This regulation may be cited as the Nature Conservation (Protected Areas) Amendment Regulation (No. 5) 2000 . ˙ Regulation amended 2. This regulation amends the Nature Conservation (Protected Areas) Regulation 1994 . ˙ Insertion of new sch 5, pts 49–55 3. Schedule 5— insert— ‘ PART 49—BEHANA CREEK NATURE REFUGE ˙ ‘ Name ‘ 241. Behana Creek Nature Refuge. ˙ ‘ Description ‘ 242. The part of lot 101 on SP114737 situated in the County of Nares, containing an area of 3.35 ha, shown hachured on plan PA49. ˙ ‘ Significant cultural and natural resources and values ‘ 243. The nature refuge supports— (a) relatively undisturbed areas of rainforest and sclerophyll forest; and (b) habitat for the endangered southern cassowary (Casuarius casuarius); and (c) habitat for the following endangered frogs likely to be found in the refuge— (i) the torrent tree frog ( Litoria nannotis );
s3 4 s3 Nature Conservation (Protected Areas) Amendment (No. 5) No. 207, 2000 (ii) the common mist frog ( Litoria rheocola ); (iii) the Australia lace-lid frog ( Nyctimystes dayi ); and (d) a vegetation corridor linking the nature refuge with Wooroonooran National Park. ˙ ‘ Declared management intent and use ‘ 244. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow the construction, maintenance and use of— (a) minimal disturbance walking tracks; and (b) a water reservoir to provide water for the land-holder’s domestic use. ˙ ‘ Duration ‘ 245. The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘ PART 50—CLAROY NATURE REFUGE ˙ ‘ Name ‘ 246. Claroy Nature Refuge. ˙ ‘ Description ‘ 247. The part of lot 4 on plan CNS40 situated in the County of Cairns, containing an area of about 423 ha, shown hachured on plan PA53. ˙ ‘ Significant cultural and natural resources and values ‘ 248. The nature refuge supports—
s3 5 s3 Nature Conservation (Protected Areas) Amendment (No. 5) No. 207, 2000 (a) regional ecosystems threatened by overgrazing and parthenium weed; and (b) mountain coolibah (Eucalyptus orgadophila) grassy open woodland; and (c) the rare plants, Bertya pedicellata and Persoonia amaliae . ˙ ‘ Declared management intent and use ‘ 249. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the control and eradication of weeds and feral animals; and (b) limited cattle grazing, at a stocking rate agreed between the land-holder and the Minister, in the nature refuge; and (c) the use of a horse or dog for stock mustering in the nature refuge if the horse or dog is under the control of the land-holder or a person authorised by the land-holder; and (d) limited removal of timber by the land-holder for fencing the nature refuge; and (e) access by special interest groups for ecotourism and nature based recreation. ˙ ‘ Duration ‘ 250. The duration of the declaration of the nature refuge is the duration of the conservation agreement.
s3 6 s3 Nature Conservation (Protected Areas) Amendment (No. 5) No. 207, 2000 ‘ PART 51—DOONGMABULLA MOUND SPRINGS NATURE REFUGE ˙ ‘ Name ‘ 251. Doongmabulla Mound Springs Nature Refuge. ˙ ‘ Description ‘ 252. The part of lot 633 on plan PH1478 situated in the County of Drury, containing an area of about 280 ha, shown hachured on plan PA51. ˙ ‘ Significant cultural and natural resources and values ‘ 253. The nature refuge supports— (a) significant artesian springs; and (b) the largest populations in Australia of the plants Eryngium fontanum and Sporobolus pamelae , and the endangered plant Eriocaulon carsonii , near artesian springs. ˙ ‘ Declared management intent and use ‘ 254. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) limited cattle grazing, at a stocking rate agreed between the land-holder and the Minister, in the nature refuge; and (b) the use of a horse or dog for stock mustering or feral animal control in the nature refuge if the horse or dog is under the control of the land-holder or a person authorised by the land-holder; and (c) the construction and maintenance of a firebreak on the perimeter of the nature refuge by the land-holder; and (d) access by special interest groups for nature based recreation.

The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘ PART 52—ILLMARGANI NATURE REFUGE ˙ ‘ Name ‘ 256. Illmargani Nature Refuge. ˙ ‘ Description ‘ 257. The part of lot 1 on plan MGL4 situated in the County of Mungallala, containing an area of about 475 ha, shown hachured on plan PA46. ˙ ‘ Significant cultural and natural resources and values ‘ 258. The nature refuge supports— (a) floodplain country on Mungallala Creek containing plants and animals endemic to floodplain soils; and (b) sandy red earth soil, dominated by mulga (Acacia aneura) and poplar box (Eucalyptus populnea) ; and (c) heavy brown clay floodplain soils with coolibah (Eucalyptus coolabah) and poplar box ( Eucalyptus populnea) communities; and (d) an ephemeral wetland providing important habitat for large seasonal populations of frogs and waterbirds; and (e) the vulnerable Major Mitchell’s cockatoo (Cacatua leadbeateri ).
