility of a withdrawal being necessary.

(5) A Cadet Midshipman may be required to withdraw at any time on account of unsatisfactory conduct.

Withdrawals.

24. No Cadet Midshipman shall be allowed to withdraw from the Naval College or the Instructional Cruiser without the consent in writing of the Naval Board.

Penalties for withdrawal without consent.

25. (1)In the case of a Cadet Midshipman who withdraws from, refuses, or fails to continue his training in, or leaves the Naval College or Instructional Cruiser without the approval of the Naval Board, a penalty of £75 for each year’s training undergone or proportionately for portion of a year, may be imposed on the parents or guardians of such Cadet Midshipman.

(2) Any sums paid under this regulation shall be credited to Navy —Revenue.

Cost of maintenance borne by Commonwealth

26. The cost of maintenance of a Cadet Midshipman after joining the College shall be borne by the Commonwealth.

Training.

Period of training.

27. The period of training for a Cadet Midshipman shall be four years at the Naval College followed by, if practicable, six months’ training in an Instructional Cruiser, except as provided in regulation 28.

Training may be reduced.

28. The Governor-General may, on the, recommendation of the Naval Board, at any time direct that the period of training at the College be reduced and the Instructional Cruiser training be omitted, in order that a Cadet Midshipman may be appointed for duty in the Fleet, provided that no Cadet Midshipman shall be so appointed until he has completed nine terms at the College.

On Leaving College.

Pay on promotion.

29. A Cadet Midshipman on appointment to the rank of Midshipman shall receive the pay and allowances prescribed for that rank in the Naval Financial Regulations.

30. (1)On leaving the Naval College for service in the Sea-going Forces, each Cadet Midshipman shall be supplied at Government expense with those articles which are required to complete his outfit for sea service, the following articles being supplied on loan:—

1 dirk and belt,

1 pair binoculars, prism,

1 telescope,

1 sextant.

(2) On the Officer being rated Acting Sub-Lieutenant, or on his discharge from the Service, the dirk and belt shall be returned to the Naval Store Officer, Sydney.

(3) The other articles on loan are to be returned to the Naval Store Officer, Sydney, in the following events:—

(a) On the discharge from the Service of an Officer before attaining the rank of Lieutenant.

(b)On an Officer finally qualifying for specialization in Engineering.

On promotion to the rank of Lieutenant, these articles shall become the personal property of the Officer.

(4) In the event of loss or damage, these articles shall be replaced at the Officer’s own expense unless it is proved that the loss or damage was caused by circumstances beyond his control.

(5) The instruments shall be inspected quarterly by the Commanding Officer of the Ship in which Junior Officers are serving, and he shall satisfy himself that they are in good condition.

Part III.—Command, Staff, etc.

Captain.

Captain of College.

31. The Naval College shall be under the command of the Officer appointed by the Naval Board for that purpose. He shall report direct to the Naval Board on all matters connected with the College.

Absence of Captain.

32. In the absence of the Captain, the next senior commissioned Naval Officer of the Military Branch on duty at the time shall control the College.

Authority of Captain.

33. (1) The Captain is authorized to issue such Standing and Routine Orders and Instructions as he may deem necessary, provided that such Orders and Instructions are not opposed to any of the provisions of the Naval Defence Act 1910-1918 and these Regulations.

(2) He is further authorized to assign quarters at the College.

34. Provided that—

(a)provision made on the Estimates will not be exceeded and the requirements for the remaining period of the financial year will not involve the necessity for applying for additional provision on any vote concerned;

(b)certificate has been inserted by the local Certifying Officer that funds are available under his control, or by the Director of Navy Accounts that funds can be made available;

(c) the expenditure is not under a new vote or item;

(d)it does not involve any alteration in the existing rules or practice;

(e) there is nothing irregular in the character of the expenditure;

(f) it is not an allowance or payment to any member of the Department except such as is governed by Regulations and does not require Naval Board approval,

the Captain is further vested with authority as follows:—

(i) To approve of demands upon Naval Store Depots for stores allowed by Establishment;

(ii) To approve of requisitions for the purchase of Stores not exceeding £5 in any one order or £25 in any one month;

(iii) To approve of expenditure other than for stores, not exceeding £25 in any one case, under Contingencies;

(iv) To approve of the employment of casual labour (non-clerical), but no person is to be employed under this authority for any longer time than an aggregate period of six (6) weeks in any financial year without the approval of the Naval Board; and

(v) To approve of the purchase of fresh provisions required for victualling personnel under the General Messing System.

