Nature Conservation (Wildlife Management) and Another Regulation AmendmentRegulation (No. 1) 2014 Part 1 Preliminary [s 1] Part 1 Preliminary 1 Short title This regulation may be cited as the Nature Conservation (Wildlife Management) and Another Regulation Amendment Regulation (No. 1) 2014 . Part 2 Amendment of Nature Conservation (Wildlife Management) Regulation 2006 2 Regulation amended This part amends the NatureConservation(WildlifeManagement) Regulation 2006 . 3 Amendment of s 246 (Harvest labels for taking whole restricted plants or restricted plant parts in the wild) (1) Section 246— insert — (2A) However, if— (a) the person harvests a whole plant; and (b) it is impractical or would be unreasonable for the person to attach an approved harvest label to the whole plant, given the plant’s nature or condition; the person complies with subsection (2)(a) if the person attaches the label as close as is reasonably practicable to the plant. Nature Conservation (Wildlife Management) and Another Regulation AmendmentRegulation (No. 1) 2014 Part 2 Amendment of Nature Conservation (Wildlife Management) Regulation 2006 [s 4] Example of a plant’s nature or condition — a plant that is too small or fragile for a person to attach a label to it (2) Section 246(5), ‘from a plant, bundle or container’— omit, insert— from a plant, or the place where it has been securely attached under subsection (2A), or from a bundle or container 4 Amendment of s 261ZK (Labelling of restricted plants for trade) Section 261ZK— insert— (2A) However, if— (a) the person uses for trade or moves a whole plant; and (b) it is impractical or would be unreasonable for a person to attach an approved trade label to the whole plant, given the plant’s nature or condition; the person complies with subsection (2)(a) if the person attaches the label as close as is reasonably practicable to the plant.
