Nature Conservation (Open Seasons) Amendment Order 2008

I make the following order under section 30(1) of the Nature Conservation Act 2002 .21 April 2008

1Short titleThis order may be cited as the Nature Conservation (Open Seasons) Amendment Order 2008 . 2CommencementThis order takes effect on the day on which its making is notified in the Gazette. 3Principal OrderIn this order, the Nature Conservation (Open Seasons) Order 2004 is referred to as the Principal Order. 4Clause 6 amended (Open season for short-tailed shearwater (muttonbird): commercial licences) Clause 6 of the Principal Order is amended as follows: (a) by omitting from subclause (1) “a commercial muttonbird operator’s licence or”; (b) by inserting the following subclause after subclause (1) : (1A)  Despite subclause (1), the open season for muttonbird that started on 27 March 2008 ends on 7 May 2008. 5ExpiryThe amendment to the Principal Order effected by clause 4(b) of this order expires on 31 December 2008 and, on that expiry, the Principal Order has effect as if that clause had not been enacted.

EXPLANATORY NOTE

(This note is not part of the order) This order amends the

(a) extending the 2008 open season for muttonbird for commercial licence holders until 7 May 2008; and (b) updating a licence reference.
