No. 82 of 1964.

AN ACT to amend the Natives (Citizenship Rights) Act, 1944-1958, to provide for the issue of Certificates of Citizenship to persons whose names as children of their responsible parents are included in Certificates of Citizenship granted or issued to those parents and who have become of full age; and for that purpose also to amend sections six and nine of that Act.

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:-

1. (1) This Act may be cited as the Natives Short title

and citation.

(3) The principal Act as amended by this Act may be cited as the Natives (Citizenship Rights) Act, 1944-1964.

2. The principal Act is amended by adding after

section five the following section-

under this Act, is entitled upon attaining the age of twenty-one years to a Certificate of Citizenship under this Act, which Certificate shall be available from the Superintendent in the district in which he ordinarily resides.

(2) The Superintendent, upon being satisfied of the identity of the person with the child whose name is included in the Certificate of Citizenship, shall without further enquiry thereupon issue under his hand a Certificate of Citizenship in the prescribed form to that person, which Certificate shall provide for the signature of that person.

(3) In this section "Superintendent" means any person for the time being holding an office of Superintendent in the Department of Native Welfare established under the Native Welfare Act, 1963.

3. Section six of the principal Act is amended

(a)

by substituting for the words, "whether granted" immediately following the word, "Citizenship" in line three, the words, "whether granted or issued";

(b)

by substituting for the words, "the last preceding section" in line four, the passage, "section five or section five A of this Act";

(c)

by inserting after the word, "application" in line three of the second paragraph, the passage, "under section five or the issue of the Certificate of Citizenship under section five A, of this Act"; and

(d)

by adding after the word, "granted" being the last word in the second paragraph, the passage, ", or as the case may be, issued".

4. Section nine of the principal Act is amended by adding after the word, "applicants" being the last word in paragraph (b) of subsection (2), the passage, ", and a form of Certificate of Citizenship to be issued under section five A of this Act".
