STATUTORY RULES.

1926. No. 181.

REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1918.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1918, to come into operation forthwith.

NAVAL COLLEGE REGULATIONS.

Part 1.—Preliminary.

Citation.

1. These Regulations may be cited as the Naval College Regulations.

Repeal.

2. The Regulations for the Royal Australian Naval College (Statutory Rules 1921, No. 239, as amended to present date) are repealed as from the commencement of these Regulations, save as to anything lawfully done, or any right, privilege, obligation, or liability acquired, accrued, or incurred thereunder.

Parts.

3. These Regulations are divided into Parts as follows:—

Part I.—Preliminary.

Part II.—Conditions of Entry and Service.

Part III.—Command, Staff, &c.

Part IV.—Leave of Absence.

Part V.—Cadet Midshipmen.

Part VI.—Cadet Midshipmen’s Canteen.

Part VII.—General.

Definitions

4. In these Regulations, unless the contrary intention appears—

“Naval Board” means the Naval Board of Administration constituted under the Acts.

“Captain” means the officer appointed by the Naval Board to command the Naval College.

“Commanding Officer” means the officer in actual command of the College at the moment.

“Cadet Midshipman” is a designation of rank equivalent to that of “Naval Cadet” in the Royal Navy, and means a youth entered at the Naval College for training as a Naval officer.

“Accountant Officer” means the officer in charge, under the Commanding Officer, of duties concerned with cash, victualling and clothing.

“Guardian” means one of the parents of a Cadet Midshipman or of a candidate for entry as Cadet Midshipman, or in cases where both parents are deceased, such other person as the Naval Board is satisfied is properly charged with the boy’s interests.

Objects of College.

5. The Royal Australian Naval College is established under the authority of the Naval Defence Act for the training of Naval officers.

Part II.—Conditions of Entry and Service.

Qualifications for Candidates.

Personal requirements.

6. A candidate to be eligible for entry to the Naval College must comply with the following conditions:—

(a) Be the son of natural-born British subjects and be substantially of European descent, the burden of proof in a doubtful case resting upon the guardian of the candidate;

(b) Attain the age of thirteen years in the calendar year during which the entrance examination which he applies to take is held; and

(c) His guardian must be domiciled in Australia.

Form of application.

7. Every candidate shall furnish an application for entry on the prescribed form, and shall attach to his application—

(a) A certified extract from the register of his birth, or if this is not obtainable, a certificate of his baptism or other documentary evidence, accompanied by statutory declaration made by his guardian before a justice of the peace, stating the exact date of birth;

(b) A certificate of good moral character, signed by the clergyman of the place of worship he usually attends, or by a prominent citizen who is personally acquainted with the candidate;

(c) A certificate of conduct and ability signed by the head of the school at which he has been educated during the two preceding years at least, and if he should have attended more than one school during that period, a certificate must be obtained from each school.

Educational Examination.

Date of educational examination.

8. The qualifying Educational Examination for entrance to the College shall be held annually, on a date which shall be fixed by the Naval Board.

Supervision of examinations.

9. (1) The Naval Board may appoint suitable persons to supervise examinations, who shall observe such instructions for the conduct of examinations as may be approved by the Naval Board.

(2) The fees payable to supervisors shall be such as the Naval Board fix from time to time, according to the number of candidates and the time involved.

10. A candidate who, for any reason, is unable to sit for the qualifying Educational Examination shall be considered to have forfeited his candidature.

 

Interviewing Committee.

11. Every candidate who passes the qualifying Educational Examination shall be required, except as provided in regulation 15, to present himself before the Interviewing Committee, where he shall be separately interviewed with the object of ascertaining his suitability or otherwise for the Naval Service. A candidate who is prevented by illness from appearing before the Interviewing Committee shall be dealt with according to the individual merits of his case.

Medical Examination.

Physical requirements.

