REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910–18.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of theFederal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910–18, to come into operation forthwith.

All Regulations other than Naval Financial Regulations under the Naval Defence Act, whether provisional or otherwise, heretofore made for the Royal Australian Naval Reserve (M) and (O) are hereby repealed.

NAVAL BRIGADE REGULATIONS.

1. In these Regulations, the following terms shall have the meanings given:—

Explanation of terms.

“Naval Board” means the Board of Administration for the Naval Forces.

“Director” means the Director of Naval Auxiliary Services.

“D.N.O.” means District Naval Officer.

“S.D.N.O.” means Sub-District Naval Officer.

“Naval Brigade” or “Brigade” means the Royal Australian Naval Brigade, and includes all members of H.M.A. Naval Forces who are not bound in time of peace to continuous Naval Service (other than the Royal Australian Naval Reserve) and all persons who are liable to be trained under Part XII. of the Defence Act, and are allotted to the Naval Forces.

“Cadet” means a Senior Naval Cadet, i.e., a male between the ages of 14 and 18 years, liable to training under the Defence Act and allotted to the Naval Forces.

“(A) Class” means those males between the ages of 18 and 25 years liable for training under Part XII. of the Defence Act and allotted to the Naval Forces.

“(B) Class” means those males over the age of 25 years who, having completed their service under Part XII. of the Defence Act, volunteer for further service under conditions prescribed.

 

“(M) Class” means members of the Royal Australian Naval Brigade (old Naval Militia) who were serving prior to the inauguration of Universal Training, and who are not bound in time of peace to Continuous Naval Service and who are paid for their services as prescribed.

“Adult” means any member of the Naval Brigade serving in A, B, or M Classes.

PART I.—ADMINISTRATION.

Section 1Organization.

Director of Naval Auxiliary Services—Powers of

1a. (1) The Director of Naval Auxiliary Services shall, subject to the control of the Naval Board, be charged with the administration of all matters relating to the Royal Australian Naval Brigade.

(2) The Director of Naval Auxiliary Services shall have similar powers to District Naval Officers as regards expenditure to those laid down in Naval Financial Regulations; but authorizations by him are to be considered by District Naval Officers as part of the sum allowed by Regulations to be expended for the District.

Naval Brigade Districts.

2. The Naval Brigade shall be divided into Districts and Sub-Districts, as follows:—

(2) Additional Districts or Sub-Districts may be formed with the approval of the Naval Board.

3. Each District shall be in charge of a Commissioned Officer termed the District Naval Officer.

4. Each Sub-District shall be in charge of a Commissioned or Warrant Officer, termed the Sub-District Naval Officer.

5. Warrant Officers and Chief Petty Officers, Petty Officers, and other ratings shall be attached to Districts and Sub-Districts for Administrative and Instructional purposes.

Inspection of Districts.

6. (1) The various Districts and Sub-Districts will be inspected annually by the Director, or by an Officer deputed by him, and also, least once a year, by the District Naval Officer or Officer deputed by him.

 

(2) The purposes of these inspections are to ascertain—

(a) Efficiency in training, discipline and internal economy;

(b) Condition of clothing, arms and equipment, and whether all books and records are correctly kept.

(See regulation 474, Books to be produced at Inspection.)

District Naval Officer.

7. The position of District Naval Officer is to be considered as constituting a definite and separate command at the Port where he has his Office.

D.N.O. as Senior Naval Officer.

8. (1) When the District Naval Officer is the Senior Naval Officer present he is to act in all respects as such. He will fly a Senior Officer’s pendant, and will direct the routine of the port by signal.

(2) He is, however, to confine himself to general supervision, and is not to interfere with the internal economy of ships and establishments not specially included in his command.

9. When he is the Senior Officer, a District Naval Officer will receive and return calls, whether made by Officers of the Royal Navy or by Foreign Commanding Officers, and generally shall have the right of command in matters of ceremony or international intercourse.

10. Regulations 7 to 9 of these Regulations shall apply also to Sub-District Naval Officers of and above the rank of Lieutenant.

Section 2.—Naval Brigade Staff.

Appointments.

14. In making appointments to the Naval Brigade Staff preference will be given to persons who have had long service in the Naval Forces of the Commonwealth.

15. Except those who have been on active service in time of war, no person shall be appointed who is under the age of 35 years, and every candidate for appointment must be prepared to serve in any State, and shall be subject to the Naval Defence Act and Regulations under the same.

Period of engagement C.P.O.’s and other ratings.

16. The period of engagement or re-engagement for Chief Petty Officers and other ratings shall be three years, but first appointments shall be on probation for six months.

Age for retirement.

17. (1) The age for retirement, except as provided in clause (2) of this regulation, shall be—

Captains, 62.

Commanders, 57.

Lieutenant-Commanders, 55.

Lieutenants, 52.

Warrant Officers, 60.

Mates, Sub-Lieutenants, or higher ranks who have been promoted from Officers of relative rank of Commissioned Warrant Officers and Commissioned Warrant Officers, 60.

 

Chief Petty Officers, Petty Officers, and all other ratings of the Naval Brigade Staff who were serving in the Permanent Naval Forces immediately prior to 1st July, 1911, and who had at that date not less than six years’ service in that Force, 60.

All other ratings, 57.

(2) The age of retirement for all ratings engaged or re-engaged on or after 1st July, 1918, shall be 55 years.

Retention for service after reaching retiring age.

18. (1) In exceptional cases the Director may recommend and approval may be given for the services of any person who would otherwise so retire being, notwithstanding his age, retained for a period not exceeding two years.

(2) All such recommendations are to be accompanied by a report as to medical fitness, and no extension will be granted for a longer period than one year at a time.

Instructors—Course of instruction.

19. Instructors must be qualified in either Seamanship, Gunnery, Torpedo, Signalling, or Physical Training, and may, before taking up their appointments, be required to undergo a short course of instruction at the Gunnery School in those of the above subjects in which they are not qualified.

Re-qualifying course.

20. Every three years all Warrant Officers and Instructors may be required to go through a re-qualifying course at the Gunnery School.

Tenure of appointment.

21. The general tenure of appointment at any place shall be for a term of not less than three years except at Thursday Island, Cairns and Townsville, where the period shall be two years.

Discipline—Punishment for breaches of.

22. Any member of the Naval Brigade Staff below the rank of Warrant Officer guilty of any act, conduct, neglect or disorder, to the prejudice of good order and Naval discipline may be punished by a fine which may be inflicted by a District Naval Officer to the extent of £5, or by a Sub-District Naval Officer of or above the rank of Lieutenant to the extent of £2. The ordinary punishments authorized by the King’s Regulations may also be inflicted so far as they can be made applicable to the peculiar nature of employment on the Naval Brigade Staff, but offences which, in the opinion of the District Naval Officer require a greater punishment than a fine, are to be reported to the Naval Board with a view to the offender being dismissed with or without disgrace (under Art. 758 King’s Regulations) or discharged “Services no longer required” or tried by Court Martial, and, pending the decision of the Naval Board, all such offenders are to be suspended from duty.

