This regulation may be cited as the Nature Conservation (Protected Areas) Amendment Regulation (No. 10) 1998 . ˙ Regulation amended 2. This regulation amends the Nature Conservation (Protected Areas) Regulation 1994 . ˙ Amendment of sch 5 (Nature Refuges) 3. Schedule 5— insert— ‘ PART 24—ACACIAVALE NATURE REFUGE ˙ ‘ Name ‘ 116. Acaciavale Nature Refuge. ˙ ‘ Description ‘ 117. The part of lot 201 on plan SP105921 situated in the County of Solander, containing an area of about 0.3 ha, shown hachured on plan PA29. ˙ ‘ Significant cultural and natural resources and values ‘ 118. The nature refuge supports— (a) a complex mesophyll vine forest identified as an endangered regional ecosystem and a priority biodiversity area in the draft FNQ 2010 Regional Planning Project; 1 and (b) habitat for many rare and threatened plant and animal species 1 Copies of this document are available for inspection at the department’s office at 160 Ann Street, Brisbane during office hours.
s3 4 s3 Nature Conservation (Protected Areas) Amendment (No. 10) No. 323, 1998 including the following endangered animals— (i) the southern cassowary (Casuarius casuarius ); (ii) the Australian lace-lid frog ( Nyctimystes dayi ); (iii) the common mist frog ( Litoria rheocola ). ˙ ‘ Proposed management intent and use ‘ 119. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the use of guide dogs in the nature refuge; and (b) the extraction of water and maintenance of a water pipeline; and (c) scientific research and monitoring. ˙ ‘ Duration ‘ 120. The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘ PART 25—BARNE’S PIKLE NATURE REFUGE ˙ ‘ Name ‘ 121. Barne’s Pikle Nature Refuge. ˙ ‘ Description ‘ 122. The part of lot 28 on plan NR426 situated in the County of Nares, containing an area of about 63 ha, shown hachured on plan PA27. ˙ ‘ Significant cultural and natural resources and values ‘ 123. The nature refuge supports—
s3 5 s3 Nature Conservation (Protected Areas) Amendment (No. 10) No. 323, 1998 (a) a complex notophyll vine forest consisting of part of the largest freehold rainforest remnant existing on the Atherton Tableland; and (b) habitat for at least 15 rare plants and 10 rare and threatened animals including the endangered southern cassowary ( Casuarius casuarius ) and the rare Lumholtz’s tree kangaroo ( Dendrolagus lumholtzii ); and (c) potential habitat for the following endangered frogs— (i) the sharp–snouted torrent frog ( Taudactylus acutirostris ); (ii) the Australian lace–lid frog ( Nyctimystes dayi ); (iii) the common mist frog ( Litoria rheocola ). ˙ ‘ Proposed management intent and use ‘ 124. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the use of guide dogs in the nature refuge; and (b) the trapping and banding of animals if the animals are released alive; and (c) the construction, maintenance and use of minimal disturbance walking tracks; and (d) scientific research and monitoring. ˙ ‘ Duration ‘ 125. The duration of the declaration of the nature refuge is the duration of the conservation agreement.
s3 6 s3 Nature Conservation (Protected Areas) Amendment (No. 10) No. 323, 1998 ‘ PART 26—PADEMELON HAVEN NATURE REFUGE ˙ ‘ Name ‘ 126. Pademelon Haven Nature Refuge. ˙ ‘ Description ‘ 127. The part of lot 1 on plan RP724522 situated in the County of Dagmar, containing an area of about 1.69 ha, shown hachured on plan PA12. ˙ ‘ Significant cultural and natural resources and values ‘ 128. The nature refuge supports— (a) a rare stand of complex notophyll vine forest whose classification has been subject to heavy development pressures; and (b) a variety of restricted endemic plants including 118 known vascular species, 5 rare plant species and the endangered plant Sankowskya stipularis . ˙ ‘ Proposed management intent and use ‘ 129. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the use of guide dogs in the nature refuge; and (b) the construction, maintenance and use of minimal disturbance walking tracks; and (c) scientific research and monitoring; and (d) the collection of water for domestic consumption. ˙ ‘ Duration ‘ 130. The duration of the declaration of the nature refuge is the duration of the conservation agreement.