12. (1) Every candidate must be in good health, free from any physical defect of body, impediment of speech, defect of hearing, and also from predisposition of constitutional or hereditary disease or weakness of any kind, possess full normal vision as determined by the prescribed tests, and be in all respects well developed and active in proportion to his age.

(2) A candidate who possesses a slight remediable defect must have such defect remedied before he attends before the Naval Medical Officers at the time of interview, when no allowance will be made for any prospective remedial operation and the existence of any such defect shall be a reason for the final rejection of the candidate.

(3) The decision of the Naval Medical Officers examining at the interview is final.

Dental treatment.

13. In the event, of a Cadet Midshipman requiring dental treatment during the first six months at the College, the cost of such treatment shall be borne by the guardian.

Interviewing Committee.

Personnel.

14. The Interviewing Committee shall be composed of the following, subject to alteration if desirable, by the Naval Board:—

the Captain of the Naval College;

a Captain or Commander;

an Officer of the Professorial Staff; and

two Naval Medical Officers,

and will sit at properly advertised dates at such capital cities of the Commonwealth as the Naval Board may decide upon.

Candidates attending for interview in other States.

15. A candidate from a State or any territory or dependency of the Commonwealth which is not included in the itinerary of the Interviewing Committee may be required to undergo a provisional interview in the capital city of such State, Territory, or Dependency, before a Provisional Committee which shall be appointed by the Naval Board, to make a recommendation as to his suitability or otherwise to appear before the Interviewing Committee at a place appointed.

Travelling and subsistence allowance whilst attending for interview.

16. (1) No travelling or subsistence allowance shall be paid except where a candidate is brought from one State to another to suit the convenience of the Interviewing Committee. In such cases the cost of rail or steamer fares and travelling allowance at the rate of 10s. per diem shall be allowed, such allowance to cover all expenses other than rail or steamer fares.

(2) Travelling allowance shall not be payable in cases of journeys by steamer or other vessel or by railway when the fare paid includes subsistence.

 

Special Cadetships.

Sons of sailors and soldiers.

17.(1) Two of the annual vacancies for Cadetships at the College shall be reserved for candidates who are the sons of persons who have been on active service abroad in the Royal Australian Navy or in an Expeditionary Force raised under the provisions of the Defence Act. These special nominations shall be made from candidates in each of the following classes, in the order of priority shown:—

(a)The sons of persons who have lost their lives or become totally incapacitated on active service abroad;

(b)The sons of persons who have been on active service abroad with the Royal Australian Navy;

(c) The sons of persons who have been on active service abroad with an expeditionary force raised under the provisions of the Defence Act.

(2) To be eligible for appointment as Cadet Midshipman, a candidate nominated under these conditions must qualify at the Educational Examination, and be recommended as suitable by the Interviewing Committee, and, except as provided in sub-regulation (3), shall compete for these special cadetships with candidates in their own particular class only.

(3) Candidates who are unsuccessful in obtaining a special cadetship shall be considered on their merits, with the ordinary candidates, for nomination to an ordinary cadetship.

(4) In the event of a vacancy for a special cadetship not being filled owing to dearth of qualified candidates, it will be allotted to a nominee from among the ordinary candidates.

Boys from H.M.A. Training Establishment.

18. (1) A boy under training in the Boys’ Training Establishment shall be eligible to enter the Naval College under the conditions prescribed in the following sub-regulations.

(2) To be eligible for entry a candidate shall be not more than sixteen years of age on the first day of January of the year following the date of his selection, and he will be required to pass an examination in the following subjects:—

(a) Seamanship.—Up to standard of 1st and 2nd year Cadet Midshipmen.

(b) Mathematics

(c) Physics

(d) English

(e) Geography

Up to the standard of 1st year Cadet Midshipmen.

(3) Candidates who pass this examination shall appear before a Selection Committee consisting of the following officers:—

Commanding Officer H.M.A.S. Tingira;

First Lieutenant or Lieutenant-Commander; and Chaplain,

who will make recommendations to the Naval Board in regard to the candidates whom they consider should be selected.