Vacancies for Warrant rank.

23. Vacancies for Warrant rank will be reserved for Warrant Officers and Chief Petty Officers who have passed the Educational and Seamanship test for “Warrant rank under the Regulations for the Permanent Sea-going Forces, except that Chief Petty Officers of the R.A.N.B. Staff appointed prior to 1st July, 1911, who had six years’ service in the force on that date may qualify for Warrant rank by passing the examination laid down in these Regulations. Chief Petty Officers who joined the R.A.N.B. Staff within the period 1st July, 1911, to 1st July, 1918, must, in addition, have served for two years in a sea-going ship.

PART II.—PERSONNEL.

Section 1.—Senior Naval Cadets.

26. The Senior Cadets allotted for Naval Training shall be called Senior Naval Cadets, and shall form a section of the Royal Australian Naval Brigade.

Registration and musters.

27. The registration of Cadets by the Military Authorities takes place annually in January and February, and each District and Sub-District Naval Officer is to arrange with the local military authorities for musters to be held annually as early as possible in March, of all persons so registered who reside within the Naval Training Area and is then to select for Naval Training such number of boys of the age of 14 as is authorized for his District or Sub-District (see Appendix IV.).

Maximum age for acceptance as Naval Trainee.

28. With the exception of sea-going persons, no trainee over the age of 14 years is to be accepted for training in the Naval Brigade without the approval of the Director, which will only be granted under most exceptional circumstances.

Enrolment and selection.

29. At Thursday Island, Port Fairy and Portland all trainees residing within a radius of 5 miles from the Naval Drill Room are to be enrolled for Naval Training.

30. (1) Except at those places where all persons registered are liable to Naval Training (see regulation 29), trainees are to be selected in the following order until a sufficient number is obtained:—

(a) Suitable volunteers residing not more than 1½ miles from the Naval Drill Room.

(b)Any other suitable trainees residing not more than 1½ miles from the Naval Drill Room.

(c) Suitable volunteers residing at a distance of from 1½ miles to 3 miles from the Naval Drill Room.

(d)Any other suitable trainees residing at a distance of from 1½ to 3 miles from the Naval Drill Room.

(2) Only in the event of there being an insufficient number of medically fit lads of the proper age resident within the 1½mile radius are any other boys to be enrolled, but under no circumstances except as provided in regulations 28 and 29 is the limit of residence to exceed 3 miles from the Naval Drill Room.

31. Immediately the selection is completed a report is to be made to the Director showing the numbers enrolled, classified as above.

Advancement.

32. Cadets who are qualified as laid down in Appendix III. and have shown aptitude and fitness to take charge of a squad may be rated Petty Officer or Leading Cadet with the approval of the District Naval Officer, provided that not more than 4 per cent. of the Cadet strength of any Sub-District shall be Petty Officer Cadets nor more than 8 per cent. Leading Cadets.

Transfer to Adult Force.

33. On the 1st of July in the year in which they attain the age of eighteen years Cadets shall transfer automatically to the Adult Force, class (A).

Section 2.—Adult Force.

Entry in Adult Force.

38. Before the 1st of July in the year in which a Cadet reaches the age of eighteen years he shall be medically examined, and if found fit in every respect shall transfer to the Adult Force on 1st July in that year, and shall receive therein such rating as he is considered most suitable for in accordance with these Regulations, provided the establishment is not exceeded.

39. For administrative purposes the Adult Force in the various Districts and Sub-Districts shall be detailed for certain specified duties.

Proportion of ranks and ratings.

40. (1) The proportion of the various ranks and ratings to be borne on the strength of each District will be as laid down in the Establishment issued by the Director prior to the beginning of each financial year.

Establishment.

(2) The Director shall be responsible to see that the Establishment fixed does not exceed the provision authorized on Estimates for the various ranks and ratings.

(3) Numbers in excess of those authorized for any particular rank or rating may be borne on the strength, provided that there are vacancies in higher ranks or ratings of the same class, and that the total complement of the District is not exceeded.

(4) Numbers in excess of those authorized for any particular rank or rating in any District, may, with the approval of the Director, be borne in lieu of a shortage of similar ranks and ratings in another district.

Rating on transfer from Cadets.

41. On transfer from the Cadets men not appropriated to any special branch, shall be given the rating of Ordinary Seaman.

Advancement.

42. Advancement to higher ranks or ratings will be as laid down in Appendices I. and II. to these Regulations.

D.N.O.’s may promote up to and including rating of C.P.O.

43. (1) District Naval Officers are empowered to promote up to and including the rating of Chief Petty Officer in accordance with these Regulations, and shall be responsible that the best and fittest men are selected for higher ratings, irrespective of seniority.

(2) Provided that, when Trainees are mobilized for three months or over in time of war or emergency, they may sit for examination, and, if passed and recommended, be given a higher rating, irrespective of whether they have served two years in the lower rating where such is previously specified.

Promotion not to be in excess of Establishment.

(3) Promotions made under the above regulation shall not be in excess of those allowed by the Establishment unless the approval of the Naval Board is first obtained.

Changes in ranks and ratings—Notice to Senior Accountant Officer.

(4) The Senior Accountant Officer as defined in regulation 159 shall be notified in writing over the signature of the District Naval Officer of all promotions, disratings, discharges, or other changes in ratings immediately after they are approved.

Promotions—ante-dating of.

44. No promotions shall be ante-dated for a period exceeding one month except with the special approval of the Naval Board.

Examinations.

45. District Naval Officers are to make all arrangements in the District under their command for the holding of examinations for all ratings up to and including Chief Petty Officers. (For subjects of examination see Appendix II. to these Regulations.)

46. (1) Whenever possible, examinations should be held by two Officers thoroughly conversant with the subjects of examination, but when such Officers are not available from his staff, the District Naval Officer is to make application to the Director for such Officers’ services.

(2) In the case of the Accountant Branch, all candidates for appointment should be recommended by the Senior Accountant Officer of the District, who shall also be one of the Officers to conduct the examination.

C.P.O.’s, P.O.’s. and Leading Ratings may revert to lower rating.

47. (1) Chief Petty Officers, Petty Officers, and leading Ratings may, with the consent of the District Naval Officer or Sub-district Naval Officer, resign their rating and revert to any rating previously held by them, but they shall not be allowed to do so in order to avoid trial by Court Martial.

(2) Such resignation, and that it was at the member’s own request, shall be noted in the Register and the Record Book, and signed by the District or Sub-district Naval Officer; the written application being filed in office.

Naval Brigade Bands.

48. (1) Subject to the approval of the Director, such number of physically fit men as may be required to maintain the strength of Naval Brigade Bands may from time to time be enrolled as members of the Citizen Naval Forces. Such members will not be liable to perform any naval training, but must attend at such places and on such occasions as the District Naval Officer may direct.

(2) Bandmasters entered under this regulation will hold the rank of Warrant Officer; Bandsmen, the rating of Petty Officer.

(3) The minimum age of entry is twenty-five years, and the retiring age fifty years.

