AN ACT to amend the Natives (Citizenship Rights)

Act, 1944-1951.

[Assented to 23rd December, 1958.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of

the Legislative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

and citation.

1. (1) This Act may be cited as the Natives

(Citizenship Rights) Act Amendment Act, 1958.

(3) The principal Act as amended by this Act may be cited as the Natives (Citizenship Rights) Act, 1944-1958.

2. This Act shall come into operation on a day Zrence-

to be fixed by proclamation.

3. Section four of the principal Act is amended— amended.

(a)

by deleting the passage, ", that for the two years prior to the date of the application he has dissolved tribal and native associa- tion except with respect to lineal descend- ants or native relations of the first degree," in lines four, five, six and seven of sub- section (2);

(b)

by adding a new paragraph (c) to sub- section (2) as follows

stating the full names, sex and date of birth of all children under the age of twenty-one years.

4. Section five of the principal Act is amended- a ended.

(a)

by deleting paragraph (a) of subsection (1);

(b)

by deleting paragraph (d) of subsection (1);

(c)

by deleting in subsection (5) the words, "may upon application in the prescribed form" and substituting the word, "shall".

5. Section six of the principal Act is amended— amended.

(a)

by deleting the passage, "the Native Administration Act, 1905-1947, or" in lines one and two;

(b)

by adding after the word, "Citizenship" in line three, the passage, ", whether granted before or after the coming into operation of the Natives (Citizenship Rights) Act Amendment Act, 1958,";

(c)

by adding before the word, "rights" in line six, and before the word, "duties" in line seven, the word, "same";

(d)

by substituting for the word, "of" in line seven, the passage, "as a person who is of the same age as the holder or, as the case may be, as the child, and who is"; and

(e) by deleting the proviso.

Section seven of the principal Act is repealed.

Section seven B of the principal Act is amended

by deleting the passage, "or complaint dismissed,"

in line four.

Section nine of the principal Act is amended

by deleting the words, "or complaint" in line two of

paragraph (d) of subsection (2).
