s1 2 s4 Nature Conservation Amendment Regulation (No. 2) No. 112, 2001 2001 1 Short title This regulation may be cited as the Nature Conservation Amendment Regulation (No. 2) 2001 . 2 Regulation amended This regulation amends the Nature Conservation Regulation 1994 . 3 Amendment of s 20 (Hearing procedures) Section 20(1)— omit, insert— (1) The procedure for an appeal to the Magistrates Court is in accordance with— (a) the rules of court applicable to the appeal; or (b) in the absence of relevant rules—directions of the court.’. 4 Amendment of s 172 (Exemption for using whole protected plants for propagation) (1) Section 172(2) and (3)— omit, insert— (2) For subsection (1), a protected plant— (a) is not propagated if a stock plant is divided sooner than 12 months after the day it was taken in the wild; and (b) is propagated under controlled conditions if its reproduction and growth is intensively manipulated by nursery operations including potting, bedding, watering and protection from the weather.’. (2) Section 172(4)— renumber as subsection (3).
s5 3 s8 Nature Conservation Amendment Regulation (No. 2) No. 112, 2001 2001 5 Amendment of s 173 (Chief executive may approve authorised cultivator or propagator) Section 173(3) and (4)— renumber as subsections (2) and (3). 6 Amendment of s 249 (Application of part) Section 249(2)(a), ‘ Explosives Act 1952 ’— omit, insert— Explosives Act 1999 ’. 7 Amendment of sch 2A (Permitted uses in national parks) Schedule 2A— insert— ‘4 Dularcha National Park (1) The construction, use and maintenance of an approved facility are permitted uses for Dularcha National Park. (2) In this section— “approved facility” means an underground sewer rising main constructed in accordance with drawing numbers 10606000-003 to 10606000-012 showing the route and construction details for the main. 1 ’. 8 Amendment of sch 4 (When wildlife permit is not needed to move wildlife) Schedule 4, section 10(2), ‘sell’— omit, insert— ‘sells’. 1 A copy of the drawings may be inspected, free of charge, at the department’s office at 160 Ann Street, Brisbane.

(2) Schedule 12, sections 5A to 7— renumber as sections 6 to 8. 10 Amendment to omit headings following cross references (1) This section applies to a section containing a cross reference to a provision of the regulation followed by the heading to the provision in round brackets.