(4) The Bandmaster will receive quarterly the pay of his rank on the certificate of the District Naval Officer that he has satisfactorily performed the duties required of him during the period for which such pay is claimed.

(5) The pay of their rating will be issued quarterly to Bandsmen on the certificate of the District Naval Officer and Bandmaster that they have satisfactorily performed the duties required of them during the period for which such pay is claimed.

(6) Provided that in any one financial year no member of the Citizen Naval Forces enrolled under this authority shall, without the approval of the Naval Board, receive more than the annual amount of pay provided for his rank or rating in regulation 283 of these Regulations.

Enrolment in “B” class and period of engagement.

49. Prior to enrolment of any person who volunteers for service in “B” Class, such person shall be medically examined, and if found fit for service shall be sworn in for service with that branch of the Brigade for a term of three years, and subsequently thereafter at the expiration of each period of three years provided such person volunteers for further service and is medically fit.

50. Members of the Brigade (M) shall be re-sworn in for service every three years provided they so volunteer and are medically fit.

Medical unfitness.

51. Any member of the (M) or (B) Class of the Brigade found to be medically unfit for further service at any time during, his engagement is to be discharged to shore forthwith.

PART III.—OFFICERS.

Section 1.—Appointments.

Appointments.

53. (1) The Naval Board may, on the recommendation of the Director of Naval Auxiliary Services, and subject to the qualifications and conditions hereinafter provided, recommend suitable candidates for appointment to, or commissions in, the Naval Brigade.

(2) No further appointments will be made to (M) Class.

Rank.

54. Officers of the Royal Australian Naval Brigade shall rank with, but after, Officers of corresponding ranks in the Royal Australian Naval Reserve.

Parentage.

55. Candidates must be of pure European descent, and the sons of natural-born or naturalized British subjects.

Age on first appointment.

56. The age for first appointment of Officers in (A) Class shall not exceed—

Seniority of officers.

57. (1) The seniority of Officers in the Royal Australian Naval Brigade in their respective ranks shall be regulated by the dates of their appointments, or, in the case of first appointment, by the order in which names appear in the Gazette in which their appointments are notified.

(2) On appointment or promotion Officers in the Royal Australian Naval Brigade shall be paid at the prescribed rates for their corresponding ranks as from the date upon which they perform the duties of their rank notwithstanding that the dates of their appointments for purposes of seniority may be ante-dated prior to the date of taking up the duties of the rank.

Establishment.

58. (1) The numbers of Officers of each rank allowed to each District shall be as shown on the Establishment issued by the Director on the approval of the Naval Board prior to the beginning of each financial year.

(2) In no circumstances shall the numbers of Officers of each rank as allowed by the Establishment be exceeded without the special approval of the Naval Board being obtained. This regulation shall not affect the appointment to any District of Honorary Officers as provided in regulation 59.

 

Honorary officers’ uniform and pay.

59. The Naval Board may recommend the appointment of such Honorary Officers as they may see fit in virtue of their honorary rank. Honorary Officers may wear the uniform of their respective ranks, but shall not be entitled to receive any emoluments.

Command afloat.

60. No Officer of the Naval Brigade shall have Naval command afloat unless duly qualified under the Regulations of the Royal Australian Naval Reserve and with the approval of the Naval Board.

Officers required to serve for twelve years.

61. (1) Officers who are liable for training under Part XII. of the Defence Act are required to serve as Officers for a period of twelve years in order that such service may count towards the service required under Part XII. of the Defence Act. In no case, except as provided for in regulation 225, can an Officer be relieved of further liability to training unless he has served as such for the full period required of him if he had served in the ranks.

(2) Provided, however, that where exceptional hardship would otherwise be caused, an Officer may be allowed to count less than twelve years’ service as a compliance with the Act subject to the special recommendation of the Director and approval of the Naval Board. (See regulation 106.)

Section 2.—Qualifications and Promotions.

Selection.

66. Officers of the Naval Brigade shall be selected from adult members of that Force who hold the necessary qualifications as hereinafter laid down.

Examination of officers.

67. Lists of candidates for Officers’ commissions are to be forwarded to the Director annually in month of December.

68. Candidates for Paymaster Cadet must have served in the Senior Naval Cadets for three years, and been classified “efficient” for that time, and must pass the examination prescribed in Appendix I.

69. (1) A candidate for Acting Sub-Lieutenant, or Acting Engineer Sub-Lieutenant, must have served in the Senior Naval Cadets for three years, and been classified “efficient” for that time, must have passed an entrance examination to a university, or must pass an approved examination of equal standard and the examination as laid down in Appendix I. to these Regulations; he must be recommended by the District Naval Officer as to general fitness for commissioned rank.

(2) A candidate for Acting Engineer Sub-Lieutenant must be an engineering student at some recognised institution, or an indentured apprentice or articled pupil at an approved engineering establishment, and have attended a technical college for his academic instruction.

(3) Notwithstanding anything contained in the next two preceding paragraphs, the Naval Board may recommend for appointment as Acting Sub-Lieutenant or Acting Engineer Sub-Lieutenant any person employed upon a sea-going vessel who has been allotted to the Naval Forces for training, and who shall comply in all respects with the conditions of appointment laid down in these Regulations, except that such

 

person shall not be required to have served in the Senior Naval Cadets for three years, provided, however, that such person must have been classified as “efficient” for the period for which he was liable to training under Part XII. of the Act.

70. Acting Sub-Lieutenants and Acting Engineer Sub-Lieutenants shall be promoted to Sub-Lieutenants and Engineer Sub-Lieutenants on probation on passing the prescribed examination, and may be confirmed inrank after completing a probationary period of six months to the satisfaction of their District Naval Officer; the probationary period may be extended for a further period not exceeding twelve months (except as provided for in regulation 79 (2) and (3), but such extension will entail a corresponding loss of seniority.

Warrant officers.

71. Warrant Officers shall be selected from candidates of not more than 23 years of age who have held a relative rating not lower than Leading Seaman for two years, and have passed the educational test for a relative rating of Petty Officer; candidates for warrant rank must also be well reported on, be of good character, be recommended by their District Naval Officer, and must pass such examination as the Naval Board may from time to time direct.

71a. Chief Warrant Officers shall be selected from Warrant Officers of not more than 30 years of age who have held Warrant Rank for not less than five years, and must be well reported on, be of good character, and be recommended by their District Naval Officer, and must pass such examination as the Naval Board may from time to time direct.

(2) In the case of E.R.A. ratings at present serving in (M) Class, the age limit for first appointment may, subject to the approval of the Naval Board, be extended, not exceeding 28 years.

Lieutenants and Lieutenants (E).

72. Lieutenants and Engineer Lieutenants shall be selected from Sub-Lieutenants and Engineer Sub-Lieutenants of not less than two years’ seniority, who have qualified by passing the examinations laid down for their respective ranks.

Lieutenants (Constructional Branch).

73. The Naval Board may recommend for appointment as Lieutenants (Constructional Branch) in the Royal Australian Naval Brigade such number of persons as may be required from time to time, who are qualified civil engineers or architects or surveyors, and who shall comply in all respects with the conditions of appointment laid down in these Regulations, whether liable to universal service under Part XII. of the Act or not.

