REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910–1912.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910–1912 to come into operation on and from the 1st March, 1917.

These Regulations shall supersede Regulations (Statutory Rules 1917, No. 161) under the said Act, made on the 18th day of July, 1917.

Amendment of Regulations for the Royal Australian Naval Brigade (Mine-Sweeping Section).

(Statutory Rules 1917, No. 161).

These Regulations may be cited as the Naval Brigade (Mine-Sweeping Section) Regulations.

Constitution.

1. The Mine-sweeping Section of the Royal Australian Naval Brigade shall comprise such Masters, Mates, Engineers, Deck Hands, Firemen, and Cooks, as may from time to time be duly appointed to or engaged in that Force under the Naval Defence Act 1910–12.

Application for appointment.

2. An applicant for engagement in the Mine-sweeping Section of the Royal Australian Naval Brigade must produce satisfactory discharges or evidence showing that he has seen service in fishing trawlers or steam tugs.

Nationality.

3. No applicant will be eligible for appointment unless he is of pure European descent and is the son of either natural-born, or naturalized, British subjects; is free from physical defects, and is in all respects suitable.

Medical examination.

4. Each candidate must pass a medical examination by a Naval Medical Officer as to fitness for duty in Mine-sweeping.

Section I.—Officers.

Masters.

5. A Master on appointment must be between the ages of 23 and 45 years.

Qualifications for appointment.

(2) He must have commanded a steam trawler or tug for at least twelve months, and must possess a Board of Trade Certificate as Master (Foreign or Coastal).

Engineers, 1st Class, Qualifications for appointment

(3) A candidate for the rank of Engineer, 1st Class, must be between 25 and 55 years of age, must hold a 1st Class Board of Trade Certificate as Marine Engineer, and produce evidence to show that he has served at least twelve months in charge of an engine-room.

Applications to District Naval Officer.

6. A Candidate for the rank of Master or Engineer, 1st Class must forward his application by letter to the District Naval Officer of the District in which he resides.

Fitness for appointment.

(2) The District Naval Officer will ascertain whether the candidate complies with the Regulations as to fitness, &c., and, if so, will arrange for his examination by a Naval Medical Officer.

(3) If declared physically fit for service, the candidate’s papers with the Medical Officer’s Certificate will be forwarded to the Director of Naval Auxiliary Services for transmission to the Naval Board as eligible for appointment as Master or Engineer, 1st Class (Probationary), as the case may be.

Appointments made by Naval Board.

7. Appointments to the rank of Master or Engineer, 1st Class will be made by the Naval Board

Relative rank.

(2) Masters and Engineers, 1st Class, will rank with, but after, Warrant Officers of the Royal Australian Navy.

Appointments on probation.

8. All appointments as Master or Engineer, 1st Class, will be made on probation, but will be confirmed by the Naval Board as from the date of first appointment, when a Master or Engineer, 1st Class, has completed his first period of eight days’ training, provided he is recommended by the Officer-in-charge of training operations as suitable in all respects for confirmation in rank.

Cancellation of probationary appointment.

9. The appointment of a Master or Engineer, 1st Class, who is not confirmed in rank within eighteen months after the date of first appointment shall be cancelled.

Discipline.

10. Masters and Engineers, 1st Class, will be borne on the books of the Royal Australian Naval Brigade for discipline and pay.

Training of Officers.

11. Masters and Engineers, 1st Class, are required to perform the following training:—

(a)Eight days’ continuous training at sea subsequent to appointment as Master or Engineer, 1st Class (Probationary). (See regulation 8);

(b)Masters and Engineers, 1st Class, will subsequently be required to perform eight days’ continuous training at sea in each training year ending 30th June;

(c) In cases where training is interfered with by bad weather the period of training may be extended to insure that actual training time at sea is not reduced;

(d)Officers undergoing training for an extended period as in (c) will be paid for the extra days for which they are retained, but extra training under these circumstances will not affect the payment of retainer.

Training under orders of District Naval Officer.

12. Training will be carried out by the Masters and Engineers, 1st Class, under the orders of the District Naval Officers at the training Ports as arranged.

Sickness during training.

