AN ACT to amend the Natives (Citizenship Rights)

Act, 1944.

[Assented to 18th December, 1950.]

BE it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Natives TArlinn.

(Citizenship Rights) Act Amendment Act, 1950, and shall be read as one with the Natives (Citizenship Rights) Act, 1944 (Act No. 23 of 1944), hereinafter in this Act referred to as the principal Act.

(2) The principal Act, as amended by this Act, may be cited as the Natives (Citizenship Rights) Act, 1944-1950.

2. Section five of the principal Act is amended

(a)

by deleting the words "two months" in line eight of subsection three and substituting therefor the words "one month";

(b)

by adding a subsection as follows:

(5) A magistrate may, upon applica- tion in the prescribed form, include in a Certificate of Citizenship granted under this Act, the names of any children not of full age of whom the applicant is the responsible parent.

In this subsection, "responsible parent," in relation to a child, means the father of that child, or, where the father is dead or the mother has been given the custody of the child by order of a Court, or the child was born out of wed- lock, means the mother of that child.

(a)

inserting after the word "Citizenship" in line three the words "and any child whose name is, under the last preceding section, included in a Certificate of Citizenship".

(b)

adding at the end of the section a proviso as follows:

Provided that a certificate of citizenship insofar as it concerns children shall be deemed to include those persons only so long as they are under the age of twenty- one years.

4. Section seven of the principal Act is amended by inserting after the word "concerned" in line two of subsection (2) the words "and every child, as a magistrate may direct, whose name is included in the Certificate and who is not of full age at the time of the suspension or cancellation".