(2) Such appointments shall be on probation, and, on passing the prescribed examination at any time within eighteen months of first appointment, they may be confirmed in rank.

Lieutenant-Commanders, Lieutenant-Commanders (E) Lieutenant-Commanders (Constructional Branch).

74. Lieutenant-Commanders, Engineer Lieutenant-Commanders, and Lieutenant-Commanders (Constructional Branch) shall be selected from Lieutenants, Engineer Lieutenants, and Lieutenants (Constructional Branch) respectively of not less than six years’ seniority in those ranks who are recommended by their District Naval Officers for promotion.

Commanders, Commanders (E), Commanders (Constructional Branch).

75. Commanders, Engineer Commanders, and Commanders (Constructional Branch) shall be selected from Lieutenant-Commanders, Engineer Lieutenant Commanders, and Lieutenant Commanders (Constructional Branch) respectively of not less than two years’ seniority in those ranks.

 

Re-qualification.

76. Sub-Lieutenants, Engineer Sub-Lieutenants, Lieutenants, and Engineer Lieutenants may be required to pass a re-qualifying examination every three years.

Paymaster, Sub-Lieutenants.

77. Paymaster Cadets, on attaining the age of 21 years, shall be eligible for promotion to Paymaster Sub-Lieutenant on passing the examination prescribed in Appendix I. to these Regulations.

Paymaster, Lieutenants.

78. Paymaster-Lieutenants shall be selected from Paymaster Sub-Lieutenants of not less than four years’ seniority in that rank who have passed the prescribed examination.

Cancellation of appointments.

79. (1) The appointments of Officers who are not recommended for confirmation within eighteen months shall be cancelled.

(2) Provided that in time of war the time during which an Officer is on active service abroad with any of His Majesty’s Forces shall not be reckoned as part of the prescribed time for probationary appointment.

(3) Provided also that an Officer who has been on active service abroad with any of His Majesty’s Forces during war may be confirmed in rank after passing the prescribed examination at any time within eighteen months of his return to his District, notwithstanding anything to the contrary contained in sub-regulation (1) of this regulation.

80. Notwithstanding anything contained in these Regulations, any Officer who has performed such particularly good service as is considered to be deserving of special promotion may, on the recommendation of the Director of Naval Auxiliary Services and the Naval Board, be promoted accordingly.

Surgeon-Lieutenants.

83. Surgeon-Lieutenants, in addition to the District and Sub-District Naval Medical Officers, may be appointed to any District subject to the necessary provision being made by Parliament.

84. To be eligible for appointment as Surgeon, a candidate must comply in other respects with the conditions of appointment laid down in these Regulations, and must be—

(a) a duly qualified and registered practitioner under the States Medical Acts; and

(b) resident in such a place that he can undertake any duties with the Brigade that he may be required to perform.

Surgeon Lieutenant-Commander—Promotion to.

85. A Surgeon-Lieutenant will be eligible for promotion in a vacancy to the rank of Surgeon Lieutenant-Commander on attaining eight (8) years’ seniority in rank, provided he has twice embarked for training in one of H.,M.A. ships, each period of training to be not less than twenty-one days.

Surgeon-Commander—Promotion to.

86. A Surgeon Lieutenant-Commander will be eligible for promotion in a vacancy to the rank of Surgeon Lieutenant-Commander on attaining eight years’ seniority as Surgeon Commander.

Appointment of D.N.M.O. or S.D.N.M.O.

87. Surgeon Commanders, Surgeon Lieutenant-Commanders, and Surgeon Lieutenants, whether on the Active or Retired List, will be eligible for appointment as District and Sub-District Naval Medical Officers.

 

88. Surgeon Commanders, Surgeon Lieutenant-Commanders, and Surgeon Lieutenants of the Royal Australian Naval Brigade will be liable to be called out for service in the Fleet in time of war or emergency.

Medical officers—Extra training.

89. Medical Officers shall be permitted to take periods of extra training in H.M.A. ships (in addition to that referred to in regulation 85), in order to acquaint themselves more fully with the Naval organization. Such extra training will be considered as war service training, and Medical Officers so embarked will be paid war service rates of pay, as stated in regulation 310. No officer will, however, be permitted to undergo this extra training more than twice in the first four (4) years, and twice in the second four (4) years of his service, and no one period shall exceed 21 days, ,

Section 3.—Removal from Naval Forces List.

Cancellation of commission for misconduct.

92. If an Officer of the Royal Australian Naval Brigade is guilty of improper conduct, or of any civil offence bringing discredit on the Service, or is negligent in the performance of his duty, the Governor-General, may cancel his commission, but before such cancellation the Officer shall be notified, in writing, of the complaint or charge against him, and shall be called upon to show cause in relation thereto.

Absence without leave.

93. The commission of an Officer absent without leave for a period of three months or upwards may be cancelled by the Governor-General.

Resignation of rank.

94. Any Officer may, at his own request and with the approval of the Naval Board, resign his rank and revert to any rating previously held by him, but he shall not be allowed to do so in order to avoid trial by Court-Martial.

Resignation may be cancelled.

95. The Governor-General may, on the application of the person concerned, cancel the resignation of any Officer who has been employed under the Acts, and may place him on the Unattached List or Retired List.

Officers to report themselves annually.

96. Officers on the Unattached and Retired List shall report themselves, in writing, during January or February in each year to the Secretary, Department of the Navy; failing this, their names shall be removed from the Forces List.

106. (1) Officers entered under the provisions of section XII. Defence Act may be permitted to retire any time after completing twelve years’ service as an Officer, and may be granted permission to retain their rank and wear their uniform, and may, on the recommendation of the Naval Board, be accorded a step of honorary rank. (See regulation 61.)

(2) Other Officers may be allowed to retire on completion of five years’ service as an Officer, and may be granted the concessions mentioned in sub-regulation (1) of this regulation.

109. Any Officer who would otherwise so retire may, nevertheless, on the recommendation of the Naval Board, be required, notwithstanding his age, to continue to perform his duty for a period not exceeding two years.

Section 5.—Duties of Officers.

Commanding Officers.

Responsible for efficiency.

112. A Commanding Officer is responsible for the maintenance of discipline, efficiency, and proper system in the unit under his command. He is to see that the Officers are practically instructed in their duties, and will, at his discretion, direct them to take command of the drill, and in his presence exercise the detachment.

Officers’ capabilities to be brought to the notice of the D.N.A.S.

113. He will bring specially to the notice of the Director through the District Naval Officer, without favour or partiality, any Officer who may be distinguished for attention to and proficiency in his duties, as well as those who from incapacity or habitual inattention have a deficient knowledge of their duties or show an indisposition to afford their superior Officers that support that the latter have a right to expect, or conduct themselves in a manner injurious to the efficiency and the credit of the Service.

Officers’ abilities.

114. A Commanding Officer shall at all times make himself thoroughly acquainted with the abilities of the whole of the Officers placed under his charge, so as to assist the District Naval Officer in the appreciation of the Naval acquirements of those under his command.

