This regulation may be cited as the Nature Conservation (Protected Areas) Amendment Regulation (No. 1) 1997 . ˙ Regulation amended 2. This regulation amends the Nature Conservation (Protected Areas) Regulation 1994 . ˙ Amendment of sch 2 (National parks) 3. Schedule 2, entry for ‘Mount Etna Caves National Park’— omit, insert— ‘Mount Etna Caves National Park Lot 117 on plan NPW568 situated in the County of Livingstone, containing an area of about 478 ha’. ˙ Amendment of sch 3 (Conservation parks) 4.(1) Schedule 3, entry for ‘Mouth of Baffle Creek Conservation Park 2’— omit, insert— ‘Mouth of Baffle Creek Conservation Park 2 Lot 511 on plan NPW571 situated in the County of Flinders, containing an area of about 312 ha’. (2) Schedule 3, entry for ‘Rosins Lookout Conservation Park’— omit, insert— ‘Rosins Lookout Conservation Park Lot 510 on plan NPW569 situated an area of 61.483 ha’. in the County of Ward, containing
s5 3 s5 Nature Conservation (Protected Areas) Amendment (No. 1) No. 36, 1997 ˙ Amendment of sch 5 (Nature refuges) 5. Schedule 5— insert— PART 5—TOPAZ RAINFOREST NATURE REFUGE ˙ Name 21. Topaz Rainforest Nature Refuge. ˙ Description 22. The parts of lot 2 on plan RP747263 and lots 1 and 2 on plan RP742280 situated in the County of Nares, containing an area of about 101 ha, shown hachured on plan PA8. ˙ Significant cultural and natural resources and values 23. The nature refuge— (a) supports an area of complex mesophyll vine forest; and (b) supports 41 identified species of native wildlife prescribed as rare, endangered or vulnerable; and (c) supports the habitat for the endangered southern cassowary ( Casaurius casaurius ); and (d) includes a forested corridor connecting Topaz Road National Park and Wooroonooran National Park. ˙ Proposed management intent and use 24. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to— (a) maintain and foster wildlife populations and communities; and (b) allow scientific research and monitoring; and (c) allow the collection of water for household consumption.
s5 4 s5 Nature Conservation (Protected Areas) Amendment (No. 1) No. 36, 1997 ˙ Duration 25. The duration of the declaration of the nature refuge is the duration of the conservation agreement. PART 6—MELALEUCA NATURE REFUGE ˙ Name 26. Melaleuca Nature Refuge. ˙ Description 27. The part of lot 1 on plan RP739200 situated in the County of Cardwell, containing an area of about 1.54 ha, shown hachured on plan PA9. ˙ Significant cultural and natural resources and values 28. The nature refuge— (a) supports a diverse array of endemic flora and fauna; and (b) supports the habitat for the endangered southern cassowary ( Casaurius casaurius ); and (c) supports a suitable habitat for the endangered mahogany glider ( Petaurus gracilis ); and (d) serves as a buffer for adjacent Edmund Kennedy National Park. ˙ Proposed management intent and use 29. The nature refuge will be managed, under the conservation agreement between the land-holder and the Minister, to— (a) prevent any commercial activity in the nature refuge that would significantly affect the integrity of the forested area; and
s5 5 s5 Nature Conservation (Protected Areas) Amendment (No. 1) No. 36, 1997 (b) protect the natural resources of the nature refuge, by supporting the land-holder’s management of the nature refuge. ˙ Duration 30.
