s1 3 s3 Nature Conservation (Protected Areas) Amendment (No. 5) No. 178, 1998 ˙ Short title 1. This regulation may be cited as the Nature Conservation (Protected Areas) Amendment Regulation (No. 5) 1998 . ˙ Regulation amended 2. This regulation amends the Nature Conservation (Protected Areas) Regulation 1994 . ˙ Amendment of sch 5 (Nature refuges) 3. Schedule 5— insert— ‘ PART 15—ARCHONTOPHOENIX GROVE NATURE REFUGE ˙ ‘ Name ‘ 71. Archontophoenix Grove Nature Refuge. ˙ ‘ Description ‘ 72. The part of lot 1 on plan RP604432 situated in the County of Livingstone, containing an area of about 6.91 ha, shown hachured on plan PA15. ˙ ‘ Significant cultural and natural resources and values ‘ 73.(1) The nature refuge supports— (a) an Archontophoenix alexandrae closed palm forest, located near the southern limit of its geographical range, whose ecosystems are considered to be endangered and poorly represented in protected areas; and (b) examples of open eucalypt forest and rainforest.
s3 4 s3 Nature Conservation (Protected Areas) Amendment (No. 5) No. 178, 1998 ‘ (2) The nature refuge is— (a) an important source for seed collection and propagation; and (b) an important source of food and shelter for animals. ˙ ‘ Proposed management intent and use ‘ 74. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the use of guide dogs in the nature refuge; and (b) the construction, maintenance and use of minimal-disturbance walking tracks; and (c) the planting of local native plant species using locally collected seed; and (d) seed collection for the regeneration of forests. ˙ ‘ Duration ‘ 75. The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘ PART 16—BENAIAH NATURE REFUGE ˙ ‘ Name ‘ 76. Benaiah Nature Refuge. ˙ ‘ Description ‘ 77. The part of lot 182 on plan CWL 3465 situated in the County of Cardwell, containing an area of about 33 ha, shown hachured on plan PA26.

The nature refuge supports— (a) an important corridor connecting the restricted diverse communities of the remnant lowland vegetation and the adjoining hillslopes of the Lumholtz National Park; and (b) a critical habitat for the endangered mahogany glider ( Petaurus gracilus ) in an area where much of this species’ habitat has been lost to agricultural development. ˙ ‘ Proposed management intent and use ‘ 79. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the use of guide dogs in the nature refuge; and (b) the keeping of a caretaker’s dog in the nature refuge; and (c) the construction, maintenance and use of minimal-disturbance walking tracks; and (d) the maintenance and use of the existing cleared area at the outdoor chapel site, including the construction of stone seating and shade shelters; and (e) the removal of surface rock and stone for landscaping and paving use by the land-holder. ˙ ‘ Duration ‘ 80. The duration of the declaration of the nature refuge is the duration of the conservation agreement.
s3 6 s3 Nature Conservation (Protected Areas) Amendment (No. 5) No. 178, 1998 ‘ PART 17—BROOKS BEACH NATURE REFUGE ˙ ‘ Name ‘ 81. Brooks Beach Nature Refuge. ˙ ‘ Description ‘ 82. The part of lot 1 on plan RP745188 situated in the County of Nares, containing an area of about 17.2 ha, shown hachured on plan PA17. ˙ ‘ Significant cultural and natural resources and values ‘ 83. The nature refuge supports— (a) an Arenga australasica palm forest, whose ecosystems are considered to be vulnerable; and (b) land designated as a critical cassowary habitat zone for the protection of the endangered southern cassowary ( Casuarius casuarius ); and (c) mesophyll vine forest of a high integrity containing at least 6 rare or threatened plant species; and (d) a corridor for wildlife between Clump Mountain National Park and a wildlife habitat to the south of the boundary of Clump Mountain National Park. ˙ ‘ Proposed management intent and use ‘ 84. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the use of guide dogs in the nature refuge; and (b) the restricted dispersion of effluent from the adjacent ecotourism lodge; and (c) the construction, maintenance and use of four-wheel drive vehicle

The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘ PART 18—DRYANDER CREEK NATURE REFUGE ˙ ‘ Name ‘ 86. Dryander Creek Nature Refuge. ˙ ‘ Description ‘ 87. The part of lots 75 and 76 on plan HR368 situated in the County of Herbert, containing an area of about 59.1 ha, shown hachured on plan PA23. ˙ ‘ Significant cultural and natural resources and values ‘ 88. The nature refuge supports— (a) a complex notophyll/microphyll vine forest regional ecosystem regarded as a critical habitat for the endangered Proserpine rock wallaby ( Petrogale persephone ); and (b) at least 2 vulnerable plant species ( Neisosperma kilneri and Medicosma obovata ) and 8 rare plant species ( Actephila sessilifolia, Atalaya rigida, Austromyrtus pubiflora, Cassia queenslandica, Larsenaikia jardenei, Macropteranthes fitzalanii, Rhodamnia pauciovulata and Ristantia waterhouseii ); and (c) a significant buffer between agricultural development and the known Proserpine rock wallaby habitat within the Dryander State Forest.
