This regulation may be cited as the Nature Conservation (Protected Areas) Amendment Regulation (No. 7) 1999 . ˙ Regulation amended 2. This regulation amends the Nature Conservation (Protected Areas) Regulation 1994 . ˙ Insertion of new s 14 3. After section 13— insert— ˙ ‘ Reference to document in sch 5 ‘ 14. Lots 1 and 3 on RP804289, lot 4 on RP743779 and lot 46 on EP191 situated in the County of Elphinstone, containing an area of about 10 ha, shown hachured on plan PA39. ˙ ‘ Significant cultural and natural resources and values ‘ 188. The nature refuge— (a) supports undisturbed lowland plant and animal communities that are unrepresented or poorly represented in the adjacent Magnetic Island National Park; and (b) protects— (i) downstream marine ecosystems; and (ii) estuarine waters flowing from the nature refuge into the area of water mentioned in the Fisheries Regulation 1995 , schedule 2, 2 section 263(1). ˙ ‘ Declared management intent and use ‘ 189. The nature refuge will be managed, under the conservation agreement between the land-holders and the Minister, to allow— (a) the keeping of domestic animals, other than cats, in the nature refuge if the animals are under the control of the land-holder or a person authorised by the land-holder; and (b) access by special interest groups for nature based recreation and scientific research; and (c) the construction and maintenance of a firebreak by the land-holder if the firebreak is adjacent to an existing track or fenceline on the nature refuge. 2 Schedule 2 (Closed waters—commercial fishing)

The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘ PART 39—BULURRU NATURE REFUGE ˙ ‘ Name ‘ 191. Bulurru Nature Refuge. ˙ ‘ Description ‘ 192. The part of lot 325 on plan NR1415 situated in the County of Nares, containing an area of about 44 ha, shown hachured on plan PA44. ˙ ‘ Significant cultural and natural resources and values ‘ 193. The nature refuge supports— (a) a complex mesophyll vine forest, within the wet tropics bioregion, identified as endangered in The Conservation Status of Queensland’s Bioregional Ecosystems; and (b) critical habitat for the endangered southern cassowary (Casuarius casuarius) ; and (c) habitat for 5 threatened animal species, including the following endangered frogs— (i) the sharp-snouted torrent frog ( Taudactylus acutirostris ); (ii) the common mist frog ( Litoria rheocola ); (iii) the Australian lace-lid frog (Nyctimystes dayi).

The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the use of a guide dog in the nature refuge; and (b) the maintenance and use of existing minimal disturbance walking tracks; and (c) access by special interest groups for nature based recreation and scientific research. ˙ ‘ Duration ‘ 195. The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘ PART 40—COOLIBAH NATURE REFUGE ˙ ‘ Name ‘ 196. Coolibah Nature Refuge. ˙ ‘ Description ‘ 197. The part of lot 9 on plan CNS42 situated in the County of Cairns, containing an area of about 119 ha, shown hachured on plan PA43. ˙ ‘ Significant cultural and natural resources and values ‘ 198. The nature refuge supports— (a) remnants of a brigalow woodland ecosystem found only in the brigalow belt north bioregion; and (b) open forest containing Acacia harpophylla, Terminalia oblongata and Eremophila mitchellii .

The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) limited cattle grazing, at a stocking rate agreed between the land-holder and the Minister, in the nature refuge; and (b) the use of a horse or dog for stock mustering in the nature refuge if the horse or dog is under the control of the land-holder or a person authorised by the land-holder; and (c) the construction and maintenance of a firebreak by the land-holder if the firebreak is on the perimeter of the nature refuge; and (d) access by special interest groups for nature based recreation. ˙ ‘ Duration ‘ 200. The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘ PART 41—DONAGHYS CORRIDOR NATURE REFUGE ˙ ‘ Name ‘ 201. Donaghys Corridor Nature Refuge. ˙ ‘ Description ‘ 202. The part of lot 64 on plan NR876 situated in the County of Nares, containing an area of about 8 ha, shown hachured on plan PA32. ˙ ‘ Significant cultural and natural resources and values ‘ 203. The nature refuge supports—
s4 9 s4 Nature Conservation (Protected Areas) Amendment (No. 7) No. 336, 1999 (a) an important vegetation corridor connecting the Crater Lakes National Park to the Gadgarra State Forest; and (b) critical habitat for the endangered southern cassowary ( Casuarius casuarius ); and (c) the following rare plants— (i) bull kauri ( Agathis microstachya) ; (ii) fern-leaved tamarind ( Sarcotoechia serrata ); (iii) boonjie tamarind ( dipploglottis bracteata ). ˙ ‘ Declared management intent and use ‘ 204. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the use of a guide dog in the nature refuge; and (b) access by special interest groups for nature based recreation and scientific research; and (c) the collection of water for stock. ˙ ‘ Duration ‘ 205. The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘ PART 42—HORSESHOE BAY NATURE REFUGE ˙ ‘ Name ‘ 206. Horseshoe Bay Nature Refuge.

