s1 2 s4 Nature Conservation (Protected Areas) Amendment No. 81, 2004 Regulation (No. 1) 2004 1 Short title This regulation may be cited as the Nature Conservation (Protected Areas) Amendment Regulation (No. 1) 2004 . 2 Regulation amended This regulation amends the Nature Conservation (Protected Areas) Regulation 1994. 3 Amendment of s 2 (Definitions) Section 2— insert— “endangered regional ecosystem” means an endangered regional ecosystem under the Vegetation Management Act1999 . “not of concern regional ecosystem” means a not of concern regional ecosystem under the Vegetation Management Act1999 . “of concern regional ecosystem” means an of concern regional ecosystem under the Vegetation Management Act1999 . . 4 Amendment of sch 5 (Nature refuges) (1) Schedule 5, section 66(2)— omit. (2) Schedule 5, section 266, from ‘8.31 ha’— omit, insert ‘11.6 ha, shown on plan PA158.’. s4 4 s4 Nature Conservation (Protected Areas) Amendment No. 81, 2004 Regulation (No. 1) 2004 ‘342 Significant cultural and natural resources and values ‘The nature refuge supports— (a) remnant areas of semi deciduous notophyll/microphyll vine forest; and (b) suitable habitat for the endangered Proserpine rock-wallaby ( Petrogale persephone ) and the vulnerable plant Corymbia clandestina ; and (c) potential habitat for a number of rare or vulnerable plants and animals. ‘PART 115—BOGGOMOSS NATURE REFUGE ‘343 Name ‘Boggomoss Nature Refuge. ‘344 Description ‘Lot 17 on crown plan LE279 situated in the County of Labouchere, containing an area of about 100 ha, shown on plan PA132. ‘345 Significant cultural and natural resources and values ‘The nature refuge supports— (a) significant numbers of artesian mound springs in freshwater wetlands, commonly known as boggomosses, described as the not of concern regional ecosystem 11.3.27; and (b) cultural and natural resources of the adjoining Mount Rose Nature Refuge.
s4 5 s4 Nature Conservation (Protected Areas) Amendment No. 81, 2004 Regulation (No. 1) 2004 ‘PART 116—BURRAWINGEE NATURE REFUGE ‘346 Name ‘Burrawingee Nature Refuge. ‘347 Description ‘The part of lot 8 on RP838791 situated in the County of March, containing an area of about 8.78 ha, shown on plan PA144. ‘348 Significant cultural and natural resources and values ‘The nature refuge supports— (a) watershed protection for the upper part of Coles Creek that flows into the Mary River; and (b) the following not of concern regional ecosystems with a low extent of conservation in protected areas— (i) notophyll vine forest with or without Araucaria cunninghamii , described as regional ecosystem 12.11.10; (ii) tall open forest complex with Corymbia citriodora , Eucalyptus siderophloia and Eucalyptus major , described as regional ecosystem 12.11.5. ‘PART 117—FOREST PARK NATURE REFUGE ‘349 Name ‘Forest Park Nature Refuge. ‘350 Description ‘The part of lot 6 on SP113391 situated in the County of Solander, containing an area of about 18.8 ha, shown on plan PA147.
s4 6 s4 Nature Conservation (Protected Areas) Amendment No. 81, 2004 Regulation (No. 1) 2004 ‘351 Significant cultural and natural resources and values ‘The nature refuge supports— (a) habitat suitable for the endangered southern cassowary ( Casuarius casuarius ); and (b) cultural and natural resources of the following areas adjoining the nature refuge— (i) Daintree National Park; (ii) Wet Tropics World Heritage Area. ‘PART 118—GRIFFITHS NATURE REFUGE ‘352 Name ‘Griffiths Nature Refuge. ‘353 Description ‘The part of lot 7 on RP31985 situated in the County of Ward, containing an area of about 3.76 ha, shown on plan PA125. ‘354 Significant cultural and natural resources and values ‘The nature refuge supports— (a) habitat suitable for the rare plants Endiandra globosa , Lepiderema pulchella and Rhodamnia maideniana ; and (b) cultural and natural resources of the adjoining Nicoll Scrub National Park.