Dress and appearance of men.

115. Great attention is required from the Commanding Officer with regard to the cleanliness of the clothing, arms, and accoutrements of the men. The dress and appearance, as well as the demeanour of the men, should, on all occasions and in all situations, be such as to create a respect for the Service.

Standing Orders.

116. An Officer in temporary command is not to give out any Standing Orders, or alter those issued by his superior Officer, without reference to the latter.

Promulgation of General Orders, &c.

117. Commanding Officers are to cause every order issued for general information and guidance to be made known to all those in their command. They are to afford to all those under their command every facility for becoming acquainted with changes in Regulations and Orders.

Orders to be read to the men.

118. All Orders relating to the R.A.N. Brigade are to be read and explained immediately after such Orders are received, and those of an important nature are to be read on two successive musters and drills.

Lieutenants.

Bad language to be checked.

121. A Lieutenant is to see that all subordinates perform their duties with diligence and propriety. He is to check all profane swearing and improper or obscene language, and all disturbances, noises, or confusion.

To be attentive to the men.

122. He is to be particularly attentive to the Company under him, keeping a list of their names, ratings and conduct. He is to see that the subordinate Officers are constant in their attention to their men, and he is to encourage them to perform their duties with strictness, but in a spirit of kindliness and thoughtfulness for the men, checking them whenever he may observe any tendency to undue harshness or irritating language.

 

Cleanliness and dress.

123. He is to see that the men of his Company are at all times as clean as their duties will allow, that they are properly dressed, and that their clothes and accoutrements are in good order and not requiring repair. He is to take opportunities of examining those who may be habitually careless or dirty, and to adopt such measures for correcting and leading them into better habits as may be necessary.

Arms and accoutrements.

124. He is to see that the men of his Company take care of their arms, accoutrements, and their clothing, and that they do not use them for any purpose not connected with the Service.

Deficiencies in kit.

125. He is to bring to the notice of his Commanding Officer any cases of any of his Company being short or deficient of any articles allowed by the Regulations.

Advancement.

126. He is to submit to his Commanding Officer the names of such men as from zeal and ability are worthy of advancement, and he is to encourage and bring forward those who are specially desirous of improving themselves in the knowledge of their duties.

Other officers performing lieutenants’ duties.

127. The above instructions for Lieutenants are to be observed by all Officers of whatever rank, who may be called upon to perform duties usually assigned to Lieutenants.

Sub-Lieutenants.

To obey orders.

130. A Sub-Lieutenant is to be attentive to his duties and zealous in carrying into effect the orders and directions he may from time to time receive from his superior Officers.

To supervise subordinates.

131. So far as practicable, he is to see that all subordinate Officers and all those of inferior rank to himself properly perform the duties required of them.

To acquaint himself with his men.

132. He is to provide himself, on joining, with a nominal roll of the Company to which he is attached, and as soon as possible is to make himself acquainted with the disposition, character, and service of each of his men, and generally to afford every assistance to the Lieutenant of his Company.

Engineer Officers.

Acting Sub-Lieutenant (E).

135. An Acting Engineer Sub-Lieutenant shall assist the Engineer Officer of the day in a Depôt ship or Establishment.

Sub-Lieutenants (E).

136. An Engineer Sub-Lieutenant shall assist the Senior Engineer Officer in watch keeping, in the care and maintenance of the machinery under his charge, and in the supervision of refits and repair of the same.

Lieutenant (E).

137. An Engineer Lieutenant shall be required to supervise under the next Senior Engineer Officer the refitting, repair, and care and maintenance of the machinery, &c., afloat or ashore, under that Officer’s charge, and in his absence to initiate and supervise the same.

 

138.An Engineer Lieutenant shall also, under the next Senior Engineer Officer, take charge of the ranks junior to him and ratings of his branch of the Brigade, detailing the mechanical ratings for their several duties, and be generally responsible for the efficiency and cleanliness of the material and personnel of his branch.

Senior Engineer Officer.

139. The Senior Engineer Officer shall be responsible under the District Naval Officer for the efficient instruction and supervision of the Ranks and Ratings of that Branch attached to his District. He is also to be responsible to the District Naval Officer for the proper care and maintenance of all machinery, stores, and material on charge to his Branch.

Officers’ Constructional Branch.

Senior Officer, Constructional Branch

142. The Senior Officer of the Constructional Branch is responsible to the District Naval Officer for the efficient instruction and supervision of the Ranks and Ratings of that Branch attached to his District. He is also to be responsible to the District Naval Officer for the proper care and maintenance of all constructional plant, stores, and material on charge to his Branch.

Medical Officers—Duties, Pay, Retainers, &c.

Attendance.

147. Medical Officers shall attend on such occasions as may be ordered by the District Naval Officer, or, in the case of an outport, by the Sub-District Naval Officer.

Duties of D.N.M.O.’s and S.D.N.M.O.’s.

148. District and Sub-District Naval Medical Officers shall perform the following duties, for which they shall receive pay as shown in regulation 149a.:—

(a) Provisional examination of Recruits for, or re-enrolment in, the Permanent Naval Forces, when required.

(b) Provisional examination of Cadet Midshipmen for the R.A.N. College.

(c) Medical examination of candidates for commissions in the Permanent Naval Forces, R.A.N.B., and R.A.N.R.

(d)Medical examination of recruits for the Citizen Naval Forces, and boys liable for training as Senior Naval Cadets.

(e) Medical examination of recruits for, or re-enrolment in, the R.A.N.R., and R.A.N. Radio Service.

(f) Medical examination of Candidates (Civil) for Permanent employment in the Department of the Navy, other than above.

(g)Medical attendance at the Medical Officers’ Surgery on members of the R.A.N.B. Staff, their wives and families, and civilian members of the permanent Clerical Staff at the Naval Brigade Staff Offices of the respective States, also attendance at their homes provided they live within a radius of 2 miles of the Naval Brigade Staff Office, such Medical attendance not to include operations, except those of a minor character not requiring an anæsthetic.

 

(i) The cost of medical attendance in confinement cases of wives of members of the Royal Australian Naval Brigade Staff shall not be allowable.

(h) Medical attendance at the Medical Officers’ Surgery on members of the R.A.N. Radio Service if they come within the district of the D.N.M.O., attendance at their homes only if they reside within a radius of two (2) miles of the Naval Brigade Staff Office.

(i) Attendance on Medical Boards and Surveys.

(j) Examination, for rating or advancement of the R.A.N. and R.A.N.B. Sick Berth Staff other than the examination for Chief S.B.S.

(k)Medical examination in cases of injury arising out of employment amongst employees of the Department not provided for by the regulations as may be considered necessary, and subsequent periodical reports as may be required by the Department. This is not to include Medical attendance on these patients.

(l) Medical examination and report in cases of sickness (other than injury) amongst employees of the Department. This is not to include Medical attendance.

(m) Medical attendance on members of the Permanent Naval Forces from H.M.A. Ships left behind or sick on leave at his port, except when in Hospital, when they will be treated by the Hospital Staff under the Hospital regulations.

