s1 3 s4 Nature Conservation Amendment (No. 3) No. 283, 1996 ˙ Short title 1. This regulation may be cited as the Nature Conservation Amendment Regulation (No. 3) 1996 . ˙ Regulation amended 2. This regulation amends the Nature Conservation Regulation 1994 . ˙ Amendment of s 4 (Applications) 3. Section 4(5)(a), ‘a registered office’— omit, insert— ‘an office’. ˙ Amendment of s 5 (How chief executive may deal with applications for licence) 4.(1) Section 5— insert— (1A) The chief executive may grant the licence only if the chief executive is satisfied the applicant is an appropriate person to hold the licence. (1B) In deciding whether the applicant is an appropriate person to hold the licence, the chief executive must consider whether the applicant has the character, knowledge and ability relevant to the activities that may be carried out under the licence. 1 ’. (2) Section 5(2), ‘However, the’— omit, insert— ‘The’. 1 Under section 135 of the Act, the chief executive may obtain a report from the commissioner of the police service about the applicant’s criminal history, including convictions mentioned in the CriminalLaw(RehabilitationofOffenders) Act 1986 , section 6.

Section 21(2), example, ‘part 4, division 1 (Protected areas) or part 5, division 1 (Protected wildlife)’— omit, insert— ‘part 4, division 1 or part 5, division 1 2 ’. ˙ Insertion of new s 27A 6. Chapter 2, part 1, after section 27— insert— ˙ Permitted uses in national parks 27A. For section 35 of the Act, 3 a use stated in schedule 2A is a permitted use for the national park, or part of the national park, stated for the use.’. ˙ Amendment of s 63 (Permit needed to conduct commercial activities) 7. Section 63(2) and (3)— insert— ‘Maximum penalty—50 penalty units.’. ˙ Replacement of s 91 (Chief executive’s powers in relation to wildlife other than native wildlife) 8. Section 91— omit, insert— ˙ Eradicating or controlling wildlife other than native wildlife 91.(1) The chief executive may give written permission to a person to carry out a controlling activity in a protected area. 2 Part 4 (Protected areas), division 1 (Basic concepts) or part 5 (Wildlife and habitat conservation), division 1 (Basic concepts) 3 Section 35 (Chief executive’s powers about permitted uses in national parks)

(3) The permission may be given on terms the chief executive considers appropriate including, for example, terms about any of the following matters— (a) taking out public liability insurance for the activity; (b) dealing with wildlife taken under the permission; (c) reporting to the chief executive. (4) Also, to remove any doubt, this regulation does not prevent the chief executive carrying out a controlling activity in a protected area. (5) In this section— “controlling activity” means an activity the chief executive considers to be reasonable and necessary to significantly reduce the population of, or eradicate, (by killing or otherwise) wildlife that is not native wildlife.’. ˙ Amendment of s 149 (Effect of licence) 9.(1) Section 149(2), penalty, ‘for subsection (2)’— omit. (2) Section 149— insert— (3) A licensee must not sell a commercial bird, other than a commonly kept bird, to a person other than a licensee. Maximum penalty—120 penalty units.’. ˙ Replacement of s 243 (Proof of identity to be given) 10. Section 243— omit, insert— ˙ Proof of identity to be given 243.(1) A licensee who sells protected, international or prohibited wildlife must—
s 11 6 s 11 Nature Conservation Amendment (No. 3) No. 283, 1996 (a) before parting with possession of the wildlife, obtain from the buyer— (i) evidence of the buyer’s identity; and (ii) the buyer’s licence or permit number (if any); and (b) keep a record of the source of the identification, including, for example, particulars of the type of document produced, the identifying number of the document and the name and address of the person named in the document. Maximum penalty—80 penalty units. (2) A licensee who buys protected, international or prohibited wildlife must— (a) on receipt of the wildlife, obtain from the seller— (i) evidence of the seller’s identity; and (ii) the seller’s licence or permit number (if any); and (b) keep a record of the source of the identification, including, for example, particulars of the type of document produced, the identifying number of the document and the name and address of the person named in the document. Maximum penalty—80 penalty units.’. ˙ Amendment of s 258 (Records to be kept) 11. Section 258(1)— omit, insert— 258.(1) If a licensee is required under this regulation or a conservation plan to keep a record book, the licensee must comply with the requirement. Maximum penalty—120 penalty units. (1A) The licensee must keep a record book supplied by the chief executive.’.

After schedule 2— insert— SCHEDULE 2A PERMITTED USES IN NATIONAL PARKS section 27A ˙ Green Island National Park 1.(1) The construction and use of support structures for an extension of the Commonwealth tower, to allow the operation of a ship reporting system radar device, are permitted uses for Green Island National Park. (2) In this section— “Commonwealth land” means the land held by the Commonwealth under special lease 9/36573, situated in the county of Nares, parish of Trinity, containing an area of about 0.0405 ha. “Commonwealth tower” means the tower that, at the commencement of this section, was situated on the Commonwealth land.’. ˙ Amendment of sch 7 (Commercial birds) 13.