s3 8 s3 Nature Conservation (Protected Areas) Amendment (No. 5) No. 178, 1998 ˙ ‘ Proposed management intent and use ‘ 89. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the use of guide dogs in the nature refuge; and (b) the keeping of domestic dogs if they are under the control of the land-holder or a person authorised by the land-holder; and (c) the use of dogs for feral pig control on the nature refuge, if they are under the control of the land-holder or a person authorised by the land-holder; and (d) the collection of native seeds; and (e) the conduct of scientific research and monitoring; and (f) the collection of water for household and stock consumption; and (g) the use of the nature refuge for film-making, including the construction, maintenance and use of temporary film sets causing minimal disturbance. ˙ ‘ Duration ‘ 90. The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘ PART 19—KELLY’S NATURE REFUGE ˙ ‘ Name ‘ 91. Kelly’s Nature Refuge. ˙ ‘ Description ‘ 92. The part of lot 4 on plan RP733748 situated in the County of Herbert, containing an area of about 2.98 ha, shown hachured on plan PA22.
s3 9 s3 Nature Conservation (Protected Areas) Amendment (No. 5) No. 178, 1998 ˙ ‘ Significant cultural and natural resources and values ‘ 93.(1) The nature refuge supports— (a) a complex notophyll/microphyll vine forest regional ecosystem regarded as a critical habitat for the endangered Proserpine rock wallaby ( Petrogale persephone ); and (b) at least 5 rare plant species ( Actephila sessilifolia, Atalaya rigida, Austromyrtus pubiflora, Macropteranthes fitzalanii and Neisosperma poweri ). ‘ (2) The vulnerable rufous owl ( Ninox rufa queenslandica ) and an undescribed leaf-tailed gecko ( Phyllurus sp.), recorded only in Conway National Park, are likely to be found within the nature refuge. ˙ ‘ Proposed management intent and use ‘ 94. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the use of guide dogs in the nature refuge; and (b) the entry of domestic dogs in the nature refuge if they are under the control of the land-holder; and (c) the control and eradication of weeds and feral animals; and (e) the collection of native seeds; and (f) scientific research and monitoring; and (g) the collection of water for domestic irrigation and consumption; and (h) the removal of surface rock and stone for landscaping use by the land-holder. ˙ ‘ Duration ‘ 95. The duration of the declaration of the nature refuge is the duration of the conservation agreement.
s 3 10 s 3 Nature Conservation (Protected Areas) Amendment (No. 5) No. 178, 1998 ‘ PART 20—THYLOGALE NATURE REFUGE ˙ ‘ Name ‘ 96. Thylogale Nature Refuge. ˙ ‘ Description ‘ 97. The part of lot 2 on plan RP724249 situated in the County of Dagmar, containing an area of about 2.34 ha, shown hachured on plan PA10. ˙ ‘ Significant cultural and natural resources and values ‘ 98. The nature refuge supports— (a) a densely vegetated, well-developed rainforest classified as complex notophyll vine forest; and (b) 1 endangered plant species ( Sankowskya stipularis ), 1 vulnerable plant species ( Jagera javanica ssp. australiana ) and 6 rare plant species. ˙ ‘ Proposed management intent and use ‘ 99. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the use of guide dogs in the nature refuge; and (b) the maintenance and use of private walking tracks; and (c) access to special interest groups for nature-based tourism, recreation and scientific research. ˙ ‘ Duration ‘ 100. The duration of the declaration of the nature refuge is the duration of the conservation agreement.
s 3 11 s 3 Nature Conservation (Protected Areas) Amendment (No. 5) No. 178, 1998 ‘ PART 21—UNA CORBOULD NATURE REFUGE ˙ ‘ Name ‘ 101. Una Corbould Nature Refuge. ˙ ‘ Description ‘ 102. Lots 2 to 4 on plan M37916 and lot 6 on plan M37928 situated in the County of March, containing an area of about 481.2 ha. ˙ ‘ Significant cultural and natural resources and values ‘ 103. The nature refuge supports— (a) a large area of predominant melaleuca wetland representing a dynamic land system that is poorly represented in the protected area estate; and (b) a relatively large area of undisturbed animal and plant habitats bounded by Lake Cootharaba, Noosa River and Great Sandy National Park. ˙ ‘ Proposed management intent and use ‘ 104. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister— (a) according to the management principles of a national park; and (b) to prevent commercial activity in the nature refuge. ˙ ‘ Duration ‘ 105. The duration of the declaration of the nature refuge is the duration of the conservation agreement.’.