s4 7 s4 Nature Conservation (Protected Areas) Amendment No. 81, 2004 Regulation (No. 1) 2004 ‘PART 119—HOMEHAVEN NATURE REFUGE ‘355 Name ‘Homehaven Nature Refuge. ‘356 Description ‘The part of lot 2 on RP746631 situated in the County of Herbert, containing an area of about 181 ha, shown on plan PA107. ‘357 Significant cultural and natural resources and values ‘The nature refuge supports— (a) remnant eucalypt and dry vine forest; and (b) cultural and natural resources of the adjoining Mount Aberdeen National Park. ‘PART 120—KEMMIS CREEK NATURE REFUGE ‘358 Name ‘Kemmis Creek Nature Refuge. ‘359 Description ‘The part of lot 12 on crown plan WHS529 situated in the County of Wodehouse, containing an area of about 1 471 ha, shown on plan PA130. ‘360 Significant cultural and natural resources and values ‘The nature refuge supports— (a) a diverse range of flora, 149 species identified; and (b) habitat suitable for the following significant fauna species—
s4 8 s4 Nature Conservation (Protected Areas) Amendment No. 81, 2004 Regulation (No. 1) 2004 (i) the vulnerable squatter pigeon (southern subspecies) ( Geophaps scripta scripta ); (ii) the rare black-chinned honeyeater ( Melithreptus gularis ) and the rare reptiles Anomalopus brevicollis and the common death adder ( Acanthophis antarcticus ); (iii) the koala ( Phascolarctos cinereus ) and greater glider ( Petauroides volans ). ‘PART 121—KOOLKUNA NATURE REFUGE ‘361 Name ‘Koolkuna Nature Refuge. ‘362 Description ‘The part of lot 4 on RP617114 situated in the County of Flinders, containing an area of about 19 ha, shown on plan PA139. ‘363 Significant cultural and natural resources and values ‘The nature refuge supports— (a) Eucalyptus tereticornis woodland to open forest on alluvial plains, described as the endangered regional ecosystem 12.3.3; and (b) Melaleuca quinquenervia tall open forest on coastal alluvial plains, described as the of concern regional ecosystem 12.3.5; and (c) watershed protection for Baffle Creek.
s4 9 s4 Nature Conservation (Protected Areas) Amendment No. 81, 2004 Regulation (No. 1) 2004 ‘PART 122—MANANI NATURE REFUGE ‘364 Name ‘Manani Nature Refuge. ‘365 Description ‘The part of lot 155 on RP738590 situated in the County of Solander, containing an area of about 7.98 ha, shown on plan PA160. ‘366 Significant cultural and natural resources and values ‘The nature refuge supports— (a) remnant areas of complex mesophyll vine forest on very wet well drained fertile lowland alluvial soils, described as the endangered regional ecosystem 7.3.10; and (b) habitat suitable for the endangered southern cassowary ( Casuarius casuarius ); and (c) cultural and natural resources of the following areas adjoining the nature refuge— (i) the Cape Tribulation section of Daintree National Park; (ii) Wet Tropics World Heritage Area. ‘PART 123—MOUNT ROSE NATURE REFUGE ‘367 Name ‘Mount Rose Nature Refuge. ‘368 Description ‘Lot 18 on crown plan LE279 situated in the County of Labouchere, containing an area of about 105 ha, shown on plan PA131.
