s1 5 s5 Nature Conservation and Other Legislation Amendment Regulation (No. 1) 2005 No. 111, 2005 Part 1 Preliminary 1 Short title This regulation may be cited as the Nature Conservation and Other Legislation Amendment Regulation (No. 1) 2005 . 2 Commencement Sections 72 and 76(1) commence on 1 July 2005. Part 2 Amendment of Nature Conservation Regulation 1994 3 Regulation amended in pt 2 and sch This part and the schedule amend the NatureConservationRegulation 1994. 4 Amendment of s 93 (Definitions for ch 3) Section 93, definitions accept , approved display purpose , authorised buyer , authorised interstate seller , authorised premises , interact , public land, relevant person , special native animal and temporary display omit. 5 Amendment of s 99 (Procedure if wildlife stolen) (1) Section 99(3), from ‘is required’ to ‘the Act’— omit, insert ‘keeps a record book under the Act for the wildlife’. (2) Section 99(4)—

(2) Section 104(2), from ‘must’— omit, insert ‘must— (a) ensure parts 2 and 3 of the advice are— (i) attached to the wildlife to which the advice relates or the container in which the wildlife is being moved; or (ii) otherwise in the possession of the person moving the wildlife to which the advice relates; and (b) give part 1 of the advice to the chief executive within 7 days after the movement happens. Maximum penalty—50 penalty units.’. (3) Section 104(3), from ‘the part’ to ‘Part 3’ ’— omit, insert ‘part 3 of the advice’. 7 Amendment of s 106 (Interfering with movement advice) (1) Section 106(2)(a), ‘the part of the advice marked ‘Part 1’ ’— omit, insert ‘part 1 of the advice’. (2) Section 106(2)(b), from ‘the part’ to ‘ ‘Part 3’ ’— omit, insert

(4) Section 106(2)(b)(ii), ‘attach the advice’— omit, insert ‘attach it’. 8 Insertion of new s 109A After section 109— insert ‘109A Relevant authority must not be granted if conservation plan restricts the grant ‘The chief executive can not grant a relevant authority for wildlife to a person if a conservation plan for the wildlife states that the chief executive can not grant the authority to the person or to any person.’. 9 Replacement of s 111 (Relevant authority must not be for more than 1 licensed premises) Section 111— omit, insert ‘111 Relevant authority must be for only 1 licensed premises or mobile facility ‘(1) The chief executive may grant a relevant authority for an animal for only 1 licensed premises. ‘(2) Also, the chief executive may grant a commercial wildlife licence (mobile) for only 1 mobile facility.’. 10 Amendment of s 112 (Maximum term for licences) Section 112(1)(b), after ‘wildlife licence,’—
s 11 8 s 12 Nature Conservation and Other Legislation Amendment Regulation (No. 1) 2005 No. 111, 2005 insert ‘commercial wildlife licence (mobile),’. 11 Insertion of new s 115A Chapter 3, part 1, division 3, subdivision 2— insert ‘115A Conservation plan may limit or extend things authorised by relevant authority ‘(1) A provision of this regulation stating what a holder, or a relevant person for a holder, of a relevant authority for wildlife may or may not do under the authority is subject to any provision of a conservation plan for the wildlife about what the holder or relevant person may or may not do under the authority. ‘(2) This section does not apply to a provision of this regulation, or a conservation plan, that creates an offence.’. 12 Insertion of new s 118A After section 118— insert ‘118A Relevant authority only authorises keeping, using and moving of lawfully obtained wildlife ‘(1) A holder, or a relevant person for the holder, of a relevant authority may only keep, use or move wildlife under the authority if the wildlife was lawfully obtained by the holder or a relevant person for the holder. Notes Under section 88(5) of the Act, it is an offence for a person, other than an authorised person, to keep or use a protected animal, or a descendant of a protected animal, that has not been lawfully taken unless the keeping or use is authorised under the Act. Under section 88B of the Act, it is an offence for a person, other than an authorised person, to keep or use native wildlife that the person ought to have reasonably suspected was not lawfully taken unless the State has, under the Act, disposed of the native wildlife to the person.