s3 7 s3 Nature Conservation (Protected Areas) Amendment (No. 10) No. 323, 1998 ‘ PART 27—RACHEL HILL NATURE REFUGE ˙ ‘ Name ‘ 131. Rachel Hill Nature Refuge. ˙ ‘ Description ‘ 132. The parts of lot 2 on plan RP135215 and lot 20 on plan C371029 situated in the County of Cook, containing an area of about 49 ha, shown hachured on plan PA21. ˙ ‘ Significant cultural and natural resources and values ‘ 133. The nature refuge supports— (a) remnant araucarian microphyll vine forest representative of a vegetation type almost entirely cleared in the area from Bundaberg to Childers; and (b) the vulnerable plant Cupaniopsis shirleyana ; and (c) valuable habitat for a range of bird species and the platypus ( Ornithorhynchus anatinus ). ˙ ‘ Proposed management intent and use ‘ 134. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the use of guide dogs in the nature refuge; and (b) the construction, maintenance and use of minimal disturbance walking tracks; and (c) access to special interest groups for nature-based tourism, recreation and scientific research; and (d) limited cattle grazing, at a stocking rate agreed between the land-holder and the Minister, in the nature refuge until 31

The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘ PART 28—RAINBOW MOUNTAIN NATURE REFUGE ˙ ‘ Name ‘ 136. Rainbow Mountain Nature Refuge. ˙ ‘ Description ‘ 137. The parts of lot 3 on plan LN729, lot 82 on plan LN198, lots 195 and 1425 on plan LIV401153, lot 243 on plan LIV401143 and lot 437 on plan LIV4066 situated in the County of Livingstone, containing an area of about 1130 ha, shown hachured on plan PA18. ˙ ‘ Significant cultural and natural resources and values ‘ 138. The nature refuge supports— (a) sandstone and sedimentary ridges and escarpments of unique habitat and scenic value in the refuge; and (b) a diverse range of plant communities including brigalow and softwood scrub communities; and (c) significant plant representation of the vulnerable Eucalyptus raveretiana , the vulnerable Cycas megacarpa and the poorly known Capparis humistrata .

The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) limited cattle grazing, at a stocking rate agreed between the land- holder and the Minister, in the nature refuge; and (b) access to special interest groups for nature-based tourism, recreation and scientific research; and (c) sustainable harvesting of seeds, foliage and flowers. ˙ ‘ Duration ‘ 140. The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘ PART 29—RHONDAN VALLEY NATURE REFUGE ˙ ‘ Name ‘ 141. Rhondan Valley Nature Refuge. ˙ ‘ Description ‘ 142. The part of lot 88 on plan HR278 situated in the County of Herbert, containing an area of about 28 ha, shown hachured on plan PA31. ˙ ‘ Significant cultural and natural resources and values ‘ 143.(1) The nature refuge supports— (a) critical habitat for the endangered Proserpine rock wallaby ( Petrogale persephone ); and (b) significant ecosystems of vegetation dominated by the vulnerable plant Neisoperma kilneri .
s 3 10 s 3 Nature Conservation (Protected Areas) Amendment (No. 10) No. 323, 1998 ‘ (2) At least 5 rare plant species and 3 rare or vulnerable animal species, found in the adjacent Dryander National Park, are likely to be found in the nature refuge because the refuge also contains habitat for the plant and animal species. ˙ ‘ Proposed management intent and use ‘ 144. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) access to special interest groups for nature based recreation; and (b) scientific research and monitoring; and (c) selective logging of millable timber and removal of dead timber for the land-holder’s personal use. ˙ ‘ Duration ‘ 145. The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘ PART 30—WINDY RIDGE NATURE REFUGE ˙ ‘ Name ‘ 146. Windy Ridge Nature Refuge. ˙ ‘ Description ‘ 147. The part of lot 58 on plan HR131 situated in the County of Herbert, containing an area of about 30ha, shown hachured on plan PA19. ˙ ‘ Significant cultural and natural resources and values ‘ 148.(1) The nature refuge supports—
s 3 11 s 3 Nature Conservation (Protected Areas) Amendment (No. 10) No. 323, 1998 (a) a complex notophyll/microphyll vine forest, recognised as a critical habitat for the endangered Proserpine rock wallaby (Petrogale persephone) ; and (b) the rare plant Larsenaikia jardeinei . ‘ (2) A leaf-tailed gecko and the vulnerable rufous owl (Ninox rufa queenslandica) , found in the adjacent Conway State Forest, are likely to be found in the nature refuge because the refuge also contains habitat for the gecko and owl. ˙ ‘ Proposed management intent and use ‘ 149. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the use of guide dogs in the nature refuge; and (b) the keeping of domestic dogs if they are under the control of the land-holder or persons authorised by the land-holder; and (c) the collection of spring-water for domestic consumption; and (d) scientific research and monitoring; and (e) construction and maintenance of the dedicated road to Conway State Forest. ˙ ‘ Duration ‘ 150.
