Regulation 2009

Native Vegetation Act 2003

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Native Vegetation Act 2003.

Explanatory note
The object of this Regulation is to amend the Native Vegetation Act 2003 to exclude land on which development is carried out for seniors housing (in accordance with State Environmental Planning Policy (Housing for Seniors or People with a Disability) 2004) from the operation of that Act.

This Regulation is made under the Native Vegetation Act 2003, including sections 5 (2) and 51 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Native Vegetation (Application of Act)
Regulation 2009.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Native Vegetation Act 2003 No 103

Schedule 1 Land excluded from operation of Act

Insert after clause 15:

16                Land on which development for the purposes of seniors housing, and no other development, is carried out under State Environmental Planning Policy (Housing for Seniors or People with a Disability) 2004 and for which a site compatibility certificate has been issued under that Policy.