(4) A successful candidate joining the Naval College after the date of commencement of the first College term of the year shall be classed with the “First Year” Cadet Midshipmen. A candidate who joins on or before that date shall be classed with the “Second Year” Cadet Midshipmen.

 

Entry to the College.

Nominations to be made by Minister.

19. Nominations for entry to the College shall be made by the Minister upon the recommendation of the Naval Board, from such candidates as are considered most suitable by the Interviewing Committee.

Names published in Gazette.

20. The names of candidates who are selected for appointment as Cadet Midshipman shall be published in the Commonwealth of Australia Gazette in alphabetical order.

Conditions of Service.

Engagement.

21. On the entry of a Cadet Midshipman to the Naval College, his guardian shall be required to execute an engagement that he will serve in the Royal Australian Navy for a term of twelve years from the date of his attaining the age of eighteen years, in addition to whatever period of service shall be necessary until he reaches that age.

Allotment to Branch of Service.

22. (1) A Cadet Midshipman shall be liable, at the discretion of the Naval Board according to the requirements of the Service, to be allotted to the Executive or Engineer Branch, provided that, in the event of the number of Cadet Midshipmen available exceeding the estimated requirements of these branches, the Naval Board may allot any Cadet Midshipman in excess of such requirements to the Accountant Branch.

(2) The desires of each Officer shall be taken into consideration by the Naval Board when allotting officers to the Executive or Engineer Branch.

Period of training is probationary.

23. (1) The period of training at the Naval College and on the Instructional Cruiser, is probationary, and the guardian of a successful candidate shall be required to sign a declaration on his admission as Cadet Midshipman, to the effect that he shall be immediately withdrawn on the receipt of an official request for his withdrawal.

(2) A Cadet Midshipman who fails to attain a certain standard during any period of his training, or who is considered unsuitable for the Naval Service, may be required to withdraw at any time.

(3) A Cadet Midshipman may be required to withdraw at any time on account of unsatisfactory conduct.

Penalties for withdrawal without consent.

24. (1) In the case of a Cadet Midshipman who withdraws from, refuses or fails to continue his training in, or leaves, the Naval College or Instructional Cruiser without the consent in writing of the Naval Board, a penalty of £75 for each year’s training undergone or proportionately for portion of a year, may be imposed on the guardian of such Cadet Midshipman.

(2) Any sums paid under this regulation shall be credited to Defence Revenue—Naval.

Cost of maintenance borne by Commonwealth.

25. The cost of maintenance, of a Cadet Midshipman whilst in residence at the College shall be borne by the Commonwealth.

Training.

Period of training.

26. (1) The period of training for a Cadet Midshipman shall be four years at the Naval College followed by, if practicable, four months’ training in an Instructional Cruiser, except as provided in regulation 27.

(2) The College year shall be divided into three terms.

 

Training may be reduced.

27.The Governor-General may, on the recommendation of the Naval Board, at any time direct that the period of training at the College be reduced and the Instructional Cruiser training be omitted, in order that a Cadet Midshipman may be appointed for duty in the Fleet, provided that no Cadet Midshipman shall be so appointed until he has completed nine terms at the College.

Pay on promotion.

28. A Cadet Midshipman on appointment to the rank of Midshipman shall receive the pay and allowances prescribed for that rank in the Naval Financial Regulations.

Outfit for sea service.

29. On leaving the Naval College for service in the Sea-going Forces, each Cadet Midshipman shall be supplied at Government expense with those articles which are required to complete his outfit for sea service.

Part III.—Command, Staff, etc.

Captain.

Captain of College.

30. The Naval College shall be under the command of the Officer appointed by the Naval Board for that purpose. He shall report direct to the Naval Board on all matters connected with the College.

Absence of Captain.

31. In the absence of the Captain, the next senior commissioned Naval Officer of the Military Branch on duty at the time shall control the College.

Authority of Captain.

32. The Captain is authorized to issue such Standing and Routine Orders and Instructions as he may deem necessary, provided that such Orders and Instructions are not opposed to any of the provisions of the Naval Defence Act and these Regulations, or Orders issued by the Naval Board.