s 13 9 s 15 Nature Conservation and Other Legislation Amendment Regulation (No. 1) 2005 No. 111, 2005 Under section 89(4) of the Act, it is an offence for a person to keep or use a protected plant that has been taken in contravention of section 89(1) of the Act. 1 ‘(2) In this section— relevant authority includes a commercial wildlife licence (wildlife interaction) and a wildlife movement permit.’. 13 Amendment of s 121 (Holders of particular relevant authorities for animals may move animal to place of keeping) Section 121(6)— omit. 14 Amendment of s 123 (Holder of relevant authority for animals may move animals from interstate sellers) Section 123(4), from ‘, emu’— omit, insert ‘or emu.’. 15 Amendment of s 126 (Holder of particular licences may move animal to or from display) (1) Section 126(1), before ‘following’— insert ‘the’. (3) Section 126(3), ‘However’— omit, insert ‘Also’. (4) Section 126(3), penalty, after ‘penalty’— insert ‘for subsection (4)’. (5) Section 126(2A) and (3)— renumber as section 126(3) and (4). 16 Amendment of s 139 (Places must be stated on relevant authority) (1) Section 139, heading, after ‘ Places ’— insert and mobile facility identification ’. (2) Section 139(1)(b)— renumber as section 139(1)(c). (3) Section 139(1)— insert ‘(b) if the authority is a commercial wildlife licence (mobile)—the registration number for the mobile facility for which the licence is granted;’. 17 Amendment of s 160 (Exemption for wholesalers to move dead protected animals) Section 160(1), ‘, emu or macropod’— omit, insert ‘or emu’.
s 18 11 s 20 Nature Conservation and Other Legislation Amendment Regulation (No. 1) 2005 No. 111, 2005 18 Amendment of s 163 (Exemption to move particular animals to show or display) (1) Section 163, heading, before ‘ show ’— insert or from ’. (2) Section 163— insert ‘(3) However, subsection (2) applies only if the person ensures the animal is moved back to the place the person keeps the animal as soon as practicable after the animal stops being displayed in the show or display.’. 19 Amendment of s 170 (Licences that may be granted) (1) Section 170(c) to (i)— renumber as section 170(d) to (j). (2) Section 170— insert ‘(c) commercial wildlife licence (mobile);’. s 21 12 s 23 Nature Conservation and Other Legislation Amendment Regulation (No. 1) 2005 No. 111, 2005 21 Amendment of s 190 (Requirement to keep record book) Section 190— insert ‘(2) The holder complies with subsection (1) if a relevant person for the holder keeps the book for the holder. ‘(3) This section is subject to any provision of a conservation plan about the keeping of a record and return book, or record book, for a commercial wildlife licence for an animal to which the plan relates.’. 22 Amendment of s 191 (Requirement to give return of operations) Section 191— insert ‘(2) The holder complies with subsection (1) if a relevant person for the holder gives the return to the chief executive for the holder. ‘(3) This section is subject to any provision of a conservation plan about the giving of a return of operations for a commercial wildlife licence for an animal to which the plan relates.’. 23 Insertion of new ch 3, pt 4, div 3A Chapter 4, part 4— insert ‘Division 3A Commercial wildlife licence (mobile) ‘Subdivision 1 Purpose of division ‘191A Purpose of div 3A ‘(1) The purpose of this division is to allow particular persons to obtain protected animals from any place in the State by using a mobile facility, without adversely affecting the conservation of the animals.
s 23 13 s 23 Nature Conservation and Other Legislation Amendment Regulation (No. 1) 2005 No. 111, 2005 ‘(2) The purpose is achieved by— (a) allowing the chief executive to grant a commercial wildlife licence (mobile) for an animal in only limited circumstances; and (b) limiting the things that a person acting under the licence is authorised to do under the licence; and (c) regulating the activities of persons acting under the licence. Note Under section 170(2), a commercial wildlife licence (mobile) may be granted only on or after 1 January 2006. ‘Subdivision 2 Restrictions on grant of commercial wildlife licence (mobile) ‘191B Restriction about animals for which licence may be granted ‘The chief executive may grant a commercial wildlife licence (mobile) only for macropods. ‘Subdivision 3 Things authorised by commercial wildlife licence (mobile) ‘191C Holder may keep and use particular animals ‘The holder, or a relevant person for the holder, of a commercial wildlife licence (mobile) may— (a) buy or accept an animal of a species identified on the licence from any place in the State; and (b) move the animal, in the mobile facility for which the licence is granted, to— (i) the licensed premises for the licence; or (ii) a person, in the State, who is authorised to process the animal under the Act.
