Part 1    Preliminary

1   Short title

This regulation may be cited as the Nature Conservation and Other Legislation (COVID-19: Fee Waiver) Amendment Regulation 2020.

Part 2    Amendment of Forestry Regulation 2015

2   Regulation amended

This part amends the Forestry Regulation 2015.

3   Insertion of new s 39A

Part 4, division 2—
insert—

39A    Commercial activity permit—daily activity fee waived for COVID-19 emergency

(1)This section applies in relation to a daily activity fee that became, or becomes, payable under the Act—

(a)by the holder of a commercial activity permit, other than for filming or photography; and

(b)for a day during the period starting on 1 February 2020 and ending on the later of the following days—

(i)31 July 2020;

(ii)a day fixed under subsection (4).

(2)Payment of the fee is waived for the holder.

(3)If the holder has paid the fee, the chief executive must refund the fee.

(4)For subsection (1)(b)(ii), the Minister may, by gazette notice, fix a day after 31 July 2020.

(5)This section expires on—

(a)if a day is fixed under subsection (4)—the day fixed; or

(b)otherwise—31 July 2020.

(6)In this section—

daily activity fee see schedule 6, item 4(c).

Part 3    Amendment of Nature Conservation (Administration) Regulation 2017

4   Regulation amended

This part amends the Nature Conservation (Administration) Regulation 2017.

5   Insertion of new pt 8, div 3A

Part 8—
insert—

Division 3A Waiver of fees for COVID-19 emergency

168A    Waived additional daily fee for commercial activity permit

(1)This section applies in relation to an additional daily fee that became, or becomes, payable under the Act—

(a)by the holder of a commercial activity permit, other than for filming or photography; and

(b)for a day during the period starting on 1 February 2020 and ending on the later of the following days—

(i)31 July 2020;

(ii)a day fixed under subsection (4).

(2)Payment of the fee is waived for the holder.

(3)If the holder has paid the fee, the chief executive must refund the fee.

(4)For subsection (1)(b)(ii), the Minister may, by gazette notice, fix a day after 31 July 2020.

(5)In this section—

additional daily fee means the fee mentioned in schedule 3, item 10(e).

168B    Expiry of division

This division expires on—

(a)if a day is fixed under section 168A(4)—the day fixed; or

(b)otherwise—31 July 2020.

Part 4    Amendment of Recreation Areas Management Regulation 2017

6   Regulation amended

This part amends the Recreation Areas Management Regulation 2017.

7   Insertion of new pt 9, div 4A

64A    Waived additional daily fee for commercial activity permit

(1)This section applies in relation to an additional daily fee that became, or becomes, payable under the Act—

(a)by the holder of a commercial activity permit, other than for filming or photography; and

(b)for a day during the period starting on 1 February 2020 and ending on the later of the following days—

(i)31 July 2020;

(ii)a day fixed under subsection (4).

(2)Payment of the fee is waived for the holder.

(3)If the holder has paid the fee, the chief executive must refund the fee.

(4)For subsection (1)(b)(ii), the Minister may, by gazette notice, fix a day after 31 July 2020.

(5)In this section—

additional daily fee means the fee mentioned in schedule 2, item 13(e).

64B    Expiry of division

This division expires on—

(a)if a day is fixed under section 64A(4)—the day fixed; or

(b)otherwise—31 July 2020.