13. Officers who fall sick during training are to cease pay from the date following the date of return to Home Port, but will be granted medical attendance by a Naval Medical Officer when such sickness is not due to their own misconduct.

(2) Officers who fall sick during training and whose sickness is due to their own misconduct are to cease pay from the date following that upon which they report sick, and are to be discharged from training forthwith.

(3) Officers injured or wounded when on duty or under training are to be medically attended and continued on pay until cured or until their claims for compensation have been dealt with under regulation 25.

(4)All absences from training are to be made good.

Pay of Officers undergoing training.

14. While undergoing training, Masters will receive pay at the rate of 16s. 8d. per diem, and Engineers, 1st Class, 14s. 4d. per diem, payable on completion of each period of annual training.

(2) Note is to be made of all payments in the Officer’s Training Certificate Book. (Form A.N.B. 48.)

Peace retainers, Officers.

15. Masters will be paid a Peace retainer of £16 per annum, and Engineers, 1st Class, £12 per annum, by the District Naval Officer of their District so long as they comply with the conditions laid down in these Regulations.

(2) This retainer will be payable in quarterly instalments of £4 each and £3 each respectively on the second Monday in January, April, July, and October, and is to be paid to each Officer in person; retainers are not to be paid to Agents or sent through the post.

(3) No retainer shall be paid until after an Officer has been confirmed in his appointment, when payment shall be made on the next quarter day as from the date of appointment, provided that, where an Officer fails to commence his training on the date notified him by the District Naval Officer, payment shall be made as from the first day of the quarter in which the training is subsequently performed.

(4) The payment of retainers will also be dependent on satisfactory conduct, and will be forfeited or suspended in every case where the Naval Board may consider that the Officer’s conduct, either on duty or in civil employment, is unsatisfactory.

(5) Payment of the ordinary peace retainer ceases from the date on which an Officer is called up for service by Proclamation in time of War or Emergency, and the war retainer becomes payable in lieu. (See regulation 22.)

(6) When the minimum amount of £10 is drawn as war retainer during any year vide regulation 22 (1) payment of peace retainer shall be made for a period of 8 months only.

(7) The retainer payable for portion of a quarter shall be the amount obtained by multiplying the quarterly retainer by the number of days in the period for which payment is claimed, and dividing the result by the number of days in the quarter.

Messing allowance, Officers undergoing training, &c.

16. While undergoing training or on active service under Proclamation an Officer will receive an allowance of 5s. per diem in lieu of rations, but must make his own messing arrangements. When practicable, facilities will be afforded for purchasing (for cash) supplies of Government provisions from H.M.A. Ships or Establishments at the usual service issuing prices.

(2) Messing Allowance will not be paid when for any reason members of this section of the R.A.N.B. are victualled in H.M. or H.M.A. Ships.

Uniform, Officers.

17. Each Officer on confirmation in rank will be provided with the following articles of uniform, which shall remain the property of the Government for a period of three years, and, except where otherwise stated, these articles of uniform are to be of the pattern prescribed for Warrant Officers of the Royal Australian Navy of under ten years seniority:—

(a) Masters:—

1 Undress Coat with R.A.N.B. buttons.

1 Waistcoat.

1 pair plain Blue Trousers.

1 Cap with R.A.N.B. badge.

1 Sou’wester.

1 Long Oilskin Coat, black.

1 Necktie.

3 White Shirts.

6 Collars.

1 pair Black Boots.

(b) Engineers, 1st Class:—

1 Undress Coat with R.A.N.B. buttons.

1 Waistcoat.

1 pair plain Blue Trousers.

1 Cap with R.A.N.B. badge.

1 Suit Overalls.

1 Necktie.

3 White Shirts.

6 Collars.

1 pair Black Boots.

(2) An additional issue of the above articles is to be made after every five years’ service.

Discipline.

18. While undergoing training or when on Active Service under Proclamation, Officers shall be subject to the same discipline as Officers of the Royal Australian Naval Brigade.

Service when called out by Proclamation.

19. When the Mine-sweeping Section of the R.A.N.B. is called out for service by Proclamation, the District Naval Officers will take the necessary steps to inform all Officers borne on their books, but, irrespective of such notice, it is the duty of every Officer upon the issue of the Proclamation to report himself at once to the District Naval Officer of his District or, if absent from his District, to the nearest District Naval Officer who will notify the Officer’s Home Port by telegram.