Professorial Staff have no executive Authority.

35. No Officer of the Professorial Staff of the College may exercise any executive (military) command.

Board of Studies.

Constitution.

36. A Board of Studies, constituted as follows:—

President—The Captain of the College.

Members—The Senior Lieutenant,

The Senior Engineer Officer, and

The Senior Officer of the Professorial Staff of each of the following Departments, viz.:—

(i) Navigation and Mathematics,

(ii) Science,

(iii) The Humanities,

shall prepare the Syllabus of Instruction for each year, conduct all examinations of Cadet Midshipmen, and generally arrange the course of studies at the College.

Professorial Staff.

Complement.

37. The Professorial Staff of the College shall be as provided on the Estimates, the complement being approved by the Naval Board.

Appointment.

38. (1) The appointment of an officer of the Professorial Staff shall be made under section 41 (1) (c) of the Naval Defence Act 1910-1918, on the recommendation of the Board of Studies. The appointment shall be on probation for one year, at the end of which period subject to the recommendation of the Board of Studies, it shall be confirmed.

(2) An officer of the Professorial Staff is required to enter into an agreement with the Naval Board that—

(a)Subject to satisfactory performance of his duties, of which the Board of Studies shall be the sole judge, the appointment shall be for a period of not less than three years;

(b)The agreement may be terminated after the expiration of three years, by six months’ notice on either side, provided that in special cases the period of notice may be reduced to three months and that in such cases the notice shall not be given during a vacation;

(c) On the recommendation of the Board of Studies, the appointment may be terminated summarily at any time for misconduct, physical unfitness, or unsatisfactory performance of duty.

Classification and pay.

39. (1) The Professorial Staff shall be classified in three grades as follows:—

(i) Head Master,

(ii) Senior Master, and

(iii) Assistant Master,

and officers shall receive the consolidated rates of pay and allowances provided in the Naval Financial Regulations for Commander, Lieutenant-Commander, and Lieutenant respectively, in the Royal Australian Naval Auxiliary Services.

Retirement.

(2) An officer of the Professorial Staff shall be compulsorily retired on account of age under the same regulations as apply to Commanders, Lieutenant-Commanders, and Lieutenants respectively in the Royal Australian Naval Auxiliary Services.

Promotion.

40. Except in special circumstances, a vacancy for Senior Master shall be filled by the promotion of an Assistant Master, provided that no Assistant Master shall be eligible for promotion to Senior Master until he has served as Assistant Master for eight years.

Dress.

41. An officer of the Professorial Staff shall not wear uniform, but during the hours of study shall wear the academical dress of cap and gown.

Rank.

42. An officer of the Professorial Staff shall not hold any Naval Rank, but shall retain the position to which his office would entitle him in civil life, and for purposes of messing and accommodation shall be classed as a Ward Room Officer.

No outside business to be engaged in.

43. An officer of the Professorial Staff shall not engage in any outside business or profession, be permitted to prepare candidates for admission to the College, nor accept fees for private instruction either in terms or during vacation.

Staff to instruct in any subject required.

44. An officer of the Professorial Staff shall at any time, if required by the Captain, afford assistance in any branch of instruction outside his ordinary sphere of duties at the College.

Officers of Instructor Branch of Permanent Naval Forces.

45. An officer of the Instructor Branch of the Permanent Naval Forces (Sea-going) may be appointed to the Professorial Staff of the College alternatively with a sea-going appointment. Whilst holding an appointment at the College such an officer shall be borne on the books of the Franklin at sea-going rates of pay and allowances prescribed for his rank, and shall be subject to the regulations of the Service, and Captain’s orders for the Royal Australian Naval College.

Naval Officers.

Naval officers.

46. Naval Officers appointed to the Staff of the College shall rank according to the regulations of the Service.

Part IV.—Leave of Absence.