Authority to incur expenditure.

33. The authority vested in the Captain to incur expenditure is as prescribed in the Naval Financial Regulations.

Board of Studies.

Constitution.

34. There shall be a Board of Studies, constituted as follows:—

President—The Captain of the College.

Members—The Senior Lieutenant,

The Senior Engineer Officer, and

The Senior Officer of the Professorial Staff of each of the following Departments, viz.:—

(i) Navigation and Mathematics,

(ii) Science,

(iii) The Humanities,

which shall arrange the studies of Cadet Midshipmen.

Civilian Officers and Employees.

35. The Professorial Staff of the College shall be as provided on the Estimates, the complement being approved by the Naval Board.

36. (1) The appointment of an officer of the Professorial Staff shall be made under section 41 (1) (c) of the Naval Defence Act,

 

on the recommendation of the Captain. The appointment shall be on probation for one year, at the end of which period subject to the recommendation of the Captain, it shall be confirmed.

(2) On the recommendation of the Captain, the appointment may be terminated summarily at any time for misconduct, physical unfitness, or unsatisfactory performance of duty.

(3) A member of the Professorial Staff may, by writing under his hand, resign his appointment at any time, not being less than three months, from the date of tendering the resignation. The resignation shall not have effect until it has been accepted, but it may, in special circumstances, be accepted at any time after receipt thereof.

Professorial staff to have no executive authority.

37. No officer of the Professorial Staff of the College may exercise any executive (military) command.

Classification and pay.

38. (1) The Professorial Staff shall be classified in three grades, as follows:—

(a) Head Master.

(b) Senior Master,

(c) Master.

(2) The following consolidated rates of pay shall apply to the Professorial Staff:—

(3) Child Endowment Allowance shall be paid at the rates and under the conditions prescribed in Commonwealth Public Service Regulations.

(4) Pay shall be inclusive of all allowances except where otherwise prescribed in these Regulations.

(5) An officer of the Professorial Staff shall be compulsorily retired on attaining the age prescribed in the following scale:—

provided that the age for compulsory retirement of a Master who held the appointment of Assistant Master on 30th June, 1924, shall be 52 years; provided further that in exceptional cases the Governor-General may, on the recommendation of the Naval Board, permit a Head Master or Senior Master, who otherwise should retire, to continue, notwithstanding his age, to perform his duty for a period not exceeding two years beyond the age laid down for retirement.

 

Promotion.

39 Except in special circumstances, a vacancy for Senior Master shall be filled by the promotion of a Master, provided that no Master shall be eligible for promotion to Senior Master until he has served as Master or Master and Assistant Master for eight years.

Travelling allowance.

40. Civilian officers and employees may be paid allowances for travelling at the rates and under the conditions prescribed in the Commonwealth Public Service Regulations for an officer of equivalent salary.

Railway fares and removal expenses on appointment or retirement.

41. (1) The cost of taking up appointment and of removal on retirement of civilian officers and employees shall not be borne by the Department, except in the case of the Professorial Staff, where the cost of railway or other fares, including, if the member is married, those of wife and children, exceed £3, when the amount in excess of £3 may be allowed.

(2) The cost of conveyance of effects on taking up appointment and on removal on retirement shall not be met by the Department.

Rental charge for quarters.

42. Where an officer of the Professorial Staff occupies for the purpose of residence the whole or part of a building, belonging to or occupied by the Commonwealth, a deduction shall be made from such officer’s salary as rent therefor, in accordance with the provisions of the Naval Financial Regulations, provided that where single quarters only are occupied, the amount to be deducted shall be determined by the Naval Board.

Furniture for quarters.

43. A charge shall be made at the rates and under the conditions prescribed in the Naval Financial Regulations, where furniture is approved by the Naval Board to be supplied to quarters occupied by an officer of the Professorial Staff.

Fuel and light.