Period of Service.

20. Officers will be liable to serve during the continuance of war or any national emergency or until they are regularly discharged by the direction of the Naval Board.

Pay when called up for Active Service.

21. Masters shall be paid at the rate of 16s. 6d., and Engineers, 1st Class, at the rate of 14s. 6d. per day, when on Active Service, except that, when on service for less than one month, they shall receive a minimum payment of £25 and £22 respectively.

Discharge to civil employment.

(2) When discharged to civil employment (other than for misconduct) after serving for more than one year on Active Service an Officer shall be granted one month’s pay at the rate prescribed above for his rank. (See regulation 29.)

 

War retainer.

22. While on Active Service under Proclamation each Master will be credited with a war retainer at the rate of £30 per annum (with a minimum payment of £10), and each Engineer, 1st Class, a war retainer at the rate of £20 per annum (with a minimum payment of £5).

(2) Payment of war retainer will be made in cash by the District Naval Officer in arrear on discharge from Active Service provided the conduct and service of the Officer have been satisfactory. (See regulation 29.)

(3) War retainer for a fraction of a year shall be calculated by dividing the product of the number of days in the fractional period and the annual retainer by the number of days in the year.

Messing allowance on Active Service.

(Messing Allowance on Active Service, see regulation 16.)

Uniforms, completion of when called up

23. When called up for Active Service in time of War or Emergency an Officer shall be provided with the following articles of Uniform in addition to that already in his possession:—

1 Blue Undress Coat with R.A.N.B. buttons.

1 pair Blue Trousers.

1 Waistcoat.

1 Cap with R.A.N.B. badge.

1 pair Black Boots.

(2) The above articles of Uniform shall remain the property of the Government for a period of three years.

(3) An Officer on Active Service shall receive, in addition to the articles mentioned in this regulation, a Clothing Allowance of 1s. per day payable quarterly in arrear. This Allowance shall be payable from the date following that upon which six months Active Service shall have been completed.

(4) Officers may wear Overcoats with R.A.N.B. buttons, of the pattern worn by Warrant Officer of the Royal Australian Navy.

Bedding on loan when called up.

24. When called out for service in time of War or Emergency, an Officer shall be issued on loan with the following allowance of bedding:—

1 Hair Mattress.

2 Covers for Hair Mattress.

1 Hair Pillow.

1 Feather Pillow.

2 Covers for each pillow.

2 Blankets.

2 Counterpanes.

Compensation for injuries received, or disease contracted on duty.

25. Claims for compensation for injuries received, or disease contracted while on Active Service under Proclamation or while undergoing training will be dealt with as may be prescribed for members of the Permanent Naval Forces (Sea-going).

Discharges.

26. Officers will be discharged on reaching the age of 55 years.

Resignation.

27. Except in time of War or Emergency, Officers who wish to resign may do so subject to the approval of the Naval Board.

Forfeiture of appointment.

28. An Officer will be liable to forfeit his appointment and have his name removed from the Navy List by order of the Naval Board for misconduct, incompetence, or failure to comply with these Regulations.

Forfeiture to retainer or extra pay.

29.An Officer who is discharged under the provisions of regulation 28, forfeits all claim to retainer or to extra pay under regulation 21 (2).

Notifying address and change of address.

30. Officers are required to keep the District Naval Officer informed of the address of their permanent residence on shore or an address to which official notices can be sent.

(2) They must also give notice to the District Naval Officer of any change in their addresses.

Applicability of R.A.N.B. Regulations.

31. The Royal Australian Naval Brigade Regulations shall be followed in all matters not specially mentioned in Section I. of these Regulations.

Section II.—Petty Officers and Men.

Entry.

32. Men will be entered on probation either as Mates, Engineers, 2nd Class, Deck Hands, Firemen, or Cooks, and will be confirmed by the District Naval Officers in their respective ratings on completion of the first period of eight days’ training provided they are recommended for confirmation by the Officer-in-charge of training operations (See regulation 46.)

(2) Men who, on the completion of eight days’ training, are not recommended by the Officer-in-charge of training as suitable for confirmation will be discharged by the District Naval Officer.