Staff.

Terms at College.

47. The College year shall be divided into three terms, and vacations shall be as follows:—

At end of 1st term (about beginning of May).......................... 4 weeks

At end of 2nd term (about beginning of September)................ 2 weeks

At end of 3rd term (about middle of December)...................... 7 weeks

Leave during vacation.

48.(1) The Captain may, subject to the provisions of sub-regulation (2), grant leave of absence to members of the Staff whose services can be spared, for the entire period of the suspension of ordinary academic studies, notwithstanding anything contained in the Naval Forces Regulations or other Naval Regulations limiting the amount of leave to be granted in one year.

R.N. personnel.

(2) In regard to Officers and Men on loan from the Royal Navy, the provisions of the Naval Forces Regulations in regard to leave shall apply, provided that for any time served at the Naval College, additional leave at the rate of fourteen (14) days per annum may be allowed without reduction of the accumulated leave due on return to the United Kingdom.

Cadet Midshipmen.

Relatives or friends to receive Cadets during long vacations.

49. The friends or relatives of a Cadet Midshipman must be prepared to receive him during both long vacations, or to make arrangements for his reception, and the name and address of the friend or relative with whom the Cadet Midshipman will spend the vacation must be communicated to the Captain at least a month before the commencement of the vacation.

Health certificate to be provided after vacation.

50. Every Cadet Midshipman, on returning to the College after vacation, shall be required to produce a health certificate, signed by his parent or guardian and dated not earlier than the day before he left his home or temporary place of residence, to the effect that so far as is known he has not for at least three weeks immediately preceding his return, or during the time he has been on leave, if less than that period, been exposed to any infectious disease, or entered any house where such disease has existed. If a Cadet Midshipman is granted permission to break his journey on return to the College to stay with relatives or friends, the health certificate is to be indorsed and dated by such relatives or friends when he leaves for the College. A form of certificate shall be sent to each parent, and failure on the part of the Cadet Midshipman to produce this Certificate duly completed and signed shall entail his not being received at the College. In such cases the Cadet Midshipman shall be placed under observation in the sick quarters, during which time he will receive no instruction and the cost of his upkeep at the rate of 6s. per day shall be charged against the parents or guardians.

Illness During Leave.

Medical certificate to be provided giving particulars.

51. Should a Cadet Midshipman be taken ill during leave of absence from the College, the fact shall be reported immediately to the Commanding Officer, and a Medical Certificate giving particulars of the ailment forwarded. A Medical Certificate must also be forwarded reporting his recovery from sickness.

Medical expenses whilst on leave not borne by Government.

52. The expense of medical or dental attendance incurred on leave will not be borne by the Government except in special cases where such attendance was advised by the College authorities in writing.

Inability to rejoin College on expiration of leave to be reported.

53. If a Cadet Midshipman is unable upon the expiration of his leave, to rejoin the College upon the appointed date owing to illness beyond his control, a Medical Certificate to that effect should be immediately furnished, and the Captain advised weekly as to his progress. In such cases a sick allowance at the rate of 6s. per day, dating from the commencement of the term shall be paid from Naval funds to the parents or guardians upon receipt of the Medical Certificate

Part V.—Cadet Midshipmen.

Pay, Pocket Money, &c.

On Instructional Cruiser.

54. (1) Whilst undergoing training on board the Instructional Cruiser, a Cadet Midshipman shall receive the pay and allowances prescribed in the Naval Financial Regulations for Midshipmen as from the date of embarkation.

At Naval College.

(2) During the time he is at the College, a Cadet Midshipman shall receive no pay, but shall be allowed the sum of 1s. per week as pocket money.

Stoppage of pocket money.

(3) Pocket money shall be liable to stoppage for punishment for periods not exceeding five consecutive weeks.

Good conduct allowances.

55. In addition to pocket money, good conduct allowances at the rates shown below shall be awarded to each Cadet Midshipman of uniformly exemplary conduct. Any serious offence shall entail the stoppage or reduction of this allowance. The qualifications necessary for the award of good conduct allowance shall be determined by the Captain.

