Nature Conservation (Wildlife Management) (Infrastructure) Amendment Regulation 2019 (Qld)

1   Short title

This regulation may be cited as the Nature Conservation (Wildlife Management) (Infrastructure) Amendment Regulation 2019.

2   Regulation amended

This regulation amends the Nature Conservation (Wildlife Management) Regulation 2006.

3   Amendment of s 43 (Marine turtle or dugong taken under Aboriginal tradition or Island custom)

Section 43(4), definition traditional use of marine resources agreement—
omit, insert—

traditional use of marine resources agreement means—

(a)a traditional use of marine resources agreement accredited under—

(i)the Marine Parks (Great Barrier Reef Coast) Zoning Plan 2004, part 5, division 1; or

(ii)the Marine Parks (Great Sandy) Zoning Plan 2017, part 5, division 1; or

(iii)the Marine Parks (Moreton Bay) Zoning Plan 2008, part 6, division 1; or

(b)a traditional use of marine resources agreement accredited, or taken to be accredited, under the Great Barrier Reef Marine Park Regulations 2019 (Cwlth), part 4.

4   Amendment of s 261ZC (Taking protected plant for particular maintenance activities)

Section 261ZC(2), definition routine maintenance, paragraph (c)—
omit, insert—

(c)necessary to maintain other infrastructure (other than contour banks) including a building, or other structure, built or used for any purpose.

Examples of infrastructure for paragraph (c)—

core airport infrastructure, fences, helipads, oil, gas or water pipelines, roads, stockyards, vehicular tracks, watering facilities, constructed drains

5   Amendment of s 261ZD (Taking protected plant for firebreak or fire management line)

Section 261ZD—
insert—

(2)In this section—

infrastructure includes a building, or other structure, built or used for any purpose.

6   Amendment of sch 2 (Special management declarations)

Schedule 2, part 1, section 1, from ‘Whitsunday’—
omit, insert—

whale protection area described in the Great Barrier Reef Marine Park Regulations 2019 (Cwlth), schedule 4.
