P A R T I .

Preliminary.

1. This A c t may be cited as t h e " Nat ive Dogs Des t ruc t ion and

Poisoned Bai ts Act , 1 9 0 1 , " and is divided in to P a r t s as follows :—

3 . I n th is Act , unless t he con tex t or sub jec t -mat te r otherwise

indicates or requ i res ,—

" j u s t i c e " means just ice of t he p e a c e ;
" o c c u p a n t " means any ho lder or occupier of any land u n d e r

any t enure , and includes any super in tendent , overseer, and other duly authorised person ac t ing for and on behalf of any such holder or occupier ; and

"po i soned b a i t " means any m e a t or o ther food for nat ive dogs
and con ta in ing s t rychn ine or o ther poison.
P A R T I I .
Native dogs destruction.
4. The enac tmen t s in th is P a r t conta ined shal l he cons t rued

wi th a n d subject to t he provisions of section five subsect ion tAvo of
t h e Pas tu res and Stock Protec t ion Act , 1898.

5. A n y occupant of land stocked wi th sheep, ca t t le , or horses m a y tender to t he neares t cour t of pe t t y sessions in t he form of t he Second Schedule for d rawing trai ls and laying poisoned bai ts upon his land a long lines upon the boundar ies of such land, or as near there to as m a y be prac t icable , and as, subject to t h e provisions of section twelve hereof, m a v be lawful .

6. E v e r y such tender shal l conta in as accura te a description as t h e t endere r can give of the boundar ies of such land, and of t he lines a long which t ra i ls are to be drawn, a n d a s t a t emen t of t h e l eng th of such l ines, and the names of any adjoining stat ion or estate, and of t h e owners thereof who will be called upon to cont r ibute towards t h e expense incur red in t h e performance of such tender .

7. (1) Every such tender shall be accepted by such court of pe t t y sessions and the reupon the t endere r shall employ a sufficient n u m b e r of m e n to draw a long such lines a t ra i l weekly, or bi-weekly, or a t such o ther periods as to the tenderer m a y seem fit, and to lay down a t p roper distances poisoned baits d u r i n g any period not exceeding one year.

(2) A n y such t ende r m a y , on appl icat ion of t he tenderer ,

be cont inued for any fu r the r period wh ich the just ices m a y deem necessary to insure t he complete des t ruc t ion of t he na t ive dogs on or in the ne ighbourhood of the lands of t he tenderer .

8. The tenderer shall keep an exact account of t he expense incur red in t h e performance of his tender w i th a s t a tement of t he w o r k done by the m e n employed to draw such trai ls and to p repare t h e poisoned baits used, and such accounts and s t a t ements m a y be verified quar te r ly or oftener as t he jus t ices in pe t ty sessions m a y

direct by such t endere r and by any person employed by h i m in t h e
per formance of t h e tender .
9. U p o n t h e due verification of a n y such account and s t a t e m e n t

t h e jus t ices in pe t ty sessions shall assess t he owners of any conter­ m i n o u s s ta t ion or estate in t he whole expense ac tua l ly incurred by t h e t endere r in t he due per formance of such tender , and fix t he quota or propor t ion to be pa id by each of t h e owners of every such conterminous s ta t ion or estate, regard being had, amongs t o ther th ings to t he benefit derived by each of such owners from t h e work :

divides the same from lands of t he CroAvn not in t h e occupat ion of any

one hold ing a lease or l icense thereof, t he quo ta or propor t ion of

expense

expense a t t ach ing to such vacan t lands u n d e r t he provisions of th i s A c t shall he paid out of any sum which m a y be voted by Pa r l i amen t for t h a t purpose, and such a m o u n t shal l be assessed by t h e just ices in l ike m a n n e r as if such lands were unde r lease or license.

10. I f any such owner omits to pay the quota or propor t ion so fixed to be paid by h im wi th in fourteen days after t h e award of any such just ices thereon, any one or more of such just ices may upon proof of such omission order the same to be paid for thwith .

11. A n y person aga ins t w h o m a quota or proport ion has been awarded under section n ine may appeal aga ins t such assessment and award in t he m a n n e r and subject to t he condit ions provided by t h e Ac t 71 , 1900.

P A R T I I I .
Poisoned bails.

12. The occupan t of any land stocked wi th s^ccp, ca t t le , or horses is hereby author ised to lay poisoned baits upon such land, b u t no such occupant be ing a lessee of any Crown lands is hereby authorised to lay poisoned bai ts wi th in three-quar te rs of a mi le from any publ ic road or t r ack used by t r w e l l i n g stock, and no occupan t of freehold

land is he reby author ised to lay poisoned baits w i th in one h u n d r e d
yards .of any road in tersec t ing such land nor wi th in one h u n d r e d yards
of t he bounda ry of such land.

13. (1) A n y occupant who has laid poisoned baits on a n y land shall, if such land is in tersected by a public road, post a legible notice six feet from t h e ground at the roadside at t he boundary of such land s ta t ing tha t poisoned bai ts are so laid.

(2) A n y person Who removes such notice or who fails to

comply wi th the provisions of this section shall be liable to a pena l ty

not exceeding ten pounds to be recovered before any jus t ice .

14. A n occupan t who lays poisoned bai ts in accordance wi th t h e provisions of th i s P a r t shall no t be liable for t he destruct ion of any dog caused by bai ts so laid.

15. This Ac t shall not ex tend to any city .or town.