The amount specified is in each case the total amount of good conduct allowance.

Pocket money for Cadet Captains.

56. Chief Cadet Captains and Cadet Captains shall receive 1s. 6d. and 1s. respectively extra pocket money weekly.

Custody of Private Funds.

Bank conducted by Accountant Officer.

57. The Accountant Officer shall conduct a bank for the safe custody of private money belonging to Cadet Midshipmen.

Sums in excess of five shillings not to be retained.

58. Except when undergoing training on board the Instructional Cruiser, a Cadet Midshipman shall not be allowed to retain in his possession sums exceeding 5s. All money in excess of this amount shall be deposited in the bank.

Hours of business of bank.

59. The bank shall be open on certain days of the week at fixed hours for deposits and withdrawals.

Limitation of withdrawals.

60. Withdrawals shall be limited to 2s. per week, except in special cases, when permission to withdraw an additional amount must be obtained from the Lieutenant of the Year.

61. A Cadet Midshipman under stoppage of pocket money shall not be permitted to make withdrawals from the bank.

Outfit

62. (1) The kit of a Cadet Midshipman shall be comprised of such articles as are approved by the Naval Board. The articles shall be issued free to each Cadet Midshipman, and maintained at Government expense.

Loss or damage.

(2) Any loss of or damage to kit resulting from the neglect or carelessness of a Cadet Midshipman shall entail forfeiture of pocket money for a period not exceeding five consecutive weeks, and any balance of cost of replacement, may on the recommendation of the Captain and with the approval of the Naval Board, be charged against his parents or guardians.

(3) Clothing or other items of kit left about in improper places shall be taken charge of by the Cadet Gunner, and a fine of 1d. for each article shall be charged against the weekly pocket money of the Cadet Midshipman concerned prior to its restoration.

Laundry.

63. (1)A laundry for the washing of clothing, mess linen, &c., of Cadet Midshipmen shall be conducted at the College under the supervision of the Cadet Gunner, assisted by the Matron. Washing other than that of Cadet Midshipmen shall be charged for at the rate of 2s. per dozen and the money so obtained shall be credited to revenue.

(2) When undergoing training in the Instructional Cruiser and entitled to pay in accordance with the provisions of regulation 54, a Cadet Midshipman shall be required to make his own arrangements in respect of laundry.

Victualling.

Scale of messing.

64. Each Cadet Midshipman shall be victualled in accordance with the General Messing System as laid down in the Naval Financial Regulations, except that the amount allowed per head shall be 2s. 4d. per day in lieu of 2s. The Accountant Officer shall make the necessary arrangements to supply suitable meals and shall submit a weekly bill of fare for the approval of the Captain.

No allowance in lieu during vacation.

65. No allowance in lieu of rations shall be credited or paid to a Cadet Midshipman during the time that he is absent from the College or Training Cruiser on short leave or during vacations.

66. (1) An officer or employee of the Department of the Navy required to attend at the College in his official capacity and entitled to Travelling Allowance under Regulations shall be personally responsible to the Mess caterer for repayment of cost of his messing, if any, whilst at the College.

(2) When an Officer or employee of a State Department or a private individual visits the College on official business at the request of the Department of the Navy, the cost of his messing whilst at the College may, on the approval of the Naval Board, be borne from Government Funds.

Travelling Expenses.

No allowance prior to entry.

67. Before entry to the College no expenses for passages or travelling shall be allowed to a candidate except as prescribed in regulation 16.

Rate.

68. The rate of travelling allowance for a Cadet Midshipman shall be an inclusive allowance of 10s. per day, calculated in the manner prescribed in the Naval Financial Regulations.

On entry.

69. On first entry to the College, a Cadet Midshipman shall be granted a first-class passage from place of residence thereto, and in addition travelling allowance at the rate prescribed in regulation 68.

During vacations.

70. When proceeding on leave during vacations, a Cadet Midshipman shall be provided with a first-class return ticket, and except when provided with meals, shall be granted travelling allowance for the journey home and for the return journey to the College.

Meals.

71. When meals are provided, no travelling allowance shall be paid.

Prizes, Honours, &c.

Examinations, &c.