s 23 14 s 23 Nature Conservation and Other Legislation Amendment Regulation (No. 1) 2005 No. 111, 2005 ‘Subdivision 4 Carrying out activities under commercial wildlife licence (mobile) ‘191D Keeping record and return book ‘(1) The prescribed person for a commercial wildlife licence (mobile) must keep a record and return book supplied by the chief executive for the licence. Maximum penalty—120 penalty units. ‘(2) If the prescribed person is the holder of the licence, the holder complies with subsection (1) if a relevant person for the holder keeps the book for the holder. ‘(3) This section is subject to any provision of a conservation plan about the keeping of a record and return book for a commercial wildlife licence (mobile) for an animal to which the plan relates. ‘(4) In this section— prescribed person , for a commercial wildlife licence (mobile), means— (a) for a period during which the mobile facility for which the licence is granted is being used to carry out activities under the licence, the particulars for which are to be included in the record and return book supplied by the chief executive for the licence—the person in charge of the facility; or (b) for another period—the holder of the licence. ‘191E Giving return of operations ‘(1) The holder of a commercial wildlife licence (mobile) for an animal must give the chief executive a return of operations complying with section 454 3 for the licence. 3 Section 454 (Form and nature of return of operations) See chapter 4 (General provisions), part 4 (Provisions about return of operations) for the requirements for returns of operations required to be given under the Act.
s 24 15 s 26 Nature Conservation and Other Legislation Amendment Regulation (No. 1) 2005 No. 111, 2005 Maximum penalty—120 penalty units. ‘(2) The holder complies with subsection (1) if a relevant person for the holder gives the return to the chief executive for the holder. ‘(3) This section is subject to any provision of a conservation plan about the giving of a return of operations for a commercial wildlife licence (mobile) for an animal to which the plan relates.’. 24 Amendment of s 203 (Requirement to keep record book) Section 203— insert ‘(2) The holder complies with subsection (1) if a relevant person for the holder keeps the book for the holder. ‘(3) This section is subject to any provision of a conservation plan about the keeping of a record book for a recreational wildlife licence for an animal to which the plan relates.’. 25 Amendment of s 207 (Restriction on grant of licence for macropods) Section 207— insert— ‘(2) This section expires on 30 June 2005. 4 ’. 26 Amendment of s 209 (Holder may take, keep and sell or give away particular protected animals) (1) Section 209, heading, from ‘ sell ’ to ‘ protected ’— omit, insert use particular ’. s 27 16 s 28 Nature Conservation and Other Legislation Amendment Regulation (No. 1) 2005 No. 111, 2005 omit, insert— ‘(4) Subsection (3) expires on 30 June 2005. 5 ’. 27 Amendment of s 212 (Requirement to keep record book) Section 212— insert ‘(2) The holder complies with subsection (1) if a relevant person for the holder keeps the book for the holder. ‘(3) This section is subject to any provision of a conservation plan about the keeping of a record and return book, or record book, for a commercial wildlife harvesting licence for an animal to which the plan relates. ‘(4) In this section— relevant person , for the holder of a commercial wildlife harvesting licence for macropods, includes the following— (a) a person who normally lives with the holder; (b) a person who is authorised to keep the record and return book supplied by the chief executive for the licence under the Nature Conservation (Macropod) Conservation Plan 2005 . 6 ’. 28 Amendment of s 213 (Requirement to give return of operations) Section 213— insert ‘(2) The holder complies with subsection (1) if a relevant person for the holder gives the return to the chief executive for the holder. 5 From the beginning of 1 July 2005, see the Nature Conservation (Macropod) Conservation Plan 2005 . 6 See the Nature Conservation (Macropod) Conservation Plan 2005 , section 70 (Other persons may keep record and return book and give returns for holder).