Classification.

33. Mates and Engineers, 2nd Class, will be classed as Chief Petty Officers, R.A.N.B.; Deck Hands and Cooks will be classed as Able Seamen, and Firemen as Stokers, 1st Class, in the R.A.N.B.

34. No applicant is to be accepted for enrolment unless he is able to speak and understand the English language and can sign his name.

Age of entry.

35. Mates, Deck Hands, Firemen, and Cooks must be between the ages of 20 and 50 years, Engineers, 2nd Class, between 22 and 55 years.

(2) The age of the applicant must, if required, beproved by a Certificate of Birth or Baptism or other satisfactory evidence.

Mate.

36. A Mate must produce evidence that he has served at least twelve months as Master or Mate of a steam trawler or steam tug of not less than 100 tons register.

Engineer, 2nd Class.

(2) An Engineer, 2nd Class, must hold a Certificate of Competency as an Engine-driver and have served at least twelve months as an Engineer on a steam trawler or steam tug.

Deck Hand.

(3) A Deck Hand must produce evidence to prove that he has been at sea for at least two years, one of which has been served on a steam trawler or steam tug.

Fireman.

(4) A Fireman must produce evidence to show that he has served as Fireman for at least twelve months on a sea-going ship, steam trawler, or steam tug.

Cook.

(5) A Cook must satisfy the District Naval Officer that he is competent to carry out the duties of Cook in a trawler or tug.

Declaration, intention to follow sea.

37. Mates, Engineers, 2nd Class, Deck Hands, and Firemen must make a declaration that they intend to follow the sea in steam trawlers, steam tugs, or coastal steamers trading inside the waters of the State in which they reside.

Engagement and re-engagement.

38. The engagement and re-engagement of every man is to be for a period of five years counting from the date of swearing in as shown in the Man’s Certificate Book.

39. Every rating on engagement or re-engagement must take the oath or affirmation of enlistment as laid down in the Second Schedule of the Naval Defence Act 1910–12.

40. Men belonging to any of His Majesty’s Forces (Imperial or otherwise) are not eligible for engagement in this section of the Royal Australian Naval Brigade.

41. Men who are eligible to join the Royal Australian Fleet Reserve are not to be accepted for enrolment.

42. Men sworn in to serve in the Mine-sweeping Section of the Royal Australian Naval Brigade may not enlist in any other branch of His Majesty’s Forces (Imperial or otherwise).

Medical examination.

43. Each applicant will be examined by the District Naval Officer as to his compliance with the qualifications laid down in these Regulations, and, if satisfactory, will be examined by a Naval Medical Officer as to fitness for service; should he be passed as medically fit, the District Naval Officer will have him enrolled (on probation).

(2) In any case of doubt as regards fitness, medical or otherwise, the papers are to be forwarded to the Director of Naval Auxiliary Services for final decision.

44. If willing to re-engage, a man is to be passed as medically fit before being re-sworn; as regards the medical examination, minor defects need not militate against retaining a man for a further period of enrolment.

Application to re-enrol.

45. Men who do not apply to re-enrol within three months of the termination of any period of engagement shall be considered to have voluntarily quitted the Mine-sweeping Section of the Royal Australian Naval Brigade and shall be struck off the lists accordingly.

Training.

46. Ratings are required to perform the following training:—

(a)Provisionally enrolled ratings will be required to satisfactorily perform eight days’ continuous training prior to being confirmed in their ratings. (See regulation 32).

(b) When confirmed, ratings are required to perform eight days’ continuous training in each subsequent training year ending 30th June.

47. In cases where the training is interfered with by bad weather the period of training may be extended to insure that the actual training time at sea is completed.

(2) The ratings concerned are to be paid for the extra days for which they are retained, but extra training under these circumstances will not affect payment of retainer.

Failure to perform training.

48. Ratings who, without satisfactory explanation, fail to undergo training, within six months of the expiration of the training year in which due, are liable to be discharged, with forfeiture of all claims to retainer.

(2) They will be warned when possible by the District Naval Officer when they have failed to perform the training due, but the men themselves will in all cases be held responsible for such breaches of the Regulations.

