This regulation may be cited as the Nature Conservation (Protected Areas) Amendment Regulation (No. 2) 1997 . ˙ Regulation amended 2. This regulation amends the Nature Conservation (Protected Areas) Regulation 1994 . ˙ Amendment of s 2 (Definitions) 3. Section 2— insert— “Great Barrier Reef Region” has the meaning given by the Great Barrier Reef Marine Park Act 1975 (Cwlth). “Maclennan Cay” has the meaning given by the MeakerTrust(RaineIsland Research) Act 1981 . “Moulter Cay” has the meaning given by the Meaker Trust (Raine IslandResearch) Act 1981 . “Raine Island” has the meaning given by the Meaker Trust (Raine IslandResearch) Act 1981 .’. ˙ Amendment of sch 3 (Conservation parks) 4. Schedule 3, entry for ‘Combo Conservation Park 1’— omit, insert— ‘Combo Conservation Park 1 Lot 12 on plan RP887443 situated in the county of Kynuna, containing an area of about 26.18 ha’.

Schedule 3A— insert— ‘Anderson Street Conservation Cairns City Council Park Kamerunga Conservation Park Cairns City Council Mount Whitfield Conservation Park Cairns City Council’. ˙ Amendment of sch 5 (Nature refuges) 6. Schedule 5— insert PART 7—BELGAMBA NATURE REFUGE ˙ Name 31. Belgamba Nature Refuge. ˙ Description 32. Lot 175 on plan RN1529 situated in the county of Raglan, containing an area of about 537 ha. ˙ Significant cultural and natural resources and values 33. The nature refuge supports— (a) an area of well-developed mixed eucalypt open forests, cabbage palm ( Livistona decipiens ) and semi-evergreen vine thicket communities; and (b) habitat for the vulnerable cycad Cycas megacarpa and rare cudgerie tree ( Hernandia bivalvis ); and (c) habitat for at least 90 species of native animals, including—
s6 5 s6 Nature Conservation (Protected Areas) Amendment (No. 2) No. 85, 1997 (i) the yellow-bellied glider ( Petaurus australis ); and (ii) the northern quoll ( Dasyurus hallucatus ); and (iii) the brush-tailed rock wallaby ( Petrogale penicillata ); and (iv) the rare glossy black cockatoo ( Calyptorhynchus lathami ). ˙ Proposed management intent and use 34. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to— (a) maintain and foster wildlife populations and communities; and (b) allow nature-based recreational and educational activities; and (c) allow for— (i) mineral exploration and mining; and (ii) the gathering of firewood for the land-holder’s personal use; and (iii) the construction, maintenance and use of minimal-disturbance walking tracks; and (iv) the growing and harvesting of native tree plantations within a restricted part of the nature refuge. ˙ Duration 35. The duration of the declaration of the nature refuge is the duration of the conservation agreement. PART 8—COOLNWYNPIN NATURE REFUGE ˙ Name 36. Coolnwynpin Nature Refuge.

Lot 4 on plan RP891128 situated in the county of Stanley, containing an area of 16.14 ha. ˙ Significant cultural and natural resources and values 38. The nature refuge supports— (a) an area, within the area of the local government of Redland, having a high koala population density; and (b) a wallum heath community, being a plant community that is in need of conservation south-east of Brisbane; and (c) an area of significant habitat diversity, including habitat for the vulnerable frog Crinia tinnula . ˙ Proposed management intent and use 39. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to— (a) control access to certain parts of the nature refuge; and (b) facilitate scientific investigations and educational programs; and (c) minimise the fire risk to adjacent residential areas. ˙ Duration 40. The duration of the declaration of the nature refuge is the duration of the conservation agreement. PART 9—MURRAY UPPER WETLANDS NATURE REFUGE
s6 7 s6 Nature Conservation (Protected Areas) Amendment (No. 2) No. 85, 1997 ˙ Name 41. Murray Upper Wetlands Nature Refuge. ˙ Description 42. The parts of lot 4 on plan RP904395, lot 7 on plan RP904396, lots 8 and 9 on plan RP904393, lots 10 and 11 on plan RP904391, lot 12 on plan RP904390 and lot 118 on plan RP845160 situated in the county of Cardwell, containing an area of about 413 ha, shown hachured on plan PA11. ˙ Significant cultural and natural resources and values 43. The nature refuge supports— (a) significant plants, including 3 plant communities not known to exist in another protected area; and (b) significant animals, including the endangered southern cassowary ( Casaurius casaurius ), the rufous owl ( Ninox rufa queenslandica ) and the estuarine crocodile ( Crocodylus porosus ); and (c) at least 17 species of native freshwater fish, including barramundi ( Lates calcarifer ). ˙ Proposed management intent and use 44.(1) The nature refuge is comprised of 8 areas, each of which is the subject of a separate conservation agreement. (2) The nature refuge will be managed, under the conservation agreements, to— (a) maintain the natural drainage and water retention features of the nature refuge; and (b) maintain and foster wildlife populations and communities; and (c) allow scientific research and monitoring.

For each of the areas comprising the nature refuge, the duration of the declaration of the nature refuge is the duration of the conservation agreement for the area. PART 10—RAINE ISLAND NATURE REFUGE ˙ Name 46. Raine Island Nature Refuge. ˙ Description 47. The land situated in the county of Jardine, consisting of Maclennan Cay, Moulter Cay and Raine Island, containing an area of about 43.3 ha. ˙ Significant cultural and natural resources and values 48.(1) The nature refuge supports— (a) the world’s largest rookery for the endangered green turtle ( Chelonia mydas ); and (b) the most significant rookery in the Great Barrier Reef Region for seabirds, including the endangered herald petrel ( Pterodroma arminjoniana hereldica ) and vulnerable red-tailed tropicbird ( Phaethon rubricauda ). (2) A stone beacon on Raine Island, that was constructed in 1844, is a landmark of national cultural significance. ˙ Proposed management intent and use 49. The nature refuge will be managed, under the 2 conservation agreements between the land-holders and the Minister— (a) to control public access to the nature refuge; and