44. An officer of the Professorial Staff shall not be provided with fuel or light at Government expense unless the Order in Council appointing such officer expressly provides for such allowances; or unless the Minister approves of one or more such services being supplied.

45. Notwithstanding the provisions of regulations 42, 43 and 44, an officer who on 1st January, 1926 was allowed, with Minister’s approval, quarters, fuel or light at Departmental expense, may continue to receive such services without charge or deduction from salary.

Dress.

46. An officer of the Professorial Staff shall not wear uniform, but during the hours of study shall wear the academical dress of cap and gown.

No outside business to be engaged in.

47. (1) No civilian officer or employee shall engage in any outside business or profession, be permitted to prepare candidates for admission to the College, nor accept fees for private instruction either in terms or during vacation.

(2) Except as provided in these Regulations, a civilian officer or employee shall not, unless with the approval of the Governor-General, receive for his own use any fee, reward, gratuity, or remuneration of any kind whatsoever other than his official salary and allowances, for services performed by him, either in or out of usual hours of duty, in connexion with the Department.

 

48. The following fees may be paid to officers of the Professorial Staff for setting and marking papers in connexion with examinations of Sea-going personnel:—

Fees in accordance with the above scale approved by the Naval Board according to the nature of the examination.

 

Medical attendance.

49. (1) Civilian officers of and employees permanently or temporarily employed at the R.A.N. College, their wives and families, also the wives and families of members of the Permanent Naval Forces (Sea-going) detailed for duty at the R.A.N. College, may be granted medical attendance at the College, free of charge by the Surgeon appointed for duty. Such medical attendance shall not include the supply of medicines free of charge.

(2) The concession of free medical attendance for all persons referred to in sub-regulation (1) of this regulation is conditional upon the work being carried out by the Surgeon appointed for official duty at the College, and subject to no additional expense being incurred by the Department.

(3) The cost of medical attendance for confinements shall not be allowed.

Hospital accommodation.

50. Civilian officers and employees, their wives and families, and the wives and families of members of the Permanent Naval Forces (Seagoing) detailed for duty at the College, may, subject to the approval of the Commanding Officer, be admitted to the hospital at the College. No charge for such accommodation shall be made in respect of the officers and employees, but a charge at the rate of 30s. per capita per week shall be made in the case of wives and families.

 

Dental treatment.

51. Civilian officers and employees may, where circumstances permit, receive free dental treatment by the Dental Surgeon so far as is necessary for the relief of pain only, provided no extra expense to the Department is incurred. Fillings or work of a similar nature shall not be undertaken at Departmental expense.

Sick leave, furlough, &c.

52. Officers of the Professorial Staff may be granted sick leave, furlough, and extended leave, under the conditions prescribed in the Commonwealth Public Service Regulations.

53. The Naval Board may determine conditions of employment of civilian officers and employees not prescribed in these Regulations.

Naval Officers.

Naval officers.

54. Naval Officers appointed to the Staff of the College shall rank according to the regulations of the Service.

Officers of Instructor Branch of Permanent Naval Forces.

55. An officer of the Instructor Branch of the Permanent Naval Forces (Sea-Going) may be appointed for Professorial duties at the College alternatively with a sea-going appointment. Whilst holding an appointment at the College such an officer shall be borne on the books of the Franklin at sea-going rates of pay and allowances prescribed for his rank, and shall be subject to the regulations of the Service, and Captain’s orders for the Royal Australian Naval College,

Part IV.—Leave of Absence.

Staff.

Leave during vacation.

56. (1) The Captain may, subject to the provisions of sub-regulation (2) of this regulation, grant leave of absence to members of the Staff whose services can be spared, for the entire period of the suspension of ordinary academic studies, notwithstanding anything contained in the Naval Forces Regulations or other Naval Regulations limiting the amount of leave to be granted in one year.

R. N. personnel.

(2) Officers and Men on loan from the Royal Navy shall be subject to the provisions of the Naval Forces Regulations in regard to leave.

Health certificate to be provided after vacation.

