STATUTORY RULES.

1961. No. 110.

REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1952.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1952.

AMENDMENTS OF THE NAVAL COLLEGE REGULATIONS. 

Definitions.

1. Regulation 4 of the Naval College Regulations is amended by omitting the definition of “The Defence Act” and inserting in its stead the following definition:—

“ ‘The Act’ means the Naval Defence Act 1910-1952;”.

2. Regulation 30 of the Naval College Regulations is repealed and the following Regulation inserted in its stead:—

The Professorial Staff.

“30. The Professorial Staff of the College consists of persons who are employed in a civil capacity in the instruction of cadets at the College in pursuance of an authority given under section 41 of the Act.

Appointments.

3. Regulation 31 of the Naval College Regulations is amended—

(a) by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation:—

“(1.) All appointments to the Professorial Staff shall be made in accordance with the authority given for the purpose under section 41 of the Act.”;

(b) by omitting from sub-regulation (3.) the words “the Governor-General may, on the recommendation of the Naval Board,” and inserting in their stead the words “the Naval Board may”;

(c) by omitting from sub-regulation (4.) the words “The Governor-General, on the recommendation of the Naval Board,” and inserting in their stead the words “The Naval Board”; and

(d) by omitting from sub-regulation (5.) the words “The Governor-General may, on the recommendation of the Naval Board,” and inserting in their stead the words “The Naval Board may”.

Eligibility for appointment.

4. Regulation 31A of the Naval College Regulations is amended by omitting the proviso to sub-regulation (2.).

Excess officers.

5. Regulation 34 of the Naval College Regulations is amended—

(a) by omitting the words “the Minister” and inserting in their stead the words “the Naval Board”;

(b) by omitting the words “the Defence Act 1903-1927, or the Naval Defence Act 1910-1918” and inserting in their stead the words “the Act”;

(c) by omitting the words “the said Acts” and inserting in their stead the words “the Act”; and

(d) by omitting the words “the Governor-General” (wherever occurring) and inserting in their stead the words “the Naval Board”.

Retiring ages.

6. Regulation 38 of the Naval College Regulations is amended by omitting from sub-regulation (2.) the words “The Governor-General may, on the recommendation of the Naval Board,” and inserting in their stead the words “The Naval Board”.

7. Regulation 39 of the Naval College Regulations is repealed and the following regulation inserted in its stead:—

Qualifications for appointments and promotions.

“39.—(1.) The Naval Board shall, for the purposes of this regulation, determine—

(a) the academic qualifications that are to be the academic qualifications to be held by members of the Professorial Staff; and

(b) the other attributes that are to be the attributes to be held by persons in each of the Grades into which the Professorial Staff is classified,

and a reference in this regulation to the appropriate qualifications for a Grade is a reference to those qualifications and the attributes so determined for that Grade.

“(2.) A member of the Professorial Staff shall not be classified in a Grade of the Professorial Staff unless he has the appropriate qualifications for that Grade.

“(3.) Subject to the next succeeding sub-regulation—

(a) a person shall not, on appointment to the Professorial Staff, be classified in a Grade other than the Grade of Master; and

(b) a person who holds the Grade of Master shall not be promoted to the Grade of Senior Master unless—

(a) he has the appropriate qualifications for the Grade of Senior Master; and

(b) he has completed not less than six years’ service in the Grade of Master.

 

“(4.) Where the Naval Board is satisfied that a person—

(a) holds academic qualifications superior to those determined by the Naval Board as the academic qualifications to be held by members of the Professorial Staff; or

(b) has had articles of outstanding merit relating to subjects in the field in which he obtained his academic qualifications published in books or journals,

and has the attributes determined by the Naval Board to be the attributes to be held by a person in the Grade of Senior Master, the Naval Board may, on the appointment of that person to the Professorial Staff, classify that person in the Grade of Senior Master or, if the person holds the Grade of Master, may promote that person to the rank of Senior Master.”.

Fuel and light.

8. Regulation 44 of the Naval College Regulations is repealed.
