s1 2 s4 Nature Conservation (Protected Areas) Amendment No. 42, 2001 Regulation (No. 1) 2001 1 Short title This regulation may be cited as the Nature Conservation (Protected Areas) Amendment Regulation (No. 1) 2001. 2 Regulation amended This regulation amends the Nature Conservation (Protected Areas) Regulation 1994. 3 Amendment of s 2 (Definitions) Section 2— insert— “Wet Tropics World Heritage Area” means the Wet Tropics of Queensland World Heritage Area described in the World Heritage list kept under the World Heritage Convention.’. 4 Amendment of sch 5 (Nature refuges) (1) Schedule 5, section 123(b), ‘ lumholtzii ’— omit, insert lumholtzi ’. (2) Schedule 5— insert ‘PART 56—BURWOOD NATURE REFUGE ‘276 Name ‘Burwood Nature Refuge. ‘277 Description ‘The part of lot 3 on plan MC141 and the part of lot 13 on plan MC97 situated in the County of Murchison, containing an area of about 4 446 ha, shown hachured on plan PA56.
s4 3 s4 Nature Conservation (Protected Areas) Amendment No. 42, 2001 Regulation (No. 1) 2001 ‘278 Significant cultural and natural resources and values ‘The nature refuge supports— (a) a scenic landscape of gorges and mountains; and (b) a number of regional ecosystems not adequately represented in the protected area estate; and (c) a major north-south vegetation corridor allowing animal movement through the nature refuge. ‘279 Declared management intent and use ‘The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) access by special interest groups for ecotourism and nature-based recreation; and (b) sustainable harvesting of seed, foliage and flowers for commercial use; and (c) limited cattle grazing at a stocking rate agreed between the land- holder and the Minister; and (d) limited taking of timber by the land-holder for fencing; and (e) with the written approval of the Minister, construction of accommodation, for no more than 20 people, that has minimal impact on the environment in the nature refuge. ‘280 Duration ‘The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘PART 57—COOPER CREEK WILDERNESS NATURE REFUGE ‘281 Name ‘Cooper Creek Wilderness Nature Refuge.
s4 4 s4 Nature Conservation (Protected Areas) Amendment No. 42, 2001 Regulation (No. 1) 2001 ‘282 Description ‘The part of lot 52 on plan SR537 situated in the County of Solander, containing an area of about 50 ha, shown hachured on plan PA64. ‘283 Significant cultural and natural resources and values ‘The nature refuge supports— (a) 2 important regional ecosystems endemic to the Wet Tropics World Heritage Area; and (b) 64 rare or threatened plant species; and (c) a population of the endangered southern cassowary ( Casuarius casuarius ); and (b) a population of the rare Bennett’s tree-kangaroo ( Dendrolagus bennettianus ). ‘284 Declared management intent and use ‘The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) access for ecotourism and nature-based recreation; and (b) the construction of walking tracks, boardwalks and picnic facilities; and (c) the use of water from Cooper Creek by the land-holder for domestic use, irrigation, stock watering and hydro-electricity generation; and (d) sustainable harvesting of seed. ‘285 Duration ‘The duration of the declaration of the nature refuge is the duration of the conservation agreement.
s4 5 s4 Nature Conservation (Protected Areas) Amendment No. 42, 2001 Regulation (No. 1) 2001 ‘PART 58—MAHOGANY GLIDER NATURE REFUGE ‘286 Name ‘Mahogany Glider Nature Refuge. ‘287 Description ‘The part of lot 1 on plan CWL3624 situated in the County of Cardwell, containing an area of about 69 ha, shown hachured on plan PA65. ‘288 Significant cultural and natural resources and values ‘The nature refuge supports— (a) habitat for the endangered mahogany glider (Petaurus gracilis) in an area where much of the species’ habitat no longer exists; and (b) habitat for the endangered southern cassowary ( Casuarius casuarius ); and (c) examples of a number of land types of the Kennedy Valley; and (d) a regional ecosystem identified as endangered in ‘The Conservation Status of Queensland’s Bioregional Ecosystems’. ‘289 Declared management intent and use ‘The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) the taking of timber for fencing or the land-holder’s domestic use; and (b) in consultation with the department, the construction and maintenance of the following— (i) firebreaks; (ii) residential buildings and associated access tracks and outbuildings; (iii) walking tracks; and
s4 6 s4 Nature Conservation (Protected Areas) Amendment No. 42, 2001 Regulation (No. 1) 2001 (c) the erection and maintenance of signs and informational displays associated with the walking tracks . ‘290 Duration ‘The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘PART 59—NASSER’S NATURE REFUGE ‘291 Name ‘Nasser’s Nature Refuge. ‘292 Description ‘The part of lot 2 on RP736362 situated in the County of Nares, containing an area of about 34 ha, shown hachured on plan PA52. ‘293 Significant cultural and natural resources and values ‘The nature refuge supports— (a) an endangered regional ecosystem endemic to the Wet Tropics World Heritage Area; and (b) habitat for the following rare animals— (i) Lumholtz’s tree-kangaroo ( Dendrolagus lumholtzi ); (ii) Atherton antechinus ( Antechinus godmani ); (iii) Herbert River ringtail possum ( Pseudochirulus herbertensis ); (iv) green ringtail possum ( Pseudochirops archeri ); and (c) at least 8 species of rare or threatened plants.
