This regulation may be cited as the Nature Conservation (Protected Areas) Amendment Regulation (No. 3) 1999 . ˙ Regulation amended 2. This regulation amends the Nature Conservation (Protected Areas) Regulation 1994 . ˙ Amendment of s 2 (Definitions) 3. Section 2— insert— ‘ “bioregion” means a biogeographical region shown on the map titled ‘Biogeographic Regions of Queensland’ held by the department. 1 ’. ˙ Amendment of sch 5 (Nature refuges) 4.(1) Schedule 5, headings, ‘ Proposed management intent and use ’— omit, insert— ‘ Declared management intent and use ’. (2) Schedule 5— insert— ‘ PART 31—AVOCET NATURE REFUGE ‘ Name ‘ 151. Avocet Nature Refuge. 1 A copy of the map is available for inspection during office hours at the department’s central office at 160 Ann Street, Brisbane.

The part of lot 31 on plan DSN964 situated in the County of Denison, containing an area of about 565 ha, shown hachured on plan PA28. ‘ Significant cultural and natural resources and values ‘ 153. The nature refuge supports— (a) vegetation ecosystems considered endangered in the brigalow belt bioregion; and (b) an Acacia harpophylla open forest and a Eucalyptus cambageana woodland considered to be endangered. ‘ Declared management intent and use ‘ 154. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) limited cattle grazing, at a stocking rate agreed between the land-holder and the Minister, in the nature refuge; and (b) the use of horses and dogs for stock mustering in the nature refuge if they are under the control of the land-holder or persons authorised by the land-holder; and (c) access to special interest groups for nature based tourism, recreation and scientific research; and (d) the removal of timber by the land-holder for fencing the nature refuge. ‘ Duration ‘ 155. The duration of the nature refuge declaration is the duration of the conservation agreement.
s4 4 s4 Nature Conservation (Protected Areas) Amendment (No. 3) No. 100, 1999 ‘ PART 32—CARABEEN NATURE REFUGE ‘ Name ‘ 156. Carabeen Nature Refuge. ‘ Description ‘ 157. The parts of lot 9 on plan ML1667 and lot 21 on plan M341103 situated in the County of Merivale, containing an area of about 69 ha, shown hachured on plan PA34. ‘ Significant cultural and natural resources and values ‘ 158. The nature refuge supports— (a) an area of remnant complex notophyll forest that is part of an area nominated for World Heritage listing; and (b) the following plants growing on the basalt-derived soils of the refuge— (i) yellow carabeen ( Sloanea woollsii ); (ii) black booyong ( Argyrodendron actinophyllum ); and (c) habitat for a diverse array of bird species, including the rare Albert’s lyrebird ( Menura alberti ). ‘ Declared management intent and use ‘ 159. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the use of dogs for stock mustering in the nature refuge; and (b) the removal of timber for firewood or fencing for the land-holder’s use; and (c) the collection of water by pump for household and stock consumption; and

The duration of the nature refuge declaration is the duration of the conservation agreement. ‘ PART 33—CASSOWARY CORNER NATURE REFUGE ‘ Name ‘ 161. Cassowary Corner Nature Refuge. ‘ Description ‘ 162. The part of lot 2 on plan RP747749 situated in the County of Nares, containing an area of about 4 ha, shown hachured on plan PA33. ‘ Significant cultural and natural resources and values ‘ 163. The nature refuge supports— (a) a complex mesophyll vine forest considered endangered in the wet tropics bioregion; and (b) critical habitat for the endangered southern cassowary ( Casuarius casuarius ); and (c) 4 rare animal species, including Lumholtz’s tree kangaroo ( Dendrolagus lumholtzi ), the Atherton antechinus ( Antechinus godmani ) and the Herbert River ringtail possum ( Pseudochirulus herbertensis ); and (d) the following rare plant species—
s4 6 s4 Nature Conservation (Protected Areas) Amendment (No. 3) No. 100, 1999 (i) the small-fruited walking stick palm ( Linospadix microcarya ); (ii) the rose silky oak ( Darlingia furruginea ). ‘ Declared management intent and use ‘ 164. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the use of guide dogs in the nature refuge; and (b) the construction, maintenance and use of minimal disturbance walking tracks; and (c) the construction, maintenance and use of a single lane vehicle access track; and (d) scientific research and monitoring. ‘ Duration ‘ 165. The duration of the nature refuge declaration is the duration of the conservation agreement. ‘ PART 34—ELLANGOWAN NATURE REFUGE ‘ Name ‘ 166. Ellangowan Nature Refuge. ‘ Description ‘ 167. The unconstructed part of the Toowoomba–Karara road and stockroute, situated in the County of Merivale, containing an area of about 11.8 ha, shown hachured on plan PA35.
s4 7 s4 Nature Conservation (Protected Areas) Amendment (No. 3) No. 100, 1999 ‘ Significant cultural and natural resources and values ‘ 168. The nature refuge supports— (a) an open woodland of bull oak ( Allocasuarina luehmannii ), Angophora costata and Eucalyptus crebra ; and (b) a rich butterfly habitat including the only known population of the endangered piceatus jewel butterfly ( Hypochrysops piceatus ). ‘ Declared management intent and use ‘ 169. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the rehabilitation of degraded areas to provide additional habitat for the piceatus jewel butterfly; and (b) the maintenance and upgrading of the dedicated road on the refuge by Clifton Shire Council on behalf of the State; and (c) the installation of telecommunications and electricity supply facilities if there is no reasonable alternative site for the facilities outside the nature refuge; and (d) scientific research and monitoring. ‘ Duration ‘ 170. The duration of the nature refuge declaration is the duration of the conservation agreement. ‘ PART 35—HAGGERSTONE ISLAND NATURE REFUGE ‘ Name ‘ 171. Haggerstone Island Nature Refuge.