Lots 1 and 2 on RP746874 situated in the County of Elphinstone, containing an area of 8.989 ha. ˙ ‘ Significant cultural and natural resources and values ‘ 208. The nature refuge— (a) supports plant communities not otherwise represented in the protected area estate; and (b) supports habitat for the following animals— (i) the koala ( Phascolarctos cinereusas ); (ii) the pied imperial pigeon ( Ducula bicolor ); (iii) the bush stone-curlew ( Burhinus grallarius ); (iv) the orange footed scrubfowl ( Megapodius reinwardt ); and (c) protects— (i) downstream marine ecosystems; and (ii) estuarine waters flowing from the nature refuge into the area of water mentioned in the Fisheries Regulation 1995 , schedule 2, 3 section 263(1). ˙ ‘ Declared management intent and use ‘ 209. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the use of a guide dog in the nature refuge; and (b) the eradication of lantana and rubbervine in the nature refuge. 3 Schedule 2 (Closed waters—commercial fishing)

The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘ PART 43—MOON VIEW NATURE REFUGE ˙ ‘ Name ‘ 211. Moon View Nature Refuge. ˙ ‘ Description ‘ 212. The part of lot 22 on SP103975 situated in the County of Ward, containing an area of about 135 ha, shown hachured on plan PA38. ˙ ‘ Significant cultural and natural resources and values ‘ 213. The nature refuge supports— (a) four regional ecosystems, 2 of which are poorly represented in the protected area estate; and (b) the following plants— (i) the rare Grevillea linsmithi ; (ii) the vulnerable Bertya pinifolia ; (iii) the common nodding blue lily ( Stypandra glauca ); and (c) habitat for the following animals— (i) the vulnerable glossy black-cockatoo ( Calyptorhynchus lathami ); (ii) the vulnerable brush-tailed rock-wallaby ( Petrogale penicillata ); (iii) the yellow-tufted honeyeater ( Lichenostomus melanops ).

The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘ PART 44—NIBBEREENA CREEK NATURE REFUGE ˙ ‘ Name ‘ 216. Nibbereena Creek Nature Refuge. ˙ ‘ Description ‘ 217. Lot 6 on plan Dc112 situated in the County of Dickson, containing an area of about 202.6 ha. ˙ ‘ Significant cultural and natural resources and values ‘ 218. The nature refuge supports— (a) regional ecosystems, within the brigalow belt north bioregion, identified as endangered in The Conservation Status of Queensland’s Bioregional Ecosystems; and (b) remnant forests of brigalow ( Acacia harpophylla ) and gidgee ( Acacia cambagei ).

The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) limited cattle grazing, at a stocking rate agreed between the land-holder and the Minister, in the nature refuge; and (b) the use of a horse or dog for stock mustering in the nature refuge if the horse or dog is under the control of the land-holder or a person authorised by the land-holder; and (c) the maintenance of a track or firebreak by the land-holder if the track or firebreak is on the perimeter of the nature refuge; and (d) access by special interest groups for nature based educational activities, recreation or scientific research. ˙ ‘ Duration ‘ 220. The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘ PART 45—PINE CLIFFS NATURE REFUGE ˙ ‘ Name ‘ 221. Pine Cliffs Nature Refuge. ˙ ‘ Description ‘ 222. Lot 19 on plan CA31827 situated in the County of Cavendish, containing an area of 517.9 ha, shown hachured on plan PA24. ˙ ‘ Significant cultural and natural resources and values ‘ 223. The nature refuge supports—
s 4 14 s 4 Nature Conservation (Protected Areas) Amendment (No. 7) No. 336, 1999 (a) five regional ecosystems, within the southeast Queensland bioregion, 2 of which are identified as endangered in The Conservation Status of Queensland’s Bioregional Ecosystems; and (b) natural stands of bunya pine ( Araucaria bidwillii ) and homalium ( Homalium alnifolium ); and (c) the vulnerable black-breasted button-quail ( Turnix melanogaster ). ˙ ‘ Declared management intent and use ‘ 224. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the use of a guide dog in the nature refuge; and (b) limited cattle grazing, at a stocking rate agreed between the land-holder and the Minister, in the nature refuge; and (c) the keeping of a domestic dog if it is under the control of the land-holder or a person authorised by the land-holder; and (d) selective logging of millable cabinet timber by the land-holder for the land-holder’s domestic use; and (e) harvesting of staghorn ferns or orchids, other than rare or threatened staghorn ferns or orchids; and (f) access by special interest groups for nature based educational activities or recreation. ˙ ‘ Duration ‘ 225. The duration of the declaration of the nature refuge is the duration of the conservation agreement.