(n) Medical attendance on members of the R.A.N.B.—

(i) At the Naval Staff Office.

(ii) At the Medical Officers’ Surgery.

(iii) At their homes if they live within a radius of 2 miles of the Naval Staff Office.

(2) Provided always—

(a)That the disease is not due to the member’s default.

(b)That in the case of Sydney and Melbourne he cannot be suitably treated at the Sick Bay of Penguin or Cerberus, and

(c) That he is not a Hospital case.

148a. (1) District Naval Medical Officers are to make arrangements, when required, for the reception of Naval patients into Civil Hospitals.

(2) When a patient is sent to a Civil Hospital from one of H.M.A. Ships, the D.N.M.O. or S.D.N.M.O. at the request of the District Naval Officer will visit him and report as to his condition and make such notes on his Hospital Case Sheet (A.M. 188) as may be necessary for the information of the Medical Officer of his Ship or the Naval Board, on the patient’s discharge.

(3) Attendance on board H.M.A. Ships in cases of emergency in the absence of the Naval Medical Officer.

148b. With regard to the granting to trainees of leave of absence from compulsory drills on the ground of illness, it is the duty of the D.N.M.O. to visit and report upon all cases of illness or injury contracted on duty.

148c. The D.N.M.O. will medically examine and report on cases other than those mentioned on which his opinion may be desired.

148d. Members of the crews of vessels under the direction of the Department may be sent to the Medical Officer for medical attendance or may be treated on board the vessel. If a boat is required this must be provided by the Department.

 

148e. A return is to be rendered monthly by the D.N.M.O. on Form A.N.B. 12 of all cases treated.

148f. In the event of a District or Sub-District Naval Medical Officer being unable to attend to any of the prescribed duties, he will required to arrange that another Medical Practitioner acts for him without cost to the Department; in which case he should acquaint the District or Sub-District Naval Officer at once of the name and address of the practitioner selected.

Special Circumstances.

148g. In addition to the foregoing, the District Naval Medical Officer at Melbourne shall perform the following duties:—

(a)Medical attendance at the Medical Officer’s Surgery on Civilian members of the Permanent Administrative Staff (City Offices) and the Permanent Clerical Staff of the R.A.N. Radio Service at the Head Office, Collins House, Collins-street, Melbourne, also at their homes provided they live within a radius of 2 miles of the Navy Office.

(b)Medical examination in cases of injury arising out of employment amongst employees at the New Pier, Port Melbourne, or docks, &c., provided such employees reside in the D.N.M.O.’s district, and subsequent periodical reports as may be required by the Department. This is not to include medical attendance.

(c) The Melbourne Metropolitan District will be fixed at a radius of 4 miles from the Naval Staff Office, Port Melbourne, but will not extend further west than the Saltwater River.

(d)The duties of the District Naval Medical Officer and Assistant District Naval Medical Officers are to be divided as follows:—

(i) The District Naval Medical Officer to attend all Naval Patients,

(ii) The Assistant District Naval Medical Officer (Melbourne) to attend all Civil Patients,

(iii) The Assistant District Naval Medical Officer (Williamstown) to attend patients west of the Saltwater River.

148h. In addition to the foregoing, the District Naval Medical Officer at Sydney shall perform the following duties:—

(a) Medical attendance at the Medical Officers’ Surgery on Civilian members of the Permanent Administrative and Clerical Staff of the Establishments and Offices, also attendance at their homes provided they reside within 2 miles of the Naval Staff Office, and water transport is not necessary.

(b)Medical examination of persons demobilized or discharged, for reasons other than sickness or injury, report of examination is to be furnished on Form A.M. 146z.

Retaining Fees.

149. (1) The retaining fees of District and Sub-District Naval Medical Officers shall, as from 1st July, 1918, be in accordance with the following scale:—

Medical officers (others).

150. (1) Medical Officers other than District or Sub-District Naval Medical Officers shall attend at Annual Continuous Training, target and rifle practice as required, for which they will receive £2 for whole day, £1 for half day.

(2) Where Medical Officers are called upon to assist District, Sub-District, or Assistant Naval Medical Officers, or to perform the duties of District, Sub-District, or Assistant Naval Medical Officers when those Officers or their substitutes, vide regulation 148f, are not available, they shall receive pay according to the scale of charges laid down in the foregoing Regulations.

151. In the event of a Medical Officer being unable to attend any of the foregoing duties he shall make arrangements with another Medical Officer to act for him without cost to the Department, at the same time informing the District or Sub-District Naval Officer.

152. Medical Attendance for R.AN.B. Staff shall be as prescribed in Naval Financial Regulations.

Accountant Officers.

Paymaster Cadet.

156. A Paymaster Cadet shall, under the Senior Accountant Officer of the Ship, Depôt, or District, perform such duties as pertain to correspondence, pay, victualling, and messing of the R.A.N. and R.A.N. Brigade. He is also to perform such clerical duties as may be detailed.

Paymaster Sub-Lieut.

157. (1) A Paymaster Sub-Lieutenant shall, under the Senior Accountant Officer of the Ship, Depôt, or District, he responsible for the Ship’s Ledger, Ship’s Steward’s Books, and such general work of the Office as may be detailed.

(2) He is also to make himself acquainted with the Pay Cash, Store and Victualling Accounts, the procedure for receipt and custody of Cash, Provisions, Clothing, &c., and is also to be conversant with the Naval Discipline Act, King’s Regulations and Admiralty Instructions, Naval Court Martial Procedure, Defence Act, Naval Defence Act, and regulations in force from time to time for the R.A.N. Brigade.

Paymaster Lieutenant.

158. (1) A Paymaster Lieutenant shall, under the Senior Accountant Officer of the Ship, Depôt, or District, instruct Junior Accountant Officers in their professional duties, and is personally to see that, apart from their actual duties, they obtain a satisfactory knowledge of the duties of an Accountant Officer.

(2) He will have under his control to assist him in the performance of his duties the Writers, Ship’s Stewards, and Ship’s Cook Ratings of the R.A.N. Brigade.

(3) In addition he is to have a good knowledge of the Naval Discipline Act, King’s Regulations and Admiralty Instructions, Naval Court Court Martial Procedure, and all Acts and Regulations governing from time to time the R.A.N. Brigade.

159. The clerk appointed to the District to be Certifying Officer under Naval Account Regulations or, in the event of a clerk not being appointed for such duties, the Accounts Officer appointed under Regulations shall, under the District Naval Officer, have direction and control of all Ranks and Ratings attached to the Accountant Branch in the district, and for the purposes of Administration of the Royal Australian Naval Brigade in the District shall be considered to be the Senior Accountant Officer.

Section 7.—Reports onOfficers.

167. (1) District Naval Officers are to render annually on 30th June to the Director a report on Form A.N.B.9 of all Officers of the R.A.N. Brigade attached to their Districts.

(2) In the cases of Sub-Districts the reports are to be prepared by the Sub-District Naval Officer, and the District Naval Officer is to insert his own remarks in the last column. Written reports from the Commanding Officer of the Training Ship and from the Senior Brigade Officer are to be obtained by the District Naval Officer, and, in the event of the latter disagreeing with the opinion expressed by either of the former Officers, such reports are to be attached to Form A.N.B.9.

