An Act to encourage native industries, by providing for the granting of bonuses in certain cases.
Preamble
production of new products in South Australia, by providing for the payment, in certain cases, of rewards or sums of money, by way of bonus, to persons who may develop new industries within the said Province: And whereas it is desirable to give the Governor power to order payment of such rewards or sums of money, by way of bonus, as have heretofore been included in any Appropriation Act, notwithstanding that the period within which such bonuses or rewards may have been legally claimable has expired; and also to offer bonuses or rewards under certain circumstances for the encouragement of new industries or discoveries, and to order payment of such bonuses or rewards notwithstanding that the amount thereof may not have been included in any Appropriation Act—Be it therefore Enacted by the Governor-in-Chief of the Province of South Australia, with the advice and consent of the Legislative Council and House of Assembly of the said Province, in this present Parliament assembled, as follows:
Governor may order payment of bonuses in certain cases
1. The Governor may, by and with the advice of the Executive Council, order to be paid to any person, whom he may consider entitled thereto, the amount of any sum of money which may have been included in any Appropriation Act, as, for, or by way of, a bonus or reward, for any mineral or other discovery, or for the purpose of encouraging any native industry, within five years from the passing of any such Appropriation Act; and upon the making of such order, the Treasurer may, out of the general revenue of the State, in his hands at or after the making of such order, pay the amount thereof to such person, notwithstanding that the amount voted for such bonus may have lapsed.
Governor may offer reward in certain cases for encouragement of native industries
2. If both Houses of Parliament of the said State shall, in one session of Parliament, address the Governor, praying him to cause to be offered any sum of money, as, for, or by way of, reward or bonus for any mineral or other discovery, or for the encouragement of any new native industry, it shall be lawful for him, by and with the advice of the Executive Council aforesaid, by proclamation in the South Australian Government Gazette, to declare such reward or bonus to be open and available, in such terms and for such period of years not exceeding five years from the last day of the session of Parliament in which he shall receive such addresses, as he shall think fit; and at any time within such period he may order such sum to be paid to the person he may consider entitled thereto, pursuant to the terms of such proclamation; and upon the making of such order, the Treasurer may pay the amount thereof to such person out of the general revenue of the said State.
Not to affect Constitution Act
3. Nothing therein contained shall operate to repeal, affect, or qualify any provision or clause contained in the Constitution Act, 1934.
Short title
4. This Act may be cited as the Native Industries Encouragement Act, 1872.