 

49. Ratings coming up for training must wear their uniforms and bring their regulation kits with them. Probationary ratings will be kitted up after confirmation.

50. While under training ratings (confirmed or probationary) will be granted the following rates of pay:—

51. Pay is to commence from date of reporting under instructions for training and is to include the day on which the man is discharged from training.

52. Ratings who fall sick during training will receive no pay while on the sick list, but will be granted: medical attendance by the Naval Medical Officer when such sickness is not due to their own misconduct.

(2) Ratings who fall sick during training and whose sickness is due to their own misconduct are to cease pay from the date of falling sick and are to be discharged from training forthwith.

(3) Ratings injured or wounded when on duty or under training are to be medically attended and continued on pay until cured or until their claims for compensation have been dealt with under regulation 72 of these Regulations.

(4) All absences from training are to be made good.

Retainers.

53. Peace retainers at the following rates per annum will be payable to ratings at the office of the District Naval Officer of their District in four quarterly instalments on the second Monday in January, April, July, and October so long as the men comply with the conditions of their engagement laid down in these Regulations.

(2) Retainers are only to be paid to the men personally and not to any Agent, or through the post.

(3) When the minimum amount of £5 is drawn as war retainer during any year (vide regulation 69(1)) payment of peace retainer shall be made for a period of 9 months only.

(4) The Peace retainer payable for portion of a quarter shall be the amount obtained by multiplying the quarterly retainer by the number of days in the quarter for which payment is due, and dividing the result by the number of days in the quarter.

54. No retainer shall be paid until after a member is confirmed in his rating when payment shall be made on the next quarter date as from the date of enrolment, provided that, where a member fails to

 

commence his training on the date notified him by the District Naval officer payment shall be made as from the first day of the quarter in which the training is subsequently performed.

55. Payment of the ordinary peace retainer ceases on the date on which a man is called up for service by Proclamation in time of War or Emergency and war retainer becomes payable in lieu. (See regulation 69.)

Messing allowance.

56. While undergoing training or on Active Service under Proclamation a man will receive an allowance of 3s. per diem in lieu of rations and must make his own messing arrangements.

(2) When practicable, facilities will be afforded for purchasing (for cash) supplies of Government provisions from H.M.A. Ships or Establishments at the usual service issuing prices.

(3) Messing Allowance will not be paid when for any reason members this Section of the R.A.N.B. are victualled in H.M. or H.M.A. Ships.

Clothing.

57. When confirmed in his rating each man will be supplied gratuitously with kit according to the following scale:—

(a)Mates and Engineers, 2nd Class—

1 Cap and Badge (C.P.O., R.A N.B.).

2 Serge Jackets, single-breasted.

2 pair Serge Trousers.

1 pair Half Boots (Sea Service).

2 White Collars.

2 White Shirts.

* 1 Jersey.

* 1 Comforter.

 1 Suit of Overalls.

 2 Serge Waistcoats.

The blue serge suits are to be of the same pattern as for C.P.O’s, R.A.N.B.

The jerseys are to have the badge  in red letters on the breast.

Mates are to wear the badge  with crown above on the left arm of the jacket midway between the elbow and shoulder.

Engineers, 2nd Class, are to wear the badge  with propeller underneath, on the left arm of jacket midway between the elbow and shoulder.

Badges are to be embroidered in red on serge jackets and in blue on duck jackets with a space of half-an-inch between the  badge and the distinguishing badge.

* Mates only.   Engineers, 2nd Class only.

 

(b)Deck Hands, Firemen, and Cooks—

2 Serge Jumpers.

2 pairs Serge Trousers.

1 Cap with “R.A.N. Brigade” ribbon.

1 Blue Jean Collar.

2 Flannel Vests.

1 Silk Handkerchief.

1 Jersey.

1 pair Half Boots (Sea Service).

1 Comforter (Deck Hands only).

A red badge  is to be worn by Deck Hands, Firemen, and Cooks on the left arm of serge jumper midway between the elbow and shoulder and on the breast of jerseys.

(2) The above are the regulation kits, which remain the property of the Government for a period of three years; whenever a man is undergoing training or is called up by Proclamation in time of War or Emergency, he must wear the kit and have it in good order and condition, reasonable wear and tear excepted.