s4 7 s4 Nature Conservation (Protected Areas) Amendment No. 42, 2001 Regulation (No. 1) 2001 ‘294 Declared management intent and use ‘The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) access by special interest groups for scientific research; and (b) in consultation with the department— (i) the construction and maintenance of walking tracks and canopy boardwalks with wildlife hides; and (ii) the erection and maintenance of covered educational and directional signs. ‘295 Duration ‘The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘PART 60—RAINMORE NATURE REFUGE ‘296 Name ‘Rainmore Nature Refuge. ‘297 Description ‘The part of lot 5 on plan DM22 situated in the County of Drummond, containing an area of about 5 760 ha, shown hachured on plan PA62. ‘298 Significant cultural and natural resources and values ‘The nature refuge supports— (a) 11 regional ecosystems, some of which are not adequately represented in the protected area estate, including 1 identified as endangered in ‘The Conservation Status of Queensland’s Bioregional Ecosystems’; and (b) habitat for the rare square-tailed kite ( Lophoictinia isura ); and
s4 8 s4 Nature Conservation (Protected Areas) Amendment No. 42, 2001 Regulation (No. 1) 2001 (c) habitat for the following vulnerable plants— (i) Acacia curranii ; (ii) Acacia deuteroneura ; (iii) Acacia lauta ; (iv) Acacia wardellii ; (v) Calytrix gurulmundensis ; (vi) Homoranthus decumbens . ‘299 Proposed management intent and use ‘The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) limited cattle grazing at a stocking rate agreed between the land- holder and the Minister; and (b) the control and eradication of feral animals; and (c) the construction of dams and vehicular tracks in consultation with the department; and (d) the use of fire to maintain the diversity of vegetation; and (e) recreational and ecotourism-based horse riding that has minimal impact on the environment in the nature refuge. ‘300 Duration ‘The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘PART 61—SAMARA NATURE REFUGE ‘301 Name ‘Samara Nature Refuge.
s4 9 s4 Nature Conservation (Protected Areas) Amendment No. 42, 2001 Regulation (No. 1) 2001 ‘302 Description ‘The parts of lots 20 and 21 on SP136199 situated in the County of Cardwell, containing an area of about 62 ha, shown hachured on plan PA72. ‘303 Significant cultural and natural resources and values ‘(1) The nature refuge supports— (a) 4 regional ecosystems, including 2 identified as of concern in ‘The Conservation Status of Queensland’s Bioregional Ecosystems’; and (b) habitat for the following rare animals— (i) Lumholtz’s tree-kangaroo ( Dendrolagus lumholtzi ); (ii) green ringtail possum ( Pseudochirops archeri ). (2) The nature refuge is adjacent to Longlands State Forest, part of the Wet Tropics World Heritage Area, and acts as a buffer for conservation and fire management in the forest. ‘304 Declared management intent and use ‘The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) limited cattle or horse grazing at a stocking rate agreed between the land-holder and the Minister; and (b) subdivision of the nature refuge; and (c) the construction and maintenance of minimal disturbance walking tracks; and (d) recreational horse riding if the horse is under the control of the land-holder or a person authorised by the land-holder; and (e) the taking of timber for fencing or the land-holder’s domestic use. ‘305 Duration ‘The duration of the declaration of the nature refuge is the duration of the conservation agreement.
s 4 10 s 4 Nature Conservation (Protected Areas) Amendment No. 42, 2001 Regulation (No. 1) 2001 ‘PART 62—SHANKEEN NATURE REFUGE ‘306 Name ‘Shankeen Nature Refuge. ‘307 Description ‘The part of lot 4031 on plan PH862 situated in the County of Labouchere, containing an area of about 470 ha, shown hachured on plan PA57. ‘308 Significant cultural and natural resources and values ‘The nature refuge supports— (a) a variety of regional ecosystems, some of which are endangered because they are suitable for use in pastoral or agricultural production; and (b) a variety of bird species. ‘309 Declared management intent and use ‘The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) limited cattle grazing at a stocking rate agreed between the land- holder and the Minister; and (b) the construction of minimal disturbance walking tracks and no more than 4 tourist huts for nature-based recreational tourism; and (c) the use of a horse or dog for stock mustering or feral animal control if the horse or dog is under the control of the land-holder or a person authorised by the land-holder; and (d) fire management by mosaic burning in consultation with the department; and (e) limited taking of timber for fencing or the land-holder’s domestic use.
s 4 11 s 4 Nature Conservation (Protected Areas) Amendment No. 42, 2001 Regulation (No. 1) 2001 ‘310 Duration ‘The duration of the declaration of the nature refuge is the duration of the conservation agreement. ‘PART 63—SOUTHERNWOOD NATURE REFUGE ‘311 Name ‘Southernwood Nature Refuge. ‘312 Description ‘The part of lot 40 on plan PT359 situated in the County of Plantagenet, containing an area of about 1 550 ha, shown hachured on plan PA60. ‘313 Significant cultural and natural resources and values ‘The nature refuge supports— (a) 15 regional ecosystems, 2 of which are identified as endangered and 5 of which are identified as of concern in ‘The Conservation Status of Queensland’s Bioregional Ecosystems’; and (b) habitat for— (i) the rare square-tailed kite ( Lophoictinia isura ); and (ii) the vulnerable squatter pigeon ( Geophaps scripta scripta ); and (c) an important wildlife corridor between the Drummond Ranges and the Nogoa River. ‘314 Declared management intent and use ‘The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to allow— (a) limited cattle grazing at a stocking rate agreed between the land- holder and the Minister; and
s 4 12 s 4 Nature Conservation (Protected Areas) Amendment No. 42, 2001 Regulation (No. 1) 2001 (b) the use of a horse or dog for stock mustering or feral animal control if the horse or dog is under the control of the land-holder or a person authorised by the land-holder; and (c) recreational horse riding if the horse is under the control of the land-holder or a person authorised by the land-holder; and (d) the control and eradication of feral animals; and (e) the taking of timber for fencing. ‘315 Duration ‘The duration of the declaration of the nature refuge is the duration of the conservation agreement.’.