57. A Cadet Midshipman on return from leave shall be required to produce a certificate signed by his guardian to the effect that he has not for at least three weeks immediately preceding his return, or during the time he has been on leave, if less than that period, been exposed to any infectious disease, or entered any house where such disease has existed. A Cadet Midshipman who fails to produce this Certificate duly completed and signed shall be placed under observation in the sick quarters, during which time he will receive no instruction, and the cost of his upkeep at the rate of 6s. per diem shall be charged against his guardian.

Illness During Leave.

Medical expenses whilst on leave not borne by Government.

58. The expense of medical or dental attendance incurred while a Cadet Midshipman is on leave will not be borne by the Government except in special cases where such attendance was advised by the College authorities in writing.

Inability to rejoin College on expiration of leave to be reported

59. In cases where a Cadet Midshipman is unable upon expiration of his leave to rejoin the College upon the appointed date owing to illness beyond his control, a sick allowance at the rate of 6s. per diem,

 

dating from the commencement of the term, shall be paid from Naval Funds to the guardian upon receipt of a Medical Certificate. The Captain is to be advised weekly as to the progress of the Cadet Midshipman.

Part V.—Cadet Midshipmen.

Pay, Pocket Money, &c.

Chief Cadet and Cadet Captains.

60. Cadet Midshipmen selected in regard to their ability to assist the Officers in maintaining the discipline and good order of the College may be rated Chief Cadet Captain and Cadet Captain by the Captain from time to time as is considered necessary.

On Instructional Cruiser.

61. (1) From date of embarkation in the Instructional Cruiser (for the training prescribed in regulation 26), a Cadet Midshipman shall receive the pay and allowances prescribed in Naval Financial Regulations for Midshipman, but shall not be credited with Deferred Pay. In the event of a Cadet Midshipman being returned to the College during the period prescribed to be spent on the Instructional Cruiser he may continue to receive active pay and allowances prescribed for a Midshipman, but shall not be also eligible for the benefits or allowances provided in these Regulations to which he was entitled prior to appointment to the Instructional Cruiser.

At Naval College.

(2) During the time he is at the College, prior to appointment to Instructional Cruiser, a Cadet Midshipman shall receive no pay, but shall be allowed the sum of 1s. per week as pocket money.

Good conduct allowances.

62. In addition to pocket money, good conduct allowances at the rates shown below shall be awarded to each Cadet Midshipman of uniformly exemplary conduct. Any serious offence shall entail the stoppage or reduction of this allowance. The qualifications necessary for the award of good conduct allowance shall be determined by the Captain.

The amount specified is in each case the total amount of good conduct allowance.

Pocket money for Cadet Captains.

63. Chief Cadet Captains and Cadet Captains shall be paid 1s. 6d. and 1s. respectively extra pocket money weekly.

Custody of Private Funds.

Bank conducted by Accountant Officer.

64. The Accountant Officer shall conduct a bank for the safe custody of private money belonging to Cadet Midshipmen.

Sums in excess of five shillings not to be retained.

65. Except when undergoing training on board the Instructional Cruiser, a Cadet Midshipman shall not be allowed to retain in his possession sums exceeding 5s. All money in excess of this amount shall be deposited in the bank.

 

Outfit.

Kit.

66. (1) Cadet Midshipmen on entry shall be supplied gratuitously with a complete kit comprised of such articles as may be approved by the Naval Board.

Clothing allowance.

(2) A Clothing Allowance at the rate of 1s. 2d. per diem shall be credited to each Midshipman, and the value of all necessary subsequent replacements of clothing and repairs to footwear shall be charged against such allowance.

(3) Except on termination of his appointment, any balance of the Clothing Allowance at the credit of the Cadet Midshipman’s account may be paid to him on leaving the College.

(4) The value of any issues and repairs in excess of the Clothing Allowance shall be transferred with the Cadet Midshipman, and charged against his pay account for gradual recovery or, in the event of the termination of his appointment, recovered from his guardian.

