Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Native Vegetation Act 2003.

Explanatory note
The object of this Regulation is to give effect to a revised Assessment Methodology for the purposes of the Native Vegetation Regulation 2005. The Assessment Methodology is a methodology adopted by that Regulation for assessing and determining whether proposed clearing improves or maintains environmental outcomes in relation to an application for development consent for broadscale clearing, or for approval of a property vegetation plan that proposes broadscale clearing.
This Regulation is made under the Native Vegetation Act 2003, including sections 15, 32 and

51 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Native Vegetation Amendment (Assessment
Methodology) Regulation 2011.

2      Commencement

This Regulation commences on 1 May 2011 and is required to be published on the NSW legislation website.

3 Amendment of Native Vegetation Regulation 2005

Clause 24 Adoption of Minister’s Assessment Methodology

Omit “8 October 2010” from the definition of Assessment Methodology in clause 24 (2).

Insert instead “4 March 2011”.