72. In all subjects of instruction the principle of awarding merit marks for current work shall be followed. At the end of each term the proficiency of each Cadet Midshipman shall be tested, partly by examination and partly by marks gained for current work. An examination shall be held at the end of each year’s service, and each Cadet Midshipman’s progress at the end of the second year shall be given particularly careful scrutiny.

Graining time for promotion.

73. On leaving the College it will be possible for a Cadet Midshipman to gain time as a Sea-going Midshipman in proportion to the merit of his examination and previous record at the College, the maximum amount of time which it shall be possible to gain being three months.

Prizes.

74. (1) The following prizes shall be awarded and shall be competed for by each Cadet Midshipman in the final year of his course at the College.

The cost of these prizes shall be defrayed from the College vote.

(2) No Cadet Midshipman shall be allowed to receive more than two prizes, and in cases where a Cadet Midshipman qualifies for more than two, the Captain, after consultation with the Board of Studies, shall decide the award.

Presentations to Cadet Captains.

75. Each Chief Cadet Captain and Cadet Captain, on finally passing out from the College for duty in the Permanent Sea-going Forces, may, on the approval of the Naval Board, be presented with a token of appreciation of his services. The cost of such presentation shall not exceed 50s. for a Chief Cadet Captain, and 40s. for a Cadet Captain, and shall be chargeable to the Contingency Vote.

Chief Cadet and Cadet Captains.

76. Cadet Midshipmen selected in regard to their ability to assist the Officers in maintaining the discipline and good order of the College may be rated Chief Cadet Captain and Cadet Captain by the Captain from time to time as is considered necessary.

77. The Accountant Officer shall obtain from each Cadet Midshipman winning a prize or presented with a token, in accordance with the provisions of regulations 74 and 75 respectively, a receipt for the articles so awarded, and such receipt shall be attached to the voucher covering the purchase of the prize or token, as the case may be.

Cadets’ Fund.

Amount of fund.

78. (1) The Cadets’ Fund shall consist of a capitation grant, of £2 per annum per capita, based upon the number of Cadet Midshipmen in the College on the 30th June of the preceding year, and of any canteen rent or sum received in accordance with the provisions of regulation 97 of these Regulations.

(2) Payment on account of the capitation grant shall be made quarterly, in advance, upon voucher drawn in favour of the Accountant Officer, and approved by the Captain, the charge being made to the Contingencies Vote.

Purposes of fund.

79. The Cadets’ Fund shall be used for the purposes of providing cricket, football, athletics, tennis, swimming, regatta, and other outdoor sports, indoor games, photography, and amusements in general for Cadet Midshipmen, and prizes therefor; also for the upkeep of the sports gear and cost of publishing the College magazine.

Administration.

80. The administration of the Fund shall be under the control of the Captain.

81.(1) The Accountant Officer shall be responsible for the proper accounting for the money belonging to the Fund and for the Cadets’ Fund Account, which shall be kept written up, in duplicate, in such form as may be approved from time to time.

(2) The Cadets’ Fund Account shall be a complete record of all moneys received and payments made in connexion with the Fund.

82. The Cadets’ Fund Account and the accounts supporting same shall be considered in all respects as public accounts.

83. (1) All claims shall be submitted to the Captain for his approval before payment and should be paid as soon as practicable after being approved to insure that there are no liabilities outstanding against the Fund.

(2) Vouchers shall be numbered consecutively, commencing with number one on the first day of each quarter, and attached to the Cadets’ Fund Account when forwarded into office.

84. (1) The Cadets’ Fund Account shall be completed and closed on the last day of each quarter or on the supercession or death of the Accountant Officer. It shall be examined and signed by the Paymaster Lieutenant, or, if a Paymaster Lieutenant is not borne, by the Senior Writer and approved by the Captain, after being examined by the Officer appointed by the Captain for that purpose. It shall then be forwarded, with all necessary vouchers and supporting documents, to the Director of Navy Accounts.

(2) A certificate on Form N.A.4 shall also accompany the Cadets’ Fund Account and vouchers into office showing the total amount disbursed by the Accountant Officer on account of the Fund during the period covered by the account.

Sports and Gymnasium Gear.