(3) A rating shall, after being on Active Service for six months become entitled to a Clothing Allowance towards the upkeep of uniform of 6d. per diem. This Allowance shall be payable quarterly in arrear from that date following that on which the rating shall have completed six months Active Service.

58. A new kit will be issued on re-engagement.

59. Ratings attending training without full kit may be issued by order of the Commanding Officer with any article short, the cost of such articles being deducted from the man’s pay.

60. On promotion to higher rating men will be supplied free with articles of kit for that rating which were not contained in their former kits.

61. If a man coming up for training is, in the opinion of the District Naval Officer, unfit for service, no clothing is to be issued or credited to him till it is decided whether he is to be retained in the Mine-sweeping Section of the R.A.N.B.

Service when called out by Proclamation, &c.

62. All ratings are liable to be called up for service by Proclamation in time of War or Emergency.

63. When this section of the R.A.N.B. is called out for service District Naval Officers will take the necessary steps to inform all rating in their Districts accordingly, but irrespective of this notice it is the duty of every man upon the issue of the Proclamation to report himself at once to the District Naval Officer of his District or, if absent from his District, to the nearest District Naval Officer who will notify the man’s Home Port by telegram.

64. Men not labouring under any infirmity incapacitating them from serving and who, when called upon to serve, fail to appear, will be liable to be apprehended as deserters or absentees and dealt with by their Commanding Officer in the same manner as deserters or absentees from the Royal Australian Navy; they will also forfeit all claims to pay and retainer.

 

Discipline.

65. While undergoing training and when on Active Service men will be borne on Ship’s Books and will be subject to the same discipline as men of the Royal Australian Naval Brigade.

Pay.

66. Men called up by Proclamation will be granted pay at the rates laid down for training with a minimum of thirty days’ pay.

67. They will also be granted an additional allowance of one month’s pay on discharge (other than for misconduct) after twelve months’ service in war time.

Messing allowance.

(For Messing Allowance when called up by Proclamation see regulation 57.)

War retainer.

68. In lieu of peace retainer, war retainer will be credited to all ratings on Active Service at the rate of £20 per annum with a minimum of £5.

(2) Payment of war retainer will be made in cash by District Naval Officer in arrear on discharge from Active Service, provided the conduct and service of the man have been satisfactory.

(3) War retainer will not be paid if the man is dismissed for misconduct.

(4) War retainers are strictly the private property of the men and are not subject to mulcts or deprivations except for the reasons stated above or for desertion.

69. Men who volunteer and whose services are accepted in a time of War or Emergency, although the R.A.N.B. (Mine-sweeping Section) have not been called out under Proclamation, will be granted the same conditions as if called out under Proclamation.

Bedding on loan.

70. When called out for service in time of War or Emergency each man of the R.A.N.B. (Mine-sweeping Section) will be issued on loan with the following allowance of bedding:—

One Hammock (complete),

One Mattress,

One Pillow,

Two Blankets.

Compensation for injuries received, or disease contracted on duty.

71. Claims for compensation for injuries received, or disease contracted while on Active Service under Proclamation or while undergoing training will be dealt with as may be prescribed for members of the Permanent Naval Forces (Sea-going).

Promotion.

72. Promotion will be subject to recommendation of the Officer-in-charge of Mine Sweeping, and that the rating holds the qualifications as laid down in these Regulations.

(2) Promotion or advancement will be made by selection as vacancies occur.

Discharge.

73. On the completion of each five years’ engagement, men will be entitled to their discharge provided they are not required for Active service under Proclamation.

74. Except in time of War or Emergency, men will be discharged from this branch of the Naval Brigade on reaching the age of 55 years.

 

75. A man will be liable to be discharged by order of the Naval Board for misconduct, incompetence, or for failure to comply with these Regulations.

76. Any man discharged under regulation 76 will forfeit all claim to pay and retainer.

Address.

77. Men are required to give the address of their permanent residence or address to which official notices can be sent.

(2) Every man must give notice to his District Naval Officer of any change in his address.

Applicability of Naval Brigade Regulations.

78. The Royal Australian Naval Brigade Regulations are to apply in all matters not mentioned in Section II. of these Regulations.