s 4 10 s 4 Nature Conservation (Protected Areas) Amendment No. 81, 2004 Regulation (No. 1) 2004 ‘369 Significant cultural and natural resources and values ‘The nature refuge supports— (a) significant numbers of artesian mound springs, commonly known as boggomosses, and described as the of concern regional ecosystem 11.3.22; and (b) cultural and natural resources of the adjoining Boggomoss Nature Refuge. ‘PART 124—REEDY CREEK NATURE REFUGE ‘370 Name ‘Reedy Creek Nature Refuge. ‘371 Description ‘Lot 1 on SP150900 situated in the County of Flinders, containing an area of about 467.2 ha, shown on plan PA156. ‘372 Significant cultural and natural resources and values ‘The nature refuge supports— (a) remnant areas of Eucalyptus tereticornis woodland to open forest on alluvial plains, described as the endangered regional ecosystem 12.3.3; and (b) the following of concern regional ecosystems— (i) remnant areas of microphyll/notophyll vine forest on beach ridges, described as regional ecosystem 12.2.2; (ii) remnant areas of vegetation complex of rocky headlands, predominantly but not exclusively on Mesozoic to Proterozoic igneous rocks, described as regional ecosystem 12.12.19; and
s 4 11 s 4 Nature Conservation (Protected Areas) Amendment No. 81, 2004 Regulation (No. 1) 2004 (c) cultural and natural resources of the adjoining Deepwater National Park, by providing a buffer between the national park and the residential development of Agnes Water. ‘PART 125—SOUTH ENDEAVOUR NATURE REFUGE ‘373 Name ‘South Endeavour Nature Refuge. ‘374 Description ‘The part of lot 101 on crown plan BS208 situated in the County of Banks, containing an area of about 4 148 ha, shown on plan PA112. ‘375 Significant cultural and natural resources and values ‘The nature refuge supports— (a) the following of concern regional ecosystems— (i) evergreen mesophyll/notophyll vine forest, described as regional ecosystem 3.10.1; (ii) Eucalyptus platyphylla and Eucalyptus leptophleba open forest to woodland on hill slopes, described as regional ecosystem 3.11.6; (iii) semi-deciduous mesophyll/notophyll vine forest, described as regional ecosystem 3.3.2; and (b) watershed protection for the Endeavour River.
s 4 12 s 4 Nature Conservation (Protected Areas) Amendment No. 81, 2004 Regulation (No. 1) 2004 ‘PART 126—TOOMBA NATURE REFUGE ‘376 Name ‘Toomba Nature Refuge. ‘377 Description ‘Lot 5369 on crown plan PH1899, lot 1 on crown plan DP52 and the part of lot 2 on DP60 situated in the County of Dalrymple, containing an area of about 47 136 ha, shown on plan PA91. ‘378 Significant cultural and natural resources and values ‘The nature refuge supports— (a) extensive areas of dry rainforest with a high diversity of plants; and (b) permanent and seasonal water bodies, including, for example, wetlands, lakes, streams and springs, that provide habitat for a high diversity of frogs and waterbirds; and (c) lava flow geological formations; and (d) a vegetation corridor between 2 sections of the Great Basalt Wall National Park. ‘PART 127—XANTHORRHOEA NATURE REFUGE ‘379 Name ‘Xanthorrhoea Nature Refuge. ‘380 Description ‘The part of lot 1 on RP215068 situated in the County of Cavendish, containing an area of about 97.9 ha, shown on plan PA155.
s 4 13 s 4 Nature Conservation (Protected Areas) Amendment No. 81, 2004 Regulation (No. 1) 2004 ‘381 Significant cultural and natural resources and values ‘The nature refuge supports— (a) remnant areas of Eucalyptus siderophloia , Eucalyptus propinqua , Eucalyptus microcorys or Eucalyptus pilularis tall open forest on remnant tertiary surfaces, usually associated with deep red soils, described as the endangered regional ecosystem 12.5.6; and (b) remnant areas of Eucalyptus tereticornis open forest on metamorphics with or without interbedded volcanics usually found at higher altitudes, described as the of concern regional ecosystem 12.11.9; and (c) habitat suitable for a number of vulnerable or rare plants and animals, including, for example, the vulnerable koala fern ( Caustis blakei subsp. macrantha ) and the vulnerable glossy black-cockatoo ( Calyptorhynchus lathami ).’.