Sports gear.

85. Notwithstanding the provisions of regulation 79, the first supply of sports gear required for any branch of sport or indoor game may, subject to the prior approval of the Naval Board, be defrayed from the Contingencies Vote.

Gymnasium.

86. Gear required for the gymnasium shall be treated as ordinary stores for the conduct of the establishment, and its supply and maintenance shall be charged to the Contingencies Vote.

88. All fines and pocket money stopped shall be credited to Navy—Revenue.

Library.

Management.

89. The Cadet Midshipmen’s Library shall be managed by an Officer of the Professorial Staff appointed by the Board of Studies to act as Librarian. One Cadet of each “year” shall assist in choosing books.

Regulations.

90. All rules and regulations for the Library shall be submitted to the Captain before promulgation.

Maintenance.

91. (1)The maintenance of the Library, including the purchase of new books, shall be a charge against the Contingencies Vote.

(2) Before incurring any expenditure, the Librarian shall prepare the necessary requisition embodying his proposals and submit same to the Captain for his approval in accordance with the requirements of the Naval Account Regulations. After the requisition is approved, the covering order may be placed in the manner prescribed in those regulations.

Fines.

92. Failure to return a book within the period allowed for its retention may entail a fine by the stoppage of pocket money and in the case of the loss of a book, a proportion of its value may be deducted from a Cadet Midshipman’s pocket money.

Damage to books.

93. (1) In the case of a book which has been wilfully damaged the Librarian shall assess the extent of the damage which shall be paid for by the person responsible and the Cadet Midshipman reported to the Captain.

(2) Any payment made in accordance with this regulation shall be credited to Navy—Revenue.

Part VI.—Canteen.

Management.

94. A Canteen shall be established at the College for the supply of confectionery &c, and shall be managed by a committee consisting of one officer, and a Cadet Midshipman of each “year.”

Custody of stores.

95. The stores shall be under the charge of a Ship’s Steward or an Officer’s Steward, 1st Class, who may be paid a percentage of the profits, on the approval of the Captain for carrying out this duty.

Accounts.

96. The Canteen Committee is responsible that all accounts for stores are promptly paid. Accounts shall be audited quarterly by the Accountant Officer and shall be submitted to the Captain.

Contracts.

97. The Captain may, subject to the approval of the Naval Board, enter into a contract with a private person or firm to conduct the Canteen, and any rent or payment paid for this privilege shall be credited to the Cadets’ Fund.

Part VII.—General.

College report.

98. The Captain shall submit to the Naval Board, in February of each year, a report to be laid before Parliament.

Gratuities not to be accepted.

99. (1) No person attached to the College shall receive a present from a Cadet Midshipman or from the relatives or friends of a Cadet Midshipman. Any Petty Officer or employee discovered accepting a present shall be liable to be removed or discharged and the Cadet Midshipman giving the present shall be punished.

(2) No Cadet Midshipman shall offer a present to any person belonging to the College or to a near relative of any such person.

Saluting.

100. A Cadet Midshipman shall salute all officers in uniform and those whom he knows to be officers when not in uniform.

Marriage of members of Staff.

101. Any officer on the Staff of the College wishing to marry must obtain the consent in writing of the Captain, failure to do which shall entail the penalty of forfeiture of appointment. Consent will, as a rule, be given only in the case of an appointment for which married quarters are allowed.

Uniform for nursing sisters.

102. Nursing Sisters attached to the College shall wear uniform, which shall be comprised of such articles as are approved by the Naval Board. Uniform shall be worn when on duty within the precincts of the College, and on such other occasions as may be directed. These articles, which shall be supplied at the expense of the Government after a period of three months’ probation, and only then if the appointee be recommended and confirmed, shall remain the property of the Government and shall be relinquished on resignation or removal, if so directed.

Visitors.

103. (1)Visitors to the College, or to any person in the establishment shall conduct themselves in such a way as not to conflict with the discipline and the regulations and orders for the government of the College. Those whose conduct is deemed unsatisfactory may be removed either by the College Staff or by the Civil authorities.

(2) The conditions under which official visitors to the College may be victualled are as prescribed in regulation 66.