PART IV.—MEDICAL EXAMINATIONS.

Medical examination of Cadets.

169. Senior Cadets on being allotted for Naval training shall be medically examined by the District or Sub-District Naval Medical Officer or by a Medical Officer of the Naval Forces.

Physical standard.

170. No absolute standard of height and chest measurement shall be required for fitness to serve in the Senior Naval Cadets, but the Medical Officer shall be guided by the principles laid down in the Regulations for Recruiting for the R.A.N., except that—

(a) The standard for eyesight shall not be less than 6-6, 6-9, or 6-12 with both eyes for ratings requiring 6-6, 6-9, and 6-12 in each eye separately, as tested with Snellin’s types at 20 feet distance.

(b) The standard for teeth may be relaxed, but no person shall be passed medically fit who is edentulous, in either jaw, or unless he has sufficient teeth in either jaw which, with dentures, enable him to masticate properly and maintain his health.

171. Senior Naval Cadets shall, in the year in which they reach eighteen years of age, be examined as to their physical fitness to serve in the A class (Adults), by a Naval Medical Officer, who shall make all necessary entries in the Record Books.

Medical examination on transfer to adult forces.

(2) Any Cadet then found to be medically unfit for Naval Service shall be transferred to his Military Area for the purpose of examination by the Area Medical Officer as to his ultimate exemption from military training. Form A.N.B. 7 is to be used for the transfer.

(3) Members of the (A) class shall be examined again before transfer to (B) class.

Standard on transfer.

172. On transfer to the (A) class a Cadet must be not less than 5 feet 2½ inches in height, with a mean chest measurement of 32 inches.

Members may be medically examined at any time.

173. At any time during his Service, a member may be required by the District or Sub-District Naval Officer to be medically examined, and if found unfit for Naval Service, he shall be dealt with as provided for in regulation 171. Form A.N.B. 7 is to be used for the transfer.

174. All persons called up by proclamation or enlisted for service shall be subject to a Medical examination as prescribed, the report of such examination being entered in the Register A.M. 93.

PART V.—TRAINING.

Section 1.—Nature and Duration of Instruction.

D.N.O.’s to arrange instruction.

177. District Naval Officers are to arrange the instruction in their Districts in accordance with the syllabus issued by the Director, and Sub-District Naval Officers shall be responsible that all drills in their Sub-Districts are carried out as directed by the District Naval Officer.

Instructors.

178. In order to obtain the best results it is necessary that the Instructional Staff should give their very best efforts to the work, and consideration will be given to those Instructors who show good results at the annual inspection by the Director.

 

Physical training.

179. Physical exercise is to be limited to the simple exercises laid down, and is to be used in conjunction with signal and boat exercises. Not more than 15 minutes in each day of 6 hours is to be devoted to this subject.

D.N.A.S.’s inspection.

180. The Director’s annual inspections will be confined to the subjects each class should have been instructed in during the preceding twelve months, as laid down in the syllabi issued from his office.

181. The text-books required for instructional purposes are:—

(a) Gunnery Drill Book for H.M. Fleet (latest issue).

(b) Rifle and Field Exercises for H.M. Fleet (latest issue).

(c) Manual of Seamanship, Vol. 1 (latest issue).

Cadet training, duration of.

182. (1) In the case of Cadets, the training prescribed is four whole-day, twelve half-day, and twenty-four quarter-day or night drills, the duration of such drills being not less than four hours, two hours, and one hour respectively, and are to be so arranged that the following compulsory drills are carried out annually in the Cadets Employers’ time, viz.:—

(a) Four whole days (4 hours each).

(b) Four half days (2 hours each).

(c) Twelve quarter days (1 hour each).

(2) Six (6) half-day drills of 2 hours each may, with the approval of the D.N.A.S., be substituted for the 12 quarter-day drills above.

(3) No voluntary or make-up drills are to be ordered in the employers’ time.

Voluntary camps.

182a. Voluntary camps may be held at the discretion of the District Naval Officer, provided that approval to the estimated expenditure involved shall have previously been obtained on the prescribed form A.N.B. 24. Each day’s attendance at such voluntary camp shall be considered equivalent to 8 hours’ drill.

Adult training, duration of.

(A) Class.

183. (1) In (A) class the training prescribed is seventeen days’ continuous training, and eight half-day and sixteen night drills, or as may be varied by the District Naval Officer in accordance with Regulation 185.

(B) Class.

(2) In (B) class the training prescribed is four days’ continuous training and six half-day and six night drills.

(M) Class.

(3) In (M) class the training prescribed is four days’ continuous training and fourteen half-day and thirty-two night drills.

(4) The “camp” referred to in section 127 of the Act shall be any Ship or place used for Naval purposes.

Duration of drills.

(5) Whole-day drills during continuous training shall include the whole twenty-four hours, otherwise the duration of a whole-day drill shall be not less than six hours, of a half-day drill not less than three hours, and of a night drill not less than one hour and a half.

(For exemption from training for War Service, see regulation 225.)

Commencement of drills.

184. Time of drills shall count from the time the class first embark or fall-in at the drill-room or other shore establishment.

Substitution of daylight for night drills.

185. At the discretion of the District Naval Officer and to suit the convenience of trainees, whole-day or half-day drills may be substituted for night drills, and day drills for half-day drills, but in no case are night drills to be substituted for daylight drills.

Extra drills.

186. Extra drills, continuous or otherwise, shall be arranged in order to enable members of the Naval Brigade who have failed to complete the prescribed training to make up the drills missed, and to afford opportunities to those who desire to attain a higher standard of proficiency or qualify for promotion. Such extra drills shall only be allowed to count for purposes of pay (and retainer where payable) as provided in these Regulations.

Drill cards.

187. In order that members of the Brigade (Cadets and (A) class) and their employers may be kept informed of the training required of the former by the Defence Act and of the opportunities afforded them of carrying out such training, every member is to be supplied with a drill card furnishing this information for the ensuing quarter.

Arrangement of drills.

188. The drills are to be arranged in quarters, and every opportunity of drill during each quarter is to be shown. The hour of commencement and duration of each drill, also whether compulsory or voluntary, and the classes of the Brigade that will be required or allowed to attend, are to be stated.

(2) The dates of rifle practice, camps, or continuous training afloat are to be given.

(3) Arrangements are to be made for “make-up” days in each quarter.

Members to show cards to their employers.

189. Instructions are to be printed on the cards directing each member to show his card to his employer when applying for leave of absence to attend drill, in order that his employer may satisfy himself that such attendance is required, and as far as possible, parents and employers are to be furnished with copies of the drill cards.

D.N.O.’s to lend instructors.

190. If required by the Commanding Officer of a training ship the District Naval Officer may lend such Instructors as he can spare for duty while training afloat in his District is proceeding.

Lights when drilling at night.