(5) In the event of a Cadet Midshipman being discharged to shore for any cause, all articles of Uniform Clothing in his possession at the time of discharge shall be returned to store, except such as may be necessary to enable him to proceed to his home suitably clothed.

Laundry.

67. (1) Washing for the resident staff may be carried out at the Laundry at the College at the rate of 2s. per dozen, and the money so obtained, shall be credited to revenue.

(2) When undergoing training in the Instructional Cruiser and entitled to pay in accordance with the provisions of regulation 61, a Cadet Midshipman shall be required to make his own arrangements in respect of laundry.

Victualling.

Scale of messing.

68. Each Cadet Midshipman shall be victualled in accordance with the General Messing System as laid down in the Naval Financial Regulations, except that the amount allowed per head shall be 2s. 2d. per diem in lieu of 1s. 9d.

No allowance in lieu during vacation.

69. No allowance in lieu of rations shall be credited or paid to a Cadet Midshipman during the time that he is absent from the College or Instructional Cruiser on short leave or during vacations.

Cost of messing of visitors to colleges.

70. When an officer or employee of a State Department or a private individual visits the College on official business at the request of the Department of Defence, the cost of his messing whilst at the College may, on the approval of the Naval Board, be borne from Government Funds.

Travelling Expenses.

No allowance prior to entry.

71. Before entry to the College no expenses for passages or travelling shall be allowed to a candidate except as prescribed in regulation 16.

 

Rate.

72. The rate of travelling allowance for a Cadet Midshipman shall be an inclusive allowance of 10s. per diem, calculated in the manner prescribed in the Naval Financial Regulations.

On entry.

73. On first entry to the College, a Cadet Midshipman shall be granted a first-class passage from place of residence thereto, and in addition travelling allowance at the rate prescribed in regulation 72.

During vacations.

74. When proceeding on leave during vacations, a Cadet Midshipman shall be provided with a first-class return passage, and except when provided with meals, shall be granted travelling allowance, for the journey home and for the return journey to the College.

Meals.

75. When meals are provided, no travelling allowance shall be paid.

Prizes, Honours, &c.

76. (1) The following prizes shall be awarded and shall be competed Prizes for by each Cadet Midshipman in the final year of his course at the College.

The cost of these prizes, which shall not exceed 50 guineas, shall be defrayed from the College vote.

(2) No Cadet Midshipman shall be allowed to receive more than two prizes, and in cases where a Cadet Midshipman qualifies for more than two, the Captain, after consultation with the Board of Studies, shall decide the award.

Presentations to Cadet Captains.

77. Each Chief Cadet Captain, and Cadet Captain, on finally passing out from the College for duty in the Permanent Sea-going Forces, may, on the approval of the Naval Board, be presented with a token of appreciation of his services. The cost of such presentation shall not exceed 50s. for a Chief Cadet Captain, and 40s. for a Cadet Captain, and shall be chargeable to the Contingency Vote.

Cadets’ Fund.

Amount of fund.

78. (1) There shall be a Cadets’ Fund, which shall consist of—

(a) a capitation grant of £2 per annum per capita, based upon the number of Cadet Midshipmen in the College on the 30th June of the preceding year, provided that the minimum grant shall be £200 per annum; and

 

(b)any canteen rent or other moneys received, which, subject to these Regulations, the Captain may approve of being credited to this Fund.

(2) Payment on account of the capitation grant shall be made quarterly, in advance, upon voucher drawn in favour of the Accountant Officer, and approved by the Captain, the charge being made to the Contingencies Vote.

Purposes of fund.

79. (1) The Cadets’ Fund shall be used for the purposes of providing cricket, football, athletics, tennis, swimming, regatta, and other outdoor sports, indoor games, photography, and amusements in general for Cadet Midshipmen, and prizes therefor; also for the upkeep of the sports gear and cost of publishing the College magazine.

Administration.

(2) The administration of the Fund shall be under the control of the Captain, and all accounts shall require his approval before payment.