Lot 4 on plan CP866939 situated in the County of Shelburne, containing an area of about 48.5 ha. ‘ Significant cultural and natural resources and values ‘ 173. The nature refuge supports— (a) island geology that is unique among the Great Barrier Reef islands; and (b) plant communities not represented in the protected area estate; and (c) populations of the vulnerable beach stone-curlew ( Esacus neglectus ) and a breeding colony of pied imperial pigeons ( Ducula bicolor ). ‘ Declared management intent and use ‘ 174. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the keeping of 1 domestic dog, 6 guinea fowl, 1 peacock and 2 wallabies by the land-holder if they are under the control of the land-holder; and (b) for the minimal impact of the low-key tourist resort for nature based tourism and recreation located in the special facilities zone described in the conservation agreement for the refuge. ‘ Duration ‘ 175. The duration of the nature refuge declaration is the duration of the conservation agreement.
s4 9 s4 Nature Conservation (Protected Areas) Amendment (No. 3) No. 100, 1999 ‘ PART 36—KABA–KADA NATURE REFUGE ‘ Name ‘ 176. Kaba-kada Nature Refuge. ‘ Description ‘ 177. Lot 391 on plan RP739004 situated in the County of Solander, containing an area of about 0.9 ha, shown hachured on plan PA36. ‘ Significant cultural and natural resources and values ‘ 178. The nature refuge supports— (a) critical habitat for the endangered southern Cassowary ( Casuarius casuarius ); and (b) significant ecosystems of vegetation considered endangered in the wet tropics bioregion; and (c) at least 15 rare plant species. ‘ Declared management intent and use ‘ 179. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the use of guide dogs in the nature refuge; and (b) scientific research and monitoring; and (c) the use of water by the land-holder to generate hydro-electric power. ‘ Duration ‘ 180. The duration of the nature refuge declaration is the duration of the conservation agreement.
s 4 10 s 4 Nature Conservation (Protected Areas) Amendment (No. 3) No. 100, 1999 ‘ PART 37—MT PROSERPINE NATURE REFUGE ‘ Name ‘ 181. Mt Proserpine Nature Refuge. ‘ Description ‘ 182. The part of lot 1 on plan RP737330 situated in the County of Herbert, containing an area of about 95 ha, shown hachured on plan PA37. ‘ Significant cultural and natural resources and values ‘ 183.(1) The nature refuge supports— (a) a complex notophyll/microphyll vine forest recognised as a critical habitat for the endangered Proserpine rock-wallaby ( Petrogale persephone ); and (b) the rare plants Actephila sessilifolia and Atalaya rigida . ‘ (2) A leaf-tailed gecko ( Phyllurus sp. ), the rare orange-sided skink ( Eulamprus amplus ) and the vulnerable rufous owl ( Ninox rufa queenslandica ), found in the adjacent Conway National Park, are likely to be found in the nature refuge because the refuge also contains habitat for the gecko, skink and owl. ‘ Declared management intent and use ‘ 184. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the use of guide dogs in the nature refuge; and (b) the keeping of domestic dogs if they are under the control of the land-holder or persons authorised by the land-holder; and (c) the selective logging of millable timber for domestic use; and (d) scientific research and monitoring; and