191. As a precaution against accidents when drilling at night in unlighted places, provision is to be made for the carrying of lights. When drilling in line a light is to be carried a few paces from each flank. When formed in column of route lights are to be carried in front and rear. On the approach of any vehicle the light is to be swung from side to side.

192. All ratings (including Cadets) before being allowed to attend bathing parades are to pass a swimming test, and when such parade is held, at least one Kisby lifebuoy and a life-line for every thirty persons attending is to be provided.

Section 2.—Leave of Absence.

Leave of absence.

198. Leave of absence may be granted by District or Sub-District Naval Officers when such is necessary, owing to temporary absence from the locality; but if, in the opinion of the District Officer, such absence if so protracted as to materially interfere with the member’s Naval training, Cadets and (A) class may be transferred to the military and (B) and (M) classes may be discharged at the discretion of the District Naval Officer. Form A.N.B. 7 is to be used for the transfer. (See regulation 208.)

Leave of absence on account of sickness.

199. (1) Leave of absence may be similarly granted for illness or other unavoidable cause. In case of illness the District or Sub-District Naval Officer may, if he thinks fit, require a medical certificate.

(2) In such cases the Department shall not be responsible for the payment of any expenses incurred by the trainee, but in cases of injury directly due to training, the Department is prepared to undertake the treatment as defined for members of the R.A.N.B. mobilized.

200. Except in cases where illness or temporary absence exceeds fourteen days, it shall be necessary for a member serving under Part XII. of the Defence Act to attend additional parades (voluntary) of equivalent duration to the statutory parades he has missed.

Leave to be recorded.

201. All leave is to be recorded by the District or Sub-District Naval Officer.

202. Any officer applying for leave of absence from continuous training must give good reasons as to the necessity thereof. Such leave, except in the case of sickness, must be applied for not later than two days prior to the date for the commencement of continuous training.

203. (1) Any member of (B) or (M) class absent without leave for a period of two months shall be discharged and shall forfeit to the Government the amount he would have to pay if purchasing his discharge (see regulation 222), unless, in the opinion of the District Naval Officer, there are extenuating circumstances.

(2) At the discretion of the District Naval Officer the amount of pay and/or retainer due to a member discharged in accordance with this Regulation may be forfeited, and in such cases these amounts shall be credited to “Navy—Revenue.”

Section 3.—Transfers.

Member leaving district.

206. Every Cadet or member of the (A) class who, by change of residence is unable to continue his naval training, must notify the District or Sub-District Naval Officer, and return all Government stores in his possession before leaving the district, except as laid down in regulation 207.

Transfers to another naval area.

207. Members of the Brigade who remove to another naval training area shall retain their rank or rating on transfer, being absorbed in the establishment as soon as vacancies occur, and in such cases they shall retain the uniform in their possession, but shall return their arms, accoutrements, and all other Government stores before so transferring.

 

Transfers to non-naval areas.

208. Cadets and (A) class whose civil occupations necessitate their removing to areas remote from naval training centres will be required to continue under the military such portion of the training prescribed by the Defence Act as they are liable to perform at the time of transfer Form A.N.B. 7 is to be used for the transfer.

(2) Officers, petty officers, and leading hands so transferred may hold in the military unit to which they become attached an equivalent rank to that held by them in the Naval Brigade, provided that they qualify for such rank within six months of transfer. (See regulation 198—Transfers on account of protracted absence.)

209. Cadets and members of the (A) class who are found to be medically unfit for Naval Service shall be transferred to their Military Area, as provided for in regulations 171 and 173.

Section 4.—Persons Employed in Sea-Going Vessels.

Registration of sea-going cadets.

211. Persons employed in sea-going vessels, as prescribed in section 137 of the Defence Act, shall register in any training, area, they may elect in the district or town at which the ship is registered, or at which they signed articles, and if the ship has not been registered, or articles have not been signed in Australia, the persons employed on such vessels shall register themselves in any training area they may elect.

Special facilities for drills.

212. To prevent interference as much as possible with their civil employment, special facilities for drill shall be afforded to trainees, so employed and, if necessary, they are to be permitted to drill with classes other than those to which, on account of their age, they would usually be attached.

May drill at any drill room.

213. All such persons are to be informed that they will be permitted to drill at any place at which the naval training is carried out, on production of their Record Books to the District or Sub-District Naval Officer, and in the event of any member so drilling a report of the drills done is to be at once made to the District Naval Officer where such person is enrolled.

Special facilities for adults.

214. Brigade (A class) serving at sea shall be permitted to perform the whole 25 days’ drill required annually at one time, as convenient, and, in the event of their ship not then being in port, they may be permitted to perform such further drill not exceeding 25 days as may be necessary until the return of such ships. Any additional drill so performed shall be deducted from the training required for the following year. Brigade (B) and (M) classes serving at sea may be permitted to perform the whole of the drill required annually at one time. At the conclusion of such training they shall be paid for actual drills performed.

Members employed in foreign-going vessels.

215. In the cases of Brigade (A) class employed in foreign-going vessels, they shall only be required to perform an equivalent amount of training for the periods during which they are actually in Australian waters, and, as regards efficiency, shall be dealt with as laid down in regulation 232.

Section 5.—Discharges, Exemptions, and Dismissals.

Certificate of discharge.

217. On completion of service, or on being released from any cause from all liability to further training, the discharge certificate in the Record or Certificate Book shall be filled in by the District or Sub-District Naval Officer, and character shall be recorded in the same manner as in the Royal Australian Navy.

Enrolment in permanent forces.

218. When a person liable for training under section 125 of the Defence Act is enrolled as a member of the Permanent Naval or Military Forces of the Commonwealth, he will be granted an exemption under Section 138 (d)of the Defence Act. The District or Sub-District Naval Officer concerned will, in such case, record the exemption in the Table 11 of the Record Book in the following manner:—“Exempt under D.A. sec. 138 (d). Joined Permanent Naval (or Military) Forces (Date).” and the duplicate Record Book is to be sent to the Commanding Officer of the ship or establishment or regiment for which the person has been recruited.

219. In the event of any person being discharged from the Permanent Naval Forces while still liable for training, his Commanding Officer will inform the District Naval Officer concerned, who, in his turn, will inform the Area Officer in whose area the trainee proposes to reside, of the date and reason for discharge. The original exemption under section 138 (d)of the Defence Act will then be withdrawn.

Members shall retain their record books.

220. On discharge, members of the Brigade shall be permitted to retain the original Record or Certificate Book of their service, and uniform, except leather gear, in their possession.

221. All members of (B) and (M) classes below the rank of warrant officer shall be discharged at the following ages:—

(2) Should it, however, be considered necessary in the interests of the Brigade to retain the services of any member who would otherwise be discharged, it may be recommended for the approval of the Director that the said member be, notwithstanding his age, retained for a further period not exceeding two years. All recommendations are to be accompanied with a report as to medical fitness and no extension will be granted for a longer period than one year at a time.

222. (1) Any member of the Brigade, other than those liable for training under section 125 of the Defence Act, may, except in time of war, resign from the Brigade on giving three months’ notice in writing to the District Naval Officer of his intention to claim his discharge, and by paying the following sums:—