s3 8 s3 Nature Conservation (Protected Areas) Amendment (No. 5) No. 207, 2000 ˙ ‘ Declared management intent and use ‘ 259. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) limited cattle and sheep grazing, at a stocking rate and for periods agreed between the land-holder and the Minister, in the nature refuge; and (b) the use of a horse or dog for stock mustering or feral animal control in the nature refuge if the horse or dog is under the control of the land-holder or a person authorised by the land-holder; and (c) access by special interest groups for nature based recreation; and (d) harvesting of animals and plants in the nature refuge by members of the Gunggari aboriginal clan for human consumption, or educational or medicinal purposes. ˙ ‘ Duration ‘ 260. The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘ PART 53—MUNGAL NATURE REFUGE ˙ ‘ Name ‘ 261. Mungal Nature Refuge. ˙ ‘ Description ‘ 262. Lot 90 on CP816530 situated in the County of Stanley, containing an area of about 3.71 ha, shown hachured on plan PA47.
s3 9 s3 Nature Conservation (Protected Areas) Amendment (No. 5) No. 207, 2000 ˙ ‘ Significant cultural and natural resources and values ‘ 263. The nature refuge supports— (a) plant communities not otherwise represented in the protected area estate; and (b) habitat for the following endangered plants— (i) the swamp orchid ( Phaius australis ); (ii) the yellow swamp orchid ( Phaius bernaysii) ; (iii) the swamp daisy ( Olearia hygrophila) ; and (c) coastal swampland; and (d) elevated Pleistocene dunes. ˙ ‘ Declared management intent and use ‘ 264. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the management of habitat critical to the survival of endangered plant species in the nature refuge; and (b) the control of the exotic umbrella tree (Scheffleraactinophylla) in the nature refuge; and (c) fire management activities, agreed between the land-holder and the Minister, in the nature refuge. ˙ ‘ Duration ‘ 265. The duration of the declaration of the nature refuge is the duration of the conservation agreement.
s 3 10 s 3 Nature Conservation (Protected Areas) Amendment (No. 5) No. 207, 2000 ‘ PART 54—SEAFARM NATURE REFUGE ˙ ‘ Name ‘ 266. Seafarm Nature Refuge. ˙ ‘ Description ‘ 267. The part of lot 1 on SP125429 situated in the County of Cardwell, containing an area of about 48.5 ha, shown hachured on plan PA55. ˙ ‘ Significant cultural and natural resources and values ‘ 268. The nature refuge supports— (a) three regional ecosystems, 2 of which are identified as endangered in ‘The Conservation Status of Queensland’s Bioregional Ecosystems’; and (b) vegetation communities in the endangered ecosystems, linking Hinchinbrook Channel, the hillslopes of Lumholtz National Park and the Wet Tropics World Heritage Area; and (c) habitat for the endangered mahogany glider ( Petaurus gracilis ). ˙ ‘ Declared management intent and use ‘ 269. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the collection of water for the land-holder’s domestic use in the nature refuge; and (b) the construction, maintenance and use of minimal disturbance walking tracks; and (c) the keeping of a domestic dog if it is under the control of the land-holder or a person authorised by the land-holder.
s 3 11 s 3 Nature Conservation (Protected Areas) Amendment (No. 5) No. 207, 2000 ˙ ‘ Duration ‘ 270. The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘ PART 55—SERPENTINE NATURE REFUGE ˙ ‘ Name ‘ 271. Serpentine Nature Refuge. ˙ ‘ Description ‘ 272. Lot 118 on plan EP532 situated in the County of Elphinstone, containing an area of about 248 ha, shown hachured on plan PA50. ˙ ‘ Significant cultural and natural resources and values ‘ 273.(1) The nature refuge supports— (a) wetlands of national significance listed in the Register of the National Estate under the Australian Heritage Commission Act 1975 (Cwlth); and (b) habitat for a variety of waterfowl including the rare cotton pygmy-goose (Nettapus coromandelianus); and (c) regional ecosystems that are under pressure from urban, industrial and rural development. ˙ ‘ Declared management intent and use ‘ 274. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) limited cattle grazing, at a stocking rate agreed between the land-holder and the Minister, in the nature refuge; and
s 3 12 s 3 Nature Conservation (Protected Areas) Amendment (No. 5) No. 207, 2000 (b) crop production in a part of the refuge, and at a production rate, agreed between the land-holder and the Minister; and (c) the use of a horse or dog for stock mustering or feral animal control in the nature refuge if the horse or dog is under the control of the land-holder or a person authorised by the land-holder; and (d) access by employees and agents of Ergon Energy Corporation Limited ACN 087 646 062 and Queensland Electricity Transmission Corporation Limited ACN 078 849 233 for the installation and maintenance of electricity supply facilities if there is no reasonable alternative site for the facilities outside the nature refuge; and (e) limited removal of timber by the land-holder for fencing the nature refuge. ˙ ‘ Duration ‘ 275.