Responsibility of accountant officer.

80. (1) The Accountant Officer shall be responsible for the proper accounting for the money belonging to the Fund and for the Cadets’ Fund Account, which shall be kept written up, in duplicate, in such form as may be approved from time to time.

(2) The Cadets’ Fund Account shall be a complete record of all moneys received and payments made in connexion with the Fund.

81. The Cadets’ Fund Account and the accounts supporting same shall be considered in all respects as public accounts.

Closing and checking fund.

82. (1) The Cadets’ Fund Account shall be completed and closed on the last day of each quarter or on the supercession or death of the Accountant Officer. It shall be examined and signed by the Paymaster Lieutenant, or, if a Paymaster Lieutenant is not borne, by the Senior Writer and approved by the Captain, after being examined by the Officer appointed by the Captain for that purpose. It shall then be forwarded, with all necessary vouchers and supporting documents, to the Director of Navy Accounts.

(2) A certificate on Form N.A.4 shall also accompany the Cadets’ Fund Account and vouchers into office showing the total amount disbursed by the Accountant Officer on account of the Fund during the period covered by the account.

Sports and Gymnasium Gear.

Sports gear.

83. Notwithstanding the provisions of regulation 79, the cost of the first supply of sports gear required for any branch of sport or indoor game may, subject to the prior approval of the Naval Board, be defrayed from the Contingencies Vote.

Gymnasium.

84. Gear required for the gymnasium shall be treated as ordinary stores for the conduct of the establishment, and its supply and maintenance shall be charged to the Contingencies Vote.

(2) All fines and pocket money stopped shall be credited to Defence Revenue—Naval.

Library.

86. There shall be a Cadet Midshipman’s library, the maintenance of which, including the purchase of new books, shall be a charge against the Contingencies Vote.

87. Rules for the conduct of the Library shall require the approval of the Captain, and may include penalties chargeable against pocket money, for loss of or damage to books or failure to return books within the time specified for retention.

(2) Any payment made in accordance with this regulation shall be credited to Defence Revenue—Naval.

Part VI.—Cadet Midshipmen’s Canteen.

Management.

88. Apart from the Ship’s Company’s Canteen established at the College, a Canteen may be established for the supply to Cadet Midshipmen of confectionery and other supplies approved by the Commanding Officer. The Canteen shall be managed by a Committee consisting of one Officer and a Cadet Midshipman of each “Year”.

 

Custody of stores where contractor not employed.

89. The stores shall be under the charge of an Officer’s Steward, who may be paid a percentage of the profits, on the approval of the Captain, for carrying out this duty.

Accounts.

90. The Canteen Committee shall be responsible that all accounts for stores are promptly paid. Accounts shall be audited quarterly by the Accountant Officer and shall be submitted to the Captain for approval.

Alternative method.

91. The Captain may, subject to the approval of the Naval Board, arrange an alternative system for Canteen supplies to Cadet Midshipmen, and any rent or payment received for the privilege shall be credited to the Cadets Fund.

Part VII.—General.

College report.

92. The Captain shall submit to the Naval Board, in February of each year, a report to be laid before Parliament.

Gratuities not to be accepted.

93. (1) No person attached to the College shall receive a present from a Cadet Midshipman or from the relatives or friends of a Cadet Midshipman.

(2) No Cadet Midshipman shall offer a present to any person belonging to the College or to a near relative of any such person.

94. (1) A Nursing Sister attached to the College shall wear uniform, which shall be comprised of such articles as are approved by the Naval Board. These articles shall be supplied at the expense of the Government on confirmation after the period of three months’ probation. They shall remain the property of the Government, and shall be relinquished on the resignation or removal of the Nursing Sister, if so directed.

(2) A Uniform Allowance at the rate of 1s. per diem, payable quarterly in arrear, shall be allowed towards the cost of upkeep of uniform.

95. All money or payments received in accordance with these Regulations, except as provided in regulation 91, shall be credited to Defence Revenue—Naval.