The part of lot 9 on plan CUE53 situated in the County of Consuelo, containing an area of about 1 500 ha, shown hachured on plan PA45. ˙ ‘ Significant cultural and natural resources and values ‘ 228. The nature refuge supports— (a) dominant vegetation communities of brigalow (Acacia harpophylla), lancewood (Acacia shirleyi) and narrow-leaved ironbark (Eucalyptus crebra); and (b) habitat for the Herbert’s rock wallaby (Petrogale herberti ); and (c) sandstone and sedimentary ridges and escarpments of scenic value within the nature refuge. ˙ ‘ Declared management intent and use ‘ 229. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the use of a guide dog in the nature refuge; and (b) limited cattle grazing, at a stocking rate agreed between the land-holder and the Minister, in the nature refuge; and (c) the use of a horse or dog for stock mustering in the nature refuge if the horse or dog is under the control of the land-holder or a person authorised by the land-holder.

The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘ PART 47—ROCKHAMPTON PISTOL CLUB NATURE REFUGE ˙ ‘ Name ‘ 231. Rockhampton Pistol Club Nature Refuge. ˙ ‘ Description ‘ 232. The part of lot 107 on plan LN852 situated in the County of Livingstone, containing an area of about 12 ha, shown hachured on plan PA30. ˙ ‘ Significant cultural and natural resources and values ‘ 233. The nature refuge supports— (a) a significant area of semi-evergreen vine forest and grassy open eucalypt forest; and (b) steep ridgelands that provide a buffer against residential development. ˙ ‘ Declared management intent and use ‘ 234. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the keeping of a domestic dog if it is under the control of the land-holder or a person authorised by the land-holder; and (b) pistol shooting activities in the nature refuge; and

The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘ PART 48—YABULLUM NATURE REFUGE ˙ ‘ Name ‘ 236. Yabullum Nature Refuge. ˙ ‘ Description ‘ 237. The parts of lots 1 and 2 on RP734391 situated in the County of Cardwell, containing an area of about 31 ha, shown hachured on plan PA41. ˙ ‘ Significant cultural and natural resources and values ‘ 238. The nature refuge supports— (a) five regional ecosystems, within the wet tropics bioregion, identified as endangered in The Conservation Status of Queensland’s Bioregional Ecosystems; and (b) critical habitat for the endangered southern cassowary (Casuarius casuarius) . ˙ ‘ Declared management intent and use ‘ 239. The nature refuge will be managed, under the conservation
s 4 18 s 4 Nature Conservation (Protected Areas) Amendment (No. 7) No. 336, 1999 agreement between the land-holder and the Minister, to allow— (a) the use of a guide dog in the nature refuge; and (b) keeping of no more than 2 domestic dogs if they are under the control of the land-holder or a person authorised by the land-holder; and (c) limited removal of timber by the land-holder for fencing the nature refuge; and (d) limited harvesting of lawyer cane ( Calamu s spp.), supplejack ( Flagellari sp a p.) and tree bark for making aboriginal artifacts; and (e) limited harvesting of fish, turtles and plants in the nature refuge by members of the Yabullumbarra aboriginal clan for human consumption, or educational or medicinal purposes; and (f) access by special interest groups for nature based recreation and scientific research; and (g) construction and maintenance of minimal disturbance walking tracks. ˙ ‘ Duration ‘ 240.
